Resolution No. 971 1 O
1. Thomas Payne (hereafter "Applicant") has applied to the Pitkin County Board of County
Commissioners (hereafter "Board") to consider an extension of vested real property rights pursuant to
Section 4-140-30.
2. One non-metro azea residential growth management allocation was granted by the Boazd
pursuant to Resolution No. 91-146 and approval of a one year GMQS extension was granted pursuant to
Resolution No. 93-80.
3. The Planning Commission granted General Submission grid 1041 Hazard Review approval
pursuant to Resolution No. PZ-91-47.
4. An extension of vested rights for the prior approvals was granted by Resolution No. 94-127.
5. The property is located off of Emma Road, and is more specifically described in`Exhibif A.
6. The Boazd considered the request at its regularly scheduled meeting of July 23, 1997, at which
time evidence and testimony was presented with respect to this application.
7. The Board determined that the proposed development meets the criteria established in Section 4-
14030 ofthe Land Use Code, and, therefore, found the extension to be appropriate.
NOW, THEREFOREBE IT RESOLVED by the Pitkin County Board o£County
Commissioners that it does hereby grant an extension of the vested rights Por the Payne property until
July 23, 2000, subject to compliance with the. following conditions of approval and the conditions of
approval as noted in Board of County Commissioners Resolution No. 94-127 (attached as Exhbif B),
except as amended by Resolution No. 95-142 and as noted below.

1. The residence shall be oriented to maximize potential for passive solaz gain and shall provide '
energy conservation features to result in a net savings of at least 10% above the County standards in
effect at the time of building permit issuance.

RE: Payne Extension of Vested Rights
REQUEST: Pursuant to Section 4-140.30, the applicants aze requesting an extension of the vested
property rights for prior approvals.
APPLICANT: Thomas Payne
LOCATION: Off of Emma Road, adjacent to Happy Day Ranch
ZONING/LOT SIZE: The lot is zoned AFR-l0 and contains approximately 36 acres.
BACKGROUND: The Payne parcel (fka Ross parcel) was granted one non-metro area residential
growth management allocation pursuant to Resolution No. 9 f-146 and. approval of a one yeaz GMQS
extension pursuant to Resolution No. 93-80. The Planning Commission granted General Submission and
1041 Hazard Review. approval pursuant to Resolution No. PZ-91-47. A 1041 hazard review site plan
was recorded in Book 30 at Page 11. The Board granted an extension of the vested rights pursuant to
Resolution No. 94-127, at which time the conditions. of approval were updated to reflect the standards of
the "new" Code that was adopted in 1994. The building envelope was relocated to the northeast of the
originally approved location to avoid the oak brush area that was rated by the Sheriff s Department as a
high wildfire hazard area. The site plan which depicts the amended building envelope was recorded in
Plat Book 39 at Page 69.
STAFF COMMENTS: There are no proposed changes to the Site Specific Development Plan. The
approval was updated in 1994 to comply with the "new" Land Use Code. Staff has reviewed the
previous approvals for conformance with current County policies and regulations.
1041 HazAltn REVIEW: The property contains mapped wildfire hazard areas, slopes in excess of 30%,
potential avalanche areas, and wildlife habitat, including elk and mule deer winter range. 'The amended
building envelope avoids slopes in excess of 30% and potential avalanche areas, is located in a low
wildfire hazard area, and the Divisionpf Wildlife stated previously that the impacts on wildlife could be
mitigated. The conditions of approval included in Resolution No. 94-127 are consistent with the current
provisions of the Code with respect to 1041 hazards.
COMPLIANCE Wrrx CONDITIONS of APPROVAL:. The applicant recorded an amended site plan, as
required by Resolution No. 94-127. The other conditions are not applicable until building permit
submittal or issuance.
Condition No. 19 required the applicant to pay a cash-in-lieu fee at building permit application to
mitigate for one category 1 employee. This condition was amended in 1995 by the Board pursuant to

Resolution No. 95-142, in which the Board granted approval for the applicant to purchase and deed
restrict an existing unit in Aspen for resale to a qualified resident under the category 3 guidelines, rather
than paying the cash-in-lieu fee. The deed restriction for Unit 1, Winfield Arms, was recorded on
September 9, 1995, in Book 794 at Page 747, and'a document verifying that the applicant had satisfied
the in-lieu payment through buy-down of the existing unit was recorded on December 6, 1995, at
Reception No. 387898.
Condition No. 15 requires the applicant to provide energy conservation features to result in a net savings
of at least 10% above County standards, and then provides specifications for those savings, which were
-based on the standards in effect at the time. Anew Model Energy Code has since been adopted by the
County, and staff recommends that the condition be amended to require the applicant to exceed by at
least 10% the County standards in effect at the time of building permit issuance.
RECOMMENDATION: Pursuant to Section 4-140-30, staff recommends that the Board approve the
Payne Extension of Vested Rights, subjectto compliance with the conditions in the attached Resolution
and the conditions of approval as noted in Board of County Commissioners Resolution No. 94-127,
except as amended.

1. APPLICANT has submitted to COUNTY an application for

2. APPLICANT undezstands and agrees that Pitkin ~ounty Resolution
No. 96-52 establishes a fee structure for Planning applications aztd the payment of
all processing fees is a condition precedent to a determination of .application
completeness.
3. APPLICANT and COUNTY agree that because of the size, nature or
scope of the proposed project, it is not possible at this time to ascertain the full
extent of the costs involved in processing the application. ~1PPS,ICANT and
COUNTY further agree that it is in the interest of the parties to all APPLICANT to
make payment of an initial deposit and to thereafter permit additional coststo be
billed to APPLICANT on a monthly basis. APPLICANT agrees he will be
benefited by retaining greater cash liquidity and will make additional payments
upon notification by the COUNTY when they are necessary as costs are incurred.

full costs to process APPLICANT's application.
4. COUIv'TY and APPLICANT further agree that it is~ impracticable for
COI7NTY staff to complete processing or present sufficient information to the
Planning Commission and/or Board of County Commissioners to enable the
Planning Commission and/or Boazd o£ County Commissioners to make legally
required findings for project approval, unless current billings aze paid in full prior
to decision.

application completeness, APPLICANT shall pay an initial deposit in the amount

NOTICE IS HEREBY GIVEN that a public hearing will be held on Wednesday, July
23, 1997 at a regular meeting to begin at 3 i00 PM before the Board of County
Commissioners, Plaza One Conference Room, 530 E. Main St., Aspen to consider an
application submitted by Tom Payne requesting an extension of a vested righf established
after approval of a 1041 Hazard Review by the Planning and Zoning Commission in 1991
and extended by the Board of County Comrissioners in 1994. -The property is located
