Independence Pass, LLC ("Applicant"), has applied to the Community Development Director of Pitkin County, ("Director"), pursuant to Section 2-20-150(b) of the Pitkin County Land Use Code ("Code"), to make some minor modifications to the building envelope and to change the basic design of the residence. N~ ~4 I~~-~ar~- 2. The property is located at 0074 ~'xesel~ Drive and is described as two parcels of land designated as the "Smith Parcel" and the "Smith Open Space" on the Preserve Subdivision Plat. The property is zoned AFR-2 and contains 3.48 acres of which 1.17 acres are designated open space. 4. The parcel was created when the Preserve Subdivision was created, but is not part of the subdivision. A building envelope was not approved at that time as there was an existing residence and no redevelopment was proposed. Pursuant to Resolution No. 98-213, the BOCC granted 1041 hazard review, scenic overlay review and caretaker dwelling unit approval, and denied the use of TDRs for additional floor area. The vested rights for the approval expired in November of 2001. The BOCC denied a request to extend the vested rights, pursuant to Resolution No. 178-2001. The parcel subsequently received 1041 hazard and scenic review approval in 2005 pursuant to Hearing Officer Determination No. 27-2005. The Applicant submitted a complete application after July 6, 2006, therefore, the application is being considered pursuant to the 2006 Land Use Code. 6. The Director finds that the request is consistent with Section 2-20-150(b) of the Land Use Code. APPROVED by the Director, subject to the following conditions: The Applicant shall adhere to all material representations made during the application process. 2. The Applicant shall comply with the provisions of Hearing Officer Determination No. 27- 2005 unless otherwise replaced or amended by the conditions of this approval. Prior to submission of any future building permit applications, the Applicant shall be required to submit for approval by the County Attorney and Community Development an amended Site Plan. The amended site plan shall establish the amended building envelope and maintain a landscaping envelope for planting. Prior to submission of a building permit, the Applicant shall provide a final grading and '~ landscaping plan to be approved by Community Development. The landscape plan shall be similar to what was included in the application materials, however, there shall be an increase in 12' to 18' conifers located to the south of the residence. Condition No. 1 of Hearing Officer Determination No. 27-2005 shall be amended to read: "...including substantial compliance with the plans dated ~~ 11/10/06..." 6. Condition No. 13 of Hearing Officer Determination No. 27-2005 shall be amended to read: "The materials shall comply substantially with the materials study dated ~}~ 11 / 10/06." The residence shall be equipped with automatic timers to turn off the interior lights at night for when the residence is unoccupied. Prior to submission of a building permit, the Applicant shall provide a final grading and landscaping plan for the new grading and landscaping envelope to be approved by Community Development. APPLICANT: Independence Pass LLC REPRESENTATIVE: Clauson and Associates LOCATION: 0074 Northstar Drive ("Smith Parcel" and "Smith Open Space Parcel", Preserve Subdivision Plat. ZONING: AR-10 (5.35 acres) BACKGROUND: The Hearing Officer granted 1041 Hazard and Scenic Review on August 25, 2005 pursuant to Determination No. 27-2005. STAFF COMMENTS: MINOR AMENDMENT (SECTION 2-20-150B): A) Minor Amendments Defined A minor amendment to any development application or permit is one that meets the following criteria,. as determined by the Community Development Director: Is consistent with action(s) taken during previous development approvals for the property; and Response: The original action taken during the review was in part aimed at reducing the visibility of the proposed residence from Highway 82 and public access areas within the Preserve Open Space. Although the residence is now completely different in design, the footprint remains in nearly the same place and configuration. Regarding the slight envelope adjustments and request for a fire truck turnaround, Staff is comfortable that they will have limited impacts. Overall the request is in line with the original request. 2. Does not change the use of the proposed development between residential, commercial and tourist accommodation uses; and 000000 r"'""ti Response: The use will remain the same. 3. Does not change the basic character of the approved use of land on which the activity occurs, including basic visual appearance and method of operation; and Response: The proposed residence, while different in design, will remain in essentially the same location with a similar footprint. The one concern for Staff is that the existing elevation of the landform located south of the residence remain (i.e. that the grade not be lowered from what is existing for the mound, which sits at 8050). Additionally, Staff is somewhat concerned with the proposed residence's "glass wall" that faces south. This is a new feature, and Staff is recommending that a new landscape plan include some larger conifers due south of the residence. In addition, Staff is recommending that the internal lights be on a timer for when the residence is not occupied in order to limit nighttime light pollution. 4. Does not constitute a new land development activity; and Response: The proposal does not constitute a new development activity. S. Does not increase off-site impacts in the surrounding neighborhood; and Response: With the above noted mitigation Staff feels the proposal will not increase off-site impacts on the neighborhood. 6. Does not endanger the public health, safety or welfare; and Response: The proposal will not endanger the public. 7. Does not violate any Land Use Code standard; and Response: The proposal does not violate any known Code Standard. 8. Does not substantially increase the need for on-site parking or utilities, or affect affordable housing generation; and Response: The request does not affect parking, utilities or affordable housing generation. 9. Does not increase the floor area of the use by more than five (S) percent or decrease the open space on the site by more than five (S) percent. Response: The request is in compliance with this criteria. RECOMMENDATION: Staff recommends that the Director approve the Independence Pass, LLC Minor Amendment to enlarge the building envelope and change the basic design of the residence based on compliance with the standards noted above and subject to the conditions of the attached Administrative Decision. The use will remain as a single family home, and fhe proposed development will not disturb the scenic view as seen from Hwy 82. APPLICANT has submitted to COUNTY an application for Minor Amendment to Development Permit (hereinafter, THE PROJECT). 2. APPLICANT understands and agrees that Pitkin County Ordinances No. 98-7 and 99-37 establish a fee structure for Planning applications and the payment of all processing fees. is a condition precedent to a determination of application completeness. 3. APPLICANT and COUNTY agree that because of the size, nature or scope of the proposed project, it is not possible at this time to ascertain the full extent of the costs involved in processing the application. APPLICANT and COUNTY further agree that it is in the interest of the parties for APPLICANT to make payment of an initial deposit and to thereafter permit additional -costs to be billed- to APPLICANT. APPLICANT agrees he will be benefited by retaining greater cash liquidity and will make additional payments upon notification by the COUNTY when they are necessary as costs are incurred. COUNTY agrees it will be benefited through the greater certainty of recovering its full costs to process APPLICANT's application. 4. COUNTY and APPLICANT further agree that it is impracticable for COUNTY staff to complete processing or present sufficient information to the Planning Commission and/or Board of County Commissioners to enable the Planning Commission and/or Board of County Commissioners to make legally required findings for project approval, unless current billings are paid in full prior to decision.
