Lowe W/3, LLC ("Applicant"}has applied to the Board of County Commissioners ("BOCC") to rezone and subdivide portions of the Ranch to create 5 new free market single-family lots and 2 new affordable housing units. The following approvals have been requested and are required to implement the proposed plan: ^ Subdivision/PUD to accommodate the creation of 5 new free market single- family lots of 2 to 7 acres each on the "upper bench", and 2 new deed restricted affordable housing sale units (one duplex). ^ Rezoning a small portion of the lower bench, adjacent to existing AH zoning, to AH-3/PUD to accommodate the required 2 units of mitigation housing and 3existu~g RO lots proposed to be relocated (to be enacted by a separate ordinance at detailed submission review}. ^ Major Plat Amendment/ Amendmeni to Development Permit to change condition of BOCC Resolution No. 89-97, which prohibits further development of the "upper bench", and to relocate 3 RO 1 ats. ^ 1041 Environmental Hazard Review. ^ Special Review for relocation of existing approved cellular site. ^ GMQS Exemption for the mitigation affordable housing. • Scenic Overlay Review. ® Lot Line adjustment with existing out parcel that contains original "ranch house". ^ Acceptance of various easements and dedications. 2. The Board approved all the above-noted requests except for the Rezoning and the Special Review for the cellular site at the Conceptual Subdivision approval on April 14, 2004. 3. The property is the W/J Ranch on McLain Flats Road in Woody Creek (legal description attached as Exhibit A). 4, The property 'rs zoned RS-20/PUD. The unsubdivided, undeveloped portions of the Ranch that constitute this application are estimated to be approximately 203 acres. ~. The BOCC granted 25,000 square feet of floor area in the 2003 Rural Area Residential Growth Management Competition for new subdivision lots to the ViT/J Ranch, pursuant to Resolution No. 141-2003. 6. The. Ptamting and Zoning Commission considered this application at a regular meeting on October 5, 2004, and recommended approval with conditions by a vote of 5-0. 7. The BOCC Ends that the application is generally consistent with the applicable provisions of the Pitkin County Land Use Code. NOW THEREFORE I3E iT RESOLVED by the BOCC that it does hereby approve the W/.1 Ranch Subdivision/PUD Detailed Submission, Final Plat, and 5pecia[ Review for cellular site, subject to the following conditions, which shall run with the land and be binding on all successors in interest: t .Applicant shall adhere to all material representations made in the application or in public meetings or hearings and shall consider those representations to be conditions of approval, unless amended by other conditions. This includes the letter from James M. DeFrancia, dated November l $, 2004, clarifying costs and obligations and attached to this Resolution as Er;hibit B. Applicant shall adhere to all conditions of BOCC Resolution No. 053-2004, unless subsequently amended by this Resolution. Prior to consideration by the BOCC the Applicant shat] submit Final Plat documents meeting Code Section 5-40. 4. Prior to recordation of final plat for Filings 2,3,and/or 4: A. The County Engineer shall review and approve the Construction Management Plan, Drainage and Erosion Control Plans, the Civil Engineering Standards Report, the Subdivision Improvements Plan, all legal descriptions and easement documents and descriptions, road plans and profiles, and the final plat documents. B. The County Attorney shall review and approve the septic "lot" conveyances, al] other easement documents, the Subdivision Improvements Agreement, the covenants, and the final plat documents. C. The three relocated R.O. lots and the two new category 4 units will require new recorded deed restrictions. D. The EHD shall review and approve a PM10 mitigation plan. ~: .Adequate fire "turnaround" shall be shown between lots 1 1 and 61 in Filing 3. F. The Applicant shall obtain a Revocable Right of Way Permit for the portions of the septic "lots" which infringe on the County's 60' ROW or the leach fields shat] be relocated. 5. In addition to the conditions contained in Paragraph 4., above, prior to recordation of the final plat for Filing 5: A. The Open Space and Trails Director and the County Attorney shall review and approve al] conveyance documents involving the County. County uses on Parcels D and E shall be ('rmited to open space, recreation, and trails associated uses. B. All conveyance documents shall be recorded. C. The proposed "cash-in-lieu" previously committed to the W/J Homeowners Association shalt be paid. The amount shall now he $83,000 to reflect current Housing Guidelines. The ,4pp(icant will work with the County to expedite the relocation and construction of these new leach fields. To the extent feasible, a[1 leach fields for Filing 2 shall be sited for 5 bedroom houses. 7. A proper water court decree evidencing adequate water rights have been obtained must be submitted before any additional ponds can be built or existing ponds expanded on the property or the sdvimming poo[ on Parcel 2 can be filled. The existing pond will be eliminated within two years of this approval if the proper court decree for it has not been obtained. 8. Al[ conveyances to the Count} shall meet the County policy on "Rea! Property Acquisition and Disposition". 9. The common dumpster shall be bear proof and its design shall be approved by tl~e County Wildlife Officer. Its location as shown on the "Dumpster & Entrance Planting Plan", sheet 2.2, July 2, 2004, is approved as a PUD variance. 10. If it can be demonstrated that 9S°/a of historically irrigated lands are being preserved, free market lots l-5 shall have development envelopes in addition to the proposed building envelopes. The development envelopes shall extend to the lot lines and shall be for landscaping, ponds and fences meeting code, but not for structures. 1 l . The five free market units are approved for 4 bedrooms each. Any increase in bedrooms will require additional housing mitigation to be provided. l2. The development shall be required to meet all codes and requirements of the Aspen Fire Protection District related to access and water supply. Sprinkler systems will be required in all buildings of consequence. ~~-i~~J The approved ce[lu[ar site shaEl be on Homeov~mers Association common area, and a plat note shall restrict the use to the approved cellular facility which consists of an equipment shed not exceeding 2,000 sq, ft, meeting accessory building height and one "Spruce Stealth" tower not exceeding 40 ft. in height. The height of the tower and the location of the tower and shed as shown on sheet 9.0, July 2, 2004, are approved as PUD variances. I4. Monitoring wells to assess the proper functioning of the "leach field envelopes" for Filings 1, 2,and 4 will be constructed by the Applicant at least by the time that 4 leach fields have been located in the common areas (G, H, or I). Monitoring wells shall be located and designed under the guidance of the Environmental Health Department to meet State standards. The wells wil[ be maintained by and periodic testing will be required of the proposed Metropolitan District. Sampling must be done once a year or at a frequency determined by the Environmental Health Department, and the results must be provided to the Environmental Health Department. If sampling indicates that the standards for ground water have been exceeded, then the systems must be redesigned and will be required to meet standards current at that time. The letter is intended to satisfy that suggestion. The applicantldeveloper, Lowe W/J LLC, is fully responsible, at its cost, for the installation of all infrastructure improvements associated with this Application, Subdivision and Final Plat. This includes the roadways, water system improvements and extensions and other associated pubfic improvements. Lowe W/J LLC is also responsible, at its cost, for the relocation of the existing leach fields serving existing units in Filing #2, which leach fields are now located outside of the building lots sewed. (This obligation has been further identified in the conditions proposed for approval). The newly farmed Metropolitan District will be responsible for operation, repair and maintenance of all these improvements, and far any future expansion or replacement of these improvements. The District will bear no costs associated with the present construction of any improvements. This is further clarified in the approved Service Plan for the District and other associated formation documents. For purposes of clarity we also expand here on the structure for "hook up" charges within the Metropolitan District.
