NOW, THEREFORE, BE IT RESOL~7ED by the Commission that it does hereby grant 1041 Hazard `Review approval £o the applicant subject to the following oondtonse 1. The applicant shall submit a 24 x 36 inch mylar site plan which delineates the building envelope and access drive location. This site plan shall meet the approval of the Planning Office`and County Attorney and shall be recorded prior to the issuance of a building permit. 2. To mitigate wildfire` hazards, the applicant should consider and apply, if possible, the fire,, protection strategies outlined in Exhibit "B" attached hereto and incorporated herein by reference. The applicant should place the'home as close as possible to the access road on the downhill side of the home. 3. To mitigate geologic hazards, the applicant should comply with the recommendations contained in Dr. Lampiris' report which is attached as Exhibit "C" and incorporated herein by reference. Prior to driveway construction, the applicant shall submit a'driveway plan to the County Planning Engineer for his review and approval. 6. Ni-- i c 1 t:: b-r_i,o, . ._;, aook 534 PacE 90 --EXHIBIT D MEMORANDUM.._ TO: Francis Krizmanich,Planning Department FROM: Bob Nelson, Department of `Environmental Health DATE: March..26, 1987 RE: Condit 1041 Geologic and Wildlife Hazard Review This department has evaluated the,.. proposed water supply system, sewage disposal system, and other anticipated"health or'environ- mental implications of the referenced development'in order to' determine compliance with Colorado Department of Health regula- tions, local regulations, and those requirements of the Pitkin County Land:"Use Code under our jurisdiction: We offer the following review comments for your consideration: 1. WATER SUPPLY Water is to be_supplied from a well which is located in the Crystal River alluvium of the stream bed, and already serving the' other houses in Ehe Seven Oaks Sutididison. We are familiar with the water supply and have found it in compliance with Colorado Department of Health requirements. The system .consists of a properly sized and constructed well producing at a rate of 50 gallons per minute. Tlie water is tkien disinfected with chlorine and pumped uphill to a water storage tank of 8000 gallons.. It then is distributed to the twelve lots through two-inch water mains. We oonsider this to be a good rural water system which should provide a dependable`water supply. A sufficient quantity of water meeting bacteriological and chemical standards, and supplied at adequate pressure is therefore available to this proposed house for domestic purposes. The subdivision homeowners' association should submit a document to the Planning Office indicating a willingness to serve this proposed building site: We think it is important to demonstrate that there is an agreement between the applicant and the owners of the water system that the house will continue to be a part of ..~... . the water system and share in the'oost of repair and maintenance, even though it may not be a formal part of the legally created homeowners' association. 2. SEWAGE DISPOSAL The .proposal indicated that the on-site wastewater disposal system is to be a conventional septic system, designed to comply with County standards. The other houses adjacent to'the property 130 South Galena Strae£ Aspen, Colorado H1611 303/925-2020 F .. P /.a; _ ::~ .Condit 1041 Review March 26, 1987 Page 2 already are served with standard septic systems and conditions were found suitable. Further, the soil type of the lower one-half of the lot as indicated on the Soil Conservation Service maps is Type 29F (Ansari-Arie-Rock Outcrop Complex) which has the following properties and conditions 'influencing the design and' construction of the sewage disposal system: 1) Rapid Permeability 2) Low Shrink-Swell Potential s~ curt ro ova course r•ragments of cobble and flagstone 4) There are some limitations to the installation of septic systems due to a shallow depth "to bedrock and the large stones. The Lampiris geological investigation report submitted with the application confirms the basic soil characteristics as`indicated ~....m above and indicates that there should" be sufficient depth to` bedrock. Therefore, it is our conclusion that, other than the potential for the amount of course material "(cobbly"sand'y'1oam~and flaggy Toam) that may present some pollution hazard, the soil should be suitable for the construction of a sewage disposal system which will comply with the fit-kin Comity`"Rego"T"at,ons on 'rnd~v~d~a' Sewage Disposal Systems. If anaYysis shows the amount of course .:,, material (pa"sling a X16 sieve Y" inthe soil `e"Xcee~"s"more"than 3"d~;` we may be required to request a design incorporating selected fill material, This t ype of system still meets regulations, and it should be possible to construct an engineered septic system even under the most difficult of conditions.: expected in this type of soil. 3. AIR. QUALITY IMPACTS The single-family residence is limited to one fireplace and one .stove certified in compliance with the County Resolution. We expect no .problems for the applicant to meet these limitations, and believe that, in this case., the wood burning has little marginal impact upon`the air quality of`the`valley. 4. WATER QUALITY IMPACTS with this type of soil with a high erosion hazard, it is mpor- tant that the residential construction activities should be kept a minimum of 50 feet horizontally "from'the stream and revegeta- tion should be completed prior to building occupancy. 'These precautions, along 'with Lampirs' recommendations to control .. surface runoff, should limit the amount of erosion and sediment introduced into stream system from the construction impacts. ~ ~~ ~ ~~{~3 ~3~11 -C~- - 0-® MEMORANpUM TO: Pitkin County Planning and Zoning Commission FROM: Francis Krizmanich, Planning Office RE: Condit 1041 Hazard Review DATE: April 17, 1987 APPLICANT: James Condit. REQUEST: The applicant is requesting 1041 Hazard Review approval to construct a single family residence on a lot`which`contains mapped 1041 hazards. including geologic, wildfire and wildlife. LOCATION: The property is located in the Seven Oaks. Subdivision near the confluence of Potato Bi11 Creek and the Crystal River (see attached vicinity map). ZONING: The property is one acre in size and is zoned RS-30 (30 acre minimum lot size). It is a legal non-conforming lot (as to lot size). WATER: Water ,will be supplied from a community well operated by the Seven Oaks Subdivision. SEWER: An individual septic system is proposed. MAJOR ISSUES AND CONCERNS: I. Referral Agency Comments 1) Colorado Geological Survey:' "In a letter 'dated April 7, 1987, Jeffrey L. Hynes commented that the State Geological Survey has no objections to this proposal if the recommends- tions of Dr. Lampiris' geologic report are followed. 2) Environmental Health Department.: _In a memo dated March 26, 1987 (attached), Bob Nelson .submitted the "following comments: o Water Supply: The Environmental Health Department considers the Seven Oaks water system to be a good rural system which supplies water of adequate quality and quantity. The applicant should demonstrate. that. the owners of the water. system are willing to provide service for this lot. o Sewage Disposal: It should be possible to construct a septic system which meets County standards. r- xJ o' Air Quality: The residence is limited to .one fireplace and one certified stove which complies with County regulations. 3) Division of Wildlife: The staff contacted Kevin Wright of the DOW- by telephone on April 16, 1987. Kevin recommends that dogs should be kenneled and native vegetation should be preserved as possible to minimize wildlife'impacts. II Staff Comments: The applicant is requesting 1041 Hazard Review approval to construct a residence on a'one acre lot which contains mapped 1041 Hazards. These hazards include geologic and wildfire concerns. and deer and elk winter range. In regard to geologic concerns, the applicant has submitted a geologic report by Nicholas Lampiris. Dr. Lampiris recommends that the rear of the home should be .landscaped to direct 'runoff around the home site and that a s,ite_specific soils engineering study should be performed. Dr. Lampiris additionally recommends that the soils. engineering study should also add'ress`a perimeter drainage system around the base of the home foundation. In regard to wildfire hazards, the applicant has indicated that the community water system will provide adequate water for fire protection, the access roads are capable of handling fire vehicles and existing brush will be cleared from around the home perimeter. When staff inspected the site, we found it to be heavily covered with oak brush which could create a moderate to severe fire hazard. There is an existing fire hydrant approximately 100 feet from the lot. This hydrant should minimize' fire hazards, however, we do recommend that brush should be cleared in a radius around the ..home as recommended in the Colorado State Forest Service fire safety guidelines brochure. The lot is also mapped as deer and elk winter range. It was apparent from the site inspection that. deer use this property in the winter as well as the surrounding developed properties. To minimize .wildlife.. impacts, the staff recommends that dogs be kenneled and as .much native vegetation as_possible, outside of the immediate homesite radius, should be preserved: The homesite is set back 100 feet into the. property due to the AF-1 zone setback requirement. If the applicant is willing, the staff would support a request for a variance to the setback. If the applicant can obtain a variance to place the residence closer to the access road it would further minimize wildlife impacts as well as reducing potential fire hazards. In addition to the above 1041. concerns, the applicant should comply with the recommendations of the Environmental Health Department. The applicant will need 'to demonstrate to the Health ~"'`' , ~, Department that he .has. a water.. service,,agreement with the Seven Oaks Subdivision. The applicant's driveway plans will need to be reviewed and_ approved by the County Planning Engineer prior to construction. STATEMENT OF INTENT AND PURPOSE The applicant .hereby submits it's application for 1041. Hazard Review Approval for a single family homesite on a parcel of land containing approximately one acre. The' property is partially affected by steap slopes, avalanche and wildfire designations on the Pitkin .County adopted` hazard maps. The property is located in Section 34 of Township 8 South, Range 88 West. A complete legal description is attached at Exhibit 2 of this application. The property is presently zoned RS-30 and the proposed construction of a single family dwelling is a permitted use in this zone category even though the lot size is non- conforming. An application £orm is attached.. at Exhibit _1,. An attached site plan map indicates topography, vicinity mapping, geology, access and the proposed homesite. 1. Compliance with Identified 1041 Hazard Areas. a. Slopes of 30% and Greater (Section 5- 401.2(h). The property has certain mapped areas which indicate slopes in excess of 30%. However; the area between the building envelope and the existing roadway has slopes which average in the range of 15 0 . Attached" at` Exhibit 4 i s "a geo"7.ogi:c report from Dr. Nicholas Lampiris, Ph'.D: Dr. Lampiris' report states as follows: "The building site is this lot, where slopes the U.S.G.S. topograpY slopes on this site, determined that the proposed homesite and in the range of 15%." located very near the center of varied from 5%`to 15%. In addition, slopes in excess 'of 30% will not be crossed by any `driveway' serving the site. The driveway would run between the homesite. ,and„the existing roadway where the above described,,relatyely gentle slopes exist. Dr. Lampiris' report states that: "Access to the site should_be fairly easy to obtain off the existing subdivision road with no significaht road r., __ ~ cut necessary." Because no development will occur in areas on the property which have slopes in excess of 30~ nor will any of these areas be traversed by access roads, the applicant has completely mitigated this hazard. b. Geologic Conditions. The property does not contain any mapped geologic hazard areas with respect to soil conditions. br. Lampiris' report attached at Exhibit 4 verifies the geology o£ the site and indcates'that it is suitable £or development provided certain concerns are addressed. The only concern for the building site is the possibility of hydrocompactive soils and the possibility o£ rapid runoff from the hillside lying to the 'east of the property. Dr. Lampiris recommends positive drainage and 3andscaping at the rear of the proposed home in order to completely direct drainage around the home to either side. Dr. Lampiris' report indicates that this mitigation measure is somewhat routine and should be based upon an engineering study at the time"of application for a building permit. Dr. Lampiris discusses the possibility of a rock fall hazard but states that the proposed homesite should not be affected because of its location well away from.the base o,£ the;,nearby hill and in view of the"lan2Cscaping recommended~£or diversion of runoff. Dr. Lampiris' report indicates that waste disposal should not be a problem through the use of a standard septic system and leech field located in the soils on the site. The"Ptkin County Sanitation. Engineer.- should be consulted for his ,specific recommendations at the time of building permit application. c. Snow Avalanche. Although the County adopted mapping indicates a snow avalanche potential in the vicinity of this property, Dr. Lampiris' report indicates that "true avalanching is not likely at this site because of'the low elevation and very .small catchment area." In addition, the location of the house far away from the base of the 'hill and the proposed landscaping' to divert runoff should be sufficient to fully mitigate this hazard." d. Wildfire Hazard (Section 5-403). The property has a mapped wildfire hazard area located. within its boundaries. Dr. Lampiris' report attached at `Exhibit 4 indicates the topography of the site as varying from gently to moderately west sloping terrain covered with sage brush, pinion and other dry land vegetation with patches of scrub oak. The area of the property between the proposed home site and the access road has relatively gentle slopes while to the veer of the property the slopes increase in steepness. The proposed homesite is located near the center of the parcel where slopes`. vary from 5 to 150. No structures will be placed on densely vegetated hillsides with slopes greater than 30~. The property will have adequuate ingress and egress for fire fighting equipment along a driveway which crosses slopes. varying from 5 to 15% in grade. The driveway grade will be gentle and not pose any problem for access in the event of fire. The property's water supply is from an existing community water system which ..has adequate pressure to serve reasonable needs. In addition, the property is located very close to the Crystal River in the event additional water is necessary°for drafting. The applicaht will clear ariy trees and heavy brush around the, perimeter of the building once it is completed. Based upon the foregoing facts and mitigation measures, 'the wildfire hazard will`be completely mitigated. 2. Utility Service. a. Water. Water will be `provided from the community water system of the Seven Oaks Subdivision. The water system is presently serving several other houses in the vicinity and is adequate to serve .the proposed single family dwelling. b. Sewer. The applicant proposes an 'on site individual sewage disposal system and will comply with the recommendations of the Pitkin County Sanita£ori Engineer with respect to same. The geologic report attached at Exhibit 4 indicates soil should be suitable for septic purposes. c. Electricity and Tele hone. The Seven Oaks Subdivision is presently served by Holy Cross` and Mountain Bell and service for another single family residence is available. d. Access. Access to the site is along an existing roadway presently serving the subdivision. The access right is granted in a Deed recorded at Book 242, Page 438 of the records of Pitkin County to a predecessor in title of the applicant. A commitment for title insurance for the'applicaht's property will be provided which guarantees such access rights. 3. The undersigned .attorney does hereby certify to this ownership. ~ The property was recently parceled pursuant to a Sheriff's Deed under a foreclosure decree recorded in Book 410, Page 650 of ~ the. records. of Pitkin Comity on June~30, 1981. A copy of the t Sheriff's Deed is attached hereto at Exhibit 5. The Sheriff's ~ Deed conveyed the property to the First National Bank'of Glenwood Springs. The applicant is not aware of any facts which would have indioated~ that `the parcel was not a lawful separate parce`1 prior to the foreclosure action, however, that inquiry is moot due to the existence of the "parceling 'through the foreclosure suit. 1. Conformance 'with the Aspen area' '2fe'rier`al plan (Article 2-1). The property lies within the Crystal River Valley and is not specifically addressed by ttie'Aspen area`gerieral plan, although the property is highly regulated pursuant tq the Pitkn County zoning regulations for the RS-30 zone classification. The construction of one single Family dwelling is permitted under the zoning and as a previously subdivided parcel does 'not require review other than 1041 Hazard 'Review. 2. Conformance with Other Laws (Article 2-2). The proposed development is not in violation of any laws of Pitkn County, the State of Colorado or the United States o£ America. 3. Drainage (Article 2-5) (Article 5-101'). Existing natural drainage patterns wall be maintained on the property and the proposed development wild no't 'cause storm drainage and flood water patterns to exceed the capacity of naturaY or constructed drainage ways or subject other areas to increased potential for damage by-.flood, erosion or sedimentation or to pollute natural streams. At the time of building permit application, a site specific drainage plan will be provided which will insure that the run off characteristics of the property after the development occurs will maintain historic patterns. Dr. Lampiris' report at Exhibit 4 indicates certain specific measures to divert existing runoff from the area of the homesite and recommends that a drainage study should be conducted in the immediate area of the proposed building to insure positive drainage around the home both on the surface and in the subsurface areas. -~ _ r ... .._ ._~....~... The water supply for this homesite will be developed from an existing community water. system capable of serving in house needs. 7. Sewage Treatment and Collection (Article 2 7) (Article 5-200). The building site has"soils which are suitable for the installation of a conventional individual sewage disposal system according to Pitkin County regulations Dr. Lampiris' report attached at Exhibit 4 i'ridicates the capability of the soils to accommodate such a system o£ a standard design. The applicant will comply with Pitkin County Individual Sewage Disposal System regulations and obtain a"permit therefore at the ., w~. _. ~..-,. time it obtains a building permit for the construction of the residence. 8. Impact on Road Svstem (Article 2-8) (Article 5 201). The property is accessed off of Highway 133 along an existing access. road presently serving several neighboring residences. No significant"traf`fc~will occur by reason of this development nor will significant service level reductions take place. 9. Road Desi n and Construction (Article 2 9) (Article 5-202). No new roadways. are proposed for this application... The building envelope will be easily accessed by a new driveway 'acros's a2i` "are"a" that ' is gently sloping. No unsightly road cuts, scars or' cut and fill operations will be necessary. 10. Logical Extension of Utilities (Article 2 10) (Article 5-203). The proposed building site will be served by existing' public and private utilities. The septic system will meet environmental health department regulations and standards and these systems can be easily constructed which meet all such regulations. No financial or other adverse impacts will be caused to any utility providers by reason of this application. 11. Erosion (Article 2-11) (Article 5-102). There are no 'areas within the project which are susceptible to significant erosion. Dr. Lampiris'' report at sxhibit 4 does not reveal any adverse surficial soil `condition§ which would be susceptible to erosion impacts. Historic drainage patterns will be maintained and the development is designed to minimize disturbance to natural cover and maintain substantial "grass' covered open space because" of the topographic features of the proposed building site on a relatively flat portion o£ the property. 12. Housing (Article 2-15) (Article 5-300). The construction of a single family dwelling 'on this„_previously subdivided .parcel is specifically exempt from any employee housing requirements. 16. Scenic Qualitv (Article 2-16 (Article 6-105). The building envelope. is not visable from any 'public 'road and is not located within any visually sensitive areas of the county. The county policy with respect to scenic quality is fully satisfied by this application'. 17. Air Qualitv (Article 2-17) (Article 5-106j The proposed development will not contribute to degradation o£ air quality in the .county. The, single family residence will"fully comply with all applicable county regulations concerning solid fuel burning devices which may be in effect at such time as the building''permit is sought. The property lies ih an area of excellent air flows and" the establishment of one single family residence in this sparsely populated area on a one"acre "parcel will not create any adverse air pollution effects. 18.
