Pursuant to Subsection 3-200-030 of the. _Pitkn_ County Land Use Code, the Community Development Director of Pitkin County, Colorado ("Director") may .approve a Temporary Commercial Use/Special Event Permit for commercial activities or special events. 2. Jazz at Aspen-Snowmass (hereafter, the "Applicant"), has applied to the Director for approval of a Temporary Commercial Use/Special Event Permit to use Cozy Point for parking for its 2004 Labor Day Festival (September 1, 2005 -September 5, 2005). The site would be used from 11:00 AM - 10:00 PM. 1,000 cars per day are expected. Applicant has received permits for such use in the past. 3. .The City of Aspen has approved the request. 4. The Director finds that, to the extent applicable, the application complies with the standards in Subsection 3-200-030 of the Land Use Code,. THE DIRECTOR HEREBY. Applicant shall adhere to all material representations made in, or in connection with, the application. 2. Applicant shall be required to revegetate the site in a time and manner satisfactory to the Cozy Point Ranch Manager, if necessary in the opinion of the Ranch Manager. 3. The number of parking spaces on-site shall be limited to 1,000 vehicles. No overnight camping shall be permitted on the site. 4. Applicant shall obtain a CDOT State Highway Access Permit prior to the event. 5. As required by the City Of Aspen, Applicant shall (a) inform homeowners in Brush Creek that it will be using Cozy Point for parking during its Labor Day event, and (b) heavily advertise/promote that its event patrons use the bus system, walk, or bicycle to the event. ~. ~~n~ ~,-~I~ .~_.•_ 6. Applicant's signage in Pitkin County shall be limited to directional signage for event parking and signage required for safety (e.g., "No Parking," "Do Not Enter"). No signage promoting Applicant's event shall be placed in the County without the approval of t}e County Zoning Officer. 7. Prior to the event, Applicant shall provide County Risk Management (to the attention of Kris Jewkes) with an adequate Certificate of Insurance which demonstrates that Applicant has secured General Liability Insurance with .minimum limits of $1,000,000 per Occurrence and $2,000,000 General Aggregate, and that names Pitkin County as an Additional Insured. 8. Failure to comply with the conditions of approval may result in revocation of this permit. The Community Development Department coordinates the review of these activities/events by various referral agencies in order to ensure that the activities/events are conducted in a safe manner, and that any impacts on the community or on public resources are mitigated by the permittee. The permittee is required by the Code to demonstrate that adequate provisions have been made for police supervision, public parking, insurance, site set-up, maintenance and clean-up, emergency services, and safety of operations. A permit will not be issued unless these requirements are satisfied. Special Events include, but are not limited to the following: ~ Public events for amusement or entertainment, such as concerts or festivals; ~ Fund-raising or non-commercial events to benefit nonprofit religious, educational, or community service organizations; and ~ Foot races and bike races. Temporary Commercial Uses include, but are not limited to the following: ~ Filming of movies, commercials, or promotional spots; and ~ Trade shows. If you answered YES to ALL of the questions above, then a permit from the Community Development Department is NOT REQUIRED. However, you must still obtain any other required permits or approvals, such as a special event liquor license, pyrotechnics permit, etc. Contact Community Development at (970) 920-5526 for assistance in determining what other permits may be required. In addition, you must notify the Sheriff and the County Engineer of the time, place and estimated attendance for your event at least 72 hours prior to the event. OTHER EVENTS AND USES: If you answered NO to ANY or ALL of the questions above, you must complete the attached app/ication and submit the required fee and application (with all required attachments) to the Community Development Department for review. See Subsection 3-200-030 of the Pitkin County Land Use Code (the "Code"). 5/13/05 ~~ The Community Development Department will be the primary contact for the applicant during the review process. Once the completed application and fee are submitted, Community Development will distribute the application to the necessary referral agencies and, if necessary, will schedule a date for the referral agencies to review the application with applicant and/or put the referral agencies directly in touch with applicant. Following review of the application, the Community Development Director will issue an Administrative Determination granting or denying the permit. The Board of County Commissioners reviews events of duration longer than 72 hours. Special event permit applications and temporary commercial use permit applications shall be submitted to the Community Development Department not less than 60 days prior to the event date, along with the following: 1. Fee for application: $1344 (Major Events), $448 (Minor Events); make check payable to "Pitkin County Treasurer". Whether or not an event constitutes a "Major Event" or a "Minor Event" will be determined by staff at the time of submittal. The fee is based on 2 hours of staff time, for Minor Events, and 6 hours of staff time, for Major Events; if staff review time exceeds 2.4 hours for Minor Events, or 7.2 hours for Major Events, the applicant will be charged for time in excess of 2/6 hours at a rate of $224 per hour. 2. Map (sketch or site plan) of event site, detailing any temporary or permanent structures, street closures, all impacted properties (identifying owners), and parking. 3. Vicinity map. 4. Schedule of events/activities. 5. Detailed Safety and Operations Plan (see Attachment A). 6. Proof of General Liability insurance/indemnification (naming Pitkin County as an "Additional Insured"} and proof of Liquor Liability insurance (if applicable). 7. A Safety and Operations Plan is required for planned events/activities because the emergency service infrastructure is funded by the Pitkin County taxpayers to offset unplanned events that pose a threat to life and property. As a result, any demand for services generated by a planned event/activity should be alleviated ahead of time by the event sponsor or organizer. The posting of financial security, in an acceptable form, may be deemed necessary by the Pitkin County Sheriff's Office upon review of the Safety and Operations Plan. ATTACHMENT A _ __ SAFETY AND OPERATIONS PLAN REQUIREMENTS The purpose of this part of your application process is to promote public safety in the conduct of special events in Pitkin County. Please provide the following information as it applies to your event. Note that some questions will not be applicable, or appropriate, given the nature and/or scale of your event. Contact the Public Safety Council for additional information or direction regarding these requirements. • Is this acorporate-sponsored event for profit? ^ or anon-profit event? (Check one.) The following statements assess the level of risk to the participant/citizens of the County by the event and its potential to affect normal public safety resources. Who has overall responsibility for the safety of the event? C. Describe (bullet topics) your safety briefing for event staff. D. We have made great strides, and our production team has proved to be exceptionally professional and resourceful while always keeping the safety of our patrons and the integrity of the "Festival experience" the top priorities. This document is to initiate the discussion on the use of Cozy Point to accommodate parking needs for the Labor Day Festival weekend. Realizing the expansion of the Intercept Lot @ the base of Brush Creek Road will not be available for this year's event, JAS feels the use of Cozy Point for parking is a critical part of our Labor Day Festival mitigation plan that will be submitted to the Town of Snowmass Village (TOSV) for appropriate permitting. After the success of the '03 & `04 Labor Day Festivals, we are confident that our experience in producing festivals, as well as strong communication with all appropriate entities will ensure a positive experience for all. Working with City of Aspen, Pitkin County, Cozy Point Staff, CDOT, Colorado State Patrol, TOSV Police, Pitkin County Sheriff s Office, A-1 Traffic and RFTA (which would provide shuttle service to/from the Festival site), we are confident that we can again bring aworld-class festival to the Aspen/Snowmss area, Even though on our busiest day in '03 & `04 we only had 600 cars, we do believe that with the location in Snowmass, the lot should again be set to accommodate 1000 vehicles. ,~~~. . Schedule ,~~~~ INTRODUCTION Currently in its 15th season, the 2005 Jazz Aspen Snowmass (JAS) Labor Day Festival (Sept. 1 through Sept. 5) will again (same as '04) at the TOSV Athletic Field Complex in Snowmass Village. To accommodate the influx of traffic to the Aspen/Snowmass vicinity, JAS is working with Pitkin County Sheriff's Dept, CSP, CDOT, RFTA, and other entities that will be reviewed in this plan. The key elements of the Traffic Management Plan are educating and informing the public on traffic, parking and shuttle information; and management and supervision of traffic on area roads, parking lots, and shuttle procedures. Management and supervision of the JAS Labor Day Festival Transportation Management Plan will be conducted by JAS Parking & Security Staff in coordination with the County's ,Sheriff s Dept. This plan will highlight a major satellite parking areas (Cozy Point), the Intercept Lot at the base of Brush Creek Road, and Two Creeks, as well as the partnership with TOSV Transportation, and RFTA, which will provide shuttles from throughout the Valley system. JAS has established solid communication through all local and statewide media outlets to communicate Festival information. Between JAS personnel and directional signage, we are confident in moving attendees and vehicles where they need to be in a timely and professional manner. Mgmnt Plan- 7/15/05 II. NOTED POINTS: 1. Attendee capacity for the Festival is 12,000/day. Staff, artists, crews, volunteers, etc. is estimated at under 1000/day. Thursday, Sept. 1 has been added to the roster. 2. At the TOSV Park Site (Rodeo Grounds and Back 401ots), there will be an estimated 600+ parking spots for JAS Patrons and handicaps, and an .additional 100+ spots for general public. 3. Cozy Point is being secured through the City of Aspen, Pitkin County, CDOT and with the lessee, who is enthusiastic in support of the event. Coming off the success of the '04 JAS Labor Day Festival and the Winter X-Games, Cozy Point is the jewel piece of the parking program for an event size such as this. Easily we can accommodate 1000+ cars. No camping or over night parking will be allowed or tolerated. Keep in mind that for'02 ,'03, `04 JAS had only 600 cars on peak days. 4. The Intercept Lot at the base of Brush Creek Road has also become a great resource with capacity at 250+. It's natural infrastructure makes it simple to service with shuttles. Along with the use of Two Creeks (through cooperation with the Aspen Skiing Co.) there will be adequate parking for expected crowds. 5. Our long time partners RFTA & TOSV will be the shuttle providers. As always, JAS will offer a $2 roundtrip ride from anywhere in the Valleywide RFTA system. This is heavily promoted over the summer and has become an effective program to alleviate vehicular congestion. 6. In the event that lots become filled they will be signed with "Lot Full." In recent years, JAS has established a solid and informative media presence both through advertising and aggressive press campaigns. 8. Daily ticket availability will be communicated to each lot and RFTA & TOSV shuttle drivers. In the event that the festival day is "sold out," communication to appropriate entities will ensure patrons will be turned around to alleviate site box office congestion. 9. The top goals for a JAS production are: safety first and foremost, and ensuring a positive ``Festival experience" for all artists and attendees. Over the last thirteen years we have developed a great reputation throughout the industry for this. III. TRAFFIC/PARKING OPERATIONS OUTLINE Unlike a "scenario determination," JAS has experienced that a full staff in place (and with communications up and running) is the best way to orchestrate a music festival crowd. If you leave people on their own, then problems are usually not far behind. With this said, staff are in place one hour prior to doors through the last attendee off the site/lot/area where they are stationed. Under the umbrella of "security," on-site security, traffic crew (certified where necessary), and parking personnel will be unified under our security partner Strategic Protective Services. We will work closely with TOSV Police & Pitkin County Sheriff's Dept. to finalize. While the proposed fare is reasonable, we wanted it to be more than the RFTA fare to promote public transportation. PARKING Based on learning from previous seasons, we are confident that the 2004 plan will be the most effective to date. We are again looking to utilize Intercept Lot (Hwy 82 & Brush Creek Road), Rodeo Complex (including Back 40), Two Creeks Lots, as well as the Cozy Point Ranch. RFTA & TOSV Shuttles will provide the free shuttle service (for patrons) to the festival site. ~:.~ Page Five Trans. Mgmnt Plan- 7/15/OS PARKING (Continued) JAS is again working closely with RFTA to continue to promote (via radio & newspapers) the $2 roundtrip fare from anywhere in the Valley to the Festival. This eliminates the hassle of exact change for return trip. We again plan to charge minimal parking fees to help offset the overall production costs. While the proposed fare is reasonable, we wanted it to be more than the RFTA fare to promote public transportation. The breakdown is as follows (pending): Rodeo Complex $20 per car JAS Patron Parking -free Cozy Point $5 per car and free shuttle service to site Two Creeks $10 per car and free shuttle service to site Intercept Lot Free and free shuttle to site JAS will provide written approval for each parking area from respective owner/operator. JAS will be responsible for the operation of all parking areas with adequate staff. A "supervisor" for each parking area will be assigned and will maintain contact with the supervisor at all times to ensure proper traffic direction. Parking staff requirements will be hired and managed by JAS and will be on-line with expected attendance by day. This would include: eight (8) for Rodeo Lot, four (4) for Two Creeks, eight (8) for Cozy Point, four (4) for Intercepf Lot. Parking staff hours are: Thurs, Fri., Sat, Sun - 12:00 PM -10:00 PM Mon. 10:00 AM - 7 PM. Traffic control will be part of egress, 45 minutes after start of last act. Participants will find parking areas via signage and vested parking staff. Page Six ~ _ , _ Trans. Mgmnt Plan- 7/15/05 PARKING (continued) All parking revenues will accrue to JAS (dependent on agreement with ASC and Cozy Point LLC) JAS Patron parking will be located in the Rodeo Complex parking area (JAS anticipates using 600 spots fog Pats°on paf°king.). Parking passes will be issued by JAS for backstage parking (staff/vendors), and "JAS Patron" (VIP) for Rodeo Lot. JAS will provide inventory of signs. We will determine if additional signage needs to be produced. As lots fill, the JAS parking team will communicate via radio and participants will be directed accordingly TRAFFIC CONTROL In review with all participating parties, we will finalize #'s of traffic control team (through AES (Meeker) and A-1 Traffic). The following are areas of note: 1. Pedestrian Crosswalk -Brush Creek Road (a~ Horse Ranch With three (3) controllers, this area can be effectively manages (see Attachment B). We will work with Roads Dept. to paint crosswalk lines. Two (2) on either side of Brush Creek Road controlling pedestrian movement, and one (1) with "stop/slow" watching for Horse Ranch traffic. FOR EGRESS WE ARE EXPLORING PLAN TO LIMIT HORSE RANCH TRAFFIC TO ONE LANE - "STOP/SLOW" which would be handled through A-1 Traffic Control. 2. Brush Creek & Highline Again with three (3) controllers, this area will include redirecting ALL south entering traffic up Brush Creek Road to the Highline detour; allowing shuttle bus entrance towards drop off zone on Brush Creek Road and exit onto Brush Creek and/or Highline; Horse Ranch traffic. (see Attachment C). ~~ C .;i. Page Seven Trans. Mgmnt Plan- 7/15/05 TRAFFIC CONTROL (continued) 3. Hwv 82 & Cozv Point As in'02- `04, we will work with CO. State Patrol (CSP), CDOT, A-1 Traffic to coordinate. Shuttles and general public vehicles will enter off Brush Creek Road (see Attachment D). All vehicles will exit via exit on Hwy. 82 with Downvalley turnaround at traffic light @ Brush Creek Road. This layout proved safe and efficient in '02 -`04. EGRESS The egress is one element in which most of our challenges have always occurred. There are a few points for this year's event that should make a difference (for the better) over year's past. While we have experienced improvement year after year, we do not have the luxury of "working out the kinks" on opening night- and then hitting our stride for the rest of the weekend. With expected capacity crowds on Thurs and Fri- JAS realizes the importance of getting it right the first time. The points are: • Well designed Staging Areas & Cuing Lines • Personnel • Equipment -buses & barricades • Signage The daily main act will complete performance around: -Thurs. 9/1 - lOpm -Fri. 9/2 - l Opm -Sat. 9/3 - 8:30pm -Sun. 9/4 - 8:30pm -Mon. 9/5 - 6pm This will initiate the main egress from the event. As in years past, communication is the key between all parties, which has proved successful. On call for roughly 20 minutes prior to end of show, egress is handled between TOSV Police, RFTA & TOSV Transportation, and Festival Security, Traffic Control & Parking staffs. Page Eight Trans. Mgmnt Plan- 7/15/05 EGRESS (continued) Based on locations of RFTA pick-up areas, adequate cueing areas will be protected for lines to develop. Some revisions from years past will include: -Removal of the wooden fence, and leveling of the ground off the cart path. This will improve on the usable space to set up cuing lines. -Moving the "Two Creeks" stop beyond the "tree" where the stop has lived for years. Please note: We've looked at moving the Two Creeks drop/pick to backstage off Clubhouse Drive but do not feel this is secure at this time. -One-lane Horse Ranch access for egress only. This will allow for more safe, secure cuing space. -Security - "walking the line" -keeping the calm as people wait to load. Looking at'04 as a starting point, a solid and strategic plan will be agreed upon. Target date is Aug. 12. TOSV Transportation shuttles will be staged on the opposite side of the festival site on Brush Creek Road (same as '04). On-Site signage would also communicate TOSV Shuttle egress area. WE WILL DO A BETTER JOB OF "STAGING" PEOPLE AS n THEY LINE UP THROUGH CUING STATIONS WITH BIKE-RACk BARICADES and PERSONNEL TO KEEP PEOPLE ON THE BIKE PATH TO AVOID WANDERING ONTO BRISH CREEK ROAD. JAS security personnel will be posted at Meadows Road throughout the festival day to detour all vehicles (other than TOSV Shuttles) from approaching site. JAS is meeting with the Snowmass Club to determine where shuttles can drop/pick-up attendees along Clubhouse Drive. This would eliminate congestion on both the Village shuttle side, and the RFTA/Ticket Booth side. Again we will use Neff Light Towers to adequately light the egress and exit from site. The # of bodies moved (per hour) for the egress will be reviewed through below Transportation item. Page Nine Trans. Mgmnt Plan- 7/15/05 CO. STATE PATROL CSP will man the intersection at Hwy. 82 & Brush Creek Road. Although they will be on for the endurance of each festival day, "hands-on" activity will be for egress (end of each evening). Vehicles exiting Cozy Point onto Hwy 82 will have to go Upvalley and make the U-turn at Brush Creek/Hwy 82 intersection to head Downvalley. Peak hrs for egress are 8:30-10:00 PM (Fri-Sat-Sun-Mon). TRANSPORTATION JAS will provide transport from Intercept Lot, Two Creeks and Cozy Point to the festival site by RFTA, CME and the TOSV routes through TOSV Transportation. Specifc scheduling will be submitted prior to the event. Towing Partner JAS will contract AJAX TOWING to be available through the Festival weekend. An impound lot location is being finalized. A detailed towing system and coordination plan will be developed prior to the event. Mgmnt Plan- 7/15/05 TRANSPORTATION (continued) JAS should have accurate estimates of the expected number of attendees through advanced ticket sales and timely reporting to TOSV Police. JAS will coordinate carefully with all transportation partners prior to the event and then with daily meetings during the event. Shuttle drop-off for corporate groups -pursuing Club House Drive. The Festival maintains its own independent group of drivers with vans and limousines to move artists and their equipment to and from the airport, hotel and performance venue. The artist will be taken to and from the venue via the backstage entrance to festival site. Schedules are varied according to each artist's needs. SIGNAGE JAS will add three LED Traffic Board for this years event. The placements are: 1.- Hwy 82 @ Brush Creek Turnoff 2.- Brush Creek Rd @ Welcome sign 3.- Owl Creek - "No camping" In addition to A-1 signage that is required to permit Cozy Point usage, JAS will develop a comprehensive signage plan that will be reviewed with TOSV special event group by August 12. PUBLICITY & COMMUNICATIONS An integral part of the transportation management plan will be the ability to communicate a number of travel and parking issues to the local community (and beyond) who are attending the Labor Day Festival. As mentioned previously, JAS has established strong media ties with the following partners: JAS is running PSA's on KSPN, KSNO, KKCH, KNFO, KDNK, KAJX (Roaring Fork Valley), KISS (G.Junction), KTUN (Vail/Eagle), KFMU (Steamboat), KBCO (Denver) and press releases in all Valley newspapers promoting mass transportation and RFTA's $2 roundtrip ride from anywhere in the Valley (which is subsidized through JAS). This promotional message will start around August 15S` and run through the Festival. Also, JAS will run an ad campaign "How to do the Labor Day Festival" which will add to the promotion of mass transit to and from the event. From Denver or Grand Junction area: take Glenwood Springs exit to Highway 82. Follow 82 east un1 you reach the Snowmas Village exit. Parking will be available at the Brush Creek Intercept Lot and Cozy Point Ranch to the left of the exit, both at the intersection of Highway 82 and Brush Creek Road Parking at Cozy Point Ranch cost $5.00/car. Snowmass Town Park Rules & Regulations: • The following items can not be brought into the venue by Festival patrons: alcohol, glass bottles, plastic milk jugs, cans, coolers, illegal drugs, fireworks, aerosol cans, beach balls, frisbees, airhorns c anything that could be construed as a weapon or could cause damage or injury. • Please note that the sale of .nitrous oxide_is strictly prohibited. N20 cuts off the flow of oxygen to your brain. Countless medical emergencies occur frorri it and can lead to very extreme cases -death. Conditions are always ripe for wildfires. Please be careful when and where you smoke. Vending: There is no unauthorized vending allowed at Snowmass Town Park. In recent years, there has been an increased crackdown on unauthorized vending in the Festival parking lots and we have every reason to believe that it will continue this year as well.
