SUMMARY OF FINDINGS REQUIRED BY REVIEW PHASE
Directions: Any applicant for a development requiring apermit under
this code shall be responsible for showing conformance with any applicable
policies of Section 2 as listed below. The applicant shall submit those
requirements necessary to show conformance with these policies and the
related general regulations of Section 5. Upon submission of the applica-
tion and all submission contents, the Planning Office shall distribute
same to appropriate referral agencies which shall indicate its certifica-
tion or non-certification of the proposal as being in conformance with
policies and as satisfying submission requirements and review guidelines
of relevant general regulations. Referral agencies shall also indicate
whether further study in a later review phase is required and any further
recommendations or conditions, attaching comments and returning same to
the Planning Office.

The application is for the purposes of a one-time
i lot split (exempt from growth management) and for an
exemption from the definition of a subdivision of
' previously developed lands as provided for in
' Article 4-2.2 a (6) of the Pitkin County Land Use Code.
The property owned by the applicant,
Charles E. Thomas, consists of two separate tracts
containing a total o£ approximately 853 acres. There
I are, at present, three single family homes on the
property, all with in 500 feet of each other. The lot
split, if-approved, would create another single family
unit in the same area.
The application, i£ approved, would provide for a
' covenant against further development of approximately
120 acres surrounding Lewis Lake, which provides for
just over 30 acres per unit to accomodate the RS-3.0
zoning of the property.
', The flood plain line as shown on the plat assumes
a water level 10 feet higher than that shown on 'the
i U. S. G. S. quadrangle sheet. The code calls for
i 5 feet above high water level, so l0 feet seems more
'than reasonable in this case.
The existing and proposed development is shown as
an area"of moderate visual vulnerability on the C. S. U.
i hazard maps. No other hazards appear.
The single family dwelling for which exemption--is
~ sought has been in place since 1969, at which"time no
subdivision regulations were in effect and the area was
unzoned.
The existing water supply is an improved spring.
,' It is proposed, however, that wells be drilled on both
the exempted and the subdivided tracts.
Sewage disposal would be site specific engineered
systems.

The application at hand is a request to transfer density
from an 800. acre tract to ,a 53 acre tract near the Crystal
River. The question of density transfer is unresolved
as far as I can determine and remains a planning con-
sideration rather than`an engineering matter.
However, with respect to engineering considerations, if
the intension of the applicant is to further pursue this
approval and develop the river acreage along the allowable
density of the upper acreage, then the criteria for
evaluating the carrying capacity of this land should be
significantly sharper than what is presented.
In other words, under current .zoning the allowable build-
out is approximately 25 units of which 3 presently exist.
The roads, utilities, geologic considerations £or evaluating
this impacts should be considered rather than allowing a
piecemeal development to occur:
with respect to the application at hand the following
information is needed:
Proof of legal access from the .highway;
A joint use and maintenance agreemment for the
common facilities;
Dedication of utility easements and recreational
use easement for the Crystal River and Lewis Lake;
An agreement to join and support improvements districts
which exist or clay be proposed for this area.

We have reviewed the data submitted regarding this application and
the,. general and engineering geology of the area and, with the exception
of flooding, there appear. to be no geologic reasons why this application
should not. be approved.
Lot 1 in sec. 22 could very well lie within the 100-year flood limit of
the Crystal River. This matter should be resolved. by a competent
hydrologist or hydrologic engineer prior to subdivisioh dnd certaihly
before thin lot is allowed to be sold..
