Sopris Ranch Rd., approximately 3 miles south of Carbondale; immediately west of State Highway 133; Portions of Sections 10, 15 and 16, Township 8 South, Range 88 West ZONING: RS-30 PUD REQUEST: The Perry Sopris Partnership is requesting approval of a minor 1041 Environmental Hazard Review/Category 2 Exemption. The partnership is proposing a building envelope for construction of a single family home which.is to be approximately 1900 square feet in-size. The proposed residence is to be located 'on a parcel which is 250 acres in size, zoned R5-30 PUD. 1041 REVIEW The house site is a slightly sloping irrigated pasture covered in brome and orchard grass. The site is mapped as critical habitat and winter range for Elk: No°other 1041 Hazards, are mapped on site. Kevin Wright, of the Division of Wildlife has reviewed the site and. indicated that there is a mapping error, on the 1041 maps regarding this area. The critical habitat for deer and elk begins on the ridge and mesa 'which Ties above the hayfield/pasture in which the applicant proposes to build the residence. Mr. Wright notes that deer winter use may occur in the cottonwood/shrub type immediately south of and adjacent to the homesite location. Deer and Elk winter range lies adjacent to the site in the sagebrush/oakbrush habitat type.. It is Mr. Wright's recommendation that the cottonwood/shrub habitat type immediately south of the homesite location be left in its natural state and that any nonworking ranch dogs be kenneled or chained. Access to the site is to be directly off of Highway 133. The driveway is to be aligned along the side of an existing hay field. The area to be disturbed for the driveway is flat and outside of any hazard areas. The applicant intends to revegetate any ground disturbed by road construction within one growing season of construction. An access permit will be obtained from the State Highway Department through the County Engineers office prior to issuance of a building permit, BUILDING PERMIT EXEMPTION REVIEW ~ ~. Pursuant to Section 18-2.@ of the Code, the applicant has addressed proposed water supply and waste water disposal for the site. The applicant commits to install a septic system which meets the approval of the Environmental Health. Department. The system design will be approved prior to issuance of a building permit. Water will be supplied from a well which was recently drilled approximately 500 feet east of the house ..site. The .well produces over 30_gallons a minute, which is more than adequate for domestic, water provision._ Holy Cross Electric Association has agreed to extend service to the residence. _There s_an existing power line. ,1100 feet south east of the home site. .Holy Cross proposes an overhead line along .the existing fence line .and an underground line the last .100 yards to the house. Any trench required for the undergrounding of the utility line will be revegetated within one growing season of the .installation ... FINDING: 1) The proposed building envelope is located outside of 1041 hazards which exist on site. 2) The applicant has submitted a site plan for recordation. 3) The County Attorney is satisfied that the property was legally created and has not merged with any contiguous lots. 4) The applicant has addressed_ the category 2 exemption criteria for land use. RECOMMENDATION' Sections 5-400.3(b) and 5-400.5(b) of the Land Use Code ,,provide that the Planning Director is authorized to approve a site plan and application for a Minor -1041 Hazard review. .Based on the findings referenced above, Staff recommends approval of the Perry/Sopris Partnership 1041`"Minor Hazard Review and Category 2 Exemption. Said approval is subject to the recommendations listed below. If you agree with Staff's recommendation, please sign this memo, which will serve as a reference document authorizing approval of said application: Planning Director's sign-off on a 1041 Review Site Plan is also necessary for completion of the administrative review process. The Site Plan shall be recorded in the `Clerk & Recorder's office. A copy shall be placed in the file. CONDITIONS OF APPROVAL: 1. The applicant shall provide the following mitigation to alleviate impacts to wildlife habitat on the parcel: r^~*, 4-- a. The cottonwood/shrub habitat type immediately south of the homesite location shall be left_in its natural state; b. Nonworking ranch dogs. shall be kenneled or chained. 2. Prior to issuance of a building permit, water well quality and quantity and septic system design for the site shall be approved by the Environmental Health Department. 3. An access permit will be obtained from the .State Highway Department through the County Engineers Office. prior to issuance of_a building permit. 4. Any ground disturbance required for the undergrounding of the utility line and construction of the driveway shall be revegetated within one growing season of construction.. 5. Galena Avenue Aspen, CO 81611 Dear Ellen: As per my conversation with you on 12/19/89 regarding the Bill Fale 1041 review, Mr. Fale selected a buliding site which lies in a pasture/ hayfield. Immediately south of this site is a cottonwood/shrub habitat type. There is a mapping error on the 1041 maps regarding this area. It is currently mapped as critical habitat for deer and elk. Critical habitat for'deer and elk begins on the ridge and mesa which lies above the hayfield/pasture. Winter range should begin at the sagebrush/oakbrush habitat type at the edge of the fields. It is difficult to map out all hayfields. Generally, irrigated hayfields are not winter range because they are relatively flat or gentle topography, no browse. species available and they usually have greater snow depths rendering them less desirable. There can be exceptions so these need to be evaluated on a case by case basis. I do not feel all are defendable as winter range. Depending on snow depth, they may receive early and late winter deer and elk use. They are used heavily during spring and fall. In reference to Mr. Fales site, it does lie in a pasture. Deer winter use may occur in the cottonwood/shrub type immediately south and adjacent to his preferred homesite location. .Deer and elk winter range lies adjacent to the site in the sagebrush/oakbrush type. I would suggest the cottonwood/shrub habitat type immediately south of .the homesite location be left in its Natural state and any nonworking ranch dcgs be kenneled or chained.
