RECITALS
1. Pursuant to Subsection 3-200-030 of the Pitkin County Land Use Code,
the Community Development Director of Pitkin County, Colorado
("Director") may approve a Temporary Commercial Use/Special Event
Permit for commercial activities or special events.
2. The Aspen Art Museum (hereafter, the "Applicant") has applied to the
Director for approval of a Temporary Commercial Use/Special Event
Permit to conduct Howl 2004 at 0114 Meadowlark Lane in Woody Creek
(the property of Suzanne Farver) on July 30, 2004. Applicant was
previously granted a permit for this event in 2003.
3. The catered event will run from 6:00 PM - 12:00 AM. It will include wine
tasting, silent and live auctions and live music. It will draw 500 people to
the site.
4. The Board of the Directors of the White Star Ranch Homeowners
Association has given its approval for the event.
5. The Director finds that, to the extent applicable, the application complies
with the standards in Subsection 3-200-030 of the Land Use Code.
THE DIRECTOR HEREBY' APPROVES the Temporary Commercial
Use/Special Event Permit for the Aspen Art Museum's Howl 2004, subject to
Applicant's compliance with each of the following conditions:
1. Applicant shall adhere to all material representations made in, or in
connection with, the application.
2. Prior to the event, Applicant shall contact the County Building
Department and shall secure an electrical permit for the generator it
will be using to supplement on-site power, if required.
3. Applicant shall obtain a CO Department of Revenue Special Event
Permit (Liquor License) prior to the event. The serving of alcoholic
beverages shall conclude at least one hour prior to the scheduled end.

4. Applicant shall contact the Aspen Fire Department prior to the event
and shall ensure that the Fire Department's requirements for tent exits
and on-site fire e~tinguishers are met.
5. All parking for the event must be on private property. No parking on
County roads is authorized under this Permit.
6. Applicant shall contact Pitkin County Environmental Health prior to the
event and submit one of their Special Event Applications with
information on catering at the event.
7. Prior to the event, Applicant shall provide to County Risk Management
(to the attention of Kris Jewkes) proof of adequate General Liability
Insurance (with minimum limits of $1,000,000 Per Occurrence and
$2,000,000 General Aggregate) and Liquor Liability Tnsurance (with a
minimum of $1 ,000,000 in coverage). Pitkin County must be named as '
an Additional Insured.
8. Failure to comply with the conditions of approval may result in
revocation of this permit.

REQUEST: The applicant is requesting approval of a Temporary Commercial Use/Special
Event Permit for Howl 2004 - a fundrais~rf6rth~AspenArt Museum: The event will occur
on July 30,2004 from 6:00 PM-12:00 AM. 500 people are expeCted at the event. The
event will be catered, and alcohol will be served. The event will include live music and,
silent and live auctions.
APPLICANT: Aspen Art Museum (hereafter, "Applicant").

BACKGROUND: The Applicant previously received a permit for this event in 2003.

Tony Fusaro, Joanna Schaffner, Tom Grady;Kris Jewkes', Je nnHer Doss', Bud 'Eylar, and
Carla Block were contacted on the application. '
Kris Jewkes requested the standard County proof of insurance, including liquor liability
coverage.
Tony Fusaro requested that the Applicant confirm that handicapped-accessible toilet
facilities would be made available. ' Applicant has confirmedlhis: '
Bud Eylar noted that there should be no parking on the County road.
Ed Van Walraven requested that Applicant contact the Fire Department regarding the
temporary tents (to ensure an appropriate number of exits and fire extinguishers).
Carla Block confirmed that, because the event is open to the public, Environmental Health
would require completion of a Special Event Application.
An application was submitted for a State ofC6Ioraoo'Specr-arEvenfDqlJorT,cemse Permit.
The hearing is scheduled for JulY14th. No problems with the license are expected. No
specific follow-up comments were received from Jennifer Doss.
Tom Grady felt that public safety woufd be' better served'inhe6~:lrtel1~ers were "TIPS"-
trained and the Applicant coordinated with Tipsy Taxi. 'The Applicanfhas indicated that the
bartenders will have TIPS-training and call taxis fofanyone unfit to drive (which the
Museum will pay for).

Joanna Schaffner stated that she had not received any complairtts about this. event in the
past and suggested that a parking plan be submitted. This was received. Valet parking will
be provided on-site.
Ellen Anderson requested the missing Safety and Operating Plan (subsequently received)
and indicated that the event had been well run in the past and that she had rlO issues.
The White Star Ranch HOA sent a letter approving the event. A letter of authorization was
also received from the owner of the property, Suzanne Farver.
STAFF COMMENTS:
Pursuant to Subsection 3-200-030 of the Land Use Code, Applicant must demonstrate that
adequate provisions have been made for all of the following:
1. Police supervision (if necessary);
2. Public parking;
3. Insurance;
4. Site set-up, maintenance and clean-up;
5. Emergency services; and
6. Safety of operations.
Additionally, temporary structures must conform to applicable building codes and other
County regulations. Each of these requirements is addressed, in turn, below.
Police Suoervision: No special arrangements are necessary, given the nature of the
request.
Public Parkinc'l: Valet parking (Jay's Parking Valets) will be provided on-site.
Insurance: Applicant has been requested to provide proof of insurance, per Risk
Management's request.
Site Set-Uo. Maintenance and Clean-Uo:.lnformation has been provided on trash
removal during and after the event. A contactpersori has been named in connection with
clean up of the site. Tent set-up will be by Alpine Party Rentals.
Emeraencv Services: Applicant provided a Safety and Operating Plan. The Sheriff's
Department raised no issues.
First Line Security will be on-site throughout the event. Their staff is certified in First Aid
and CPR. First Aid Kits will be available on site.
Safety of Ooerations: As noted above, the Sheriff's Department has identified no safety
issues. No issues have been raised by the County Engineer, or Environmental Health.
The tents that will be erected on-site will be inspected by, and must meet the
requirements of the Fire Department regarding number of exits and fire extinguishers.
Conformance with Buildina Code: No Building Code requirements, other than the need
for an electrical permit for the generator, have been identified.

The Aspen Art Museum has applied for a Temporary Use/Special Event Permit
for their summer fundraiser, Howl 2004 which takes place at Suzanne Farver's
residence, the Gitalong Ranch in Woody Creekon'Frraay;Jul}7'30. ...,
The fee already paid for this permit is $420. The Aspen Art Museum respectfully
requests that as it is an important fund raiser for this non profit organization, the
County Commissioners would look favorably on reimbursing this fee.

The temporary use and occupancy of public or private properties and/or roadways for
commercial activities or special events that are not otherwise permitted within a specific Zone
District may be permitted by the Community Development Director.' The Community
Development Department coordinates the review of these activities/events by various referral
agencies in order to ensure that the activities/events are conducted in a safe manner, and that
any impacts on the community or on public resources are mitigated by the permittee. The
permittee is required by the Code to demonstrate that adequate provisions have been made for
police supervision, public parking, insurance, site set-up, maintenance and clean-up,
emergency services, and safety of operations. A permit will not be issued unless these
requirements are satisfied.
Special Events include, but are not limited to the following:
=> Public events for amusement or entertainment, such as concerts or festivals;
=> Fund-raising or non-commercial events to benefit nonprofit religious, educational, or
community service organizations; and
, => Foot races and bike races.
Temporary Commercial Uses include, but are not limited to the following:
=> Filming of movies, commercials, or promotional spots; and
=> Trade shows.

If you answered YES to ALL of the questions above, then a permit from th~ Community
Development Department is NOT REQUIRED. However, you must still obtain any other
required permits' or approvals, such as a special event liquor license, pyrotechnics permit, etc.
Contact Community Development at (970) 920-5526 for assistance in determining what other
permits may be required. In addition, you must notify the Sheriff and the County Engineer of
the time, place and estimated attendance for your event at least 72 hours prior to the event.
OTHER EVENTS AND USES:,
If you answered NO to ANY or ALL of the questions above, you must complete the attached
application and submit the required fee and application (with all required attachments) to the
Community Development Department for review.
See Subsection 3-200-030 of the Pitkin County Land Use Code (the "Code").

The Community Development Department will be the primary contact for the applicant during
the review process. Once the completed application and fee are submitted, Community
Development will distribute the application to the necessary referral agencies and, if necessary,
will schedule a date for the referral agencies to review the application with applicant and/or put
the referral agencies directly in touch with applicant.
Following review of the application, the Community Development Director will issue an
Administrative Determination granting or denying the permit. The Board of County
Commissioners reviews events of duration longer than 72 hours.
Special event permit applications and temporary commercial use permit applications shall be
submitted to the Community Development Department not less than 60 days prior to the
event date, along with the following:
1. Fee for application: $1260 (Major Events), $420 (Minor Events); make check payable
to "Pitkin County Treasurer". Whether or not an event constitutes a "Major Event" or a
"Minor Event" will be determined by staff at the time of submittal. The fee is based on 2
hours of staff time, for Minor Events, and 6 hours of staff time, for Major Events; if staff
review time exceeds 2.4 hours for Minor Events, or 7.2 hours for Major Events, the
applicant will be charged for time in excess of 2/6 hours at a rate of $210 per hour. .
2. Map (sketch or site plan) of event site, detailing any temporary or permanent structures,
street closures, all impacted properties (identifying owners), and parking.
3. Vicinity map.
4. Schedule of events/activities.
5. Detailed Safety and Operations Plan (see Attachment A).
6. Proof of General Liability insurance/indemnification (naming Pitkin County as an
"Additional Insured") and proof of Liquor Liability insurance (if applicable).
7. Letter of authorization/executed contract granting approval to use the specific site(s)
from public or private property owner(s).
8. Written approval of any applicable Caucus(es)/Homeowners' Association(s).
9. Copies of all other applicable permits. (Some helpful contacts and references are
included in Attachments B, and C.) Other permits may be processed concurrently.with

ALL APPLICANTS: Please complete the attached Safety and Operations Plan or
provide a separate document containing all of the required information (see Attachment
A). A Safety and Operations Plan is required for planned events/activities
because the emergency service infrastructure is funded by the Pitkin County
taxpayers to offset unplanned events that pose a threat to life and property. As a
result, any demand for services generated by a planned 'event/activity should be
alleviated ahead of time by the event sponsor or organizer. The posting of financial
security, in an acceptable form, may be deemed necessary by the Pitkin County
Sheriff's Office upon review of the Safety and Operations Plan.

Safety and Operating Plan for Howl 2004 - The Tenth Anniversary.
A fund raiser for the Aspen Art Museum taking place at the private residence of
Suzanne Farver, Gitalong Ranch, 0114 Meadowlark Lane, White Star Ranch,
Woody Creek, at 6pm on Friday, July 30.
1. The event includes wine tasting, silent and live auctions in a tent by the
house at 6pm, cocktail party in the barn at 7.30pm, dinner and dancing
in the Big Top at 8.30pm - midnight. The location is surrounded by
open ground, with a pond, and fire hydrant on the property. The only
risk is a single lane track which only one vehicle can drive on it at a
time. The contract valet services along with security staff at key
locations will be in radio contact to ensure traffic flow with no hazards.

D) All First Line Security Staff will be briefed on their responsibilities
prior to the event. They will act as a first responder to any crisis.
All security staff are certified in First Aid and CPR. First Line
Security at times use off duty EMTs, Firemen, Law Enforcement
Officers at their events. All security staff have some type of
background in these areas. The Director, along with the event
coordinator, will determine if outside assistance is needed. Pitkin
County dispatch will be notified to request the appropriate
agencies.
E) No first aid station will be set up and manned for this event. First
Line Security Director will have a First Aid Kit in the company's
vehicle. Additional First Aid Kits are at the house and in the barn.
F) The event is staged under canvas. If it rains, guests are protected.
If its hot, the sides can be rolled up.

1. Turn at Cemetery Lane (1st: light after the bridge leaving town toward Glenwood).
Trip your odometer here. Follow this road down and then up the hill, continuing as it
levels out on the plateau. After a few miles, you will come to the end of the plateau. On
your right will be a curvy road sign. Turn right there (your odometer will read 4.6 miles).
If you start to go down the hill on the winding road, you've gone too far.
2. Take an immediate right onto the gravel road, bearing right as you pass another gravel
road that veers off to the left. Continue about .8 miles and take your SECOND right on
Meadowlark Lane (do NOT turn on Yellow Fox Lane:: stay on Whi~f3S~r Road until you
get to Meadowlark Lane). At the end of Meadowla-fk lane take the left driveway to the
top of the hill.

1. Turn left on Smith Way (across from Cozy Point Ranch), at the Woody Creek Canyon
sign on Highway 82. (If you get to Brush Creek Road on Hwy 82, you've missed your

Attached is the application we recently received for this annual event. It will
be held on Friday, July 30th at 0114 Meadowlark Lane in Woody Creek (Suzanne
Farver's property). Approximately 500 people are expected on the site. The event
will run from 6:00PM to as late as 1 :OOAM.
Community Development previously issued a permit for the 2003 Howl event
at the same location.
I would appreciate receiving any comments you may have on this

TEMPORARY COMMERCIAL USE/SPECIAL EVENT PERMIT ---
INFORMATION ON THE PERMIT PROCESS AND APPLICATION
The temporary use and occupancy of public or private properties and/or roadways for
commercial activities or special events that are not otherwise permitted within a specific Zone
District may be permitted by the Community Development Director.' The Community
Development Department coordinates the review of these activities/events by various referral
agencies in order to ensure that the activities/events are conducted in a safe manner, and that, .
any impacts on the community or on public resources are mitigated by the permittee. The
permittee is required by the Code to demonstrate that adequate provisions have been made for
police supervision, public parking, insurance, site set-up, maintenance and clean-up,
emergency services, and safety of operations. A permit will not be issued unless these
requirements are satisfied.
Special Events include, but are not limited to the following:
=> Public events for amusement or entertainment, such as concerts or festivals;
=> Fund-raising or non-commercial events to benefit nonprofit religious, educational, or
commLinity service organizations; and
=> Foot races and bike races.
Temporary Commercial Uses include, but are not limited to the following:
=> Filming of movies, commercials, or promotional spots; and
=> Trade shows.
EXEMPT EVENTS:

reliqious, educational, or community service organization?
Will the event be conducted entirely (including parking) in a
permanent facility on private property owned or leased by the
sponsoring entity?

If you answered YES to ALL of the questions above, then a permit from thE3 Community
Development Department is NOT REQUIRED. However, you must still obtain any other
required permits' or approvals, such as a special event liquor license, pyrotechnics permit, etc.
Contact Community Development at (970) 920-5526 for assistance in determining what other
permits may be required. In addition, you must notify the Sheriff and the County Engineer of
the time, place and estimated attendance for your event at least 72 hours prior to the event. '
OTHER EVENTS AND USES:
If you answered NO to ANY or ALL of the questions above, you must complete the attached
application and submit the required fee and application (with all required attachments) to the
Community Development Department for review.

RECITALS
1. Pursuant to Section 3-200-030 of the Pitkin County Land Use Code,' the
Community Development Director of Pitkin County, Colorado ("Director") may
approve a Temporary Use/Special Event Permit for commercial activities or
special events.
2. ' The Aspen Art Museum (hereinafter "Applicant") has applied to the Director for
approval of a Temporary Use/Special Event Perrnit for a charity benefit.
3. The event will take place at the Gitalong Ranch, 'Meadowlark Lane, White Star
Ranch.
4. The event will take place on August 8, 2003, starting at 6pm and concluding at
lam.
5. The Director finds that the Applicant has obtained all the necessary comments,
from refenalagencies, and the proposed event complies with standards in Section
3-200-030 of the Land Use Code.
NOW, THEREFORE, BE IT DETERMINED by the Pitkin County Community
Development Director that the Aspen Art Museum Fundraiser "Howl" .Temporary Use
'pemlit be approved subject to the following conditions:
1. The applicant shall adhere to all material representations made in the application
process.
2. All Parking shall take place on private property.

The temporary use and occupancy of public or private properties and/or roadways for commercial
activities or special events that are not otherwise permitted within a specific zone district may be
permitted by the Community Development Director.! The Community Development Department
coordinates the review of these activities/events by various referral agencies in order to ensure that the
activities/events are conducted in a safe manner, and that any impacts on the community or on public
resources are mitigated by the permittee. The permittee is required by the Code to demonstrate that
adequate provisions have been made for police supervision, public parking, insurance, site set-up,
maintenance and clean-up, emergency services, and safety of operations, as required by the Code. A
permit will not be issued unless these requirements are satisfied.
Special Events include, but are not limited to, the following:
=> Public events for amusement or entertainment, such as concerts or festivals;
=> Fund-raising or non-commercial events to benefit nonprofit religious, educational, or communitY"
service organizations;
=> Foot races and bike races.
Temporary Commercial Uses include, but are not limited to, the following:
=> Filming of movies or commercials;
=> Trade shows.

If you answered YES to ALL of the questions above, then a permit from the Community Development
Department is NOT required. However, you must still obtain any other required permits or approvals,
such as a special events liquor license, pyrotechnics permit, etc. Contact Community Development at
920-5090 to determine what other permits may be required. In addition, you must notify the Sheriff and
the County Engineer of the time, place and estimated attendance at least 72 hours prior to the event.
If you answered NO to any or all of the questions above, you must complete the attached application and
submit the application and all required attachments to the Community 'J:jevelopment Departtnent for

In order to make the process as efficient as possible for permittees, staff and other referral agencies, the
Community Development Department will be the primary contact for permittees during the review
process. Once the completed application is submitted, CommunitY Development will distribute the

Special event permit applications and temporary commercial use permit applications shall be submitted to
the Community Development Department not less than sixty (60) days prior to the event date, along
with the following:
1. $1260 (Major), $420 (Minor). Fee for Application (Whether or not the Application is Major or
Minor will be determined by Staff at time of submittal. Applicant has the opportunity to request
a refund from the BOCC);
2. Map (sketch or site plan) of event site, detailing any temporary or permanent structures, street
closures, all impacted properties (identifYing owners), parking, vicinity map, etc.
3. Schedule of events
4. Detailed safety and operating plan (see Attachment A)
5. Proof of insurance/indemnification (naming Pitkin County as "additional insured")
6. Letter/signed contract of approval to use the specific site(s) from public or private property
owner(s)
7. Comments from applicable caucuslhomeowners association (see Attachment B)

SAFETY AND OPER-\ TING PLAN REQUIREMENTS
The purpose of this part of your application process is to promote public safety in the conduct of special
events in Pitkin County. You should also consider this activity as a template to facilitate your safety
program development. Together we can work to ensure a safe and Successful conclusion to your efforts.
Please provide the following information as it applies to your event. Note that some questions will
not be applicable, or appropriate, given the nature and/or scale of your event. Contact the Public Safety
Council (970-920-5234-Ciody Mohat) for additional information or direction regarding these
requirements.

The following statements assess the level of risk to the participant/citizens of the county and its
potential to affect nonnal public safety resources: (please Check appropriate boxes.)

DYes 0 No B.) Does the event occur in wilderness, swift water/open water or mountainous
terrain and have the potential to affect nonnal public safety resources?
If either A or B were answered yes, then the applicant may be required to post fmancial security
to the Sheriff's Office.
All participants of an event are encouraged to purchase and carry during the event a
hiking, fishing, hunting, snowmobile, boat registration or back county certificate, which
may cover costs of an emergency through the Colorado Department of Local Affairs-
DOLA Grant.

A safety plait can be written in outline format to facilitate ease in fmding detailed information for both the
participant and public safety officials.

office (920-5180/5196). This permit process takes 30 days and is ONLY issued to incorporated non-
profit organizations. Proof of Host Liquor Liability insurance must be provided.

Wine tasting guests arrive. Taste wines at the main house and bid
on silent auction.
Charles Dale of Rustique/Range restaurants provides hors
d'oeuvres. Sotheby's auction house conducts live auction.
7.30pm
8.15pm
Barn cocktail party guests arrive for cocktails in the barn.
All guests move to the Big Top for dinner catered by Syzygy.
9pm.
Network start playing live music.
Guests start to leave from 9.30pm - there is nevera'rush. Last
guests leave property between 11 pm and 1 am.
Security for evening.
Responsibility for the event rests with Susan Claire Burston of Aspen Art
Museum. This will be the 6th Howl she has organized. She is available all
evening on radio contact. Museum staff are also linked by walkie-talkies.
Security will be handled by First Security Services. Their radio frequency will be
available nearer the time. They have worked this event before. At the beginning
of the evening, security checks guests at bottom of hill. The driveway to the
Gitalong Ranch is a single track road. Security are on radios at the bottom of the
hill, linked with Jay's Valet Parking and additional security at the top. Jay's Valet
have worked this event at least 6 years. In the event of an emergency, Security
can stop the flow of traffic easily by radio.
The parking field is mown very low just before the event to prevent any sparks
between cars and grass. There is a small lake on the property. The Fire
Marshall checks the property while the event is being set up during the day.
