DWELLING UNIT Resolution No. 95- ~` RECITALS 1. Betsy-Ann and Charles Anastas, hereafter "Applicants", have applied to the Board of County Commissioners of Pitkin County, Colorado, hereafter "Board", for approval of a caretaker dwelling unit pursuant to Section 3-1511(B) of the Land Use Code. 2. The Applicant's lot is zoned AFR-10 and is approximately 2.25 acres in size. 3. Said parcel°is located . on 0332 Horseshoe Drive, and is known as Lot 7, Double K Ranches. Subdivision. 4. The Applicant proposes to deed restrict a caretaker dwelling unit pursuant to Section 3-1511(B) of the Land Use Code. 5. The Board heard this application at a regularly scheduled meeting on July 12, 1995, at which time evidence and testimony was presented with respect to the application. 6. The Board finds that the proposed caretaker unit complies with the criteria established in Section 3-1511(B) of the Land Use Code. NOW, THEREFORE, BE IT RESOLVED by the Board that it does hereby grant approval to the Anastas Caretaker "Dwelling Unit application subject to the following conditions: 1. FROM: Suzanne Wolff, Planning Office RE: Anastas Caretaker_Dwelling Unit Review REQUEST: The applicant requests approval of a caretaker dwelling unit of approximately 551 square foot of net livable floor area within an existing detached garage. APPLICANT: Betsy and Charles Anastas LOCATION: 0332 Horseshoe Drive; Lot 7, Double K Ranches Subdivision ZONING/LOT SIZE: The lot oontains 2.25 acres and is non-conforming in the AFR-10 zone district.. ACCESS: Access to the property is off of Horseshoe Drive and Emma Road. WATER: Water is provided by the Double K Subdivision Water Association. The Association has verbally approved connection of the accessory unit to the system. A letter from. the Association will be required to be submitted to the Environmental Health Department stating that the subdivision's water system is adequate in quantity and quality of water to accommodate the caretaker unit, and also allowing connection of the caretaker unit to the system. SEWER: The applicant proposes to install a new septic system to accommodate the caretaker unit because the existing septic system is sized for only four bedrooms. A permit shall'be obtained from the Environmental Health.. Department. REFERRAL AGENCY COMMENTS are attached. 1. Environmental Health: The Environmental Health Department recommends that prior to issuance of a building permit, the applicant obtain approval of a septic permit and a fireplace permit, if necessary, and provide proof of adequate water for the unit. 2. Zoning: The Zoning Officer notes that the allowed floor area for the parcel will not be exceeded. 3. Comments were not received .from the Double R Ranches E. F'1.. to 9 ! to the Environmental Health Department from the Double K Subdivision Homeowner's Association showing proof of adequate quantity and quality of water and allowing a connection to the subdivision's water system to accommodate the caretaker unit. 2. ZONE: AFR-10, ten acre minimum lot size This parcel contains approximately 2.25 acres and is non-conforming in size. The Double K Ranch is an approved subdivision. SETBACKS: The required setbacks for this parcel are: 30 foot front yard setback 20 foot side yard setback 30 foot rear yard setback The garage lies in the required rear yard setback. Note that the setbacks indicated on the site plan are not correct. The Land Use Code definition of Lot Line, Front, states that the front lot line is "the property boundary line dividing a lot from the street". Therefore, the front lot line on this parcel has changed from the East to the North. FLOOR AREA: This site is allowed a total of 15,000 square feet of floor area. All structures are included in the calculation of floor area. The existing garage` is exempt from floor area calculation. The site is well below the allowed :floor area, and a conversion from garage to residence will not exceed the allowed floor area. NET: The proposed dwelling unit will contain 551 square feet of net livable floor area. HEIGHT: The. existing garage complies with County height regulations and no changes to the height are proposed. Qther Caretaker. The Board may permR Caretaker Dwelling Units up to 700 square feet on non~onformtng lots in the ft-30, AFR-iD, AFR-2, RS-217, RS~0 and RS-960 Tones. The Beard may pennif caretaker dwelling units up to four hundred (400) square feet on non-ccnforrning lots in the R-S, R-15 sort R-15A zone districts. All such units must be either attached to, or within, the principal residence. These dwelling units s#mll 6e included in the calculation of Stoar area for the property on which they are located, and applicafyle FAft requirements shall be met. The deed restrictions referred A7 in A.4. must be adopted and pieced on the unit; however, the provisions of A.6 may ~ utilised to modify these requirements. dENDATiCYti's The Housing Office recommends approval as long as the following conditions are met: 1. The Y3ousing Office will require the net liveable square footage be calculated for the deed restriction. Net liveable square footage is described as follows per the Amended Aspen/Pitkin County Housing 1994 Guidelines: is calculated on interior living area and is measured intesSOr wall to mlerior wall, ineiuding all interior partitions. A deed restriction must be recorded t'or the caretaker dwelling unit before building permit approval. Environmental Health Director Date: April 20, 1995 Re: Anastas Caretaker Dwelling Unit Review Parcel ID #2465-141-O1-010 The Aspen/Pitkin Environmental Health Department has reviewed the details of the Anastas application under the authority of the Pitkin County Code Land Use Code and has the following comments. ADEQUATE PROVISIONS FOR WATER NEEDS: Sections 2-17 and 3-1104: "It is the policy of the County to insure the availability of a water supply of adequate quality, quantity, pressure and dependabilityfor fire protection and support of a proposed land use prior to approval of the use. The County shall require land uses to hook up to emsting public systems if serviceis available." Lots in the Double K Subdivision are served by subdivision wells. This department needs to make sure the water supply for this unit is adequate in quantity and meets drinking water standards for quality. No reports indicating a problem with the quality of the water have been received by this department. Adding one caretaker unit will create only a small increase. in demand which the well should be able to meet. However, either the applicant needs to provide proof or the subdivision needs to provide a letter stating that the Double K subdivision water system is adequate for this addition. A condition of approval for this application is receipt by the Environmental Health Department of proof of adequate quantity and quality of water for this unit before a septic permit and building permit can be issued for the caretaker unit. ti ~ r~ SEWAGE TREATMENT AND OLLECTION• ection 2-18 and 3-1105 "It is tl~e policy of the County to insure that adequate sewage treatment facilities are available to serve existing and new developments. Public and private sewage disposal systems and connectionsto such systems shall comply with the sewage disposal guidelines of 1?itldn County Code Title X." Lots in the Emma area are served by individual septic systems. There is a septic system for the main house sized for 4 bedrooms. A new system will need to 6e installed for the caretaker unit since the existing system is not big enough to handle an additional bedroom. All such systems installed within Pitkin County require permits issued by the Environmental Health Department, and must comply with the County regulations. To receive a Septic Permit, the applicant will need to submit a Septic Permit Application and appropriate fee. An additional. soil test (perc test and profile hole) is not needed, because existing soil data from the lot can be used. According to our files, the soil data for the main house indicates a percolation rate of 5 mpi and no ground water or bedrock to 12 feet. We are confident that a conventional. septic system can be installed.. The Aspen/Pitkin Environmental Health Department will design the system for the applicant as part of the permit fee. The applicant will need to adhere to minimum horizontal setback requirements for placement of septic system components which should not be difficult on this lot. They will need to locate the leach field site a minimum of 100 feet from any well and 50 feet from irrigation ditches. Water drainage from the ditch could impair the functioning of the septic system by overloading and saturating the soils. This would severely impair the soil's ability to absorb and filter water of the septic system. Measures to mitigate water drainage could include but are not limited to culverting the ditch or creating diversion swales to move the water away from the septic system. The area for the leach field should be located in an .area of no traffic, planted with dry land grass, and should not be flood irrigated or heavilywatered. It is desirable to locate the system below the house so that the system can operate by gravity. The applicant should refer to the Pitkin County Sewage Regulations for detailed information, or call our office to discuss this site. A condition of approval for this application is the receipt and approval of the septic permit by the Environmental Health Department before a building permit can be issued. 2 T WATER QUALITY IMPACTS• Sections 2-14 and 3-705 and 3-710• "It is the policy of the County to preserve and protect its presentwater resources. To this endit is the policy of the County that no land use be initiatedwhichwould adverselyaffect the quantity, quality, or accessibilityof the County'swater resoutces;or wtiicti would occurat the expense of establishedwater-dependentagricultuialactivities; or which would result in increasedsalinization of water resources,loss of minimum stream flows, further destructiondf wildlife habitat, or majorexpendituTesto reacgvireor redistribute major water resouroes. It is also the policy of the County to maintain a naturzivegetatlve buffer along its sutfacewatets such that the surface and groundwatersof the area are not encroachedupon by land uses or other human activitieswhichcovld cause deterioration of water quality or impair the natural treatment processesprovidedbymeadows andwetlands." The Environmental Health Department will be addressing impacts only on down stream water quality. This application is not expected to impact down stream water quality if the minimum horizontal distances between colnponents of the system and physical features are in accordance with the Pitkin County ISDS Re ulations. A condition of approval for this application is: NONE AIR QUALITY: Sections 2-13 and 3-602: 'OnlythatdevelopmentispermittedwhichwillnotconvibutesignifioantlytodegradationofairqualityihPitkinCounry. DevelopmentsmaynotconstituteanindirectordirectairpollutionsourceunderFederahSfateorCountyregulations.." This project is not expected to contribute significantly to degradation of air quality in Pitkin County. The plans for the caretaker unit do not show a fireplace or wood stove. If the caretaker unit will have a fireplace, the applicant must file a fireplace/woodstove permit with the Environmental Health Department before the building permit will be i§sued. The less densely populated parts of the county like Emma may have one wood burning fireplace and one department certified device or two department certified devices per buirding. In addition, unlimited numbers of decorative gas appliances are allowed. Coal may not be burned in any device. No wood burning device may be installed in barns or agricultural buildings. A condition of approval for this application. is the receipt and approval of the fireplace/woodstove permit by the Environmental Health Department before the building permit can be issued. CONFORMANCE WITH OTHER ENVIRONMENTAL HEALTH LAW '• Section 2- 2~ "It is [he policy of the County ro ensure that no use or development of land is permitted which is iti violation of the laws of the County, the State of Colorado, or the United Statesbf America."
