Note: All required land use approvals must be obtained prior to submittal o£an earthmoving permit
application. Applications. with outstanding land use reviews will be rejected in the Planning and
Zoning Office and returned to the Building Department. If you are unsure as to whether a review is
required, please contact the Planning and Zoning Qffice at 920-5090.

The following is required for an application to be accepted. More information may be required as each
project is individually evaluated.
I. PLEASE BE AWARE OF THE FOLLOWING:
^ You are responsible for the information contained in the attached Earthmoving Permit
Requirements handout.
^ State Law (Senate Bill 93-155) requires that you contact the Utility Notification Center of
Colorado at (800)922-1987 before commenting any earthmoving
^ Work in a wetlands area is_generally prohibited; however, some activities are permitted. Any
work ocurring in a wetlands area requires a permit from the Army Corps of Engineers. If you are
working in a wetlands area, please call the Corps at (303)243-1199.
^ You will be required to post a bond with the Building Department for revegetation if your
project:
^
a) Has a potential to impact watershed areas (riparian or streams, etcJ;
b) Has a potential for visual impacts from public viewing corridors (roads, county
parks, trails);
c) Has steep (15°Io or greater) slopes or unstable soils,
d) Disturbs large areas (to be determined by the Land Management DepartmenU.
If bonding is required, a revegetation plan, including the following items, MUST be submitted.
a) Plant material list (BE SPECIFIC -scientific names are required).
b) Planting schedule. This is a commitment by the applicant to perform the work
by a certain date.
The bond will be released after the vegetation has been successfully established.
Most projects require a Fugitive Dust Control Plan. If you are ensure whether you need to submit
a dust plan, please call the Environmental Health Department at 920-5070.
Proposed ponds will require an impoundmentpermit from the State Water Engineer. Call Joe
Bergquist of 945-5665 to obtain this permit. Y
Incomplete permit applications will be voided within six months of submittal. ,

receiving area fornally designated by
the County,
1.01.03 Hazardous or Har*.nful Conditions, whenever any
existing excavation, emban}cnent or fill has become
a hazard to public safety or welfare, or endangers
property, or adversely affects the safety, use or
stability of a public way or drainage channel, the
owner of the property upon which the excavation is
lecated, or other person or agent in control of
said property, upon receipt of written notice from
the County shall, within the pericd specified
therein, repair or eliminate such excavation, fill
or emban.~ement so as to erase the hazard and be in
conformance with the recuirements contained
herein.
1.01.04 Enforcement. Requirements contained herein may be
enforced by the authorized representative of the
County, or by injunctions resulting in work
stcppage issued by the District Ccurt in and for
the County of Pitkin, State of Colorado, pursuant
to law, or suit may be commenced by the County
Attorney on behalf of the Bcard of County
Commissioners for damages or hazardous or harmful
conditions due to non-compliance.
1.01.05 Definitions
a. County: The County Representative or any
one of his authorized agents.
b. Develooer:...._.Individual ..conducting
earthmoving work under an approved
Earthmoving Permit.
c. Earthmovincr. Any excavating, filling or
combination thereof.
d. Existing Grade: Vertical location of the
existing grcund surface prior to excavation
or filling.
e. Fi11: Deposits of soil, rock, or other'
materials placed by man.
f. Finish Grades. The final grade or
elevation of a fill or excavation.
1.02.02 SutiDlemental Reports. Supplemental reports and
data (geology, soils, etc.) may also be recuired.
Supplemental reports are to be prepared by
qualified geolcgists or professional engineers.
Recommendaticns included in such reports as
approved by the County shall be incorporated into
the earthmoving plan.
1.02.03 Permit Limitations and Condi'~~ens.
a. General. The issuance of a permit shall
constitute an authorization for only
that wcrk (no more or no less) which is
described or illustrated on the approved
plan or application for the permit. The
securement of other required permits by
the developer shall not relieve it of
the responsibility for securing an
Earthmoving Permit from the County.
b. Jurisdiction of Other Acencies. Permits
issued shall not relieve the developer
of the responsibility for securing
reaz;ired permits for wcrk to be done
under regulation of any other code,
department, or governing acency.
c. Time Limits. All of the work authorized
by the permit shall be fully performed
and completed within the time limit
specified. If no time limit is
specified, the work shall be completed
within 180 days after the date the
permit is issued. If the work cannot-be
performed and completed within the
specified time, a request for an
extension of time setting forth the
reasons for the requested extension
shall be presented in writing for review
and approval by the County.
d. Public Safety and Storm Damace
Precautions. All persons performing any
earthmoving operations shall put into
effect all necessary precautions such as
removing all loose dirt form the
earthmoving site, providing adequate
anti-erosion and/or drainage devices, ~%
debris basins, or other safety devices
to protect the health and welfare of
persons or private and public property
from damage of any kind.

1.02.06 Authorization. The developer shall, at the
request of the County, submit proof that it has
authority or permission to conduct earthmoving
work on the site(s) proposed. This documentation
shall be submitted with ..the application for
permit.
1.02.06 Protection of Utilities. During earthmoving
operations, the developer shall be responsible for
the prevention of damage to public or private
utilities or services. This responsibility is not
confined to the limits of the earthmoving. --_
1.02.07 Protection of Adiacent Property. The developer is
responsible for the prevention of damage to
adjacent property, and no person shall excavate or
fill on land sufficiently close to the property
line to endancer .any adjoining public street or
any. adjacent property. _ Such property shall be
supported and protected from. settling, cracking,
or other da?nage which might result.
1.03 Fees and Bonds.
1.03.01 P1ar. Checking Fee. For earthmoving on the same
site, the fee shall be based on the. total
excavation and fill quantities. Before a permit
is issued for earthmoving, a fee must be paid as
follows:
0 to 10,000 cubic yards $25.00
Above 10,000 cubic yards 25.00 for the first

1.03.02 Bords and Other Securities. Bends, letters of
credit, or other financial assurances will be
required for all earthmoving in excess of 1,000
cubic yards or where, in the opinion of the
County, it would be necessary to guarantee'
' enforcement of applicable requirements, including '~
landscaping or earthmoving on steep slopes.

cash payment for an amount set by the County shall
be provided and secured unto the County, and, if
the work authorized by the permit is not completed
as herein specified, any bonds shall be in default
The natural ground surface shall be prepare3 to
receive fill by removing vegetation, unsuitable
top soil, and, where existing slopes are steeper
than 5 horizontal to l vertical, by benching at
least 5 feet into the natural slope. no organic
material, rock, or similar irreducible material
with a maximum diameter as shown in the following
table shall be buried or placed in fills.

Exposed fill slopes in excess of. 40- feet in
heicht, measured frcm the lower toe of a slope,
shall have paved drainage terraces spaced and
sized as specified for cuts.
Setbacks. Toes and tons of cuts and fills shall
be set back from property lines and buildings in
accordance with the following figure:

The develcper .shall also be responsible for
assuring the County that the areas to be
revegetated will grow and take root to the soils
on the disturbed areas. This will include any
watering or fertilizing needed to insure or
otherwise promote this growth. To guarantee the
revegetation, the developer will be required to
provide a bond, letter of credit, or other
financial assurance, as mare fully described in
Section 1.03.02 of these requirements. The
assurance monies will be equal to the costs of
revegetation, and will be returned to the
developer when it is detersiined by the County that
the revegetation of the disturbed areas at the
.. earthmoving.site has been successfully completed.
If within a one year period from the revegetation
efforts a ,successful stand..of native grasses at
the earthmoving site has rct been accomplished,
the Ccunty may, at its option, retain any or all
of t're assurance monies necessary in order to
attempt revegetation of the grounds. A successful
stand of native grasses is defined as being at a
75~ gez:aination rate and/or having a vecetation
cover equal to or greater than the surrounding
vegetation. cover. The success of the revegetation
at the earthmoving sits will be measured at the
end of the summer growing season by the Ccunty who
will approve or reject it between that time and
the end of the one-year assurance period.
1.05 Inspection.
1.05.01 Supervised Earthmovinc Required. All earthmoving
in excess of 1000 cubic yards shall be performed
under the supervision of a qualified registered
engineer at the developer's expense and shall ,be
designated "supervised earthmoving." For
supervised earthmoving, it shall be the
responsibility of the developer's engineer to
supervise and coordinate all site inspection and
testing during earthmoving operations. If the
engineer finds that the work is not being done in
attendance with accepted practices, he shall
immediately send a written notice of the
noncenfo rnity and of the recommended. corrective
measures to the person in charge of the ,`
earthmoving work and to the County. ';
1.05.02 Recular Earthmovinc. The County shall have access
to the premises to inspect the work and may
require soil bearing, compaction or other tests at

the developer's expense. Tests. shall be taken at
locations designated by the County and shall be
performed by an independent testing firm approved
by the County. Certified conies of the test data.
are to be furnished .upon request to the. County.
Inspection shall include but need. not be limited
to preparation of surface for fills, retaining
walls, drainage devices, etc. The developer or
his agent shall notify the Ccunty at least one (1)
day in advance of each required inspection. Final
approval shall not be given until. all work,
including installation of all drainage structures.

1.05.03 Final Reports. Upon completion of the work, the
following reports or data may be required:
a. For supervised earthmoving, a report
from the developer's engineer certifying
that all earth~oving work has been
completed in conformance with the
approved plans and applicable
requirements, accompanied by "as-built"
.._ plans of the completed work.
b. Soils and/or geology reports.
c. Cross sections.
d. .other reports as required.
The.release,of any bond or.security posted by the
developer may be conditioned. upon the submittal of
the final report. _-
