Stuart Urfrig and Shelly Sheppick ("Applicant") have applied to the Community Development Director of Pitkin County ("Director") to establish an activity envelope and obtain site plan approval for an addition to and remodel of an existing legal residence. The existing septic system will also be replaced. 2. The lot contains 1.01 acres and is conforming in size in the R-30 zone district. 3. The lot is located at 110 Katydid Lane; and is described as Lot 11, Block 1, Filing 1, Little Elk Creek Subdivision. 4. The application was received after July 6"', 2006 and therefore is reviewed pursuant to the 2006 Land Use Code ("Code"). 5. The BOCC approved the Little Elk Creek Subdivision in 1970. A single family residence (1,801 square feet according to the Assessor's Office) was built on the lot in 1978. Building envelopes were not established as part of the subdivision review. 6. The Director finds that the request is consistent with the applicable requirements of the Code, and that the development is exempt from scenic review pursuant to 7-20-120.c.4.a because it is not visible from Capitol Creek Road. APPROVED by the Director, subject to the following conditions, which shall run with the land and be binding on all successors in interest: 1. The Applicants shall adhere to all material representations made during the application process. 2. Prior to submission of any future building permit applications, the Applicant shall be required to submit for approval by the County Attorney and Community Development a Site Plan with an Activity Envelope in accordance with Land Use Code Section 2-30-20(g) and Application Manual Section 2.1.12. The above referenced approvals shall be a condition precedent to finalization and recordation. The following changes shall be made on the Site Plan prior to submission for recordation: A. Add a north directional arrow. B. Amend title to "Urfrig/Sheppick Site Plan." C. Eliminate the Erosion Control and Drainage Plan, the Revegetation Plan and the Owner Representative/General Contractor information. D. Add the following disclaimer, "Environmental hazard areas exist that might affect the property, any improvements and occupancy thereof" E. Submit a drainage and erosion control plan acceptable to the Planning Engineer. B. Submit a construction management plan for review and approval by the Planning Engineer. C. Pay the applicable road and employee housing impact fees. D. Obtain a permit for construction of the new ISDS. 4. The lot is exempt from the Growth Management up to 5,750 square feet. 5. The Applicant shall comply with the following standards for Development in a Low Wildfire Hazard Area: A. Defensible Space: The area around all buildings/structures, limited by property boundaries that may limit a property owner's ability to comply with this section, shall incorporate landscaping with wildfire defensible space considerations as follows (note: actual vegetation manipulation to meet these conditions may not be necessary where the natural vegetation patterns have already fulfilled these conditions): 1) Brush, debris and non-ornamental vegetation shall be removed within a minimum ten-foot (10') perimeter around all structures. 2) Vegetation shall be reduced to break up the vertical and horizontal continuity of the fuels at a minimum of a thirty (30) foot perimeter around a structure built on flat ground. (For greater slopes, reference the CSFS Safety Zone chart in Wildfire Guidelines For Rural Homeowners, which provides general guidelines that may be modified by a wildfire expert acceptable to the County). 3) Spacing between clumps of brush and vegetation up to the thirty (30) foot perimeter shall be a minimum of two (2) times the height of the fuel. Maximum diameter of the clumps shall be equal to the height of the fuel. All measurements shall be from the edges of the crowns of the fuel. 4) All branches from trees and brush within the thirty (30) foot perimeter shall be pruned to a height often (10) feet above the ground with removal of ladder fuels from around trees and brush. 5) Tree crown separation within the thirty (30) foot perimeters shall have a minimum often (10) feet between the edges of the crowns, except for mature stands of aspen trees where ladder fuels have been removed. In areas of aspen regeneration, understory shrubs and down and dead materials shall be removed. 6) All branches that extend over the roof eaves shall be trimmed and all branches within fifteen (15) feet of chimneys shall be removed. 7) The density of fuels up to a one hundred (100) foot perimeter of the structures shall be reduced where natural reduction has not already occurred. 8) All deadfall up to a one hundred (100) foot perimeter shall be removed. 9) No new conifer trees shall be planted within ten (10} feet of a residence. 10) No flammable mulches shall be placed within two (2) feet of a residence. 11) The property owner shall be responsible for the continued maintenance of the defensible space vegetation requirements. i ~~~~~ Page: 3 of 4 Administrative Decision No 2007 ~ 05/@4/2007 02:59F JRNICE K UOS CRUDILL PITKIN COUNTY CO R 0.00 D 0.00 Page 3 B. Roofing Materials: Class A covering or Class A assembly as defined by the currently adopted Building Code. No wood shakes or shingles. All other adopted Building Code compliant methods and materials permitted. Roofs with less than a 3:12 pitch are not permitted unless they comply with the following: 1) All roof coverings shall be constructed ofnon-combustible materials and installed on a Class A roof assembly. 2) All raof coverings shall have a surface that shall facilitate the natural process of clearing roof debris. 3) Protrusions above the roofline, such as parapets, shall be prohibited. 4) Roofs shall be installed as required by the adopted Building Code and shall have a minimum pitch of 1:48. 5) All roof designs, coverings, or equivalent assemblies shall be specifically approved by the Fire Marshal prior to submittal of a building permit application. C. Maintenance and Miscellaneous Requirements 1) Roofs and gutters shall be kept clear of debris. 2) Roof vents shall be screened with corrosive resistant wire mesh, with mesh one-fourth ('/4) inch maximum. 3) Any outbuilding shall adhere to the same wildfire requirements. 4) Yards shall be kept clear of all litter, slash and flammable debris. 5) All flammable materials shall be stored on a parallel contour a minimum of fifteen (15) feet away from any structure. 6) Weeds and grasses within the ten (10) foot perimeter shall be maintained to a height not more than six (6) inches. 7) Firewood/wood piles shall be stacked on a parallel contour a minimum of fifteen (15) feet away from the structure. 8) Swimming pools and ponds shall be accessible by the local fire district. 9) Fences shall be kept clear of brush and debris. 10) Wood fences shall not connect to other structures. 11) Fuel tanks shall be installed underground with an approved container. 12) Propane tanks shall be buried, if possible, or installed according to NFPA 58 standards and on a contour away from the structure with standard defensible space vegetation mitigation around any aboveground tank. Any wood enclosure around the tank shall be constructed with materials approved for two (2) hour fire-resistive construction on the exterior side of the walls. 13) Each structure shall have a minimum of one ten (10) pound ABC fire extinguisher. 14) Addresses shall be clearly marked with two (2) inch non-combustible letters and shall be visible at the primary point of access from the public or common access road and installed on anon-combustible post. 6. Prior to commencement of any earthmoving or other construction activity, the Applicant shall stake the corners of the activity envelope and install construction fencing around the construction site within the perimeter of the building envelope. The fencing shall remain in place until issuance of a Certificate of Occupancy. 8. No calculations for height, bulk, setback, size, floor area, or any other building and zoning requirements have been conducted. These requirements will be considered at the time of building permit. Any structures represented in the application may not be permitted under building and zoning regulations. 9. Statutory vested rights for the approval contained herein are granted pursuant to the Pitkin County Land Use Code and Colorado Statutes, subject to the exceptions set forth in Pitkin County Land Use Code § 2-20-170 and C.R.S. § 24-68-105. The statutory vested rights granted herein shall expire on '~ , 2010. 10. The existing septic system will also be replaced. APPLICANTS: Stuart Urfrig and Shelly Sheppick REPRESENTATIVE: Wade Livingston LOCATION: 110 Katydid Lane; Lot 11, Block 1, Filing 1, Little Elk Creek Subdivision ZONING/LOT SIZE: The lot contains 1.01 acres and is conforming in size in the R-30 zone district. BACKGROUND: The BOCC approved the Little Elk Creek Subdivision in 1970. A single family residence (1,801 square feet according to the Assessor's Office) was built on the lot in 1978. Building envelopes were not established as part of the subdivision review. Site Plan approval has also been requested. Site plan approval is contingent upon location of development with in the activity envelope and scenic review. The Applicant has provided an illustration for the new footprint of the residence and locations of all other developments. The Applicant has proposed an activity envelope that avoids constrained areas and successfully located all development within it. Most notable constraints the parcel is subject to include riparian vegetation avoidance and a 100' setback requirement from West Sopris Creek. REFERRAL COMMENTS: The Snowmass/Capitol Creek Caucus has no objection to the proposal. The Board raised a concern with impacts on the septic system from seasonal fluctuations in the water table and flooding from the WhiteBorman ditch; these issues will be addressed with the septic system design. The Basalt and Rural Fite Protection District notes that the subdivision is compliant with the District's requirements for access and water supply. If the remodel and addition increases the size of the house to 5,000 square feet or greater, the Applicant will be required to install an automatic sprinkler system. STAFF COMMENTS: GROWTH MANAGEMENT: The lot is exempt from Growth Management up to 5,750 square feet, pursuant to Land Use Code Sec. 6-30-100.b. ACTIVITY ENVELOPE/SITE PLAN REVIEW: The Applicant has requested site plan approval to remodel/expand the existing residence and to replace the septic system. The proposed activity envelope encompasses the entire area of the lot less the required setbacks, and all of the proposed development will occur within the activity envelope. The site plan depicts the footprint of the expanded residence, the existing driveway, and the existing septic tank and seepage bed that will be replaced in the same location. Steep/Potentially Unstable Slopes c~ Grading: The activity envelope does not contain any slopes greater than 5%. Limited grading will occur to ensure positive drainage away from the residence. Water Courses & Drainage: There are no water courses or irrigation ditches on the property. Drainage will be retained on-site. Wildfire: The wildfire hazard is low. The Applicant will comply with the standard wildfire mitigation measures in the Code. Wildlife: The lot is not within any mapped wildlife habitat areas. Scenic Review: Capitol Creek Road is a designated scenic corridor. The proposed development is exempt from scenic review pursuant to 7-20-120:c.4.a because it is not visible from Capitol Creek Road. Rural Character Guidelines for Building Location: The guidelines are not applicable as the Applicant is proposing to expand an existing residence, the size of the lot is limited, and the lot does not contain any irrigated pastures or meadows. Landscaping and Vegetation Protection: Existing landscaping will be retained; and disturbed areas will be landscaped with trees and shrubs or revegetated with pasture grasses. RECOMMENDATION: Staff recommends that the Director approve the Urfrig/Sheppick Activity Envelope and Site Plan Review for an addition to the existing residence, subject to the conditions of the attached Administrative Decision. The Board did want to raise the concern of impacts on the ISDS from seasonal fluctuations in the water table and flooding from the White/Borman ditch. It's my understanding the applicant is planning to do an addition and remodel to their home along with improvements to the existing leach field. The applicants reside in Little Elk Creek subdivision which is a typical subdivision having compliant access and water supply per the International fire Code as adopted by Basalt Fire. The roads are paved and have widths greater than 20 feet. A fire hydrant is within 300 feet of the property. If the addition and remodel bring the home to greater than 5000 square feet in size, the applicants should be advised that the sprinkler provision within the Pitkin County Land Use Code and the adopted code of Basalt Fire would apply. The site in question is a flat lot (no slope greater than 5%) within the platted Little Elk Creek Subdivision. There is an existing single family dwelling on the lot (1,801 square feet in size) and septic tank seepage bed that were built 1978. The home remodel/addition and replacement of septic tank seepage bed will occur where each is currently sited. With concern to vegetation, significant landscaping has occurred with mature trees and grass areas in front of and surrounding the existing home. The remainder of the lot is dominated by native irrigated pasture grasses. While no formal landscaping plan exists, existing landscaped areas will be returned to pre- disturbed condition. All other areas will be re-seeded with native pasture grasses. Sec. 7-10-50 Activity Envelope: Due to the smaller size of this lot (1.01 acre), the desired "activity envelope" would include the entire area of the lot less defined setbacks. Sec. 7-20-30 Water Courses and Drainage: There will be no changes made to the drainage plane on the site. No irrigation ditch exists on this property. Irrigation water is pumped from an irrigation ditch on an adjacent property. Silt fencing will be utilized during construction and landscaping activities to protect areas outside of the "activity envelope". Sec. 7-Zfl-60 Wildfire Hazard: According to Basalt Quad Map Wildfire Hazard Areas (Colo. Sec. 7-20-70 Wildlife Habitat: According to Colorado Division of Wildlife Maps (Jan. '97), this lot contains "no activity" for either Mule Deer or Elk. No fences will be constructed to impede thru access for these animals. No fruit bearing trees exist or will be planted on this site. 7-20-120 & 7-20-120(e) Scenic View Protection & Rural Character Guidelines: This lot does not fall within any of the applicable County Scenic View Protection Area Maps. The existing home does not impair any ridgeline views and will comply with the "earth tones" standard set forth in this section. The addition portion of this project will not exceed the height of the existing dwelling. Sec. 7-20-130 Landscaping and Vegetation Protection: No grading will take place that alters the existing drainage plane and no berms above Oft will be constructed. Significant landscaping has occurred with mature trees and grass areas in front of and surrounding the existing home. No grading will take place to alter the slope and/or drainage plane of site except to insure positive drainage away from the home. Silt fencing will be utilized during construction and landscaping activities to protect areas outside of the "activity envelope".
