RECITALS
I. Glen Auerbacher, hereinafter" Applicant", has applied to the Board of County
Commissioners of Pitkin County, Colorado, hereinafter "Board", for approval of 1041
Hazard and GeneralSuiJ111ission~eyi~:YJ()rth~c()n~tI'llStj()!LQf<l~ingle family residence
and an attached or detached caretaker dwelling unit.
2. The Applicant's lot is zoned RS-3Q and is approximately 2.5 acres in size.
3. Said lot is a metes and bounds parcel known as Lot II of the Nystrom Tracts on West
Sopris Creek which is described in the attached Exhibit "A".
4. The Planning and Zoning Commission reviewed this application on August 15, 1995
and found that this proposal complies with the criteria set forth ip the 'pitkin County Land
Use Code.
5. The Board heard this application at a regularly scheduled meeting on December 6,
1995, at which time evidence and testimony was presented with respect to this
application.
6. The Board determined that the proposed development meets the criteria established in
the Land Use Code.
NOW THEREFORE BE IT RESOLVED by the Board of County
Commissioners of Pitkin County, Colorado that it does hereby grant approval of the
Auerbacher lO41 Hazard ReviewGenera.I~uiJmi~~iQn, and CaretakerDwelling Unit
application subject to the following conditions:
1) The applicant shall adhere to all material representations made in the
application and in public meetings.
2) Prior to building permit application, the applicant shall record a 24" by 36"
mylar 1041 Environmental Hazard Review Site Plan ;yith theCounty Clerk and
Recorders Office. The site plan shall meet the approval of the Planning Office and
the County Attorney and shall include the follo;ying hazard warning and
disclaimer:

6) Prior to building permit issuance, the applicant shall demonstrate an adequate
supply of domestic water to the satisfactiQn of the Enyi~ontne[lti),ltIe.<l!th

7) The applicant shall provide proof of adequate quality and quantity of water
prior to issuance of a septic permit. All setback requirements shall be met in
accordance with the Pitkin County Individual Sewage Disposal System
Regulations. If an engineered system is required, it shall be approved by the
Environmental Health Department.
8) The applicant must file a fireplace/woodstove permit with .the Environmental
Health Department before a building permit will be issued. Coal may not be
burned in any device and no wood burning devices may be installed in barns or
agricultural buildings.
9) The applicant must submit plans to the Zoning Department to show compliance
with County floor area and height regulations before a lJuilding permit will be
issued.
10) The applicant shall record a Caret~ d;y~Iling unit deed restriction, pursuant
to Section 3-150.130 of the Land Use Code prior to the issuance of a building
permit.
11) The caretaker dwelling unit shall be limited to 700 square feet of livable area.

REQUEST: The applicant requests approval of a minor amendrPentt()':lgeyelopment permit to
amend the approved building envelope in order to comply with the setback requirements between
the existing well and the leach field. Th~13()a.!<i()fC()\Inty Commissioners granted approval of the
Auerbacher 1041 Hazard Review, General Submission and <:areta.Is~~ ])'Y~lling Unit on December
6, 1995, by Resolution No. 95-224 (attached). .

The applicant contacted the EnvironrPi::lltalH'?alth.Ri::partment after the Board's approval, and was
informed that the minimum setiJack ri::quirement from the well to the leach field. would have to be
increased to 125' if the leach fii::ld was proposed to accommodate a residence and a caretaker unit.

field, therefore, the applicant proposes to install separate leach fields: the leach field. for the IIlain
residence will be located in the soutl:J.e':l~t portion of the lot and the leach field for the caretaker unit
will be located in the northwest portion of the lot. However, the envelope must be extended beyond
the 1030' elevation line to the northwest in order to accommodate a separate leach field for the
