Pursuant to Section 3-200.30 of the Pitkin County Land Use Code, the Community Development Director, hereby "Director", may approve a temporary use permit for commercial activities or special events. 2. Robert Stephens Productions will use a section of Castle Creek Rd. approximately 4 miles up from its intersection with Maroon Creek Rd. to shoot an advertisement for Honda Between the hours of loam and 8pm on May 22, 1998. The photo shoot will involve road closure on this section of Castle Creek Road intermittently. 3. The Director finds that the Applicant has obtained all the necessary comments from referral agencies, and that the proposed event complies with the standards in Section 3-200.30. THE DIRECTOR HEREBY APPROVES the Temporary Use Permit for Honda Photo Shoot subject to the following conditions: 1. The applicant shall adhere to all material representations made during the application process. 2. The applicant shall hire a professional traffic control company to direct traffic during the photo shoot. The fee shall be $27,~..:Qp-x$175 CDD, $50 Engineer ~~~*~~ 1. An applicant for a special event permit shall confer with the Community Development Department staff in apre-application conference to obtain information and guidance in the process at.least 30 days prior to the proposed event. The staff will identify for the applicant the procedural review requirements, applicable standards of the code, submission requirements, and the additional agencies or deparnnents that must be consulted prior to submitting a complete application. 2. All applications will be reviewed by the County Engineer (if use of public right of way is involved), The Director of Risk Management, the Emergency Management Coordinator, and the Department of Environmental Health. Other reviews may be required at the discretion of the CDD. 3. The applicant will be responsible for contacting and gaining approval from the review entities identified by Community Development Staff. 4. A complete application packet with all required "check-offs" must be received by the CDD at least 7 days prior to the proposed commencement of the temporary use/special event. In addition to the materials specified in Code Section 5-50, the applicant must provide a narrative of the proposed event which. details all locational, timing, functional, and operational aspects of the proposed use/event; estimated number of participants and spectators; proof of insurance; a safety and operations plan; a sketch, map, or site plan which clearly represents the site and roadway aspects of the use/event; signed contracts or approvals for use of the specific sites, land parcels, or facilities; and evidence from other specific agencies of any necessary licenses or certifications (food handling, noise, etc.}. The CDD may request the applicant to provide any plans or other materials necessary to properly assess the potential impacts of the proposed Temporary Use/Special Event. 5. All review agencies shall respond in writing on the temporary use/special events checklist with any concerns or conditions of approval. The CDD may issue the permit after receiving an approval from each of the review agencies and assurance that all other required permits, licenses, and certifications have been acquired. The CDD shall approve, deny, or approve with conditions a complete application within 5 working days. Community Development Director subject to compliance with the standards in this section. Refer to Section for procedures and Section 5-50 for submission contents. The Community Development Director may requre additional submission materials specific to the planned use or event in order to make a proper determination as to whether or not the proposed use or event meets the applicable standards of this. section. A. An applicant must demonstrate adequate provisions have been made for: 1. Police supervision if necessary; ~. Public parking; 3. Insurance; 4. Site set-up maintenance and clean-up.; 5. Emergency services; and 6. Safety of operations. B. Temporary structures constructed or placed on the premises shall conform to any and ail applicable building codes and other County regulations. C. These permits shall be issued for no more than 72 hours. Applications for activities of Ionger duration must be approved by the Board at its discretion. (Ord. 95-3 (part), 1995: prior code § 3-1903) D. Afund-raising ornon-commercial event for a nonprofit religious, educational, or community service organization shall not require a Communty Development permit provided the special event is conducted entirely (including parking) on private property owned or leased by the sponsoring organization as a permanent facility; any structure used in conjunction with the event shall meet all setback requirements, shall be the subject of a valid building permit, and shall be promptly removed upon cessation of the event; and the event shall be limited to hours of oepration between 8:00 a.m and 9:00 p.m., to a maximum duration of 1 day, and to a maximum frequency for similar events of two times per calendar year. This does not exempt the sponsoring organization from obtaining other permits or approvals which may be required such as special events liquor license, pyrotechnic permit, amplified. noise variance, etc. Notice of the time and place of the event and estimated attendance shall be provided to the County Engineer and Sheriff 72 hours prior to the event. (Ord. 97-16, Amended, 04/23/1997) SPECIAL EVENTS are temporary, short-term, non-commercial uses of lands or structures, not otherwise included as a permitted or accessory use by these zoning regulations. Special events includes uses such as public events intended for amusement or entertainment (concerts, festivals); fund-raising or non-commercial events for nonprofit religious, educational, or community service organizations; foot races, bike races and such. TEMPORARY COMMERCIAL USES are commercial uses of property for 72 hours or less unless a longer duration is approved by the Boadd of County Commissioners at its discretion. TEMPORARY USES includes uses that aze required in-the construction phase of development, or which is uniquely seasonal in nature, or which are for a relatively short time duration. " County Sheriff's Office Special Requirements for special events Since this is a planned event, the applicant should demonstrate through a written, approved Safety And Operating Plan the ability to mitigate 1040 of the potential impacts on the emergency services infrastructure in Pitkin County. The reasoning behind this requirement is that the emergency services infrastructure is funded by the Pitkin County taxpayers to mitigate unulanned events that pose a threat to life and property. This infrast=^scture is funded far an average demand for services, not pea:x. As a result any potential demand for services generated by a planned event should be mitigated ahead of time by the event sponsor/organizer. Hopefully, this will eliminate any demand for public sector emergency services and as a result pernit those resources to remain available for any unplanned event that poses a threat to life or property. The purpose of the refundable ($10,000.00) bond is in keeping with the Search And Rescue industry trend in response to public demand that planned events, particularly ones with a documented record of high-risk activity, demonstrate the ability to assume the financial impacts~in the event that a response is required from the public sector emergency response infrastructure. In order to demonstrate the ability to mitigate I00~ of the potential 'impacts on the emergency services infrastructure,. the applicant should develop a detailed, written safety and operating plan outlining the applicant's ability to Locate, access, stabilize and transport any injured event participant to a fixed medical facility without impacting local emergency services. Also included should be a traffic plan for traffic control, access and parking. In an attempt to facilitate the approval. process for the applicant, I have included under separate cover the Pitkin County Sheriff's Office Special Event Safety And Operating Plan Requirements. Honda Dear Ms. Houben, Robert Stevens Productions would like to gain permission to use a one mile part of Castle Creek Road from approximately 4 miles from the intersection of Maroon Creek Road. to approximately 5 miles from that intersection for a sti l photo shoot for the 199 Honda Passport brochure. The shoot would ideally fake place on Friday, May 22, 1998 and would involve about ten people,. a motorhome, a 14' cube grip truck, the picture vehicle, two vans and four personal vehicles. Ail vehicles would be parked out of the way of any traffic passing Through. The crew would arrive at approximately 10:00 a.m. and stay until about 8:00 p.m. Intermittent traffic control for both motor vehicles and bicycles would be required for very short periods of time, usually no longer than three minutes. The intermittent traffic control would not have fo take place throughout the entire day, but would only need to happen during filming situations, for perhaps a half hour in the morning while we find a camera angle to shoot from and about forty-five minutes at the end of the day when. we do the actual photography. During the rest ofi the day, while we are setting up a "rig" on the picture vehicle that will attach the camera directly to the vehicle, traffic could flow uninhibited. We would like police officers to stay with us for the entire day for traffic control, since the exact time we would need to be out on the roadway for both the intial set-up and actual shooting. are dependent upon the amount of time it takes to build the "rig" and that cannot be precisely timed. To reiterate again, though the officers are with us the entire day, traffic control is not necessary for the entire day. During the rest. of the day, while we are setting up a »rig° on the picture vehicle that will attach the camera directly to the vehicle, traffic could flow uninhibited. We would like police officers to stay with us for the entire day for traffic control, since the exact time we would need to be out on the roadway for both the intial set-up and actual shooting are dependent upon the amount of time it takes to build the "rig" and that cannot be precisely timed.
