DIRECTOR OF PITKIN COUNTY, COLORADO, APPROVING A TEMPORARY
COMMERCIAL USE/SPECIAL EVENT PERMIT FOR ASHCROFT SKI
TOURING, INC.'S SPECIAL EVENTS AT THE PINE CREEK COOKHOUSE ON
MARCH 6 &7, 2004, AND APRIL 9, 2004

RECITALS
1. Pursuant to Subsection 3-200-030 of the Pitkin County Land Use Code,
the Community Development Director of Pitkin County, Colorado
("Director") may approve a Temporary Commercial Use/Special Event
Pe~mit for commercial activities or special events.
2. Ashcroft Ski Touring, Inc. (hereafter, the "Applicant"), through its
President, John Wilcox, has applied to the Director for approval of a
Temporary Commercial Use/Special Event Permit for dinner parties at the
Pine Creek Cookhouse on the evenings of March 6th and th, and April 9th,
2004. The Pine Creek Cookhouse is located in the Ashcroft Ski Touring
Area, which is operated by Applicant on the White River National Forest
under permit from the U.S. Forest Service.
3. Pursuant to Par. 19 of SOCC Resolution No. 052-2001, the number of
"special events" at the Pine Creek Cookhouse is limited to no more than
35 per year. A "special event" is defined as " an event that exceeds the
normal seating capacity of the [Pine Creek] Cookhouse, which is ... one
seating at dinner in the winter...." Pursuant to SOCC Resolution No.
052-2001, Applicant is required to obtain a temporary Lise permit for all
winter events that exceed the normal seating capacity. Pursuant to
Administrative Determination No. 01-2004, Applicant received approval for
second dinner seatings during the period December 20, 2003 and ending
January 5, 2004. Applicant subsequently obtained approval for additional
dinner seatings on February 15th, 16th and 17th of 2004, under
Administrative Determination No. 11-2004.
4. Under the terms and conditions of SOCC Resolution No. 052-2001,
Applicant is exceeding the normal seating capacity by offering a special
group seating for dinner on each of March 6th and th, and April 9th, 2004.
The Director finds that the dinner parties being offered by Applicant
constitute "special events" under SOCC Resolution No. 052-2001.
5. The Director finds that, to the extent applicable, the application complies
with the standards in Subsection 3-200-030 of the Land Use Code.
THE DIRECTOR HEREBY APPROVES the Temporary Commercial
Use/Special Event Permit for Ashcroft Ski Touring, Inc.'s "special events" at the

Pine Creek Cookhouse during the evenings of March 6th and 7th, and April 9th,
2004, subject to Applicant's compliance with each of the following conditions:
1. Applicant shall adhere to all material representations made in, or in
connection with, the application.
2. The three (3) special dinner seatings covered by this Determination
shall count as "special events" for purposes of calculating the thirty-five
(35) "special events" Applicant is entitled to conduct each year.
3. Failure to comply with the conditions of approval may result in
revocation of this permit, or any subsequent permit(s) related to this
property, or vested rights associated with this property.

REQUEST: The applicant is requesting approval of a Temporary Commercial Use/Special
Event Permit for 3 dinner parties (for private parties and the Aspen Valley Land
Trust/Aspen Ski Club) it is hosting at the Pine Creek Cookhouse March 6 & 7,2004, and
April 9, 2004. There will be a party of 18 on the 6th, a party of 14 on the 7th, and a party of
100 on April 9th. ,
Applicant has this day submitted the $420 fee for the Permit.
APPLICANT: Ashcroft Ski Touring, Inc. (hereafter, "Applicant").
LOCATION: Pine Creek Cookhouse, Ashcroft Ski Touring Area.
BACKGROUND: The application is required under the conditions imposed by BOCC
Resolution No. 052-2001. A similar application was submitted and approved for dinner
seatings during the 2003/2004-holiday season (see Administrative Determination No. 01-
2004) and for dinner seatings in February of this year (see Administrative Determination
No. 11-2004). Based upon the report provided by Applicant in connection with
Administrative Determination No. 01-2004, there were 15 "special events" during the
2003/2004-holiday season. With the 3 "special events" approved in February of this year,
this brings Applicant to a total of 18 "special events" to date. It is therefore well under its
allowed cap of 35 "special events" per year.
REFERRAL COMMENTS: None - due to the nature and timing of the' application.
(Applicant submitted its application on March 3, 2004). Applicant previously informed us
that Lynn Mace, at Toklat Lodge, had requested that she be informed of subsequent
applications by fax. Applicant's current application states that a copy of its application was
sent by fax.
STAFF COMMENTS:
Pursuant to Subsection 3-200-030 of the Land Use Code, Applicant must demonstrate that
adequate provisions have been made for all of the following:
1, Police supervision (if necessary);
2. Public parking;
3. Insurance;
4. Site set-up, maintenance and clean-up;
5. Emergency services; and
6. Safety of operations.

Additionally, temporary structures must conform to applicable building codes and other
County regulations. Each of these requirements is addressed, in turn, below.
Police Suoervision: No special arrangements are necessary, given the nature of the
events.
Public Parkinq;, Applicant has represented that dinner guests will use the King Cabin Lot.
Insurance: Not requested, given the nature of the events.
Site Set-Uo. Maintenance and Clean-Uo:. No special provisions are necessary for these
events. Applicant is operating the Pine Creek Cookhouse on an ongoing basis.
Emeraencv Services: No special provisions are necessary for emergency services.
Applicant is operating the Pine Creek Cookhouse on an ongoing basis.
Safety of Ooerations: No special provisions are necessary. Applicant is operating the
Pine Creek Cookhouse on an ongoing basis.
Conformance with Buildina Code:, Applicant was previously granted a Certificate of
Occupancy for the Pine Creek Cookhouse. There are no temporary structures
associated with these events.
RECOMMENDATION: Staff recommends that the Director approve the Temporary
Commercial Use/Special Event Permit application subject to Applicant's compliance with
each of the conditions in the attached Administrative Determination.
