The use and occupancy of the barn-shall henceforth be limited to shelter or enclose livestock, horses, poultry, feed or field equipment, or to grow trees, shrubs, flowers or vegetable plants. 2. Representatives of the County shall be entitled to enter upon the Property, at reasonable times and upon at least 48 hours' advance notice to the Owner of the Property, or the Owner's representative, in order to inspect the Barn for the sole purpose of determining compliance with the terms and conditions of this Agreement. 3. If the Barn or any portion of the Barn is not utilized in a manner consistent with the foregoing, the area must be either removed or restored to an appropriate agricultural use pursuant to direction from Pitkin County. 4. This Agreement shall constitute a covenant running with the Property as a burden thereon for the benefit thereof, and shall be specifically enforceable by, the County, and its successor, by any appropriate action, legal or equitable. 5. Lauren Graves ("Applicant") has applied to the Pitkin County Boazd of County Commissioners ("BOCC'~ to consider a Reinstatement of Vested Real Property Rights pursuant to Section 4-140.30 of the Land Use Code: 2. The property is referred to as Lot 8 of West Sopris Creek Subdivision and is more specifically described in attachment A. 3. The property is caned RS-30 and contains 35.4 acres. 4. The BOCC heard this application ata duly noticed public hearing on September 27, 2000, at which time evidence and testimony were presented with respect to this application. 5. The BOCC determined that the proposed development does not meet the criteria established in Section 3-80-050 of the Land Use Code.. R ~ 6. If building permits aze not obtained within 30 days, the Applicant shall remove all illegal structures on the property by May 1, 2000. If any structure on the property is occupied prior to issuance of a building permit, this approval is retroactively null and void. 13. Applicant is requesting a Reinstatement of Vested Rights for a period of three years pursuant to Section 4-14030 of the Land Use .Code fora 1041 Hazard Review approved in 1995 pursuant toResolution No. 95-.179. The property was previously denied 1041 Hazard Review approval pursuant to Resolution No. 95-168. The decision was rescinded upon an appeal and a filing for a Takings Determination Hearing by the Applicant. APPLICANT: Lauren Graves LOCATION: The property is described as Lots 3 and 8 of West Sopris Ranch Subdivision. ZONING/LOT SIZE: The properties are zoned RS-30 PUD and contain 35.14 acres and 35.4 acres respectively. REFERRAL COMMENTS: Comments from the County Zoning Officer, Wildlife Biologist, Colorado State Forest Service, and Geologic consultant are attached for reference. Comments were not received from the West Sopris Homeowner's Association. BACKGROUND/EXISTING CONDITIONS: The properties were initially denied 1041 Hazard Review approval pursuant to Resolution No. 95-168 due to concerns regarding "the life and safety of residents and emergency response personnel." The Applicant appealed the decision and was granted1041Hazard Review approval by theBOCC on October 11,1995, pursuant to Resolution 95-179, The Applicant is proposing a new building envelope on Lot 3 to which an access easement will be provided by adjacent property owners. Vested rights for these properties expired on October 11, 1998. Lot 3 • Jonathan Lowsky, the Pitkin County Wildlife Biologist, indicated that the property lies within 0.75 miles of active. mule. deer severe winter range and critical habitat. The property is also mapped for elk winter range and is adjacent to elk critical habitat, winter concentration, and severe winter range areas. Mr. Lowsky mentioned that black bears inhibif the area and ~'",~ . there is a history of human/bear conflicts. in the vicinity. Conditions are included in the attached resolution to minimize impacts to wildlife on the property. • Vince Urbina of the Colorado State Forest Service visited Lot 3 on July 5, 2000 and rated the wildfire hazard within the proposed building envelope as "a little above medium." He indicated that the wildfire danger would be lowered to a medium rating upon undertaking mitigation within the building envelope pursuant. to the conditions in the attached resolution. • Bruce Collins, a private Consulting Geologist, compiled a report and indicated that the newly proposed building envelope on Lot 3 is better located with regard to avoiding geologic hazards and the access avoids slopes in excess of 30 percent (as opposed to the access to the previously approved building envelope). He emphasized the importance of constructing _. proper foundation drainage on the lot due to the presence of Mancos Shale. • Joanna Schaffner, the Pitkin County Zoning Officer, submitted comments and raised concerns regarding non-compliance with the 90 degree emergency access requirements to the property. She suggested that the Applicant submit a driveway plan including topography for review. Lot 8 • Upon the initial review, Kevin Wright of the Division of Wildlife gave recommendations to minimize the impacts on wildlife on the property, which were included as conditions of approval in Resolution No. 95-179. Jonathan Lowsky, Pitkin County Wildlife Biologist indicated the property's proximity to mule deer severe winter range and critical habitat. Lof 8 is mapped for elk winter range and is adjacent to elk critical habitat, winter concentration, and severe winter range areas and is inhabited by black bear. • Kelly Rogers of the Colorado State Forest Service had visited Lot 8 pursuant to the original 1041 Hazard Review in 1995, at which time he rated the wildfire hazard as severe due to the presence of oakbrush and serviceberry on the property. He indicated that the building envelope on Lot 8 was placed in the best possible areaYo minimize wildfire hazardas the driveway may act as a fuelbreak. • Initial reports indicated no significant geologic hazard in regard to development on the property. Bruce Collins, a private Consulting Geologist emphasized the importance. of constructing proper foundation drainage on the lot due to the presence of Mancos Shale. • The Applicant has erected two temporary structures on the property that have not received approval from the Building Department • The original 104 f Hazard Review approval pursuant to Resolution No. 95-179, condition No. 141imited principle structures on the property to 5,000 square feet of floor area. The Applicant is requesting that Lot 8 be allowed 6,000 square feet of living space, an exemption of 3,000 square feet ofnon-livable basement space and 750 feet of garage space, as some improvements, including a well and septic system, have been been installed on the property to accommodate that level of development. Staff does not support this request. ANALYSIS OF PROPOSAL EXTENSION of VESTED RIGHTS: The following is a review and analysis of the proposal relative to the applicable standards of Section 4-140.30 of the Land Use Code. In reviewing a request for the reinstatement of vested property rights, the Board shall consider, but not be limited to, the following criteria: 1. The applicant's compliance with any conditions requiring performance prior to the date of application for extension or reinstatement of vested rights. Response: There were no conditions included as part of the initial 1041 Hazard Review approval which required performance prior to the date of application for extension of vested rights. 2. The progress made in pursuing the project to date, including the effort to obtain any other permits, such as building permits, and the expenditures mdde by the applicant in pursuing the project. Response: There have been no efforts made to obtain building permits pursuant to the original approval. 3. The nature and extent pf any benefits already received by the County as a result of projecf approval, such as impact fees or land dedications. Response: There have been no benefits received by the County such as impact fees or land dedications. There were no land dedications required. 4. The needs of the County and the applicant that would be served by approval of the extension or reinstatement:request. Response: The needs of the Applicant would be served by an extended time frame for development. The needs of the County would be served by applying current standards of the Code, including those adopted pursuant to Ordinance No. 23-2000. S. An extension or reinstatement may be in the form of a development agreement duly authorized and executed by the applicant and the County. Reasonable conditions may be imposed by the Board when granting any such extension or reinstatement. Response: The applicant agrees Yo comply with reasonable conditions imposed by the County. RECOMMENDATION: Staff recommends that the BOCC adopt the following motion, "to approve the Graves Reinstatement of Vested Rights for Lot 3, West Sopris mountain Ranch, with modifications to the building envelope and access easement fora period of three years, subject to compliance with current zoning regulations and calculations and with the conditions of the attached Resolution." Residential development shall be clustered outside of habitat areas to the maximum extent possible to m;n;m;~e impacts on wildlife as per Section 3-80.080(A) (2) of the Pitkin County Land Use Code. 2. This lot had gone through a 1041 review ih 1995 for a different building envelope site than the oriel visited on June 28t". In 1995 Kelly Rogers of the Colorado State Forest Service had Noted that the former building site was rated as a X: Severe Hazard -Brush. 1 would concur with that assessment. The. new building envelope has a lower hazard rating and much better access. Access to the new building site wilt be from Skookum Road. The driveway was flagged in to the envelope. Slopes are not prohibitive and vegetation is predominantly grass; sage,' snowberry and antelope bitterbrush: I recommend that the driveway originate at a right angle to Skookum Road. This right angle orientation facilitates emergehcy vehicle access. The aspect of the building envelope is east with a slope of 12-15%. The vegetation is sage, snowberry, ahtelope bitterbrush and grass. There are scattered serviceberry and Gambel oak plants. throughout the building envelope. !would .rate the wildfire hazard as medium to severe. The presence of scattered !iak/serviceberry raises the hazarda little above medium. If these oak/serviceberry plants were not in the envelope the wildfire' hazard would definitely be rated as medium. Following the mitigation recommendations described below will definitely lower the existing wildfire hazard. There is a spot east of the envelope where the slopes become significantly steeper: The fuels here are all severe. I talked with Lauren about positioning'any structure as far away from this drop as possible (i:e.; at least 75 feet): Tht= objective here is to avoid any radiant and/or convective heat that could ignite a structure coming from any wildfire burning on this slope. My other wildfire mitigation recommendations are as follows. 1) For a distance of 10-15 feet around all structures establish and maintain vegetation at 6 inches or less. This can accomplished by mowing grass, planting low growing perennials or putting in a hardscape (e.g., rock mulch, sidewalk, pavers). Woody vegetation should not be planted within thisperimeter. In addition, flammable material (e.g:, firewood) should not be stored here. Y '~ Page 2 -Graves 2) For a distance of 70 feet uphill and to the sides, and 100 feet downhill thin existing shrub vegetation to break up the vertical and horizontal continuity of fuels, which helps create a defensible space around. all structures.. The spacing parameters are as follows. If the height of the shrubs are 10 feet then the maximum diameter of clumps allowed to remain is 2 times the height or 20 feet. The spacing between clumps where woody vegetation has been removed is 3 times the height or 30 feet. The vegetation between these clumps should ideally be grass. 3) The lower limbs of all shrubs fhaf remain within the perimeter should be removed up to half the total height of plants to eliminate ladder fuels. For example, if the shrubs are 10 feet tall then the lower limbs should be removed up to a height of 5 feet. 4) All deadfall within 100 feet of structures should be removed As I stated above the existing implementing the thinning and spacing recommendations can lower the wildfire hazard. Geologic conditions. have not changed and except as may specifically relate to the new envelope and access l have little to add to the original report, Lots 3 and 4 will come under common otivnership, and the proposed envelope at the junction of these three lots, as well as access to it, are better located with regard to avoiding geologic hazards than the previouslyapproved site. Topographically the center of the new envelope is located approximately 725 ft southwest. and 200 ft in elevation above the old, `in the southwest corner of Lot 3. Access will be from an existing road in the northern. part of 4ot 4. The new envelope is on an essentiallyfiat bench above the slope on which the previous envelope was located. The new access road crosses slopes that average 20~ or less, as opposed to 30~ segments along the previously-approved route. White it would be beneficial to lay out the access with proper instruments to assure minimum grades, engineering beyond that necessary for eny roadway constructed on Mancas Shale should not be necessary. AS noted in the 1994 report, bedrock under the property consists ofthe lower portion of the Upper Cretaceous Mancos Shale, which dips'northwest into the hillside at about 1S°, with the Lower Cretaceous Dakota Sandstone underlying the valley fluor. Significant faulting has been projected in the area, both north and southeast of the. property. The Mancos frequently contains swelling ("bentonitic") clay which ran seriously damage foundations. Saturation of the Mancos can iead to slumping and landsliding, although the shallow dip into the hillside mitigates against this possibility in the area ofinterest here. In addition, the impendous nature ofthe rock leads to rapid runoffn response to SnowmeIt and heavy rain, so drainage on and around the envelope and along the access road should designed with the entire drainage area above the property in mind. Welts in the area generally contain acceptable water supplies at depths between 200 and 400 feet. As you are aware; water originating from the Mancos Shale can be brackish and odoriferous, and as a matter of personal taste may require modest treatment. Conditions regarding waste disposal on the new envelope should not differ significantly from the oid. As noted in the 1994 report areas ofnear-surface bedrock may exist but there is no suggestion of a high ground-water table in the area. Inhabited structures should lie constructed in such a manner as to prevent the accumulation of radon gas. Neither the proposed envelope or the access route to it are exposed to observed rorkfah, debris flow, or snow avalanche hazards, and there is no indication of natural or man-made subsidence in the area. The importance of proper foundation drainage in areas of Mancos Shale construction cannot be overemphasized. At the time that both parcels were granted approval to build asingle-family residence (October 11, 1995), I did not understand that I had an,access easement to a more appropriate building envelope on Lot 3. Had I known that there is, in fact, adequate access to the more appropriate site, I would have requested this building site at that time. Therefore, I am requesting an amendment to modify the location of the access and building envelope for Lot 3. Please find enclosed additional notes, and letters ,from appropriate agencies documenting that the newly requested site is more appropriate. Furthermore, at the time of the previous approval, there was a request by county planning staff to limit the house size to 5,000 square feet of living space. I agreed, because at that time, square footage measurements did not include up to a 4,000 square foot basement and a 750 square foot garage. During the course of a two year period, not only did I bring electricity to Lot 8, provide access (by county standard) to that property and drill the well, but I also, at great expense, installed a septic system which can service up to a 4 bedroom/6,000 square foot house, According to the Environmental Health Department, their measurements do not include non-livable_basement space or garage space. I respectfully request a compromise in order to accommodate the, improvements I have made thus far, in good faith according to my previous conditions of approval. My request is to be allowed, on Lot 8, up to 6,000 squaze feet of living space, and an exemption'of up to 3,000 square feet ofnon-livable basement space and 750 squaze feet of garage space. He stated that this building envelope is better than the previously approved site, as this one narrows the area of disturbance because of it's close proximity to the subdivision road. and because it is relatively clustered with other residences. Lots 3 and 4 will come under common ownership, and the proposed envelopeat the junction of these three lots, as well as access to it, are better located with regard to avoiding geologic haaards than the previouslyapproved site. Topographically the center of the newenvelope is located approximately 725 R southwest and ZOO ft in elevation above`the old; in the southwest corner of Lot 3. Access will be from an existing road in the northern part of Lot 4. The new envelope is on an essentiallyElat bench above the slope on which the previous envelope was located. The new access road crosses slopes that average 20~ or less, as'opposed do 30`~ segments along the previously-approved route. While it would be beneficial to lay out the access with proper instruments to assure minimum grades, engineeringbeyond that necessary for any roadway constructed on Marcos Shale should rat be necessary. As noted in the 1994 report, bedrock under the property consists of the lower portion of the Upper Cretaceous Marcos Shale, which'dips northwest into the hillside at about t 5°, with the Lower Cretaceous Dakota Sandstone underlying the valley floor. In addition, the impenaous nature ofthe rock [ends to rapid runoffin response to snotvmelt and heaty rain, so drainage on and around the envelope and along the access road should designed with the entire drainage area above the property in mind. Wells in the area generally contain acceptable water supplies at depths. between 200 and 400 feet. As you are aware, water originating from the Mancos Shale can be brackish and odoriferous, and as a matter of personal taste may require modest treatment, !t is possible that significantly higher-quality waxer could be obtained from greater depths, perhaps around 600 feet, by drilling into the Dakota Sandstone, although this cannot be guaranteed. Conditions regarding waste disposal on the new envelope should not differ'signific5ntly from the old. As noted 'tn the 1994 report areas ofnear-surface bedrock may exist but there s no suggestion of a high groundwater table in the area... Inhabited structures should be constructed in such a manner as to prevent the accumulation of radon gas. Neither the proposed envelope or the access route to it are exposed to observed rockfall, debris fiow, or snow avalanche hazards, and there is no indication of natural or man-made subsidence in the area:' The importance of proper foundation drainage in areas of Mancos Shale construction cannot be overemphasized. When I receive a referral from the county I will defer to the comments contained in this letter. I visited the property (i.e., Lot #3} with the owner Lauren Graves on June 28th. This lot had gone through a 1041 review in 1995 for a different building envelope site-than the one l visited on June 28th. In 1995. Kelly Rogers of the Colorado State Forest Service had noted that the former building site was rated as a X: Severe Hazard -Brush. I would concur with that assessment. The new building envelope has slower hazart~ rating'and much better access. Access to the new building site will be from Skookum Road:. The driveway was flagged in to the envelope. Slopes are not prohibitive and vegetation is predominantly grass, sage, snowberry and antelope bitterbrush: I recommend that the driveway originate at a right angle to Skookum Road. This right angle orientation facilitates emergencyvehicle access. The aspect of the building envelope is east with a slope of 12=15%. The vegetation is sage, snowberry, antelope bitterbrush and grass. There are scattered serviceberry and Gambef oak plants. throughout the building envelope. I would rate the wildfire hazard as medium to severe. The presence of scattered oaklserviceberry raises the hazard a little above medium. If these oaklserviceberry giants were not in the envelope the wildfre hazard would definitely be rated as medium. Following the mitigation recommendations described below will definitely lower the existing wildfire hazard. There is a spot east of the envelope where the slopes become significantly steeper. The objective here is to avoid any radiant andlor convective heat that could ignite a structure coming from any wildfire burning on this slope. My other wildfire mitigation recommendations are as follows. 1 } For a distance of 10-15 feet around all structures establish and maintain vegetation at 6 inches or less. This can accomplished by mowing grass, planting low growing perennials or putting in a hardscape (e.g., rock mulch, sidewalk, pavers}: Woody vegetation should not be planted within this perimeter. The spacing between clumps where woody vegetation has been removed is 3 times the height or 30 feet. The vegetation between these clumps should ideally be grass. 3) The lower limbs of all shrubs that remaihwithiri the perimeter should be removed up to half the total height of plants to eliminate ladder fuel's.. For example, if the shrubs are 10 feet tall then the lower limbs should be removed. up to a height of 5 feet. 4) All deadfall within 100 feet of structures should be removed.
