OF COIINTY COMMISSIONERS OF PITRIN COIINTY COLORADO GRANTING APPROVAL RO THE CONNERB CARETAKER DWELLING IINIT _ Resolution No. 95-~ RECITALS L Mike and Lisabeth Conners, hereinafter "Applicants" have applied to the Board of County Commissioners of Pitkin County, Colorado, hereinafter "Board", for approval of a caretaker dwelling unit pursuant to Section 3-1511(B) of the Land Use Code. 2. The Applicant's lot is zoned AFR-l0 and is approximately 3.422 acres in size. 3. Said parcel is located on 172 Horseshoe Drive, and is known as Lot 4, Double R Ranches Subdivision. 4. The Applicant proposes to deed restrict a caretaker dwelling unit pursuant to Housing Guidelines in effect at the time of the issuance of a Certificate of Occupancy for the unit. 5. The Board heard this application at a regularly scheduled meeting on June 28, 1995, at which time evidence and testimony was presented with respect to the application. 6. The Board finds that the proposed caretaker unit complies with the criteria established in Section 3-1511(B) of the Land Use Code. APPLICANT: Mike and Lisabeth Conners LOCATION: 172 Horseshoe Drive; Lot 4, Double K Ranches Subdivision ZONING/LOT SIZE: The lot is zoned AFR-10 AND contains 3.422 acres. ACCESS: Access to the property is off of Horseshoe Drive and Emma Road. WATERd Water is provided by the Double K Homeowners Water Association, with a tap provided by an existing water line. The applicant indicates that the Double K Homeowner's Association has verbally approved connection of the accessory unit to the system. A letter from the Association will be required to be submitted to the Environmental Health Department stating that the subdivision's water system is adequate in quantity and quality of water to accommodate the caretaker unit, and also allowing connection of the caretaker unit to the system. SEWER: The applicant proposes to install a new septic system to accommodate the caretaker unit because the existing septic system is sized for only four bedrooms. A permit will be obtained from the Environmental Health Department. REFERRAL AGENCY COMMENTS: 1. The Environmental Health Department's comments are attached as Exhibit "A". 2. The Zoning Officer notes that the allowed floor area for the parcel will not be exceeded. 160 square feet of floor area will. be added to the barn to accommodate the caretaker unit. Comments are attadhed as Exhibit "B'~. 3. Comments were not received from the Double R Ranches Homeowner's Association. The applicant received verbal ~. approval from the Architectural Committee for the proposed caretaker unit. 4. The Housing office recommends approval of the caretaker unit, subject to recordation of a deed restriction for the unit prior to building permit approval. A copy of the actual floor plans of the unit showing the net liveable square footage shall be ,,provided to the Housing Office. Comments are .attached as Exhibit "C". STAFF COMMENTSt Compliance with Section 3-1511(B) of the Land Use Code Pursuant to Section 3-1511(B) of the Code, the Board may permit a caretaker dwelling unit of 700 square feet or less within a properly approved outbuilding, on non-conforming lots within the AFR-10 zone district under the following conditions and limitations: 1. The total floor area of the principal and caretaker unit shall not exceed the allowable FAR of the applicable zone,. district; Response: A maximum floor area of 15,OO0 square feet is currently allowed in the AFR-10 zone district. The main residence contains approximately 3,475 square feet with a 1,250 square foot garage; the barn currently contains 1,060 square feet, and the applicant proposes a 160 square foot addition to the structure to accommodate a 700 square foot caretaker unit. The total floor area is within the maximum allowed. 2. There shall be provided one off-street parking space for each bedroom in the caretaker unit. Response: Two off-street parking spaces are provided for the caretaker unit. 3. The applicant shall deed restrict the unit to comply with the caretaker unit deed restriction puTSUant to Section 3-1511(B)(3) of the Land Use Code. Response: The applicant will deed restrict the caretaker unit in accordance with County regulations. 4. The dwelling unit--deed restriction may only be .removed upon approval by the Eoard of county Commis§ioners. Response: The applicant agrees to comply with this restriction. As the Double K Subdivision was approved by the Board of County Commissioners, development within the Subdivision is not subject to 1041 Review. The barn containing the caretaker unit is not 2 visible from Emma Road, and lies outside of all required setbacks. RECOMMENDATION: Staff recommends approval of the request subject to the following conditions: 1. Prior to issuance of a building permit for the caretaker dwelling unit, the applicant shall provide written approval to the Environmental Health Department from the Double K Subdivision Homeowner's Association showing proof of adequate quantity and quality of water and allowing a connection to the subdivision's water system to accommodate t~e caretaker unit. She said that last fall with the Anastas one, she talked to Cindy H. and Cindy said that the intent' was that we were just made sure there was enough water. .That they were all written that way. So, maybe you and I should get together with. Cindy to talk about this one.' There still is the concern for water availability for fire protection... and how that would be determined, I don't know unless the engineering company would do that. A couple of years ago, the Anastas' at Double K wanted to build a caretaker. We need to get a letter from the'subdivision if they are on subdivision wells, saying that they have enough water before we can issue and ISDS permit. Anyway, at the time the subdivision wellkeeper said that they didn't have enough water. Somehow, the homeowner questioned that and had an engineering consultant do an investigation and we now have the report. It --- is just my feeling that the subdivision didn't want either more homes or for people to have caretakers or some such situation. Apparently last fall when I was on vacation, the Anastas were given an ISDS permit based on this report that there was enough water. Now another homeowner in the same subdivision - Mike Conners - is contacting me and also gave me this engineer report. So this makes 2 caretakers in that area. Here were a couple of things that the engineer wrote in the report that I thought you may be interested in... I'd be glad to give you a copy of it if you~d like. On the report, the eng. consultants - Zancanella and Assoc. stated that the studies did not involve limits on the legal availability or yield of the subdiv. water supply, but rather the water delivery network limitations. We don't look at legal aspects of water and didn't know if you needed to look into this for building, permits. Also, from a model that they. made, they said for planning purposes they have estimated approximately a 20% increase (four more units) could be expected prior to requiring significant system upgrades. From what I can tell from their report, it seemed like. they were basing the four units on the smaller caretaker units and therefore less water usage. As Ind mentioned, this would be the second out of four. Do you all know if this subdivision has any vacant lots left? In their conclusion they mentioned that this didn~t include fire protection flows. We donut.look at what's needed for fire protection and thought I'd alert you to this. Anyway, as far as what we need to look at, they are good to go. I will ~/ -, ater - ou e hold off getting back to him for a day or so to see if I hear back from you all. Re: Conners Caretaker Dwelling Unit Review Parcel ID # 2465-132-01-008 The Aspen/Pitkin Environmental Health Department has reviewed the details of the Conners application under the authority of the Pitkin Countv Code `Land Use Code and has the following comments. ADEQUATE PROM IONS F'OI2 ~V?;'TERfI~EED~'•'Sections~2`~17 and 3 1104 ' u "ITis the policy of theCounty to insure the availability of a water supply of adequate quality, quantity, pressure and dependabiliryfor fire protection and support of a proposed land use prior to approval of the use. Tfie County shall require land uses to hookup to existingpub]icsystemsifserviceisavailable." Lots in the Double K Subdivision are served by subdivision wells. This department needs to make sure the water supply for this unit is adequate in quantity and meets drinking water standards for quality. No reports indicating a problem with the quality of the water have been received by this department. Adding one caretaker unit will create .... only a small increase in demand which the well should be able to meet. However, either the applicant needs to provide proof or the subdivision needs to provide a letter stating that the Double K subdivision water system is adequate for this addition. A condition of approval for this application is receipt by the Environmental Health Department of proof of adequate quantity and quality of water for this unit before a septic permit and building permit can be issued for the caretaker unit. i n c'3 SEWAGE TREATMENT AND OLLECTION• Se +~ n 2 18 and 3 1105• "It is the policy of [tie County to insure that adequate sewage treatment facilities are available to serve wasting antl new developments. Lots in the Emma area are served by individual septic systems. There is a septic system for the main house sized for 4 bedrooms. No information was in the application on the total number of existing bedrooms in the main house: A new system will need to be installed if the caretaker unit will bring the total number of bedrooms to more than four. All such systems installed within P"itkin `County iequire` permits issued by the Environmental Health Department, and must comply with the County regulations. To receive a Septic Permit, the applicant will need to submit a Septic Permit Application and appropriate fee. An additional soil test (pert test' and profile hole) is not needed, if a new system is located in the same area because existing soil data from the lot can be used. According to our files, the soil data for the main house indicates a percolation rate of 27 mpi and no ground water or bedrock to 8 feet. We are confident'that a conventional septic system can be installed. Our files indicate that the existing septic system was installed in 1974. If the Conners have noticed any problems with such an old system, they should consider installing one new large system to service both the house `and the caretaker unit. The Aspen/Pitkin Environmental Health Department will design the system for the applicant as part of the permit fee. -The applicant will need to adhere to minimum horizontal setback requirements for placement of septic system components which should not be difficult on this lot. They will need to locate the leach field site a minimum of 100 feet from any well and SO feet from irrigation ditches. Water drainage from the ditch could impair the functioning of the septic system by overloading and saturating the soils. This would severely impair the soil s ability to absorb and filter water of the septic system. Measures to mitigate water drainage could include but are not limited to culverting the ditch or creating diversion swales to move the water away from the septic system. The area for the leach field should be located in an area of no traffic, planted with dry land grass, and should not be flood irrigated or heavily watered. It is desirable to locate the system below the house so that the system can operate by gravity. The applicant should refer to the Pitkin County Sewage Regulations for detailed information, or call our office to discuss this site. A rnndition of approval for this application is the receipt and approval of the septic permit by the Environmental Health Department before a building permit can be issued. 2 ~ ~ WATER QUALITY IMPA .. • ection 2-f4 and 3-705 and ,~-710 "I[ is the policy of the County to preserve and protect its presentwater resources. It is also the policy of the County to maintain a naturalvegetative buffer along its surfacewaters such that the surface and groundwatersof the area are not encroachedupon by land uses or other human activitleswhich couldcause deterioration of water quality orimpair the natural treatment processesprovided by meadows and wetlands." The Environmental Health Department wilt be addressing impacts only on down stream water quality. This application is not expected to impact down stream water quality if the minimum horizontal distances between components of the system and physical features are in accordance with the Pitkin County ISD Regulations. A condition of approval for this application is: NONE AIR QUALITY: Sections 2-1 and 3-602• "Only that development is pennittedwhichwill not contributesignificantlyto degradanonof air quality in Pitkin County. Developmenm may not oonstitute as indirector direct air pollution source under"Federal; Slate or County regulations." This project is not expected to contribute significantly to degradation of air quality in Pitkin County. The plans for the caretaker unit do not show a fireplace or wood stove. If the caretaker unit will have a fireplace, the applicant must file a fireplace/woodstove permit with the Environmental Health Depaztmenf before the building permit will be issued. The less densely populated parts of the county like Emma may have one wood burning fireplace and one department certified device or two department certified devices per building. In addition, unlimited numbers. of decorative gas appliances are altowed. Coal may not be burned in any device. No wood burning device may be installed in barns or agricultural buildings. A condition of approval for this application is the receipt and approval of the fireplace/woodstove permit by the Environmental Health Department before the building permit can be issued. CONFORMANCE WITH OTHER ENVIRONMENTAL HEALTH LAWS Section 2 Z: "It is the policy of the County to ensure that no use or development of land is permitted which is in violation of the laws of the County, the State of Colorado, or the United States of America." ZONE: AFR-10, ten acre minimum lot size This parcel contains 3.422 acres and is non-conforming in size. SETBACRSi"The required setbacks for this parcel are: 50 foot front yard setback 30 foot side yard setback 30 foot rear yard setback The proposed addition lies outside of all required setbacks. FLOOR AREA: This parcel is allowed a total of 15,000 square feet of floor area. The applicant represents that the parcel presently contains approximately 5,500 square feet of floor area. Although this amount has not been verified by the zoning office, it is clear that 15,000 square feet is not being approached. The applicant intends to add approximately 160 square feet of floor area to the existing barn.
