DUNCAN Applicant wishes to construct a two-car garage, 24 feet wide by 28 feet deep (26 feet by 30 feet including roof overhangs) and of frame construction, at the northwest corner of his lot, at the far end of the existing driveway. At the proposed site, the closest point of the west elevation (back) of the structure to the west property line (an interior side line) is approximately 24 feet, in conflict with the present County setback requirement of 30 feet. The closest point of the north elevation (side) of the structure to the north property line is about 20 feet. Since the existing driveway enters through this north line, albeit some 200 feet away, the line is considered a front property line, and the 20-foot distance is in conflict with the present County setback requirement of 100 feet. Applicant makes appeal for a variance allowing positioning of the structure as close as 20 feet from the west property line (but no closer at any point), and as close as 20 feet from the north property line (but no closer at any point). Justification for the variance, in the opinion of the applicant, lies in several factors. The first and most important is that, given the shape and topography of the lot, the locations of existing trees, and the placement of the existing residence (see photos), no other location is appropriate or feasible. While building on other spots on the lot would be technically possible, none would be remotely practical or economical. Second, this particular garage site was selected and coordinated with other elements of the improvements as a part of the overall lot development plan back in 1970, before the current regulations were in effect; now that site is in a sense at least partly "locked in." Third, this location appears to allow the most unobtrusive practical placement of the structure, from the viewpoints of applicant, neighbors, and passersby, of any point on the lot, given existing conditions. Fourth, the placement (and the structure) is in keeping with the layout of the lot and the existing improvements. Fifth, this placement allows construction on undisturbed native soil (no fill) and requires the least amount of site disturbance and disruption. In fact, nothing but minor grading and shaping of the existing parking pad is needed. Last and probably least important, this is certainly the most convenient and economical location, from the standpoint of the applicant. The proposed garage location, as well as the structure plans, have been approved by the Architectural Committee (James Delman, Chairman) of the Gateway of Snowmass Mesa Subdivision Property Owners Association. Smyth stated that he was confused about 1he drainages, Vogel pointed out the naturaJ drainage to Smyth. Vogel stated that 47.5 was e;..;actly wbat he needed on the front for a setback. Lukes questioned ahout the original zoning or normal zoning for that subdivision, Newbury stated that it was unzoned at time of subdivision, Fox questioned about checking the covenance of the subdivision and Newbury answt'red that there was no covenonce, Lukes was concerned about previous decisions made in relation to prior zoning standards and how to determine the amount now in question. Vogel told the Board t.hat this was an earth Sheltered home. ~lason stated that there was no obj ect ions from the adj acent proper1:y ownc'rs. .Fox mot i onE'd t hat the variance be g-ranted for '17.5 foot front yard set.back variancc' and an 8 foot sideyard setback variance due to the topoi~raphical configuration of land and the fact i,hat there is draina~e and because of the downzoning, Joe Zanin second the motion. Vote was called for and all was in favor. Stutsman-Gerbaz. Inc,. State Hi~hway 82 82-9 requesting a J foot si_dc;yard setback variance to construct an addition. Dick Stutsman was there to represent Stutsman-Gerbaz. He explained that they wanted to extend 28 feet on the end of the existing building and on the back side for the proposed addition of 1950 square feet, It would look the same as the building does now. Mason stated that the existing building was built prior to the 200 foot setback now in effect, ~'lason commc~llded the owners for keeping the property in such ~ood shape. Newbury st;lted that on the back part or Gateway it is RS-30 and on the front if is AF-1, Mason stated there was no objections from the adjacent property owners, Fox motioned to approve the variance because of topographical hardsl]ip of 80 feet on the front yard and 6 feet on the rearyard. Vote was called for, All in favor, Gene Bishop, Ole)!l Pacif ic Ave, Servi ce Area 6, ABC 82-11 requesting a 7 fo-ot sideyard setbick variance '-for ~third ffoor exit balcony and stairway, Herb Paddock ind Kassar Sedaghi was tl]ore to represent Gene Bishop. Smyth abstained from voting due to the fact he is affiliated with the A,B,C,. Paddock stated that the setback was necessary on the south side of the buildin!; to accommodate the placement of an exterior balcony and stairway. This is a re- quired exit and stairway. This balcony would be to accommodate ~he employee unit that will be on the end of the building, Smyth verified that the building was under construction at this time. Paddock said that was correct, however, this appendage was not under construction at this time. Smyth questioned if there was a building permit for this and where the stairway was originally shown, It was determined that the building permit was issued with the stairway in a location that would not require a variance. Lukes questioned what the hardship was, Paddock stated that there was not really a hardship, however, this was necessary to maintain the proper amount of parking spaces and to accommodate the third floor balcony, Lukes stated that without a hardship he did not know what basis to grant a variance on, Mason explained to the applicants that what they defined as a hardsllip, which was a hardship [or them, was not the type of hardship with which the Board could work with, Nassar Sedaghi stated to tho Board tllat without the variance the building would suffer apsthetically, Thrum questioned S(~daghi about the elevation of the building and the grade across thp property. Sedaghi explained the property to Throm. Throm suggested another location for the b~tlcony, however, Spdaghi stated that would mess up the li_ving room of the lower apartment.
