Open Space and Trails staff reviewed your application and determined that r the proposed use is consistent with Title 12 Article 2 of the Pitkin County Code and with the protection of the recreation values of the Arbaney Kittle Trailhead. Conditions which must be met for authorized use by the Roaring Fork Club are stated below. Authorized Use: This letter authorizes the Roaring Fork Club to use up to 15 parking spaces during the weekday and 10 parking spaces during the weekend and holidays at the Arbaney Kittle Trailhead for-staff parking. ~ Time of use is from 7:00 a.m. to 9:00 p.m. from July 1 through September 7, 2003. A total of 15 parking passes will be issued and must be placed on the dashboard of each parked car. (Please note under "Requirements" that if the Roaring Fork Club must obtain a Temporary Commercial Use Permit by no later that July 31st in order to retain this permitted use.) Exceeding this permitted use will result in a $100 fine per offense. Open Space staff will be monitoring the use of this parking area. Open Space and Trails reserves the right to revoke this permit at any time. if it determines that this use in anyway impacts public enjoyment of the trailhead. Requirements of Roaring Fork Club: The Roaring Fork Club will be required to: • Apply for a temporary commercial use permit from the Community Development Department. If the Roaring Fork Club does not receive approval for a temporary use permit by July 31st, then this permit is revoked. Pursuant to Section 3-200-030 of the Pitkin County Land Use Code, the Community Development Director of Pitkin County, Colorado ("Director") may approve a Temporary Use/Special Event Permit for commercial activities or special events. 2. The Roaring Fork Club (hereinafter "Applicants") has applied to the Director for approval of a Temporary Use/Special Event Permit to utilize the Parking Area at t e Arbaney Kittle Trailhead for employees of the Roaring Fork Club. 3. APPLICATION INFORIVTATION A1VD"PE~t1VIIT PROCESS ~~ The temporary use and occupancy of public or private properties and/or roadways for commercial activities or special events that are not otherwise permitted within a specific zone district may be permitted by the Community Development Director.' The Community Development Department coordinates the review of these activities/events by various referral agencies in order to ensure that the activities/events are conducted in a safe manner, and that any impacts on the community or on public resources are mitigated by the permittee. The permittee is required by the Code to demonstrate that adequate provisions have been made for police supervision, public parking, insurance, site set-up, maintenance and clean-up, emergency services, and safety of operations, as required by the Code. A permit will not be issued unless these requirements are satisfied. Special Events include, but are not limited to, the following: ~ Public events for amusement or entertainment, such as concerts or festivals; ~ Fund-raising or non-commercial events to benefit nonprofit religious, educational, or community service organizations; ~ Foot races and bike races. If you answered YES to ALL of the questions above, then a permit from the Community Development Department is NOT required. However, you must still obtain any other required permits or approvals, such as a special events liquor license, pyrotechnics permit, etc. Contact Community Development at 920-5090 to determine what other permits maybe required. In addition, you must notify the Sheriff and the County Engineer of the time, place and estimated attendance at least 72 hours prior to the event. If you answered NO to any or all of the questions above, you must complete the attached application and submit the application and all required attachments to the Community Development Department for review. If you are requesting a permit for filming of commercial and films, please obtain the separate application specific to those activities from the Community Development Department. In order to make the process as efficient as possible for permittees, staff and other referral agencies, the Community Development Department will be the primary contact for permittees during the review process. Once the completed application is submitted, Community .Development will distribute the 1 Per Section 3-200-030 of the Ptkin County Land Use Code ("Code") application to the necessary referral agencies and will schedule a -date-for the Special Event Committee ("Committee") to review the application. Sigri-off by all of the required referral agencies on the attached "Committee Review" sheet will constitute the approved permit, unless further review and approval by the __ BOCC is deemed necessary by the Community Development Director. Special event permit applications and temporary commercial use permit applications shall be submitted to the Community Development Department not less than sixty (60) days prior to the event date, along with the following: 1. $460 fee ($l~?Community Development, $50 Engineer, $50 Environmental Health) 2. Authorized Use: This letter authorizes the Roaring Fork Club to use up to 15 parking spaces during the weekday and 10 parking spaces during the weekend and holidays at the Arbane Kittle Trailhead for staff parking. Time of use is from 7:00 a.m. to 9:00 p.m. from July 1 through September 8, 2002. (Please note~urider "Requirements" that if the Roaring Fork Club must obtain a Temporary Commercial Use Permit by no later that July 30`h in order to retain this permitted use.) Exceeding this permitted use will result in a $100 fine per offense. Open Space staff will be monitoring the use of this parking area. Open Space and Trails reserves the right to revoke this permit at any time if it determines that this use in any way impacts public enjoyment of the trailhead. I would add the cond ion that the County could at any time, without any warning withdraw this approval if it determines tha the approval compromises public use of the trailhead in any way. I also let their staff know tha ANI' use of County property requires approval which have long lead times. So, if they want to seek again next year, they need to contact us a couple of months in advance, and that approval this does not in any way indicate that they would receive and approval next summer. SO..... my question to you is, do you want me to refer them to Com Dev, which would pretty their use of the trailhead, or do you want me to go ahead and forward authorization? (I think last a-mail said that they should apply for a temp use permit??} My biggest hesitation in rejec is that we don't really have much means of enforcing against this use anyway, so we might as ahead and get them to participate in maintenance.
