ADMINISTRATIVE, DECISION OF THE, COMMUNITY DEVELOPMENT DIRECTOK OF YITKIN COUNTY, COLORADO, APPROVING THE LEHRMAN SITE PLAN KEVIEW AND MINOR AMENDMENT TO DF,VF.LOPMENT PERMIT Administrative Decision No.~ 2007 RECITALS Robert Lehrman ("Applicant") has applied to the Community Development Director of Pitkin County ("llirector") to obtain Site Plan Review approval to replace the single family residence. The proposed Activity Envelopes are essentially the same as the previously approved building envelopes. The Site Plan depicts a Primary Activity Gnvelope for redevelopment of the residence, an Activity Envelope to the south for wildtre mitigation, an Activity Envelope to the north tier landscaping purposes only, and an Activity Envelope for water and sewer line extension and revegetation along the existing water line to the south. 2. The parcel contains 6.5 acres and is within the R-30 zone districts. 3. The parcel is located at 1300 Willoughby Way, and is more specifically described in Exhibit A. 4. The parcel was legally created prior to 1972 and has not merged with any adjacent parcels. 5. The existing residence was built in 1972. 1'he BOCC granted 1041 hazard review approval to replace the residence, pursuant to Resolution No. 99 ~4, and granted approval for a caretaker dwelling umt, pursuant to Resolution No. 99-25. The 1041 site plan was recorded in Plat Book 51 at Pages 10-10A. The BOCC granted an extension of vested rights, pursuant to Resolution No. 136-2001; the vested rights expired in 2004. The Community Development Director approved a minor amendment to the building envelope, pursuant to Administrative Decision No. 40-2002. The amended site plan was not recorded. 6. The Director finds that the proposed Site Plan is consistent with the applicable requirements of the Code, as follows: A. The activity envelope is primarily comprised of slopes of less than 30% and the small areas of slopes in excess of 30% qualify as minor slope anomalies pursuant to Sec. 7-20-20(c)(3) of the Codc. B. The other Activity Envelopes -for wildfire mitigation, landscaping and the water and sewer lines - allcontain slopes in excess of 30% and 45%, but activities within these envelopes will be limited to removal of vegetation (wildfire mitigation envelope), plantings (landscape envelope) and placement of a new sewer line within the existing water line trench and revegetation of the cut. Installation of the sewer line on a slope in excess of 30% is permitted, pursuant to Sec. 7-20-20(e)(9). Given the existing cut for the water line, which was never revegetated, the Director finds that it is appropriate to allow installation of the sewer line within the same trench as the water line and to require revegetation once the line is installed. C The wildfire hazard is rated as severe, and can be mitigated pursuant to the provisions of Sec. 7-20- 60.c of the Codc. D. 'fhe replacement residence is consistent with the criteria for development within the Scenic Vicw Protection Area. APPROVED by the Director, subject to the following conditions, which shall run with the land and be binding on all successors in interest: I . The Applicants shall adhere to all material representations made during the application process. 2. The conditions of this Administrative Decision shall replace all conditions of approval established in BOCC Resolution No. 136-2001. 3. Prior to submission of any future building permit applications, the Applicant shall he required to submit for approval by the County Attorney and Community Development a Site Plan with an Activity Envelope in accordance with Land Use Code Section 2-30-20(g) and Application Manual Section 2.1.12. The above referenced approvals shall be a condition precedent [o finalization and recordation of them. 4. Prior to issuance of a building permit for the residence, the Applicant shall: A. Provide proof of an adequate water supply (in terms of yuantity and availability) for domestic and tire protection purposes, and Cor irrigation purposes, if applicable, to the Environmental I lealth and Natural Resources Department. B. Obtain an access/driveway permit from the Planning Engineer to construct the turnaround. C Obtain a fireplace/woodstove permit from the Community Development Department, iC necessary. D. Submit a site specific drainage and erosion control plan prepared by a qualified engineer or geologist for review and approval by the Planning Engineer. E. Pay the applicable road and employee housing impact fees. F. Submit a construction management plan for review and approval by the Planning Engineer. G. Submit a detailed revegetation plan for disturbed areas with appropriate seed miles. 5. Prior to issuance of a Certificate oC Occupancy for the residence, the Applicant shall connect to the Aspen Consolidated Sanitation District and abandon the septic system to the satisfaction of the Environmental Health and Natural Resources Department. 6. 5,750 square feet of gross floor area is exempt from growth management without the use of TURs or growth management allotments for additional Floor area. 7. "fhe Applicant shall comply with all standards for development within Scenic View Protection Areas as represented in the application and approved in this Determination. The exterior of the residence shall utilize indigenous earth tone materials or colors and the roofs shall have anon-reflective color or composition. Reflective roof materials shall not be used unless the materials are treated prior to installation to eliminate reflection, with the exception of materials associated with solar or photovohaic equipment. Samples of exterior materials shall be reviewed and approved by Community Development prior to building permit application. The residence shall be substantially consistent with the elevation attached as Exhibit B. Driveway lighting ~s prohibited and all other lighting shall comply with the lighting code. K. "1'he Applicant shall comply with the following standards for Development in a Severe Wildlire Hazard Area: dclminislratice Decrsinn No. -(_,,-?11~~ /'age 3 A. Defensible Space: The area around all buildings/structures, limited by property boundaries that may limit a property owner's ability to comply with this section, shall incorporate landscaping with wildfire defensible space considerations as follows (note: actual vegetation manipulation to meet these conditions may not be necessary where the natural vegetation patterns have already fulfilled these conditions): 1) The area within 1 S of the structure and the furthermost projection of combustible construction shall be of primarily noncombustible hardscape surfaces, low growing perennials, flowerbeds, cut grass and deciduous, well-trimmed and irrigated plants. Woody vegetation should not be planted within this area. 2) Beyond 15' and up to 6S of the structure and the furthermost projection of combustible construction or to the property line, maintain natural and/or irrigated grass at less than 6" and thin existing trees, sagebrush, and brush into individuals or clusters. Oak and serviccherry should he thinned and clustered. Limbs of trees shall be pruned to '/ the height of the tree or 10' whichever is Icss. No brush or shrubs which when mature shall be tall enuugh to act as ladder fuels shall be installed or marinated around the trees. Clusters of bushes or shrubs should he separated from each other and from those beyond the 6S area by a distance of ? '/z times the height of the mahire vegetation. The diameter of a cluster shall be limited to 2 '~ times the height of the mature vegetation. Thin and remove lower branches of brush or shrubs within clusters or individual plants to eliminate ladder fuel. Treat cut ends with an herbicide to prevent resprouting. 3) All branches that extend over the roof naves shall be trimmed and all branches within fifteen (15) feet of chimneys shall be removed. 4) The density of fuels up [o a one hundred (100) foot perimeter of the structures shall be reduced where natural reduction has not already occurred. 5) All deadfall up to a one hundred (100) foot perimeter shall be removed. 6) The property owner shall be responsible for the continued maintenance of the defensible space vegetation requirements. B. Roofing Materials: Class A covering or Class A assembly as defined by the currently adopted Building Code. No wood shakes or shingles. All other adopted Building Code compliant methods and materials permitted. Roofs with less than a 3:12 pitch are not permitted unless they comply with the following: I) All roof coverings shall be constructed of non-combustible materials and installed on a Class A roof assembly. 2) All roof coverings shall have a surface that shall facilitate the natural process of clearing roof debris. 3) Protrusions above the roofline, such as parapets, shall be prohibited, unless constructed as for a one-hour fire resistive assembly, as recommended by Art Hougland, W ildtire Expert (letter attached as Exhibit C). 4) Roofs shall be installed as required by the adopted Building Code and shall have a minimum pitch of L48. 5) All roof designs, coverings, or equivalent assemblies shall he specifically approved by the Fire Marshal prior to submittal of a building permit application. C. Root Venting: .4dministrutire Decision No. _ )r'-2007 Pine 4 1) Soffit venting shall be located in the outer ]/3"~ portion of the overhang. 2) Attic, soffit and other roof venting shall be ofnon-corrosive metal mesh with maximum'/a" openings. D. Projections at the Roofline, including Soffits, Rafters, Porch or Dcck Roots, Fascias, or Other: One hour rated material or any material underlain by 5/S" Type X gypboard or equal, or "Type IV" Heavy Timber materials, per the currently adopted building code. E. Decks, Decking, Cantilevered Floors, or Other Projections Below the Roofline: I) Construction with noncombustible or one (1) hour rated material, or material with tlame spread <25 (tested to ASTM E84 and listed for exterior use), or 2) Conventionally framed deck with waterproof surface and underside protected with 5/8" Type X gypboard or equal (decking as "a" above), or ;) "Type IV" Heavy Timber materials: joist and beams minimum 6"x10", columns nunimum 8"x8", decking minimum 4" in depth, or decking as "a" above; or equivalent log construction, or 4) Unclose projection vertically to ground with one hour fire resistive materials. Decking as "a" above. F. Railings: Railings must be constructed of noncombustible or "Type IV" Heavy'I'imber materials. G. Exterior of the Structure, Including All Walls: 1) One (1) hour fire resistive rated materials, or 2) 5/8" gypboard underlying combustible materials, or 3) Cement stucco, minimum '/d' thickness. 4) All glazing to be tempered glazing; and 5) Doors to be metal or wood 1 '/a" thick minimum. H. Foundations: Foundations, skirting, and crawl space openings shall be fully enclosed and constructed with materials approved for one (I)hour fire-resistive construction on the exterior side of the walls and shall extend from the top of grade to the underside of the floor decking or walls. I. Maintenance and Miscellaneous Requirements I) Roofs and gutters shall be kept clear of debris. 2) Roof vents shall be screened with corrosive resistant wire mesh, with mesh one-fourth (''/a) inch maximum. 3) Any outbuilding shall adhere to the same wildtire requirements. 4) Yards shall be kept clear of all litter, slash and flammable debris. 5) All flammable materials shall be stored on a parallel contour a minimum of fifteen (15) feet away from any structure. 6) Weeds and grasses within the ten (10) foot perimeter shall be maintained to a height not more than six (6) inches. 7) Firewood/wood piles shall be stacked on a parallel contour a minimum of fifteen (15) feet away from the structure. 8) Swimming pools and ponds shall be accessible by the local tiro district. 9) Fences shall be kept clear of brush and debris. lo) Wood fences shall not connect to other structures. Propane tanks shall be buried, if possible, or installed according to NFPA 58 standards and on a contour away from the structure with standard defensible space vegetation mitigation around any aboveground tank. Any wood enclosure around the tank shall be constructed with materials approved for two (2) hour fire-resistive construction on the exterior side of the walls. 13) Each structure shall have a minimum of one ten (10) pound ABC fire extinguisher. 14) Addresses shall be clearly marked with two (2) inch non-combustible letters and shall be visible at the primary point of access from the public or common access road and installed on anon-combustible post. 15) Utilities shall be extended underground. 9. 'fhc Applicant shall comply with the applicable codes and requirements of the Aspen Fire Protection District, including but not limited to access, ri~rning around of fire apparatus, installation of an approved fire sprinkler system and a minimum 10,000 gallon on-site water supply for fire fighting. 10. Native vegetation shall be maintained outside of the Activity Envelopes, except to comply with the wildfire mitigation measures described above. 11. Trash/garbage shall be kept in an approved bear resistant container or enclosure, pursuant to the County's Wildlife Protection Ordinance. Veritication of compliance shall be provided prior to issuance of a certificate of occupancy. 12. Prior to commencement of any earthmoving or other construction activity, the Applicant shall stake the corners of the activity envelope and install construction fencing around the construction site within the perimeter of the activity envelope. The fencing shall remain in place until issuance of a Certificate of Occupancy. 13. All areas disturbed by construction and the installation of the sewer line shall be revegetated with native shrubs and grasses within one growing season of the project's completion. The vegetation planted along the sewer line extension shall "blend in" with the existing vegetatiun. 14. No calculations for height, bulk, setback, size, floor area, or any other building and zoning reyuirements have been conducted. These requirements will be considered at the time of building permit. Any structures represented in the application may not be permitted under building and zoning regulations. 15. Statutory vested rights for the approval contained herein are granted pursuant to the Pitkin County Land Use Code and Colorado Statutes, subject to the exceptions set forth in Pitkin County Land Use Code ~ 2-20-170 and C.R.S. § 24-68-]O5. The statutory vested rights granted herein shall expire on .)~~d 7~"I ,0010. 16. BACKGROUND: The existing residence was built in 1972. Only previously disturbed areas with slopes in excess of 30% are included within the Primary Activity Envelope. fhe other Activity Envelopes -for wildfire mitigation, landscaping and the water and sewer lines -all contain slopes in excess of 30% and 45%. Activities within these envelopes will be limited to removal of 000001 ~~ ~~; vegetation (wildfire mitigation envelope), plantings (landscape envelope) and placement of a new sewer line within the existing water line trench and revegetation of the cut. Installation of the sewer line on a slope in excess of 30% is permitted, pursuant to Sec. 7-20-20(e)(9), through the Site Plan review process. Given the existing cut for the water line, which was never revegetated, staff finds that it is appropriate to allow installation of the sewer line within the same trench as the water line and tp require revegetation once the line is installed. The Applicant commits to comply with the grading and retaining wall standards in the Code, and to provide drainage and erosion control as required and as shown on the Grading, Drainage and Erosion Control Plan; a detailed plan will be required at building permit application. Disturbed areas will be landscaped and revegetated. Water Courses & Drainage: The proposed development will not encroach on the Roaring Fork River. Historical drainage flow patterns will be maintained and adequate drainage will be provided. Wildfire: The wildfire hazard was rated as severe by Art Hougland. His recommendations are incorporated into the conditions of approval with the Code standards for development in severe wildfire hazard areas. Landscnpirrg and Vegetntiou Protection: A schematic landscaping plan is included in the application. Existing aspen and spruce trees will be maintained. Installed landscaping will include nahrrally occurring species (except for tlower gardens). Only fruitless crabapple trees will be permitted. Access: The existing driveway will be utilized for the new residence. The existing driveway splits in two to serve the upper and lower levels of the residence; the split will be eliminated and a turnaround will be provided. An access permit will be required for improvements to the driveway. The proposed access complies with the grading requirements for the Code. Sewer and Waster: There is an existing well in the southern portion oCthe parcel near the Rio Grande Trail, and a water line extends up the hill to the residence. The well and water line will be included within the proposed activity envelope for water and sewer. The existing residence is served by a septic system; the system is to be abandoned and the new residence will connect to the Aspen Consolidated Sanitation District main sewer outfall near the Rio Grande Trail. The sewer line is proposed to be placed within the same trench as the water line within the proposed activity envelope. Drainage/Erosion Control: The Applicant will be required to submit a drainage and erosion control plan acceptable to the Planning Engineer prior to building permit submittal. Sc•enic• Review: 'The parcel is within the Highway 82 scenic view protection area ("SVPA"). 'fhe property is over three miles from the visible part of Highway 82 with the primary view from highway 82 and the Cemetery Lane intersection. The Applicant feels that the property could be exempt from the standards for Scenic Vicw Protection as the proposed redevelopment of the residence will have similar minimal visual impacts as currently exist. I lowever, the Code only provides an exemption for an addition to or remodel of an existing structure that "has been located to minimize perceived mass;" this exemption does not apply [o redevelopment. The slope of the property below the existing house is on the average between 20 8i 25% Yi~r about a hundred feet or so then increases to about 30% or more farther down slope. "I'he vegetation is mostly oak, service berry, other native brush and grass. There are some clustered conifer east of the existing house and scattered aspen in the vicinity of the existing house. The slope north of the existing house appears to exceed 30% to the property line. The vegetation on the property is very dense and difficult to see and move through and there are very few small clearings. There is a considerable amount of dead wood in the existing trees and brush, deadfall on the ground and some standing dead trees. 1 moved probably no more than 250-feet down slope from the house, however from a vantage point across the Roaring Fork River 1 could confirm that the vegetation is almost continuous from just above the Rio Grand 'Grail to the home site. These conditions cause me to determine this to be a High Wildfire Hazard Area. If a fire for whatever reason would involve the trees, brush and grass in the area I would expect the fire to continue and propagate as in a High Wildfire Hazard Arca especially as the moisture index of the vegetation diminishes. The property is generally long north to south and narrow east to west. The short distances from the proposed building site to the east and west property lines limit the owners ability to manage the vegetation without cooperation and an agreement with the owners of neighboring properties. 1 understand that the property to the east may also he in the process of creating defensible space and this may provide an opportunity for cooperation and agreement feasible along this property line. T)aly Enterprises, LLC are working on a landscape plan with wildfire hazard mitigation incorporated into the plan. To aid in the development of this landscape plan I offer the following: Vegetation Management and Modification Recommended: Around the proposed house and beyond the furthermost projection of combustible construction for a distance of ] 5-feet the area should be of primarily noncombustible hard scape surfaces, low growing perennials, flowerbeds, cut grass and deciduous, well-trimmed and irrigated plants. Woody vegetation should not be planted within this area. Firewood or other combustible materials should not be stored within this area. If the owner would like to retain the trees near the house this may be done if the I S-foot area is extended outwazd from the furthest growth expected from the mature trees. In other words, these trees should have defensible space as the buildings do. Again, because of the short distances to the east and west property lines consideration should be given to cooperation and agreements with these neighboring property owners. 2. Beyond the 15-foot area up to 65-feet maintain natural and/or irrigated grass at less than 6-inches and thin existing trees and brush into individuals or clusters. Oak and serviceberry should be thinned and clustered. Limbs of trees should be pruned to one half the height of the tree or 10-feet whichever is less. No brush or shrubs which when mature will be tall enough act as ladder fuel should be provided or maintained azound the trees. Clusters of bushes or shrubs should he separated from each other and from those beyond the 65-foot area by a distance of 2 '/ times the height of the mature vegetation. The diameter of a cluster should be limited to 2 '/2 times the height of the mature vegetation. As an example: [f the expected mature height of the vegetation is 10 feet then the diameter of the cluster should he no greater than 2.5 feet and the distance between clusters should be greater than 25 (eet. Ideally the plant material growing between trees and clusters of bushes or shrubs is grass maintained at 6-inches or less. Thin and remove lower branches of brush or shrubs within clusters or individual plants to eliminate ladder fuel. Most of the shrubs that will be cut are vigorous sprouting plants and the cut ends should be treated with a product named Garlon~w or an equivalent by a by person licensed to apply herbicides. Cut materials should be either removed or chipped and spread. ~~i~~~~ 3. Remove or chip all standing dead and deadfall on the property within 100-feet of the house or other buildings.. New Construction: Special attention should be given to "Pirewise" construction on the south, east and west sides of the house where exposed to adjacent property and/or slope. 1 recommend that the design, materials and construction of buildings conform to the design features and materials required by Pitkin County for sate construction in a severe wildfire hazard area as restated below: Pitkin County has Structural Design and Construction Requirements, the following are paraphrased from Pitkin County Land Use Code, Chapter 7, Section 7-20-60 Wildfire Hazards and may not contain exact language but it is intended to be consistent with the intent and purpose of the Pitkin County Requirements. Projections: I recommend that no portion of the building(s) or addition(s) be constructed with unenclosed projections such as decks. Eves should be kept to a minimum on the down slope side and on the sides and should not have ventilation openings unless the design and configuration of the openings are specifically approved by Pitkin County. Projections may include, but are not limited to eaves; cornices; soffits; roofs over open decks, cantilevered floors; bay windows; decks or balconies. Projections may cause heat traps and should be protected as follows: Any projection including guardrails should be constructed with materials approved for one-hour fire-resistive construction, any material underlain by 5/8" Type X gypboard or approved equal or Type IV Heavy Timber materials per the currently adopted building code. Projections should have no inside angles of less than seventy-five (75) degrees. An alternative construction for projections would require the use ofnon-combustible building materials or materials with a flame spread rating of less than twenty five (<?5 tested to ASTM F,84) and listed for exterior use. Areas below projections should be void of vegetation or other combustible materials. The azeas below these projections shall be protected from accumulation of vegetative materials by placement of a vegetative barrier covered with rocks or gravel or shall be concrete or stone. There shall be no storage of combustible materials under projections. The walls under projections shall be constructed of materials approved for one-hour fire-resistive construction on the exterior side of the wall. Window openings in walls below projections shall be tempered glass. Doors shall be noncombustible or one and three-fourths inch (1 '/4") solid wood. Windows and Glass Glazed openings shall be provided with closing, solid, exterior non-flammable shutters or shall be tempered glass. ~~~~U~ / Exterior Walls and Siding: Siding and exterior wall construction shall have a minimum of one-hour fire-resistive rating ground level to roofline, 5/8" gypboard underlying combustible materials or cement stucco with a minimum thickness of/a". If a hardscape patio and masonry wall has been designed as a buffer, exterior doors having tempered glass may be used if approved by the fire marshal. Roofs: ** Roofs shall be constructed with a Class A roof assembly as defined in the 2003 lntemational Building Code ([BC) Section 1505.2 Wood shake/shingle roof coverings are prohibited in all wildfire hazard areas. Roofs with less than a 3:12 pitch are not permitted in wildtre areas unless they comply with the following: 1. All roof coverings shall be listed for installation as a part of the Class A roof assembly. 2. All roof coverings shall have a surface that shall facilitate the natural process of clearing the roof. 3. All roof designs shall facilitate the natural process of clearing the roof of debris. Protrusions above the roofline, such as parapets, shall be prohibited.** 4. Roofs shall be installed as required by the adopted building code and shall have a minimum slope of 1:48. 5. All roof designs, coverings or equivalent assemblies shall be specifically approved by the Fire Marshal prior to submittal of a building permit application.** 6. (1) Is consistent with actions taken during previous development approvals for the property; The approvals that were previously obtained for the property are essentially the same as what is now being requested -the redevelopment of an existing house in the same general area where the site was disturbed and the existing house was built. The previously approved building envelope, the approved location of the utilities, landscaping and defensible space for wildfire mitigation are the same as that proposed in the new Lehrman Property Site Plan. The new Site Plan reflects the terms and language of the new Code. (2) Does not change the use of the proposed development between residential, commercial and tourist accommodation uses; The use will still be residential and a change in use is not proposed. (3) Does not change the basic character of the approved use of land on which the activity occurs, including basic visual appearance and method of operation; The current proposal for the redevelopment of the existing single family residence does not change the basic character of the approved use. The visual appearance and method of operation will be essentially the same. The approved building envelope and the approved location of the landscaping, utilities, wildfire mitigation will be the same as that currently proposed for the Lerhman Property Site Plan, therefore the visual impacts should be similar. (4) Does not increase off-site impacts in the surrounding neighborhood; The impacts are the same as previously approved as the applicant is asking for the same approval to redevelop an existing house under the new Land Use Code. (5) Does not increase off-site impacts in the surrounding neighborhood; Off-site impacts should be the same as under the previous approval. (6) Does not endanger the public health, safety or welfare; The redevelopment of the existing house will not endanger the public health, safety or welfare. Section 7-20-20 Steep and Potentially Unstable Slopes This section of the land use application demonstrates compliance with the Land Use Code standards for Steep and Potentially Unstable Slopes. Please refer to Attachment 7, the proposed Lehrman Property Site Plan which includes a slope analysis on page 4 of the four page Site Plan. The slope analysis shows that most of the land in the proposed Primary Activity Envelope for the home has slopes less than 15%, though there are a few man made slopes around where the driveway and retaining walls were developed. These are minor slope anomalies which are not prone to slope instability. Since the portion of the site where the existing home is located was leveled when the house was built, the Primary Activity Envelope incorporates the flat area around the home. The Primary Activity Envelope avoids all slopes in excess of 30 percent which are outside this area of original development. Similar to what was previously approved, an "Activity Envelope for Wildfire Protection Purposes Only" is located to the south of the Primary Activity Envelope. This will provide defensible space to mitigate the severe wildfire hazard on the site. There is an "Activity Envelope for Landscaping" to the north of the Primary Activity Envelope where a retaining wall currently exists. This wall will be redeveloped and landscaped appropriately to enhance fire protection as well as aesthetics. The lower, southern "Activity Envelope for Utilities" contains the existing water line which connects to the water well of Aspen water along the Rio Grande. When this existing water line was installed years ago, it was never re-vegetated. As approved before, a new sewer line will be placed adjacent to this existing water line, in the same trench, in order to connect to the Aspen Consolidated Sanitation District system. This "Activity Envelope for Utilities" will also allow for the re-vegetation of the trench which did not occur years ago. Section 7-20-20 addresses existing roads and driveways and short driveway encroachments onto steeper slopes in Sections (4) and (5). The driveway was legally created in the 1970s and has been servicing the existing house since its development in the 70s. The use of the driveway is only for access to the home and will not change. No further area will be disturbed that has not already been disturbed from the original development. The driveway now splits into two with the upper drive serving the residence, and the lower drive accessing the lower half of the property. This split will be eliminated, substantially reducing the visual impact of the driveway. The redevelopment will enhance the visual impacts as well as improve slope stability. Please refer to Tom Newland's report in Attachment 9 which addresses access. The proposal reflects the least impactive and most appropriate area for development with regard to slope. -4- oooao~ Section 7-20-20 (e)(2)through (e)(10) Grading The pre-application conference summary states that the additional standards in Section (e)(2) through (10) of the Code should be addressed. Please refer to the Grading, Drainage and Erosion Control Plan on page 2 of the four page Site Plan in Attachment 7. Section (e)(2) addresses limits on changing natural grade. The existing driveway and retaining walls will be used and redeveloped as necessary and will meet the requirements on changing natural grade. Most of the area of grading has been leveled as part of the original development of the existing home built in 1972 or was part of a retaining wall which will be enhanced. Section (e)(3) addresses grading for accessory pads. There will be no development on areas over 20% in grade and this standard will be met. Guidelines and standards for retaining walls are found in (e)(5) and (e)(6). The use of retaining walls is encouraged to reduce the steepness of man-made slopes and to provide planting pockets conducive to re-vegetation. This is what is planned for the "Activity Envelope for Landscaping" to the north and for the retaining wall along the driveway which falls within the Primary Activity Envelope. The guidelines and standards for retaining walls will be followed. Section (e)(7) and (e)(8) address waterways and detention/storm water facilities and will be followed, when applicable. All development with negative visual and aesthetic impacts will be minimized to the maximum extent possible. Section (e)(9) states that utility cuts on any slope with a gradient of 15% or greater shall be reviewed through the Site Plan process. As mentioned previously, and as was previously required and approved, the applicant plans to install a new sewer line in an existing trench along an existing water line south of the Primary Activity Envelope within the proposed "Activity Envelope for Utilities". This will allow a sewer connection to an existing Aspen Consolidated Sanitation District (ACSD) line near the Rio Grande Trail. The existing water line was never re- vegetated when it was installed years ago, so the applicant will be improving the situation by re- vegetating the area, improving the aesthetics as well as enhancing fire protection with appropriate vegetation. Information on the water and sewer is found in Attachment 9, a report from Tom Newland from 2001 regarding utilities for the property. As stated in the report, under a condition of the existing land use approvals, the existing individual septic system on the property was required to be abandoned in favor of this connection to the main sewer outfall of the ACSD located near the Rio Grande Trail. The owner/applicant was required to use the existing hillside cut that was in place for the existing water line running from the Activity Envelope (previously the approved building envelope) to where the line connects to the system near the Rio Grande Trail.. As stated above, the applicant's proposal has not changed, and this connection and re-vegetation is still planned for the property. Section 7-20-20(e)(10) requires re-vegetation. The applicant will landscape and re-vegetate any slope exposed or created as part of the new development and will also landscape and re-vegetate areas not previously re-vegetated. The re-vegetation will meet the Pitkin County Re-vegetation Guidelines and the applicable re-vegetation provisions and standards of the Code. -5- D~D~~J Section 7-20-30 Water Courses and Drainage There will be no encroachment or channeling activities in the nearby Roaring Fork River or any other water course. The project will meet any applicable requirements of the state and federal statues and regulations, including the U.S. Army Corps of Engineers. Section 7-20-30(c)addresses drainage. The development of the property and related activities will maintain historical flow patterns, runoff will be maintained to reasonably preserve the natural character of the area and to prevent property damage attributable to runoff rate and velocity increases, diversions, unplanned ponding and/or storm water runoff. The development will provide for unimpeded flow of natural water courses and ditches, adequate drainage for all low points, a drainage system designed to account for an entire drainage basin capable of accommodating runoff from the proposed development and where when applicable, the runoff from areas adjacent and upstream. A Grading, Drainage and Erosion Control Plan is found in Attachment 7, page 2. The development will be in compliance with all of the requirements of Section 7-20-30, Water Courses and Drainage, including drainage, groundwater, irrigated areas, irrigation ditches, sedimentation and water quality requirements. All setbacks will be met. Section 7-20-130 Landscaping and Vegetation Protection A schematic landscaping plan with wildfire mitigation is found on the Activity Envelope and Driveway Profile on page 3 of the 4 page Site Plan in Attachment 7. This Plan meets or exceeds all the requirements of the Code. The Plan will comply with the Pitkin County Landscape Guidelines and Roadway Landscaping Guidelines when appropriate. The Landscape Plan for the site is intended to protect the rural character of the area, by preserving natural vegetation to the maximum extent practical and by installing landscaping which will include naturally occurring species (except for flower gardens). Existing aspen and spruce trees will be maintained and redtwip dogwood and Rocky Mountain Maple and Spring Snow Crabapple will also be used. Some areas will have native wildflowers and grasses. The Landscape Plan will mitigate the wildfire hazard on the site and will meet or exceed all wildfire mitigation requirements. Please refer to Attachment 10, a letter from Vince Urbina of the Colorado State Forest Service regarding the wildfire hazard on the site. The landscaping will meet the standards regarding berms, landscape enclosures, utility easements, site distance (visibility clearance) and maintenance. The landscaping will enhance visual quality, minimize negative visual impacts and will further the intent of this section of the Code by providing appropriate screening using the recommended appropriate techniques and plants. Attachment 11 presents a photograph of the property from the intersection of Cemetery Lane and Highway 82, the most visible vantage point of the property from a Scenic Corridor. -6- 0~0~~ Section 7-20-60 Wildfire Hazard Area The wildfire hazard on the subject site is severe, particularly in the area south and west of the Primary Activity Envelope where the vegetation consists of Gambel Oak and Serviceberry which contribute to the fire hazard and fuel density. Please refer to the letter from Vince Urbia of the Colorado State Forest Service in Attachment 10 . Urbana visited the site for referral comments for the original approvals. The applicant will comply with the Land Use Code standards for severe wildfire hazards plus the extensive list of previously approved conditions regarding wildfire mitigation. These include the widening of the driveway to provide for pullouts for fire protection. Section 7-20-120 (d) Standards for Scenic View Protection Areas; The Scenic View Protection regulations are intended to preserve the character of Pitkin County through careful attention to the visible impacts of proposed development. The standards are designed to (1) minimize the impacts of development when viewed from 13 designated road corridors in the County, (2) maintain a natural ridgeline silhouette against the sky and to steer development away from ridgelines, (3) to insure developments are designed and located to complement the natural landscape and the natural features within the public viewplane in order to achieve an aesthetically pleasing atmosphere and (4) to reduce damage to natural landforms and views throughout the County. State Highway 82 is the only designated view corridor from which the subject property can be seen. The property is over three miles away from the visible part of Highway 82, down Red Mountain and to the west. It can be seen primarily from the intersection of Highway 82 and Cemetery Lane. A photograph of the property as viewed from this intersection is found in Attachment 11. The proposed residence as viewed from the south (down Red Mountain and along Highway 82) will consist of a two story high stucco and glass main house with dark patina copper colored roof and soffits and a two story studio garage building which will be clad entirely in dark patinated copper. There is very little stucco surface on the valley side of the house and what there is will be colored red brown. Retaining walls on either side of the house will be made of integrally colored (red/brown) board formed concrete. These will be screened by low vegetation so they should not be visible from below. An existing group of five mature Aspen trees will be retained. These will interrupt the house at the middle and will break down the apparent length and scale of the building. Viewed across its curved length, the proposed house will step back in segments to further break down the volume. The curving plan and the step backs will diminish the apparent size of the house when viewed from any angle. Please refer to the Elevations in Attachment 12 as well as the description of the proposed Lehrman residence from the architect in Attachment 13. The applicant feels that the subject property could be exempt from the standards for Scenic View Protection as the proposed re-development of the existing house will have similar minimal visual -7- ~QOOU impacts as currently exist since re-development will occur in the same general area of the site. Though slightly visible from the designated Highway 82 view corridor, the proposed home will be located to minimize perceived mass when viewed from the Highway. The site is so far away from the Highway, that visual impacts are minimal. Even so, we have addressed the Scenic View Protection Standards as they are listed in the pre-application conference summary. These standards for Scenic View Protection are addressed below. Please refer to the Activity Envelope and Driveway Profile including a Landscape Plan in page 3 of Attachment 7, the north and south Elevations of the Proposed Residence in Attachment 12 and the architect's description of the proposed residence in Attachment 13. (1) The proposed development shall utilize existing topography and natural vegetation, such as ridges, hills, and existing trees, to screen buildings to the maximum extent practicable when viewed from those right of ways listed in subsection (b) above. The existing topography and natural vegetation will be used as much as possible to minimize visual impacts from Highway 82. (2) The proposed development shall avoid the location of structures within the Scenic View Protection Areas, and shall avoid the location of structures within any Viewplane identified in the State Highway 82 Corridor Master Plan and Down Valley Comprehensive Plan if possible. If location outside the Scenic View Protection Area and defined Viewplane is not practical, then the proposed development shall not be located on the highest ground or most visible portion of any site as viewed from those corridors listed in subsection (b) above. The proposed location of the redeveloped home is the least impactive location on the site. The visible portions of the home from Highway 82 three miles away will be minimized through design techniques discussed previously and vegetation. (3) The proposed development's height and bulk shall be designed to avoid, to the maximum extent practicable, the visibility of buildings from those corridors listed in subsection (b) above. This may include, but shall not be limited to, breaking the mass of the building down into a series of smaller forms, articulation of the building facades to avoid a wall or row effect, and staggering rooflines to avoid a long unbroken plane. The proposed home has been designed to break the mass to avoid a wall or row effect. Please refer to Attachments 7 and 13, the proposed Activity Envelope and Driveway Profile which includes the landscape plan and architect's description of the proposed residence.. (4) The proposed structure shall be placed so it does not project above a ridgeline such that a structure silhouettes against the sky when viewed from those corridors listed in subsection (b) above. The proposed structure does not project above the ridgeline of Red Mountain when viewed from Highway 82. (5) The proposed development shall be designed to complement the natural topography of the land through the use of techniques such as earth-sheltered design, the use of natural materials and coloring, the use of low-reflectance materials, or clustering of structures on the least visible portions of the site. -8- ~OOOUO~ When a building is proposed near a ridgeline, then its form (particularly its roof form) shall replicate, parallel, or complement the natural form of the ridgeline so that it appears to be an element of the natural ridgline. The proposed home has been designed to complement the natural topography of the land. Earth tone colors and materials will be use, as will low-reflective materials. The landscaping in the Activity Envelope for Landscaping Purposes Only will be used to blend and follow the natural landscape so it appears to be part of the natural slopes. (6) The proposed development shall preserve natural vegetation and avoid development within irrigated meadows, to the maximum extent practicable. The proposed development will preserve the natural vegetation as much as practical. There is no irrigated meadow on the property. (7) The proposed development shall install utilities in locations and through procedures that minimize visual impacts to the maximum extent practicable. After the installation of the new sewer line in the same trench as the existing water line, the applicant will re-vegetate the area. Since the area was not re-vegetated after the installation of the water line years ago, this will improve the appearance of this area within the Activity Envelope for Utility Purposes Only. Using the existing trench is the least impactive procedure for connecting to the ACSD system. (8) All satellite dishes in the proposed development shall be located to minimize visibility from those rights-of--way listed in subsection (b), and shall use earth tone colors and/or screening to minimize their visual impact. The applicant agrees to meet this condition if satellite dishes are used. (9) The proposed development shall not use earth moving and berms as the primary means of compliance with these regulations, but earth moving may be utilized in conjunction with other techniques to comply with standards in this section. Where earth moving techniques are necessary, man-made forms should be undulating and natural in appearance. Berms will not be used in the landscaping plan. Due to the distance from Highway 82, berms and earth moving techniques are not a feasible method for screening. All landscaping will be natural in appearance. The retaining walls will have pockets suitable for plantings which will make them more natural in appearance as well. (10) In the Rural Areas only, development shall be located so that activities and development occur in at least one of the locations specified in subsection (f) as they may apply to the particular property. The subject property is located within the Urban Growth Boundary and this does not apply. (11) Earth Tone Materials. The exterior of all development, except development located and designed in the form of a ranch compound, shall be built or painted with indigenous earth tone materials or colors. The exterior of a ranch compound should be built or painted with indigenous earth tone materials, or shall be painted or stained using local, traditional ranch colors, which shall include shades of red, brown, or white. -9- ~~OD~g Paints or stains that simulate weathered barn wood also shall be permitted. Earth tone materials are proposed for the subject property and this criteria will be met. (12) Roofs. All roofs shall have anon-reflective color or composition. Reflective roof materials shall not be used unless the materials are treated prior to installation to eliminate reflection, with the exception of materials associated with solar or photovoltaic equipment. The proposed residence will have dark patina copper colored roof and soffits. The roof will slope away from the valley side to the south, so the apparent height is minimized and the only visible portions of the roof will be the six inch edge and the soffit underside; both will be clad in dark copper, which has abrownish/black appearance. The roof and roof materials will meet this criteria. (13) Revegetation of Disturbed Areas. Lands disturbed by earth moving or berms should be revegetated using native species that are already growing on or near the site. Topsoil shall be stockpiled and placed on disturbed areas. Irrigation shall be provided to the revegetated areas if it is necessary to ensure survival of planted native species. Re-vegetation will use native species. Topsoil will be stockpiled and placed on disturbed area and re-vegetated areas will be irrigated if necessary to ensure the survival of the plants. The applicant agrees to meet this criteria. (14) Driveways Avoid Dividing Meadows and Pastures. To the maximum extent practicable, roads and driveways shall be located to skirt the edge of and avoid dividing meadows and pastures and to avoid major road cuts. Roads and driveways should take advantage of the screening potential of natural topography and existing vegetation. Existing roads and driveways shall be used where practical. To enhance screening, a row of trees may be planted along the roads or driveways. To the maximum extent practicable, roads and driveways located around the edge of or in meadows shall be laid out with soft, curving edges and shall avoid straight line corridors that are incongruous with the natural setting. The existing house effectively has two driveways which will be combined into one with the redevelopment. The driveway is not located in or near a meadow. This criteria does not apply. SUMMARY This land use application seeks approval for Site Plan Review and a Minor Amendment to a Development Permit. The proposed Activity Envelopes reflect the same proposal as the original approvals, with the essentially the same building envelope and location of landscaping and utilities. Minor modifications have been made to reflect the language of the new Code. The application has demonstrated compliance with the Land Use Code sections identified in the Pitkin County Pre-Application Conference Summary sheet which appears as Attachment 8. All branches from trees and brush within the 30 toot perimeter shall be ptuned to a height of 10 feet above the ground and removal of ladder fuels from around trees and brush. Tree crown separation within the 30 foot perimeter shall have a minimum of IO feet between the edges of the crowns, This does not apply to mature stands of Aspen trees where the above recommendation for removal of ladder foals have been compiled with, In areas of aspen regeneration, the spacing guidelines shall be followed. Robert Lehrman ("Applicant") has applied to the Board of County Commissioners ("BOCC") for an Extension of Vested Property Rights for a period of one-year from April 1~, 2002. ?. For projections below the roofline (including but not limited to exterior balconies, decks, porches, cantilevered floor projections, and bay windows which extend over a flat or sloped surface) the open space between grade and the underside of projections below the roofline shall be enclosed by solid, vertical walls. These walls shall be constructed with materials approved for 1 hour tire- resistive construction on the exterior side of the wall and shall extend from the top of grade to the underside of the floor decking or walls of the projection. An alternative construction method for such projections would require use of non-combustible building materials, or heavy timber or log wall construction, it the underside of the projection portion is covered with materials approved for one hour fire resistive construction and if there are not inside angles of less then 7~ degrees. Areas below such projections shall be void of vegetative or other combustible materials. These areas below projections shall be protected from accumulation of vegetative materials by placement of a vegetative barrier covered with rocks or gravel or by coverage with concrete or stone. There shall be no storage of combustible materials under projections. Tl~e walls underneath projections shall be constructed with materials approved for 1 hour tire-resistive construction on the exterior side of the wall. Window openings in walls below projections shall be} tempered glass. Doors shall be non-combustible or 13/~l" solid wood. 4. Windows and Glass: Glazed openings shall be provided with close-able, solid, exterior non-flammable shutters or shall be tempered glass. r 5. Foundations: Foundations, skirting and crawl space openings shall be fully enclosed and constructed with materials approved for 1 hour fire-resistive construction on the exterior side of the walls and shall extend from the top of grade to the underside of the floor decking or walls. 7. Addresses shall be clearly marked and visible with minimum 2" noncombustible letters and shall be clearly visible at the primary point of access from the public or common access road and installed on anon-combustible post. Any outbuildings or additional buildings shall adhere to the same standards as structures. E. Utilities: I. Utility lines shall be buried. 4. No development, includingAgrading, excavation, fill placement, berming, landscaping, entry or ranch gates, and vegetation removal or disturbance shall occur outside of the approved building and accessory building envelopes, except for utility and driveway extension and maintenance, and as may be necessary to implement the wildfire mitigation measures required elsewhere in this document. The accessory envelope is for well or septic purposes only. 5. All areas disturbed by construction and the installation of the sewer line shall be revegetated with native shrubs and grasses to limit water consumption and additional runoff within one growing season of the project's completion. Landscaping and revegetation on the property shall utilize [ow water (xeriscaping) native plant materials and concepts. The timing of any sprinkler systems shall be decreased for low water plants. The vegetation planted along the sewer line extension shall "blend-in" with the existing vegetation. 6. Prior to the submittal of any building permits, the Applicant shall obtain an Access/Driveway Development approved by the County Engineer. The driveway shall comply with County standards at the time of issuance of the permit. The Applicant shall install a turnout on the far east side (downhill side) of the existing driveway for emergency vehicles. 15. Pursuant to Ordinance No. 022-2000, the Applicant is subject to the Fair Share Requirements and shall pay a road impact fee as calculated at the time of building permit issuance. 16. At the time of building permit application submittal,'the Applicant shall submit, for review and approval by the County Engineer, a Construction Management Plan in accordance to the Asset Management Plan. The Construction Management Plan shall indicate that vehicles associated with construction (i.e. employee traffic, construction vehic~es, staging and deliveries) shall not violate County Law, such as parking on County rights-of--way. • 17. Lighting shall comply with the Pitkin County lighting standards at the time of installation. 18. All waste storage shall comply with Wildlife Protection Ordinance No. 010-2001. Prior to Certificate of Occupancy, compliance with the ordinance shall be verified. 19 The Applicant shall adhere to all material representations made in the application and public meetings. 20. Statutory vested rights for the approval contained herein are granted pursuant to the Pitkin County Land Use Code and Colorado Statutes, subject to the exceptions set forth in Pitkin County Land Use Code, § 4-140 and C.R.S., § 24-68-105. Attached for your review as Exhibit "A" is the County Resolution approving 1041 Hazard Review for the Lange property. I have reviewed the site and researched public records regarding the property and would like to forward the following information to you: Water; Based on a report issued by Wright Water Engineers on September 6, 1996, the existing well is fully capable of providing up to 2000 gallons of water per day. The well was permitted as a domestic well in 1972 and decreed in 1987 for 0.033 cubic feet per second (cfs). This allows for pumping of up to 15 gallons per minute. According to the report the well tested to be sufficient to provide for the water needs of a 5-bedroom house with 3,500 square feet of outside irrigation. The report also tested the quality of the water from the well. The quality of the water supply from the well is within Colorado Primary Drinking Water Standards. The report recommends that the.. water be treated by water softening and pH conditioning that was already be accomplished with an existing system at the house. The report goes on to recommend disinfection and installation of a reverse osmosis system in the kitchen for drinking and culinary uses. The report did mention some concerns about the long-term pumping ability of the existing water system. This is because the water level in the well made a sharp decline after 1-'/z hours of continual pumping, forcing the test to be terminated after 2 hours. The report recommends along-term pumping test to better define the yield of the well. Sewer. Under the land use conditions of approval, the owner is required to abandon the existing septic system in favor of a connection to the main sewer outfall of the Aspen Consolidated Sanitation District (ASCD). This sewer outfall is located below the house within the Denver & Rio Grande railroad right-of- way. The landowner is required to use an existing hillside cut that was placed for the existing water line. This cut runs from the building envelope to the well that is located near the railroad right-of-way. The cut ranges from 18- to 20-feet in width and the water line appears to be located more or less in the center of the cut. After talking to Tom Bracewell of ACSD, a sewer line can be placed in the existing hillside cut with the water line provided that there is at least 10-feet of horizontal separation between the two lines. For every 2-feet in vertical separation between the two lines there can be a reduction of 1- foot in horizontal separation. For example, if the sewer line is located 4-feet below the water line, the horizontal separation can be reduced to 8-feet. In addition, the sewer line and the water line can cross one another (or be located within 10 horizontal feet on one another) if the water line consists of a plastic, seamless conduit that has no breaks in it. A product known as "yellow-mite" would fit this specification. ~~QU~g To summarize, the sewer line can be placed within the existing hillside cut together with the water line provided that: 1) The two lines are separated as described above, or 2) The water line is replaced with yellow-mite piping or relocated in the hillside cut so that the horizontal separation described above is achieved. Access for Emergency Vehicles: The existing driveway to the property is approximately 12-feet wide and is paved to the property line. The existing house has a primary parking area that is approximately 100-feet long and 48-feet wide with an additional parking/turnaround area that is 20- to 60-feet wide and 70-feet long. The nearest fire hydrant is located approximately 1000-feet from the property line. Ed Van Walraven of the Aspen Fire Protection District was contacted regarding the property. He said that although the existing access road to the property is not the required 20-feet in width, it is paved and fire trucks can use it to access the property. This is provided that an adequate tumaround area is provided on the property. Ed went on to say that the Langes had met with him and a method for emergency vehicle ingress and egress was determined for the particular residential design that the Langes had developed. I obtained specific turning radius and approved access roadway tumaround specifications from the Aspen Fire protection District that are attached as Exhibit "B". Based on the existing condition on the site, I feel that either the flattened cul-de-sac design or the two acceptable alternatives to the "hammerhead" design can be placed on the property. Based on this information, I believe that provision of emergency vehicle access is possible on the property but must be developed in cooperation with the fire district as a part of building and site design. Woodstove/Fireplace Placement: If a wood burning stove or fireplace is desired as a part of any new development on the parcel, an application for this device must be submitted to and approved by the Community Development Department prior to issuance of a building permit. Access Permit: In addition, an access permit for the driveway must be obtained from the County Engineer prior to issuance of a building permit. I see no restriction on the property that would prohibit the owner from complying with the county standards and specifications with regard to driveway construction. This concludes my report. The report is based on the county approvals for the property to date and represents my best assessment of the property based on site inspection and available records on file. This report does not address any development contemplated that it outside of the existing approvals for the property. If I receive a referral from Pitkin County concerning this property I will defer to these comments. I visited the site with you and Chadwick Lange on July 25th. Access to this parcel is via Willoughby Lane. This particular property has an existing house on it. It is also the last house on Willoughby Lane. Although access is probably adequate for emergency service vehicles, the road gets narrower and narrower as you get closer to the home, so by the time you arrive at the house your are on a one lane driveway. In the event of a wildfire incident, access or egress may present a serious problem. The house has cleared or graveled areas north, east and south of the house as a result of past clearing for construction. Outside of these cleared areas to the south and west the slopes are greater than 30% and covered with Gambel oak and serviceberry. To the .east is the driveway, a turnaround area and parking for vehicles. To the north is the slope up to the neighbors and a small stand of narrowleaf cottonwood. I would rate the wildfire hazard as severe because of the existing fuel density below the house to the south and west. The Colorado State Forest Service (CBEs) uses the Pitkin County Land Use Code, the National Fire Protection Association 299_ standard for the Protection of Life and Property from Wildfire and other CSFS publications to arrive at the wildfire hazard mitigation recommendations. These recommendations are listed below and are in line with what we discussed on the day of my visit. 1) For a distance of 10 feet around all structures establish and maintain vegetation at 6 inches or less (e.g., mowed grass). Woody vegetation should not be planted in this area. In addition, flammable material (e.g., firewood) should not be stored within this perimeter. 2) For a distance of 45 feet uphill and to the sides, and 60 feet downhill (see enclosed chart) thin existing vegetation to the specifications outlined in Section 3-80.7.C.a.2-5 of the Pitkin Land Use Code. This section of the code describes the manner in which defensible space is created. Once the thinning is completed it must be periodically worked on to maintain the effectiveness of the defensible space. ~- 000040 Page 2 -Lange 3) The removal of the lower limbs to eliminate ladder fuels does not need to be as drastic as described in the code. The lower limbs on all shrubs or trees within the defensible space perimeter need to be removed up to half the total height or 10 feet whichever is least. 4) All dead fall within 100 feet of all structures should be removed. 5) Because of the severe nature of the surrounding fuels I recommend implementing some of the Structural Design and Construction Options as an added safety precaution. Some areas to consider are enclosing all projections (e.g., decks) from the top of grade to the underside of the floor decking with a 1 hour fire-resistive construction material and installing a roofing material resistant to burning. 6) Installing turnouts on the existing driveway would be advisable. June 1, 2007 Description of the Lehrman Residence at 1300 Willoughby Way, Aspen, Colorado The proposed residence viewed from the Valley will consist of a two-story high stucco and glass main house with dark-patina copper roof and soffits; and atwo-story Studio Garage building which will be clad entirely in dark patinated copper. There is very little stucco surface on the valley side of the house and what there is will be colored red brown. Retaining walls on either side of the house will be made of integrally colored (red/brown) board formed concrete. These will be screened by low vegetation so they should not be visible from below. An existing group of five mature Aspen trees will be retained- these will interrupt the house at the middle and this will break down the apparent length and scale of the building. Viewed across its curved length, the proposed house will step-back in segments to further break down the volume. The curving plan and the step-backs will diminish the apparent size of the house when viewed from any angle. The main house will have large areas of glass facing the valley, but these will be shaded by a 6' overhanging roof with a dark copper-clad underside. The reflectivity of the glass will thus be kept to a minimum. Window mullions and framing will all be dark patinated copper. The roof of the house slopes away from the valley side, so the apparent height is minimized and the only visible portions of the roof will be the 6' edge and the soffit underside; both clad in the dark copper, which has abrownish/black appearance. To the greatest extent possible this is intended to be a "stealth" house- as invisible from the down valley view as possible. It was designed to follow the footprint of the existing house (to be demolished) at the western end and the studio/garage will be separated from the main house to avoid the appearance of a large continuous mass.
