KNOW ALL MEN BY THESE PRESENTS, that the undersigned,Lm

valuable consideration, the receipt whereof is co
hereby acknowledged, does hereby grant unto HOLY CROSS
ELECTRIC ASSOr.IATION, INC., a cooperative corporation
whose post office addre5s is P.o. Drawer 2150, Glenwood Springs,
Colorado (hereinafter called "Grant.ee") and to its sucr.:essors ..od
assigns, the right of ingres~ and egress across lands of Grantor,
situate in the County of Pitkin, State of Colorado, describen as
follows:
A idtcel of la~d situated in Sections 12 and 13, To~nship 8 South,
Range 97 West of the 6th P.M. as more fully described in book 436,
pages 478 and 479 of the Pitkin County Courthouse, Aspen,
Colorado.

And, to co~~truct, reconstruct, enlarge, operate, maintain and remove
an electric transmission or distribution line or system, ~ithin the
above mentioned lands, upon an easement described as follows:
An easement thirty (30) foot wide strip of land lying south of and
adjacent to the follc~ing described line: beginning at a point
whence corner numb~r four of Tract 88 of Section 12, TOW~9hip 8
South, Range 87 West bears north 7041'12. west 240.97 feetl thence
north 63029'30. east 94.4 feetl thence north 75055'30. east 196.4
feet: thence north 73049'30. east 570.0 feet to the ooint of
ending. .

And, in addition, Grantor hereby grants to Grantee, and to its
successors and assigns, the right to clear all trees and brush, by
machine work or otherwise, within said easement, and the further right
to CU~ trees, even though outsid~ of said easement, which are tall
enough to strike the wires in falling.
Grantor agrees that all poles, wire and other facilities installed by
Grantee on the above described lands, shall remain the property of
Grantee, and shall be removable at the option of Grantee.
Grantor covenants that she is the owner of the above deser ibed lar.ds
and that the said lands are free and clear of encumbrances and liens of
whatsoever ~haracter, excp-pt t~ose held by the following:
TO HAVE; AND TO HOLD, said right-of-way and easement, together with all
and singular, the rights and privileges appertaining thereto, unto
Grantee, its successors and assigns, forever.
