DJ LLC (hereafter Applicant ) has applied to the Community Development Director (hereafter .. C ~ "Director") for 1041 Hazard Review approval to establish a building envelope for the construction of a ~ single-family residence. " '~"~ 2. The Director finds that the wildfire hazard is low, that the building envelope avoids wetland areas and ~ ~ ~ slopes in excess of 15 percent. "' + 6. The Director further finds that the existing residence on the parcel is an identified historic resource, and that further review will be required related to the preservation or demolition of the residence. THE DIRECTOR DOES HEREBY APPROVE the DJ LLC 1041 Hazard Review, subject to the following conditions, which shall run with the land and be binding on all successors in interest: 1. The Applicant shall- adhere to all material representations made in the application and shall consider those representations to be conditions of approval, unless amended by other conditions. 2. Prior to submission of any building permit applications for new development, the Applicant shall submit a 1041 Hazard Review Site Plan to the Community Development Department for approval alid recording. The mylar copy of the site plan must be signed by the owner prior to submittal for recording. 3. :Prior to submission of a building permit application for a new single family residence, the Applicant shall either: A. Submit a 1041 application under the provisions of Section 3-80-060, Historic and Archaeological Resource Areas, and obtain approval to demolish the historic structure and replace it with a new single family residence; OR B. Submit a special review and GMQS exemption application to designate the historic structure to the County's Historic Inventory and obtain the right to construct an additional single family residence of up to 5,750 square feet of floor area on the parcel. 5~15~ . Prior to commencement of any earthlnoving or construction activity, the Applicant shall stake the corners of the building envelope and install construction fencing around the perimeter of the building envelope. The fencing shall remain in place until issuance of Certificate of Occupancy. 5. Prior to issuance of any building permits for the new residence, the Applicant shall: A. Complete afireplace/woodstove registration form with the Community Development Department, if necessary. B. Obtain a County access/driveway permit. C. Submit a drainage and erosion control plan for review and approval by the County Engineer. D: Submit a construction management plan for review and approval by the County Engineer showing the locations of staging, material storage and employee and construction traffic parking. E. Pay the applicable road and employee housing impact fees. 6. The applicant shall comply with the following landscaping and wildfire defensible space mitigation standards: A. Brush, debris, and non-ornamental vegetation shall be removed within a minimum 10 foot perimeter around the structure. B. Vegetation shall be reduced to break up the vertical and horizontal continuity of the fuels a minimum of a 30 foot perimeter around the structure. C. For a distance of 10 feet around all structures establish and maintain vegetation at 6 inches or less. Woody vegetation should not be planted and flammable material should not be stored within this perimeter. D. Spacing between clumps of brush and vegetation within the 30 foot perimeters shall be a minimum of two times the height of the fuel Maximum diameter of the clumps shall be two times the height of the fuel. All measurements shall be from the edges of the crowns of the fuel. E. All branches from trees and brush within the 30 foot perimeter shall be pruned to a height of 10 feet above the ground and ladder fuels' from around trees and brush shall be removed. F. Tree crown separation within the 30 foot perimeters shall have a minimum of 10 feet between the edges of the crowns. G. All branches which extend over the roof eaves shall be trimmed and all branches within 15 feet of the chimneys shall be removed. H. The density of fuels within a 100 foot perimeter of the structure shall be reduced. I. All deadfall within the 100 foot perimeter shall be removed. J. The applicant shall be responsible for the continued maintenance of the defensible space vegetation requirements. 7. The applicant shall comply with the following additional wildfire mitigation standards: A. Roofs shall be constructed with a Class A roof covering or a Class A assembly as defined in the International Building Gode (IBC) Section 1505.2. Wood shake/shingle roof coverings are prohibited. Protrusions above the roofline, such as parapets, shall be prohibited. 4) Roofs shall be installed as required. by the adopted building code and shall have a minimum slope of 1:48. 5) All roof designs, coverings, or equivalent assemblies shall be specifically approved by the Fire Marshal prior to submittal of a building permit application. B. Vents shall be screened with corrosive resistant wire mesh with mesh '/4 inch maximum. C. Roofs and gutters shall be kept clear of debris. D. Yards shall be kept clear of all litter, slash, and flammable debris. E. All flammable materials shall be stored on a parallel contour a minimum of 15 feet away from any structure. F. Weeds and grasses within the 10 foot perimeter shall be maintained to a height not more than 6 inches. G. Firewood/wood piles shall be stacked on a parallel contour a minimum of 15 feet away from the structure. H. Swilnming pools shall be accessible to Fire Department vehicles. I. Fences shall be kept clear of brush and debris. J. Wood fences shall not connect to the structure. K. Any outbuildings or additional structures shall adhere to the same standards as structures. L. Fuel tanks shall be installed underground with an approved container. M. Propane tanks shall be installed according to NFPA 58 standards and on a contour away from the structure with standard defensible space vegetation mitigation around any above-ground tank. Any wood enclosure around the tank shall be constructed with materials approved for 2 hour fire- °~"'^ resistive construction on the exterior side of the walls. N. Each structure shall have a minimum of one 10 pound approved ABC fire extinguisher placed in a visible and accessible location. O. Addresses shall be clearly marked wit112 inch non-combustible letters and shall be visible and installed on anon-combustible .post. P. New utility lines shall be buried within the driveway or approved envelopes. 8. No development, including grading, excavation, fill placement, berming, landscaping, entry or ranch gates, well, septic system, and vegetation removal or disturbance shall occur outside of the approved. building [and/or] access envelopes unless otherwise specified in this document, such as necessary wildfire mitigation. Construction, staging, parking, utility and driveway extension and maintenance shall occur within the approved building or access envelopes. 9. The Applicant shall comply with the following to minimize ecological impacts: A. Install and use approved bear-proof trash containers as required by the County's Wildlife Protection Ordinance.. B. Native vegetation shall be maintained outside of the building envelope. C. The Applicant desires to construct an additional single-family residence on the property within the proposed building envelope. The building envelope is the same as was approved in 1999 and 2003. APPLICANT: DJ LLC REPRESENTATIVE: Glenn Horn LOCATION: The property is located at 722 Woody Creek Road across from the turnoff for Little Woody Creek Road. ZONING/LOT SIZE: The property is zoned RS-20 PUD and is 23 acres in size. BACKGROUND: The Community Development Director granted Administrative1041 Hazard Review approval in 1999 pursuant to Administrative Decision No. 99-48. The 1041 site plan was recorded in Plat Book 63 at Page 22. The Community Development Director granted a new 1041 Hazard Review approval by pursuant to Administrative Decision No. 19-2003. REFERRAL COMMENTS: The Woody Creek Caucus.supports the application. 1041 ENVIRONMENTAL HAZARD AREAS (SECTION 3-801: Slopes: The building envelope is relatively flat with no slopes exceeding 15 percent. Wildfire: The wildfire hazard within the building envelope is low. Wetlands: There are jurisdictional wetlands located on the southeast portion of the property (encompassing a majority of the parcel; approximately 18.3 acres). The building envelope is located at least 50 feet away from these designated wetland areas. Grazing of cattle on the. property was prohibited by the 2003 approval. Historical and Archeological Resource Areas: Suzannah Reid, the Pitkin County Historic Preservation Officer, commented on the historic structure during the 2003 review. She determined that the existing structure was built in 1910 and has historical significance to Pitkin County. The 1999 approval stated that demolition or alteration of the existing historic structure would require further review and that prior to submission of any building permit, the Applicant shall submit an application for special review and GMQS exemption to designate the historic structure to the County's historic inventory in order to construct one additional single family residence on the property. In 2003, Hearing Officer Determination _ ~. -2003 Page 2 the Applicant requested to amend the condition to specify that preservation of the historic structure would be at the discretion of the owner rather than a requirement. The Applicant stated, "With the reduced floor area allowed at this time, the owner or future owners may not want to keep the existing structure as it will use more floor area than would be desirable." The 2003 approval does not appear to provide the discretion that was requested by the Applicant, as it states that the Applicant "shall" seek approval to designate the historic structure in order to construct a new single family residence. The Applicant has again requested clarification regarding the discretion to preserve or demolish the historic structure. Staff agrees with the Applicant and would clarify that the Applicant has two options with regard to the historic structure: 1. Submit a 1041 application under the provisions of Section 3-80-060, Historic and Archaeological Resource Areas, in order to demolish the historic structure; OR 2. Submit a special review and GMQS exemption application in order to designate the historic structure to the County's Historic Inventory and obtain the right to construct an additional single family residence of up to 5,750 square feet of floor area on the parcel (the square footage of the historic structure would not count towards the 5,750 square feet). The Applicant would be required to obtain approval under one of the two options prior to submission of a building permit application for a new residence. RECOMMENDATION: Staff recommends that the Community Development Director approve the DJ LLC 1041 Hazard Review subject to the conditions in the attached Administrative Determination. ATTACHMENTS: 1. Please see Attachment 1 for a vicinity map showing the property's location and the surrounding area. The subject site is improved with a small single family house which is served by a private water well and an individual waste water disposal system. Please see Attachment 2, the current, approved and recorded 1041 site plan for the property, formerly known as the Spaghetti Ranch company property. The subject property was granted an Administrative 1041 approval in 1999 in Pitkin County Resolution 99-48 and another administrative 1041 approval was granted in 2003 through Resolution 19-2003. These resolutions are found in Attachments 3 and 4. As the vested property rights for the current approval expires on Apri123, 2006, the owner is requesting another approval and an extension of the vested property rights for the approval for an additional three years until Apri123, 2009. The formerly approved and currently proposed building and access envelopes are the same and these envelopes avoid all 1041 hazards. The applicant agrees to all the conditions of approval in the 2003 which are found in the resolution in Attachment 4 and to all the material representations made in the original land use applications. Section 3-80-020 A. of the Pitkin County Land Use Code provides for the Planning Director to exempt the "remodeling, expansion or reconstruction of single-family and duplex structures provided there is no construction or expansion of a structure that would create additional 1041 impacts." The applicant is submitting the same recorded 1041 Site Plan which is amended only to reflect current dates and the new owner name. This is found in Attachment 5 and it shows that the building and access envelopes avoid all 1041 hazards and meets this requirement for this exemption. It is our understanding, that at the owner's discretion, the existing house on the subject parcel can be designated historic and upon designation, the property will be eligible for Growth Management Incentive for Preservation of Historic Structures pursuant to Code Section 9-110- 043 (A). This is stated in condition 18 of the 2003 approval. The applicant would like to clarify that the decision to have the existing house designated historic is at the owner's discretion. Should a future owner not wish to designate the existing house as historic, and therefore chooses to either keep and expand the existing house or demolish the existing house and build a new residence, that is the owner's prerogative. We are requesting that the existing language in condition #3 be amended to clarify that this historic designation is optional and not a requirement of the 1041 approval. The existing house and proposed access and building envelopes are located in the northwest corner of the site. Both envelopes are flat with slopes of less than 15 percent. The site plan in Attachment 5 does not depict topography. During a site visit for the original application, Suzanne Wolf indicated that if the envelopes were located in the area she inspected, a topographic map would not be required as the area is flat. The applicant understands that a topographic map with two foot contours will be required to obtain a building permit. The subject site is traversed by Woody Creek. Andy Antipas, Ecological and Environmental Consultant, inspected the site and delineated wetland areas on the property in 1999. Attachment 6 is a June 15, 19991etter from Andy addressing wetlands on the property. Approximately 18.3 areas of wetlands are depicted on the 1041 Site Flans in Attachment 2 and 5. The Director finds that. the building envelope is low wildfire hazard, avoids wetland habitat areas, avoids slopes in excess of 30 percent and is more or less void of 1041 Hazard concerns. NOW THEREFORE BE IT RESOLVED by the Director that approval is hereby granted to the Spaghetti Ranch 1041 Hazard Review subject to the following conditions, which shall run with the land and be binding on all successors in interest: 1. The Applicants shall adhere to all conditions and material representations made in the application herein. Prior to submittal for any building permits, the Applicants shall record a 24 X 36 inch mylar ] 041 Hazard Review Site Plan in accordance with Section 5-70-040 of the Land Use Code. Community Development shall approve the site plan prior to recordation. Upon approval by Community y Development, the site plan shall be submitted in digital format for integration in to theCounty Geographic ]nformation System (GIS) prior to submission of a building permit. Prior to building permit submission for another single-family residence, the Applicaa~t shall submit an application to the Community Development Department seeking Specid review and GMQS exemption approval to desis;nate the existing single~family house as a historic dwelling. The driveway shall comply with County driveway standards at the time of issuance of an access permit. The applicant shall comply with the following landscaping and wildfire defensible space mitigation standards: A. Brush, debris, and non-ornamental vegetation shall be removed within a minimum l0 foot perimeter around the structure. B. Vegetation shall be reduced to break up the vertical and horizontal continuity of the fuels a minimum of a 30 foot perimeter around the structure. C. For a distance of l0 feet around all structures establish and maintain vegetation at 6 inches or less. Woody vegetation should not be planted and flammablematerial should not be stored within this pernneter. D. Spacing between clumps of brush and vegetation within the 30 foot perimeters shall be a minimum of ttivo times the height of the fuel. Maximum diameter of the clumps shall be two times the height of the fuel. All measurements shall be from the edges of the crowns of the fuel. E. All branches from trees and brush within the 30 foot perimeter shall be pruned to a height of 10 feet above the ground and ladder fuels from around trees and brush shall be removed, F. Tree crown separation within the 30 foot perimeters shall have a minimum of 10 feet between the edges of the~crowns. G. All branches which extend over the roof eaves shall be trimmed and all branches within 1 ~ feet of the chimneys shall be removed. H. The density-of fuels within a 100 foot perimeter of the structure shall be reduced. I. All deadfall within the 100 foot perimeter shall be removed. J. The applicant steal! be responsible for the continued maintenance of the defensible space vegetation requirements. The applicant shall comply with the following additional wildfire mitigation standards: A. Roofing: New roofs shall have a class A roof covering or a class A assembly roof system. Wood shake/shingle roof coverings and. flat roofs (up to a 3: ] 2) pitch are prohibited. B. Vents shall be screened with corrosive resistant wire mesh with mesh''/a inch maximum. C. Roofs and gutters shall be kept clear of debris. D. Yards shall be kept clear of all litter, slash, and flammable debris. E. All flammable materials shall be stored on a parallel contour a minimum of 15 feet away from any structure. F. Weeds and grasses within the l0 foot perimeter shall be maintained to a height not more than 6 inches. G. Firewood/wood piles shall be stacked on a parallel contour a minimum of l 5 feet away from the structure. H. Swimming pools shall be accessible to Fire Department vehicles. I. Fences shall be kept clear of brush and debris. J. Wood fences shall not connect to the structure. K. Any outbuildings or additional structures shall adhere to the same standards as structures. L. Fuel tanks shall be installed underground with an approved container. Propane tanks shall be installed according to NFPA 58 standards and on a contour away from the structure with standard defe»sible space vegetation mitigation around any abova~ ground tank. Any wood enclosure around the tank shall be constructed with materials approved for 2 hour fire-resistive construction on the exterior side of the walls. N. Each structure shall have a minimum of one I O pound approved ABC fire extin_uisher placed in a visible and accessible location. y O. Addresses shall be clearly marked with 2 inch noncombustible letters and shall be visible and installed on anon-combustible post. P. New utility lines shall be buried. 10. No development, including grading, excavation, fill placement, berming, landscaping, entry or ranch gates, and vegetation removal or disturbance shall occur outside of the approved building [and/or] development envelopes unless otherwise specified in this document, such as necessary wildfire mitigation. Construction, staging, parking, utility and driveway extension and maintenance shall occur within approved building, or access driveway. No construction staging shall occur on Woody Creek Road. 11. Prior to application for building permit the applicant shall provide for review to the County Engineer a trip generation and construction trip generation study for any free market residential structure exceeding x,000 square feet. Atraffic-engineering consultant hired by the applicant and pre-approved by the County Engineer shall develop this study. 12. Pursuant to Ordinance No. 022-2000, the Applicants are subject to the Fair Share Requirements and shall pay a road impact fee. 13. Y ~° , 'r ATT14CWr1E~ii'__~ On Apri124, 1999 I completed a wetland investigation on a 23.5 acre parcel identified as the Spaghetti Ranch, which is located at Sections 9, 10, 15 + 16, Township 9 South. Range 85 West of the 6th P.M., Woody Creek, Pitkin Co. Colorado. I identified and delineated a large wetland meadow adjacent to a well developed riparian community associated with Woody Creek. The following letter briefly outlines the wetlands methodology, study findings, wetland functions and values, and stewardship recommendations. Methodology The routine criteria as described in the Army Corps of Engineers 1987 Delineation Manual (Environmental Laboratory, 1987) was utilized. The 198? manual utilizes the three parameters of vegetation, soils, and hydrology to identify and delineate wetlands, and requires that these parameters be determined during the growing season. Weber's Colorado Flora of the Western Slope (1987) was the primary taxonomic reference, and plant species nomenclature and wetland indicator status follow Reed (1988) for the intermountain region (Region 8). Dominant plants species at each sample location were determined by visual estimation within a 30 foot radius plot. All soil characteristics reported here reflect field determined conditions in the B horizon or the greatest depth above an impermeable layer. The Soil Survey ofAspen-Gypsum Area (1992) and the regional hydric soil list were also utilized during the investigation. Results 18.3 acres of jurisdictional wetlands (palustrine emergent) and riparian vegetation (paIustrint scrub/shrub) were identified and delineated on the subject property. A wetland boundary map is attached to this report. There is a well defined topographic break which loosely defined the wetland boundary. • Wetland herbaceous species including a variety of grasses, sedges, and rushes dominate the ~ meadow. While several willow species, alder, and cottonwood dominate the riparian community. Soil testing revealed low chromes soils, which serve as an indicator of a high seasonal water table. Finally, much of the meadow and streambanks were saturated or inundated with water. Therefore, all three jurisdictional parameters were observed during the field investigation. Late April in Woody Creek is early in the growing season and most of the trees and shrubs had not leafed out. In addition, the herbaceous vegetation had not matured making species identification difficult. However, there was sufficient soil and hydrologic evidence to make an accurate boundary determination. I am very excited to have the opportunity to discuss wetland functions, values, and stewardship. That is something that does not happen very often in the consulting business! Water continually circulates in our environment. Water evaporates from the oceans, lakes, streams, and soils to become part of the vapor of the atmosphere. Here it condenses to form clouds. Rain, snow, and other forms of precipitation, return the water to the earth's surface. Water that reaches the ground may collect in natural basins where it is stored. It also flows over the terrain, finding its way to creeks and streams, or it infiltrates the soil and joins the groundwater reserve. Groundwater can discharge to produce seeps and springs that feed our wetlands. Regardless of its origin, water that collects on a site frequently, or remains there long enough, may create wetlands. Many plant and animal species are entirely dependent upon wetlands for survival. Animals spawn, nest, breed, rest, and raise their young in wetlands. Plants find suitable conditions to germinate, grow, and flower there. Large animals associated with wetlands include muskrat, otter, and beaver. As pressure for land development reduces upland habitat, deer and bear spend greater time in wetland areas. A real concern in our valley. The waters of wetlands are teaming with many microscopic organisms. Insects abound, including damselflies, dragonflies, water striders, and boatman. Invertebrates such as freshwater clams and crayfish live there too. These creatures form the basis of the food pyramid for many fishes, reptiles, and amphibians, birds and mammals that flourish in wetland habitats. Wet environments, together with large amounts of nutrients often result in an abundance of vegetation. This mass of plant material traps the sun's energy and is a driving force in the wetland. Due to their great productivity, wetlands are rich with species, also known as biodiversity. Wetlands also function to improve water quality and control flooding by acting as a sponge. Wetland Stewardship The proposed conservation easement will protect the two wetland types identified on the subject property. Riparian communities maintain water quality and provide valuable habitat for all of our wildlife. The trees and shrubs shade the stream keeping the water cold for native trout populations. The vegetation also Slters storm runoff removing nutrients and sediment which maintains water quality and clarity. The shrubs and trees provide valuable nesting habitat and shelter for many migratory song birds. The second wetland type is the wetland meadow which is dominated by grass like plants. The wetland meadow is important habitat for a wide variety of invertebrates and insects which are important to sustaining the resident small mammal population and migratory bird population. As mentioned previously, the biological pyramid starts at the microbe level and that's what we will find in the wet meadow. Plus, because the meadow is adjacent to the creek, it helps to moderate flood flows during storm events or during the peaks of spring runoff. It is my understanding that this parcel of land has been utilized for grazing livestock for many years. On the upland portions of the site grazing is an excellent use. The western slope of Colorado is a semi-arid environment which is well suited to ranching. However, wetlands are easily damaged. Cattle, feeding in wetland areas. can cause significant damage to wetland soils and streambanks. Compaction of soils in wetland meadows provide -~oooo~o i ,~ ~ 1 opportunities for none native plant species to colonize these areas. In addition. the wetland meadow can not act as a biological filter when the "mat" of herbaceous vegetation is eliminated by over grazing and compaction by cattle hooves. This can change the whole structure of the ecosystem forcing out native plants and eventually wildlife. The wetland areas were in good to excellent condition during my site visit. I do not believe any rehabilitation is needed or is necessary. By implementing the following the wetlands will sustain themselves well into the future: Maintain the continues shrub and tree community along Woody Creek. Even though human passage through this wall of vegetation is difficult, wildlife move through it with ease. • The wetland boundary should be marked with signage in order to identify the resource and discourage mowing or disturbance during low water when the site may be crossable by machinery. • Grazing of cattle should be discontinued 'in order to maintain the integrity of the wetland. meadow and riparian community. A single wire electric fence should be adequate to discourage Hve stock from feeding. In addition, by preventing live stock from entering the wetlands we will be reducing the amount of nutrients (via manure) which eventually enter the creek and Roaring Fork watershed.
