RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF PITKIN
COUNTY~ COLORADO, APPROVING A TEMPORARY COMMERCIAL USE
PERMIT TO LOCATE A TEMPORARY TELECOMMUNICATIONS FACILITY
ON THE MORROW PROPERTY UNTIL DECEMBER 31, 2006

RECITALS,
1. Pursuant to Section 3-200-030 of the Pitkin County Land Use Code, the Board of
County Commissioners of Pitkin County, Colorado ("BOCC") may approve a
Temporary Use/Special Event Permit for commercial activities or special events
that exceed 72 hours in duration.
2. Verizon Wireless (hereafter "Applicant") has applied to the BOCC for approval
of a Temporary Use Commercial Use Permit. to locate a Temporary
Telecommunications Facility, or Cellular on Wheels (COW), on the Morrow
property located at 0097 Sherman Lane. The Facility will consist of a small
trailer and a 28' wood pole with 4 antennas mounted to it.
3. The BaCC heard this application at a duly noticed public hearing on December 7,
2005, at which time evidence and testimony were presented with respect to this
application.
NOW THEREFORE BE IT RESOLVED by the Pitkin County Board of County
Commissioners that it does hereby grant approval for the Verizon Wireless Temporary
Commercial Use Permit to locate a Temporary Telecommunications Facility on the Morrow
property sUQject to the following conditions:
1. TIle Applicant shall obtain the proper Electrical and Building Permits from the
Building Department for the facility.
2. Exterior lighting on the f~cility shall be prohibited.
3. The facility shall be removed no later than December 31, 2006. In the event a
new permanent facility is located in the immediate area prior to November 30,
2006, the Applicant shall have 30 days to remove the temporary facility from date
of operation of the permanent facility.
4. All material representations made by the applicant in the application shall be
adhered to and considered conditions of approval, unless amended by other
conditions.

Verizon Wireless Temporary Commercial Use Permit,
SUMMARY: The Applicant is requesting Temporary Commercial Use Permit approval
pursuant to Code Section 3-200-030 to locate a temporary wireless telecommunications facility,
or Cellular on Wheels (COW). The facility consists of a small mobile trailer and a 28' wood pole
driven into the ground 4', with four antennas mounted to it. Each antenna is 4' long and l' wide.
The Applicant has requested the temporary site until December 31, 2006, at which time the lease
runs out with the landowner.
APPLICANT: Verizon Wireless (Ann Closser)
LOCATION: Morrow Property, Wingo Junction
ZONING: AFR-IO
BACKGROUND/EXISTING CONDITIONS:
The Applicant is requesting the temporary site due to the elimination of the cellular site on Basalt
Mountain (Colorado Division of Wildlife will not renew the lease). The Applicant is in the
pr()cess of locating a permanent site for this particular area (Basalt, Wingo, Snowmass Canyon).
STAFF COMMENTS:

Temporary Commercial Uses are subject to review pursuant to the criteria in Code Section 3-200-
030.
A. An applicant must demonstrate that adequate provisions have been made for:
1. Police Supervision ifnecessary;
2. Public Parking;
3. Insurance;
4. Site set-up maintenance and clean-up;
5. Emergency services; and
6. Safety of operations;

The Applicant have contacted Kris Jewkes of the Risk Management Department, and
have satisfied the County's insurance needs.
4. Site set-up maintenance and clean-up;
The location of the trailer and the pole will be mixed with other similar buildings on
the property (see attachment B).
5. Emergency Services; and
Not Applicable.
6. Safety of Operations.
Not Applicable.
B. Temporary structures constructed or placed on the premises shall conform to any and all
applicable building codes and other County regulations.
Response: The Applicant will be required to obtain any necessary electrical or building permits
for the temporary use.
C. These permits shall be issued for no more than seventy-two (72) hours. Applications for
activities of longer duration must be approved by the Board at its discretion.
Response: The Applicant is requesting a permit for more than 72 hours, thus they are seeking
approval from the Board of County Commissioners.
D. A fund-raising or non-commercial eventfor a nonprofu religious, educational, or
community service organization shall not require a community development permit
provided the special event is conducted entirely (including parking) on private property
owned or leased by the sponsoring organization...
Response: Not Applicable.
OTHER COMMENTS:
It should be noted that there is a member of the public that is opposed to the location of the COW
(see attachment C).
RECOMMENDATION: Staff recommends that the Board of County Commissioners approve
the Special Event/Temporary Use Permit for the location of a temporary telecommunications
facility on the Morrow property subject to the conditions in the attached resolution.

Dear Mr. Clark:
As you can note from the enclosed documents, I have been asked to give
a blanket endorsement of the proposed temporary Verizon project intended for the
Morrow Ranch in Wmgo Junction. The documents that were sent to nie are of such
inferior quality that I can guess the proposed site is only severa1hundred yards from the
permanent site that the Pitkin County BOCC denied last April 28.
Now the Company is back requesting a temporary site due to the crisis that they
find themselves in at this time. The crisis is one of their fiillure to appropriately pursue
the problem years ago when they had their original site on Colorado State Wlldlife
property. Now it is crisis management. For me this is not an excuse!
From discussions I recently had with long timers in the Valley, the solution was
offered to Verizon and other carriers years ago. The proposal then was to locate all
towers on a common site and not place them all over the Valley. Now we are approached
, by the applicant to solve the problem. The Company should have solved this problem
yearS ago" when it was apparently offered to them by the County
The applicant's engineers obviously have not come up with a long-term solution.
I find this difficult to believe since I do have another service that works wen throughout
the entire Valley. Why doesn't Verizon work with the other broadcasting companies and
concentrate the equipment?
I have discussed this subject with some of the other parties in Holland Hills. I do
not represent Holland Hills, but I have talked with Kent Schuler, the President of the
Holland Hills Homeowners Association. He, too, told me that he refuses to sign a letter of
endorsement for the temporary site.
Therefore I, as a l'e~ident of Pitkin Cou.'lty, request this application and permit be
denied. I believe with study and proper knowledge of the already existing sites, this
equipment could be located as to adequately cover the Valley.
Maybe it is time to ask the various providers to share sites and towers. Is not this
what is being done with the oil and gas equipment sharing that is being accomplished
here on the Western Slope?

Dear Ezra:
Consistent with our previous discussions, I am submitting an application for a
temporary cellular facility. The facility will be located on the Robert Morrow property,
97 Sherman Lane, Basalt, CO. The existing Basalt site will have to be completely
dismantled and the site revegetated by April 30, 2006. I am in a panic and need to
develop a replacement site as soon as possible. This facility is intended to be temporary
only. This site will be operational only until a permanent facility can be developed.
However, the lease with Robert Morrow will expire on December 31, 2006.
I enclose the following:
(1) Application fee of$1344 as this is deemed to be a "major" event for
consideration by the Pitkin County Board of County Commissioners;
(2) Application for a Temporary Commercial Use;
(3) Site plan and survey which contains a vicinity map and survey;
(4) Picture which illustrates the site location as well as access;
(5) No detailed Safety and Operations Plan is tendered, as this is not an event. The
requirements of that plan do not seem applicable to the unmanned cellular
facility;
(6) Certificate of Insurance which names Pitkin County as an additional insured;
(7) Letter of Authorization from Verizon Wireless which enables Closser Consulting,
LLC to act as an agent with respect to this application;

(8) Letter of Authorization from Robert T. Morrow relative to the temporary
commercial use application;
(9) Letter dated September 9,2005 from me to Kent Schuler, Holland Hills HOA in
which I seek its approval of the temporary installation. Note, Mr. Schuler recently
advised that the Holland Hills HOA will not support the application for the very
reasons it opposed the Cox location. He indicates that the letter signed by Sidney
Smock in reaction to the Special Use and Hazard Review proceedings for the Kris
Cox property applies here as well. Unfortunately, I cannot locate a copy of that letter.
However, as the pictures demonstrate, there will be no off site impacts associated
with the development. It will blend in well with the built environment. Additionally,
this site will be a temporary installation only. These facts distinguish this application
from the ill-fated proposal on the Kris Cox property.
I understand that the Board of County Commissioners must consider this
application. Please schedule this request for consideration as soon as possible.

As you know, I am a land use consultal1~ to Verizon Wireless. My client had
proposed to locate a permanent cellular facility pn property owned by Kris Cox_ The
special use application for that proposal was deiied by the Pitkin County Board of
County Commissioners. That installation was iptended to provide coverage to be lost by
the decommissioning of a cellular facility on a mountain overlooking Basalt. 1 am
scrambling to find a replacement site as Soon as!possible.
As an interim measure only, Verizon WiffeIess would like to locate a temporary
cellular facility on property owned by Bob Monrow. The proposed location has an
address of97 Sherman Lane, Basalt, CO. I pre~iously submitted drawings of the
temporary installation closer to the Holy Cross lfower lines and pedestrian walkway. I
enclose revised drawings which illustrate the faGility near the existing horse trailers on
Lot 6 of the Monow property. The facility will ,include equipment on a trailer and a 28'
wood pole. The pole will be sunk into the grouqd only by 4', and is a temporary
-l1easure. Please see the enclosed drawings whiQh illustrate the equipment on the trailer
and pole. This facility is necessary to ensure th~t there will be continuous coverage when
the existing Basalt site is turned off. This facility \vil1 remain on the property only until
such time as a permanent facility is developed. fIowever, the lease for this facility will
expire on December 31, 2006. '

We have scheduled this application for review at a public hearing by the Board of County
Commissioners on Wednesday, December 7, 2005 at a meeting to begin at 2:00 P.M. in the Plaza
One Meeting Room at 530 East Main St., Aspen. Should this date be inconvenient for you, please
contact me within 3 working days of the date of this letter. After that the agenda date will be
considered fmal and changes to the schedule or tabling of the application will only be allowed for
unavoidable technical problems. The Friday before the meeting date, we will call to inform you that
a copy of the memo pertaining to the application is available at the Planning Office.
Please note that it is your responsibility to post a public notice sign on the property at least fifteen
days prior to the hearing (and remove it within one week after) and to mail notice to all adjacent
property owners and mineral estate owners at least 30 days prior to the hearing with the return
address of the Community Development Department (copy of notice will be sent to you by the
Community Development Department). The names and addresses shall be those on the current
tax records of Pitkin County as they appeared no more than 60 days prior to the date of the public
hearing. Please submit the enclosed Affidavit of Notice by Posting & Mailing as proof of
compliance with the Code at the hearing.
