Amended 10_16_06 \ ~ ., PITKIN COUNTY CONTRACT AMENDMENT Project/Purchase Contract # 15-2005 Line Item Account # 110.54.96200.87260 The 2005 Red Mountain Reconstruction Engineering Services Contract for Provision of Services (the "Agreement") dated April 26, 2005 between Pitkin County (the "County") and Schmueser Gordon Meyer Inc. 118 W. 6' Suite 200 G1enwood Springs, CO 81601 (the "Engineer"; references to "Contractor" in original Agreement also refer to the Engineer), is hereby amended as follows: . 2. Engineer's Obligations. Engineer shall provide professional services in accordance with the commitment and requirements set forth in Exhibit 'A' and Exhibit 'B' and in Exhibit 'C'. These exhibits are incorporated herein by this reference. 3. Compensation and Exoenses. Invoicing. Pavment and Offset. The County shall compensate Engineer for its services in accordance with the Project Budget and Schedule set out in Paragraph 2. It is expressly understood and agreed that in no event will the total compensation and reimbursement to be paid hereunder exceed the sum of Two Hundred Fiftv Six Thousand. Seven Hundred Fortv Three Dollars and Zero Cents ($ 256.743.(0) (includes reimbursables and snowmelt feasibility study) for all services rendered. By contract or amendment, the County and Engineer may reallocate the budget among project tasks if the total budget amount remains unchanged. Engineer shall invoice for the project monthly based on hours worked, with payment expected within thirty (30) days of invoice, but any payment by the County may be offset by any amount the Engineer owes the County for any reason. Payment of five percent (5%) of each invoice will be withheld by the County until the Engineer's obligations are completed or each task is complete. In the event the Engineer incurs time and expenses in excess of the total compensation stated above, no compensation for said additional time and expenses shall be required to be paid by the County without written amendment to this contract executed by the County. Compensation for services provided pursuant to the Scope of Construction Observation Services set forth in Exhibit 'C' shall not exceed One Hundred Two Thousand, Nine Hundred Eighteen Dollars and Zero Cents ($102,918.00). 5. Piktin County's Obligations. Pitkin County shall administer this contract through a County Representative. Gerald Fielding, County Engineer will manage the project as the County's Representative. In the event that Gerald Fielding, County Engineer is not available, Bert Pearce, Public P- - - N ~.;, Representative. Gerald Fielding, County Engineer will manage the project as the County's Representative. In the event that Gerald Fielding, County Engineer is not available, Bert Pearce, Public Works Technician shall assume the County's Representative duties. The services provided and products delivered by the Engineer under this contract will be subject to review by the County's Representatives, or a designee, for compliance with Engineer's obligations prior to final payment. Scope of Construction Observation Services Red Mountain Road Reconstruction Project Provide directed construction management services support to the Pitkin County to act as field observation, for the construction of the Red Mountain Road Reconstruction Project. Services are to include project coordination, traffic control review, field inspection, project documentation, materials testing, and check surveying, Construction work on this project includes the following: removals, excavation and embankment, coordination of the relocation of utilities, placement of drainage and irrigation facilities, widening of existing roadway template, and topsoil, gravel and HBP surface treatments, All of this construction will be in accordance with the Plans and Specification created by SGM dated April 2007 including any revisions that may take place from time to time. The anticipated period of service for this project starts April 6th, 2007 and runs through October 31 5t, 2007, The scope of services provided are based on a maximum duration of hours in the attached Construction Engineering Estimate Forms, Schmueser Gordon Meyer shall provide a part time Field Inspector to assist the County Engineer in the administration of the contracts, The Construction Administration services shall be in accordance with Pitkin County and CDOT practices and policies and the industry standards. The administration work includes tasks commencing with the advertisement for bids and the completing with project finals. Tasks include, pre-constnJction meeting, directed coordination with utilities and other interested parties, conferences and weekly meetings, submittal coordination, work inspection and documentation, coordination with material testing fIrm, project reviews, coordination of changes to plans and specifications, and project finalizing. Work will be documented using standard County and CDOT practices and forms, Primary duties of the ProjectInspector will include, but not be limited to, inspection of base course, HBP, reinforced concrete, traffic control, embankment and other incidental construction items as may be assigned by the Pitkin County staff. One Tester is required at a level comparable to the CDOT EngineeringlPhysical Science Technician lor II, Primary duties will include, but not be limited to, the testing of base course, HBP, reinforced concrete, embankment and other incidental construction items, as may be assigned by the Project Engineer, This person will be responsible for tt;sting and therefore will need to have certifications called for under CP- I 0 of the current CDOT materials manual. Task 1.0 Construction Management Support Provide County Engineer with the following inspection support, 1,1 Construction Coordination: Regularly scheduled weekly or as-needed meetings will be conducted with the Contractor and other involved parties to review, update, and coordinate construction activities, Weekly meetings will include a review of issues which are impacting progress, the cost to complete the work, and significant ~ .......__.-...,~~."'""...~.^.,,'..,------~--~ situations encountered related to the construction of the Project. 1.2 Review of Contractor's Traffic Control Plan: During construction, monitor the Contractor's approved traffic control plan for implementation of traffic signing, barriers, and other traffic control measures. Relocations and adjustments to detours will be coordinated with the Contractor, County, and other impacted agencies, 1.3 Review of Construction for Conformance with Plans and Soecifications: Monitor the Contractor's construction activities with respect to the contract documents and relevant schedule submittals governing the performance of the work, Resolve construction problems and/or recommend action for their resolution, as they relate to changed field conditions or conflicts in the contract documents, Coordinate with the County Engineer and designer during construction for implementation of revisions to the plans as may be required. 104 Processinl! of ShoolWorking Drawinl!s Submitted bv the Contractor: Submittals, design drawings, shop drawings, materials, and test procedures received from the Contractor will be forwarded to appropriate design personnel and/or the Consultant designer of record for review and approval. Approved drawings will be returned to the Contractor, as well as a copy retained for use during the remainder of the project. 1.5 Periodic Ouality Control Insoection: Perform periodic quality control observations of construction activities to document construction activities performed and assessment of conformance with the contract documents, Inspection items will include excavation, backfill, and compaction operations; concrete placement; pile driving; paving; drainage; utilities; guardrail placement; structures; signing and striping; landscaping; and traffic control installations, 1.6 Ouantitv Control: Assist the County in resolving disputes in quantities with the Contractor prior to the preparation of the pay estimate, 1,7 Proiect Documentation: Maintain daily diaries, prepare inspectors progress reports, and complete appropriate paperwork and forms with inspection and testing, 1.8 Materials Testing: Materials testing will be directed and scheduled to assess the contractor's compliance with the requirements of the contract documents, Testing reports to be submitted to CDOT as part of a Form 250 at the conclusion of the project. The Consultant Tester shall follow the guidelines stated on the current CDOT Field Materials Manual. The Consultant Tester shall be permanently assigned to the project and have obtained the requirements set forth in the current CDOT Field Materials Manual CP-lO. All certifications will be made available to the County Engineer, ~ The Consultant Tester shall provide and have available the following equipment in sufficient quantity and in good working order to ensure accurate performance of all work required in a timely manner: 1. Nuclear Asphalt Content Gauge and/or extraction equipment and solvents 2, Nuclear Moisture-Density Gauge 3, Concrete air meter, slump cone, and other concrete testing equipment 4, 12 inch sieves for aggregate and soil gradations 5, Electronic scales 6, Sample containers and small tools 7, Proctor equipment for soil curves and one point tests 8, Atterberg, Rice value, and Sand Equivalent equipment 9, ,Concrete cylinder molds meeting AASHTO requirements, except that paper molds shall not be used and plastic molds shall not be reused, 10, All eqnipment necessary for properly performing the required soils, asphalt and concrete tests 1.9 Check Surveving: Provide quality control surveying and quantity verifications as needed, (The Contractor is responsible for performing all surveying required to properly layout and construct the work covered under this contract.) 1.10 Miscellaneous: Duties as assigned by the Pitkin County staff due to project needs, Task 2.0 Post Construction Support 2.1 ComDletion InsDection and Punch List: Conduct a final inspection with the Contractor upon substantial completion, The result of this inspection is the development of a punch list of remaining and/or outstanding work to be performed by the Contractor prior to final project acceptance, 2,2 As-Construction Drawings: Review for completeness full sized as-constructed drawings submitted by Contractor. 2.3 ComDletion InsDection and Close-Out: Following the completion of all punch list items by the Contractor, conduct a final inspection with representatives from the Contractor, to confIrm the completion of all work. The result of this inspection will constitute [mal project acceptance and initiation of the Contractor's warranty period for the work.
