AGREEMENT WITH THE CITY OF ASPEN AND THE TOWN OF SNOWMASS
VILLAGE CONCERNING SPECIAL EVENTS

Recitals
1. Pitkin County, the City of Aspen and the Town of Snowmass Village are the locations of
numerous special events throughout the year, many of which impact more than one of the three
jurisdictions.
2. A special events subcommittee consisting of staff from each jurisdiction and
representatives from referral agencies (the "subcommittee") has developed a uniform application
that will simplify the special event application process for applicants and referral agencies.
3. The subcommittee is in the process of finalizing a shared website for special events.
3. The attached Intergovernmental Agreement among the Governments sets forth the
agreement of the parties concerning the financing and process to be used in operating the special
events website.
4. It is in the best interests of Pitkin County to approve the Intergovernmental Agreement.
NOW, THEREFORE, BE IT RESOLVED, that the Board of County Commissioners
of Pitkin County, Colorado hereby approves and authorizes the Chair to sign the attached
intergovernmental agreement with the City of Aspen and Town of Snowmass Village.

AMONG THE BOARD OF COUNTY COMMISSIONERS
OF PITKIN COUNTY, COLORADO, THE CITY OF ASPEN AND THE TOWN OF
SNOWMASS VILLAGE CONCERNING SPECIAL EVENTS

day of~, , by and among the Board of County Commissioners of Pitkin County,
Colorado, a Colorado home rule county (Pitkin County), The City of Aspen, a Colorado home
rule municipality (Aspen) and the Town of Snowmass Village, a Colorado home rule
municipality (TOSV), collectively referred to as the Governments.
RECITALS
1. The Governments are duly formed governmental entities governed by Boards or
Councils elected by qualified electors in the political boundaries of the Governments.
2. The Governments receive numerous applications for special events each year, many
of which cross jurisdictional boundaries.
3. The Governments believe that a uniform application and shared Special Events
website will significantly increase efficiencies in the special events permitting process for
applicants, staff, referral agencies and the general public;
4. Staff from each of the Governments have worked together since 2005 to develop a
uniform special events application and are currently developing a shared web site for special
events applications for the Governments.
5. This Agreement is entered into, inter alia, pursuant to Section 29-1-201, et seq.,
C.R.S., and Article XIV, Section 10, of the Colorado Constitution.
6. The Governments have determined it is in the best interests of the citizens of their
respective jurisdictions to enter into this Intergovernmental Agreement.
OBLIGATIONS OF PARTIES
NOW, THEREFORE, the Governments agree as follows:
1. Purpose. The purpose of this Intergovernmental Agreement is to establish the agreement
among the Governments concerning the use of a uniform special events application and the
development and operation of a shared Special Events website.
2. Participation. Each Government will from time to time designate an administrator to
participate with the other Government's designated administrator in the ongoing
improvement of the uniform application and the website for special events. Each
Government will also have a point person for receipt of web applications or referrals. The
point person may also be the administrator. The Governments will use their best efforts to
assure full cooperation in the use of the website by all staff, applicants and referral agencies.
3. Financial/ AccountingIW ebsite Administration.
A. Each Government has or will contribute one-third of the cost of development of the
website, the total cost of which is $10,848.
B. The Governments, through their designated administrators, must agree before any
additional website development or maintenance costs are incurred.
C. The joint City of Aspen/Pitkin County Information Systems Department (IS) will be
responsible for the initial special event website training of the website administrators
from each Government. The administrators will then be responsible for training their
successors and their referral agency contacts.
D. IS will provide the ongoing support for the website. However, if any request for changes
to the website requires the use of a consultant as determined by IS, the Government
administrators shall agree on an equitable distribution of the costs before IS hires the
consultant. In addition, IS and the administrators will consult as needed about ongoing
support and whether or not TOSV should make an annual financial contribution for such
support. No such financial support will be required for the first ~ear.
4. Fees for Special Events. The shared website will not be set up initially for payment of
special event fees electronically. Each Government remains responsible for establishing and
collecting its own fees for special events within its jurisdiction.
5. Duration of Agreement. This Agreement will continue in effect until the Governments
agree to terminate it. Any Government may terminate its involvement in the joint application
and website and this Agreement by providing notice in writing to the other Governments at
least 60 days prior to termination.
6. Entire Agreement. This Agreement contains the entire understanding of the parties. Tuis
Agreement may not be modified or amended except by writing, signed by all of the parties
hereto.
7. Governing Law. The interpretation, construction and performance of the Agreement shall
be governed by the laws of the State of Colorado. In the event of any litigation, jurisdiction
and venue shall be with the courts of Pitkin County, Colorado.
