Pursuant to Subsection 3-200-030 of the Pitkin County Land Use Code, the Community Development Director of Pitkin County, Colorado ("Director") may approve a Temporary Commercial Use/Special Event Permit for commercial activities or special events. 2. The City of Aspen (hereafter, the "Applicant") has applied to the Director for approval of a Temporary Commercial Use/Special Event Permit to conduct the Aspen High Country Triathlon/Duathlon on August 20, 2005. The -event will be staged from the Aspen Recreation Center and include biking up and back on, Maroon Creek Road to the Maroon Bells, and a run around the Aspen Golf and Tennis Club; only part of the event will occur in the County. The event will run from 7:OOAM - 1:OOPM. Approximately .300 people are expected. 3. This is the thirteenth year for this event. It was granted a Temporary Commercial Use/Special Event Permit in 2004. 4. The Pitkin County Sheriff's Office, the Aspen Fire Department, and the Emergency Management Department have all approved this event. County Risk Management has received and approved a Certificate of Insurance covering this event and naming the County as an Additional Insured. 5: The Director finds that, to the extent applicable, the application complies with the standards in Subsection 3-200-030 of the Land Use Code. THE DIRECTOR HEREBY APPROVES the Temporary Commercial Use/Special Event Permit for the Aspen High Country Triathlon/Duathlon, subject to Applicant's compliance with each of the following conditions: 1. Applicant shall adhere to all material representations made in, or in connection with, the application. 2. During the event, Applicant shall place signs at all major road intersections (e.g., subdivision entrances/exits) warning motorists that there is a race in progress. Traffic marshals shall be present at all road crossings to facilitate the ability of race participants to cross intersections. ~~(~~~ s s ., 3. At the mandatory check-in with participants, Applicant will stress the requirement that cyclists ride single file on Maroon Creek Road and do not pass RFTA busses headed down Maroon Creek Road. Applicant's course marshals shall enforce this requirement. 4. Prior to the event, Applicant shall contact Tom Parry, Electrical Inspector for Pitkin County and the City of Aspen, to determine if there is a need for an electrical inspection of its outdoor hook-up(s) to the Aspen Recreation Center. 5. Applicant shall secure any necessary permits from the U.S. Forest Service and the City of Aspen prior to the event. 6. MEMORANDUM TO: Cindy Houben FROM: Rose Ann Ilivan RE: Aspen High Country Triathlon/Duathloh 2005 -Temporary Commercial Use/Special Event Permit DATE: May 24, 2005 REQUEST: The applicant is requesting approval of a Temporary Commercial Use/Special Event Permit in order to conduct the annual Aspen High Country Triathlon/Duathlon. APPLICANT: City of Aspen (hereafter, "Applicant"). LOCATION: Aspen Recreation Center, up and back on Maroon Creek Road and around the golf course. Only a portion of the event occurs in the County. BACKGROUND: This event was most recently granted a permit by the County in 2004. The event will be held August 20, 2005 from 7:OOAM - 1:OOPM. Approximately 300 people will participate. REFERRAL COMMENTS: The application was referred to the Maroon/Castle Creek Caucus, RFTA, USFS (Aspen District), Tom Grady, Dr. William Rodman, Ellen Anderson, Ed Van Walraven, Kris Jewkes, and Bud Eylar. Ellen Anderson signed off on the application for Emergency Management and Ed Van Walraven approved the application for the Aspen Fire Department. Dr. Rodman favored application of an insurance requirement. This was not included because the BOCC voted to exclude the requirement from the permit for the Bicycle Tour of Colorado and it was felt that it would be inappropriate to include it here, when it had not been required for the other event. Bud Eylar indicated that Applicant should place "Race in Progress" signs at intersections with major driveways from Highlands to T-Lazy 7 (e. g., subdivision entrances). Kris Jewkes reviewed and approved the Certificate of Insurance provided by Applicant. Tom Grady reviewed and signed off on the application for the Sheriff's Department. Kent Blackmer, on behalf of .RFTA stated that: Last year I raised [the] issue of starting the Triathlon bicycling up Maroon Creek instead of with the swim. I can't recall why this was not possible. Again, we would prefer this as it would preclude any conflicts with our Maroon Bells bus service. Short of this happening, it is good to hear that there will be motorcycle monitors. With all participants and monitors I hope the unequivocal understanding is single OO~J~70 . ~ ~. file to the right at all times and no passing buses headed down Maroon Creek. STAFF COMMENTS: Pursuant to Subsection 3-200-030 of the Land Use Code, Applicant must demonstrate that adequate provisions have been made for all of the following: 1. Police supervision (if necessary); 2. Public parking; 3. Insurance; 4. Site set-up, maintenance and clean-up; 5. ~ Emergency services; and 6. Safety of operations. Additionally, temporary structures must conform to applicable building codes and other County regulations. Each of these requirements is addressed, in turn, below. Police Supervision: No special provisions are deemed necessary. The Sheriff's Office has signed-off on the application. Public Parkins:, School parking lots will be used and volunteers will direct parking. Insurance: Applicant has provided adequate proof of insurance. Site Set-Up, Maintenance and Clean-Ua: Outdoor set-up is minimal for this type of event. The City of Aspen Parks Department is identified as the responsible party for any clean up required. Emeraencv Services: Applicant has provided a plan for dealing with emergencies during the races. This includes aid stations along the way staffed by individuals that are in radio or cell phone contact with each other as well as the race directors. Local emergency personnel will be notified of the event. Safety of Operations: There will be two course marshals on motorcycles and one person in a golf cart to scope out the bicycle course during the event and to check if anyone needs assistance. Lifeguards will be on duty during the swim portion of the event. T-Lazy 7 and RFTA will be notified prior to the event. Volunteers will be stationed at the entrance and exit to the ARC, at Highlands' exit/entry, and at any other entry to Maroon Creek Road to caution/stop traffic, if needed. Helmets are mandatory on the bicycle course. Conformance with Building Code:. Electricity will be supplied from the ARC and Applicant is being requested to contact Tom Parry to determine if there is a need for an inspection of the hook-up. Bcc: Attached: Thx Kent. I happened to speak w/ 'Stark at the USFS yesterday and he also mentioned problems w/riders going up to the Bells (specifically re that "Ride for the Cure" event last year). He also seemed inclined to start requiring better enforcement of the law on these rides. I will put your specific points in as conditions of the permit. If there is not good compliance this year, I will suggest that we start requiring CO State Patrol participation, like we have with the really big rides, to be sure people ride single file. Enclosure t'!!t:l; ~ Uvv~l~ ~'"'' PITKIN COUNTY COMMUNITY DEVELOPMENT DEPARTMENT TEMPORARY COMMERCIAL USE/SPECIAL EVENT PERMIT --- INFORMATION ON THE PERMIT PROCESS AND APPLICATION The temporary use and occupancy of public or private properties and/or roadways for commercial activities or special events that are not otherwise, permitted within a specific Zone District may be permitted by the Community Development Director.' The Community Development Department coordinates the review of these activities/events by various referral agencies in order to ensure that the activitieslevents are conducted in a safe manner, and that any impacts on the community or on public resources are mitigated by the permittee. The permittee is required by the Code to demonstrate that adequate provisions have been made for police supervision, public parking, insurance, site set-up, maintenance and clean-up, emergency services, and safety of operations. A permit will not be issued unless these requirements are satisfied. Special Events include, but are not limited to the following: ~ Public events for amusement or entertainment, such as concerts or festivals; ~ Fund-raising or non-commercial events to benefit nonprofit religious, educational, or community service organizations; and ~ Foot races and bike races. Temporary Commercial Uses include, but are not limited to the following: ~ Filming of movies, commercials, or promotional spots; and ~ Trade shows. EXEMPT EVENTS: Is this afund-raising or non-commercial event fora nonprofit I ~o- Yes I ~ No religious, educational, or community service organization? Will the event be conducted entirely (including parking) in a ~ ^ Yes ~j No permanent facility on private property owned or leased by the sponsoring entity? Will the event have a maximum duration of 1 day and be limited to i~ Yes ^ No the hours between 8:00 AM and 9:00 PM? If you answered YES to ALL of the questions above, then a permit from the Community Development Department is NOT REQUIRED. However, you must still obtain any other required permits or approvals, such as a special event liquor license, pyrotechnics permit, etc. Contact Community Development at (970) 920-5526 for assistance in determining what other permits may be required. In addition, you must. notify the Sheriff and the County Engineer of the time, place and estimated attendance for your event at least 72 hours prior to the event. They have this one lock in. Bud The Triathlon needs to have informational signs "Race in Progress " at all of the major drives from Highlands to T-Lazy 7. All the transition stuff (swim to bike to run) takes in the City. The info signs can be a printed on poster board on a small wooden stake readable from the driveway. PITKIN COUNTY COMMUNITY DEVELOPMENT DEPARTMENT TEMPORARY COMMERCIAL USE/SPECIAL EVENT PERMIT --- INFORMATION ON THE PERMIT PROCESS AND APPLICATION The temporary use and occupancy of public or private properties and/or roadways for commercial activities or special events that are not otherwise permitted within a specific Zone District may be permitted by the Community Development Director. The Community Development Department coordinates the review of these activities/events by various referral agencies in order to ensure that the activities/events are conducted in a safe manner, and that any impacts on the community or on public resources are mitigated by the permittee. The permittee is required by the Code to demonstrate that adequate provisions have been made for police supervision, public parking, insurance, site set-up, maintenance and clean-up, emergency services, and safety of operations. A permit will not be issued unless these requirements are satisfied. Special Events include, but are not limited to the following: ~ Public events for amusement or entertainment, such as concerts or festivals; ~ Fund-raising or non-commercial events to benefit nonprofit religious, educational, or community service organizations; and ~ Foot races and bike races. The Board of County Commissioners reviews events of duration longer than 72 hours. Swim portion of the Triathlon takes place at the James E. Moore Pool at the Aspen Recreation Center, Certified Life Guards will be on duty. The Bike Portion, 17 mile out and back course on Maroon Creek Road. Aid station located at turn around point, and Course Marshals will be combing the course. Course will be open to traffic, and helmets are mandatory. The run part of the race is a 4 mile loop course around the Aspen Gold Course, and back to the transition area with 2 aid stations on course. The runners follow a paved bike path and a side walk, course marshals will be combing the course. 2.
