Jim Colombo, hereinafter "Applicant", has applied to the Board of County Commissioners of Pitkin County, Colorado, hereinafter "Board", for approval of a caretaker dwelling unit pursuant to Section 3-8.13(d) of the Land Uae Code. 2. The Applicant's lot is zoned AF-1 and is approximately 5.3 acres in size. 3. Said parcel is located off of Emma Road at 300 Horse Shoe Drive, Basalt, more specifically described in Exhibit A, attached. 4. The Applicant proposes to deed restrict the caretaker dwelling unit pursuant to Ordinance 91-11. 5. The Board heard this application at a regularly scheduled meeting on May 31, 1994, at which time evidence and testimony was presented with respect to this application. 6. The Board found that, should the Board of Adjustment deny the application for a variance to the side yard setback, the Applicant shall be allowed to construct a caretaker unit attached to the main residence, pursuant to the provisions of this Resolution and the policies and regulations of Pitkin County. 7. Dwelling Unit REQUEST: Pursuant to Section 3-8.13 (d) of the Code, as amended. by Ordinance #91-11, the Applicant is requesting approval of a one bedroom caretaker dwelling unit to be located in an existing detached garage. LOCATION: The subject property is located off of_Emma Road at 300 Horseshoe Bend Drive. APPLICANT: Jim Colombo _ _. SIZE/ZONING: 5.3 acres in size / AF-1, ten acre minimum, lot size PROJECT INFORMATION:...,The__,Applicant is proposing to utilize approximately 319 square feet of an existing outbuilding, in conjunction with approximately 375 square feet of new construction, .:. . to create the caretaker dwelling unit. The existing garage is approximately 15 feet from the main residence and the. addition will be approximately 10 feet from the. house,. Sopris Creek comprises the easterly boundary of the property. The proposed addition is approximately 60 feet from the centerline of the Creek. Home Supply Ditch crosses through the northwest corner of the property and then runs parallel to the northern lot line. The subject also contains two ponds, one .located towards thee. northeast corner and the other in the western portion of the property, adjacent to Sopris Creek. There are numerous: large cottonwood trees and riparian species along Sopris Creek and Home Supply Ditch. The proposed addition is approximately 50 lateral feet and 10 vertical feet from the mean high water line. of-6~st-Sopris Creek. The floodplain of the creek will 'hot be impacted by`£he proposed caretaker unit. There are no other mapped or known 1041 Hazards on the. subject property. The nearest residential .structure is approximately 400-500 feet from the proposed caretaker unit. The proposed addition will not be visible from ahy adjacent residences, due to the thick riparian vegetation along Sopris Creek and Home Supply Ditch. The existing garage received a variance to the side yard setback in 1992 (the garage is 11 feet from the property line). The proposed addition is within the required 30 foot side yard"setback (13 feet from the property line). Board of Adjustment approval for development within the side yard setback is required. The Applicant has indicted that water will be supplied to the caretaker unit and main residence via an existing well. The Environmental Health Department will require proof of adequate water supply and the location of the well, relative to the septic field, prior to the issuance of aseptic permit. RECOMMENDATIONS: Staff recommends that the Board of County Commissioners approve the Colombo Caretaker Dwelling Unit subject to the following conditions: 1. The Applicant shall submit a signed and recorded caretaker dwelling unit deed restriction, pursuant to Section 3- 8.13(d)(3) of the Code, to the Housing Office, prior to the issuance of a building permit. 2. The caretaker dwelling unit shall be limited to 700 square feet of livable area. 3. The Applicant shall install a kitchen, as defined by the Housing Office, prior to the issuance of any certificates of occupancy for the caretaker unit. 4. Site Plan memo Colombo cdu n ~ MEMORANDUM TO: Rick Magill, County Planner FROM: Cindy Christensen, Housing Office DATE: May 2, 1994 RE: Colombo Review for a Caretaker Dwelling Unit Parcel ID No. 2465-132-00-018 ISSUE: The applicant is requesting approval to deed restrict a proposed outbuilding into a caretaker dwelling unit, which would be approximately 695 square feet. RECOMMENDATION: After reviewing the above-referenced application, the Housing Office recommends approval of the proposed Caretaker Dwelling Unit pursuant to Section 3-8.13 of the Pitkin County Land Use Code and Board of County Commissioner Ordinance 91-11. Section 3-8.13(d), Caretaker Units - Outbuildings, states: The Board may permit one caretaker dwelling unit not to exceed 700 square feet, to be located within a properly approved outbuilding on any lot within the R-30, AF-1, AF-2, RS-20, RS-30 and RS-160 zone districts .. . The applicant states that this unit is to be 695 square feet. The unit must also contain a kitchen as defined below: For Accessory Dwelling Units and Caretaker Dwelling Units, a minimum of atwo-burner stove and oven, standard sink, and a 6-cubic foot refrigerator plus freezer. The applicant must also comply with Section 3-8.13(a)(4), added per a Code amendment enacted with Ordinance 91-11, which states: The applicant shall by deed restriction or other permanent commitment running with the land, guarantee that the caretaker unit not be required to be rented; not be condominiumized or sold; not be occupied by the owner or spouse; be limited to occupancy by not more than two (2) adults, and related children, who qualify as (and have been found by the Housing Authority to be) employees of the community under such guidelines as may be from time to time established by said. Authority; be rented for terms not less than six (6) months 'rf rented. The caretaker dwelling may be occupied by members of the immediate family even though they may not qualify as an employee of the community. "Immediate Family" shall mean a person related by blood or marriage who is a first bousin (or closer relative) and his or her children. Prior to building permit approval, a signed and recorded Deed Restriction must be submitted to the Housing Office. A copy of this deed restriction can be obtained in the. SEWAGE TREATMENT AND COLLECTION Sectlons 2 7 and 5 200: ^lt is the policy of _., ,.~ . ~..~ ~ . >;~ ,~. ,.~a, , the County w ensure that land is not commmed to any use and thaY~no''~ise is mutateii'~~w7t~iout adequate evidence that facilities to collet[, treat and dispose of anticipated types and quantines of waste water are available or can and will be provided with suitable capacity, quality of discharge, suitable point of discharge and dependability'. According to our files, the existing septic system for the main house was installed in 1973. and the pert rate was 26 mpi. The permit was issued for 3 bedrooms. Thee as-built drawing indicates a 1,000 gallon septic tank and a seepage absorption bed of 720 sq ft. were installed. According to current regulations this size septic tank is adequate for 3 bedrooms and the size of the bed is adequate for 1.25 bedrooms.., For soils with a percolation rate of 26 mpi, an absorption area of 575 sq ft per bedroom for seepage beds is required. Fora 3 bedroom house the total, absorption area. for a seepage bed is 1,725 sq ft. The existing system under current regulations is .thus too small by 1,005 sq ft. It is the policy of this department to not require any addition to an existing system if the number of bedrooms does not increase, if the system was. originally sized by meeting the regulations in place at the time the system was installed, and if there has been no problem with the existing system. So i£ the number of total bedrooms is three for the combined. main house and caretaker unit, this department would. not require an increase to the system. However, we do strongly recommend.. that the. system be increased to meet current regulations, since the system is more than 20 years old. 1 - , s ~, ;,~ v~ .,~, ~. ~ -,~~-; . £, I~a,~sx ~ ~ . .~ ~ , ~ If the number of bedrooms does. increase above.. the number originally permitted, the system will have to be upgraded to meet current regulations. If the system is enlarged, Mr. Colombo needs to be aware that all individual .sewage disposal systems installed. within Pitkin County require septic permits and must comply with the Pitkin County septic regulations. Septic permits are issued by the Aspen/Pitkin Environmental Health Departmelt. Previous percolation rates and soil profile data would be used to size the new system. The applicant will need to adhere to minimum horizontal setback requirements for placement of septic systems components. They will need to located the leach field site a minimum of .100 feetfrom their well and from any neighboring wells. The site could pose some difficulty in placing the system away from hazards. The proximity to water and irrigation ditches could impair the functioning of the septic system by overloading and saturating the soils. This would severely impair the soil to absorb and filter water of the. septic system. Measure to control this problem could include but are not limited to culverting the ditch or creating diversion swales to move the water away from the septic system. Minimum horizontal distances between components of a sewage disposal system and pertinent physical features must be in accordance with Section 4-4 of the Pitkin County Sewage Regulations. The area for the leach field should be located in an area of no traffic and planted with dry land grass. Please refer to the Pitkin County Sewage Regulations .for detailed information. ADEQUATE PROVISIONS FOR WATER NEEDS: Sections 2-6 and 5-2OSi "II is the policy of the County to ensure that land is no[ committed ro any use`and that no use is initiated without adequate evidence that a water supply of adequate quality quantity, pressure and dependability is available to support theuseintended." This Department needs adequate information provided on the quantity of water available. This can be done from tests of wells present on-site by a water engineer's or well driller's report. Before a septic permit can be issued the location of the well must be indicated to assure that setback requirements from the well to the septic system can be complied with. WATER QUALITY IMPACTS; Sections 2-22 and 5-107.2: "It is the policy of the County to preserve and protect itspresent water resources. To this end it is ttiepolicy of the County that no land use be initiated which would adversely affect the quantity, quality, or accessibility bf the County'swaterresources; or which would occur at the expense of established water-dependent agricultural activities; or which would iesult in increased salinization of water resources, loss of minimum stream flows, further destruction of wildlife habitat, or major expenditures to reacquire or redistribute major water resources. It is also [he policy of the Counry to maintain a natural vegetative buffer along its surface waters such [tint the surface and groundwaters of the area are not encroached upon byland uses orbther human activities which could cause deterioration of water quality or impair the natural treatment processes provided by meadows andwetlands." The Environmental Health Department will be addressing water quality impacts only on down stream water quality. This application is not expected to impact down stream water 2 E'~ quality if the minimum horizontal distances between .components of the system and physical features are in accordance with Section 4-4 of the Pitkin County Sewage Regulations. AIR QUALITY: Sections 2-17 and 5-106: Single-family/small: Only that development is permitted which will. not contribute significantly to degradation of air quality in Pitkin County. This project is -not expected to contribute significantly to air quality degradation. The applicant must file afireplace/woodstove permit with the Environmental Health Department before the building permit wil] be_issued._The less densely populated parts of the county like Emma may have one wood burning fireplace and one department certified device or two department certified devices per building. In addition, unlimited numbers of decorative gas appliances are allowed. Coal may riot be burned iri any device. Barns and agricultural buildings may not install any type of fireplace or woodstove device. CONFORMANCE WITH OTHER ENVIRONMENTAL HEALTH LAWS: Section 2- "It is [he policy of [he County to ensure [hat no use or development of land is permitted which is in violation of the. laws of the County, the State of Colorado, or the United States of America." This Department is not aware of any issues of concern regarding other environmental health laws. ... I understand the existing garage encroaches upon the sideyard setback, and that the Coretaker Dwelling would also encroach upon the sideyard setback. 1 support Mr. Colombo's request fo a Coretaker Dwelling Unit as presented in his application and urge BOCC and Board of Adjustments to grant approval to his application. The existing garage was constructed without any building permits prior to 1990. A previous owner wished to legalize the garage prior to selling the lot to Mr. Colombo. The. garage received a height and a setback variance from the Board of Adjustment in 1992. The proposed caretaker unit is located within the required 30 foot side yard setback. If possible, the caretaker unit should be relocated outside of the setback. Board of Adjustment approval is required prior to development within required setbacks._ FLOOR AREA: The maximum allowed floor area on this site is 15,000 square feet, pursuaht to Ordinance 92-08.
