OF PITKIN COUNTY, COLORADO, APPROVING A TEMPORARY COMMERCIAL .
USE/SPECIAL EVENT PERMIT FOR THE FETZER ASPEN ANTIQUE ART FAIR AND
CONTEMPORARY ART FAIR, JULy 7~24, 2006

RECITALS
1. Pursuant to Subsection 3-200-030 of the Pitkin County Land Use Code, the Community
Development Director of Pitkin County, Colorado ("Director") may approve a Temporary
Commercial Use/Special Event Permit for commercial activities or special events.
2. Scott V. Fetzer (hereafter, the "Applicant") has applied to the Director for approval of a Temporary
Commercial Use/Special Event Permit to conduct the following two events: (1) The Aspen Antique
Art Fair; and (2) the Aspen Contemporary Art Fair. The Antique Art Fair will begin set up on July 7,
2006 however actual operations for the event will. commence on July 12th, 2006 and run until July
16th, 2006. The Contemporary Art Fair (second event) will operate from July 20th, 2006 to July 2300,
2006 with tear down of event equipment on July 24th, 2006. Equipment and materials for both
events will be staged in the Buttermilk Mountain parking lot. Hours for both events are 11:00 AM-
7:00 PM each day. There will be 100 participants for both events and approximately 1,000
spectators are expected daily.
3. Applicant has executed a License Agreement with Aspen Skiing Company, LLC for the use of its
property in connection with the event.
4. Applicant has requested use of the Stapleton parking lot for overflow parking during the event.
5. The Director finds that, to the extent applicable, the application complies with the standards in
Subsection 3-200-030 of the Land Use Code.
THE DIRECTOR HEREBY APPROVES the Temporary Commercial Use/Special Event Permit.
for the Fetzer Aspen Antique Art Fair and the Aspen Contemporary Art Fair, subject to Applicant's
compliance with each of the following conditions:
1. Applicant shall adhere to all material representations made in, or in connection with, the
application.
2. . Applicant shall contact the County Electrical Inspector to determine if an Electrical Permit is
required and shall secure an Electrical Permit prior to the event, if required.
3. Applicant shall refrain from using signage for the event with the exception of one sign that shall
comply with the standards of the sign code and is acceptable to the Zoning Officer.
4. Applicant shall contact the Aspen Fire Department for an inspection of the tent and shall ensure
that the Fire Department's requirements (e.g., for tent exits and on-site fIre extinguishers) are
met prior to the event.
5. When siting the tent for the events 16' of access for EMS vehicles shall be adhered to in the
event of an emergency. .

6. All parking for the event will be on site (in the Buttermilk Mountain parking lot), or in the
adjacent Stapleton parking lot (which shall remain open to the general public at all times). No
event parking shall occur on Highway 82 or Owl Creek Road. There shall be no general public
parking in the Inn at Aspen lot. Applicant shall contact a towing company prior to the event and
arrange for their services on an as-needed basis. Contact information for the towing company
shall be provided to on site security personnel, the County Engineer and the County Sheriff's
Department prior to the event. Applicant shall also provide the Sheriff's Department with
contact information for its private security personnel prior to the event.
6. Prior to the event, Applicant shall provide County Risk Management (to the attention of Kris
Jewkes) with an adequate Certificate of Insurance which demonstrates that Applicant has
secured General Liability Insurance with minimum limits of $1,000,000 per Occurrence and
$2,000,000 General Aggregate, and that names Pitkin County as an Additional Insured.
7. Failure to comply with the conditions of approval may result in revocation of this permit.

If you answered YES to ALL of the questions above, then a permit from the Community
Development Department is NOT REQUIRED. However, you must still obtain any other
required permits or approvals, such as a special event liquor license, pyrotechnics permit, etc.
Contact Community Development at (970) 92()"5526 for assistance in determining what other
permits may be required. In addition, you must notify the Sheriff and the County Engineer of the
time, place and estimated attendance .for your event at least 72 hours prior to the event.

application and submit the required fee and application (with all required attaChments) to the
Community Development Department for review.

The Community Development Department will be the primary contact for the applicant during
the review process. Once the completed application and fee are submitted, Community
Development will distribute the application to the necessary referral agencies and, if necessary,
will schedule a date for the referral agencies to review the application with applicant and/or put
the referral agencies directly in touch with appliCant.
Following review of the application, the Community Development Director will issue an
Administrative Determination granting or denying the permit. The Board of County
Commissioners reviews events of duration longer than 72 hours,
Special event permit applications and temporary commercial use permit applications shall' be
submitted to the Community Development Department not less than 60 days prior to the
event date, along with the following:
1. Fee for application: $1344 (Major Events), $448 (Minor Events); make check payable
to "Pitkin County Treasurer". Whether or not an event constitutes a "Major Event" or a
"Minor Event" will be determined by staff at the time of submittal. The fee is based on 2
hours of staff time, for Minor Events, and 6 hours of staff time, for Major Events; if staff
review time exceeds 2.4 hours for Minor Events, or 7.2 hours for Major Events, the
applicant will be charged for time in excess of 2/6 hours at a rate of $224 per hour.
2. Map (sketch or site plan) of event site, detailing any temporary or permanent structures,
street closures, all impacted properties (identifying owners), and parking.
3. Vicinity map.
4. Schedule of events/activities.
S. Detailed Safety and Operations Plan (see Attachment A).
6. Proof of General Liability insurance/indemnification (naming Pitkin County as' an
"Additional Insured") and proof of Liquor Liability insurance (if applicabfe).
7. Letter of authorization/executed contract granting approval to use the specific site(s)
from public or private property owner(s).
8. Written approval of any applicable Caucus(es)/Homeowners' Association(s).
9. Copies of all other applicqble permits. (Some helpful contacts and references are
included in Attachments Band C.) Other permits may be processed concurrently with
the application.

Attachment A). A Safety and Operations Plan is required for planned events/activities
because the emergency service infrastructure is funded by the Pitkin County taxpayers
to offset unplanned events that pose a threat to life and property. As a result, any
demand for services generated by a planned event/activity should be alleviated ahead
of time by the event sponsor or organizer. The posting of financial security, in an
acceptable form, may be deemed necessary by the Pitkin County Sheriff's Office
upon review of the Safety and Operations Plan.
