EXEMPTION TO THE DEFINITION OF A SUBDIVISION
(David & Sheila Metcalf)
WHEREAS, application has been filed for an ,
exemption to the definition of a subdivision by David and
Sheila Metcalf for a tract of land, 7.96 acres in size,
AND WHEREAS, the Planning Commission has reviewed
and duly considered the application and all statements concerning
the request, and recommends approval based on the following
specific conditions:
1. A certified boundary survey of the tract
shall be recorded in the Pitkin County Clerk
and Recorder`s Office.
2. Said tract of land shall be used for residential

purposes only and no building shall be erected,
altered, placed upon or permitted to remain thereon
other than one detached single-family dwelling and
appropriate outbuildings, except .that any and all
present residential buildings may be used for resi-
dential purposes.
3. Access to the tract shall be noted on the survey.
4. New access to the tract shall not be allowed.
5. A fee of $26 shall be paid,
NOW THEREFORE BE IT RESOLVED, that an exemption
to the definition of a subdivision, subject to the above
conditions, is hereby granted for the following described

I am sorry tb hear that you have been unable to resolve the issues
of water supply and waste water disposal related to your bandit
employee dwelling unit.
As you are aware, Board of .County Commissioners (BOCC) Resolution
92-221 state§ that`"The app'Yicant shall contact the Planning and
Zoning Department within three months of the Board approval and
demonstrate or document in whiting that adequate sewer and water
service can be provided to the bandit"unit." If adequate sew"er and
water service cannot be supplied; then the- applicant shall
immediately remove the bandit unit as prescribed by the Planning
and Zoning Department".
Planning Staff has granted two 90 day extensions to the three month
deadline imposed by the BOCC. Both 'qf these' extensions have
expired. Unfortunately, the Planning Staff is unable to grant any
,additional extensions.
If you believe that resolution of the water and sewer. issues is
eminent, you may contact Senior Planner, Tim Malloy, at 920-5090,
to request a final extension to be reviewed'by the BOCC. _
Otherwise, the bandit unit. must be removed by June 30, 1993 and
your residence must be converted into a single-family residence.
For your residence to be considered single-family, it must contain
no more than five bedrooms, and .one kitchen.
Once the bandit unit has been removed, please contact me at 92.0-
5090 to arrange for an inspection to ensure that your residence
has been converted to a single family residence.

Dear Mr. Malloy:
I have reviewed Resolution No. 92-221 from the Board of
County Commisioners of Pitkin County in regards to the
clearance on the water supply for my property. It
clearly states that T must have a letter from the
Colorado Division of Water Resources as to the adequacy
of the water supply. Because of the explicit wording in
the resolution, I did not contact Bob Nelson on this
subject.
The "Ammended Adjudacation" along with the well
agreement, the well test reports, a new well location
map, and a new owner application, was sent to the
Division on Monday with a request that I receive the
letter no later than 20 April 1993. I will be in touch
with the state office either by phone or in person on
April 8th or 9th to follow up on this matter.
All corrections as required by the electrical inspection
will be completed by Saturday, March 27th and a
reinspection will be requested next week.
The "Deed Restriction" is being filed today with the
Housing Authority.
I have asked the contractor to please try to complete
the replacement of the windows no later that April 30th
which he has agreed to do.

Note: I cannot open up the outside walls until the
weather moderates. I am in the process of
obtaining bids on this work at this time. I
estimate completion by April 3b, 1993.
Electrical work should be completed by the
end of March 1993.
The "Employee Unit Deed Restriction" is being filed with
the Pitkin County Housing Authority this week.
On the water supply, it was necessary that I obtain an
Ammended Ruling of Referee" from the Water Referee of
Water Division No. 5 and approval of The Ninth Judicial
District Court. This has been completed and approved and
I am now sending the necessary paperwork to State
Engineer at the Division of Water Resources in Denver. I
do not know how long it will take to obtain a letter as
to the adequacy of water is obtained.
I regret the further delays in accomplishing this
project and hope that the above plan will meet your
approval.

Re: Metcalf exemption
Dear Herb;
I have another suggestion concerning this recommended
exemption relating to the condition concerning a limitation
for existing uses only. The protective covenants of record
in Book 258 at page 629, a copy of which was included with
our letter of July 10, already contain some language which
it might be appropriate to include in hole or in part in
the language of your proposed condition. This language
appears in Sec. 2, which reads as follows;
"That said tract of land shall be used for residential
purposes only and no building shall be erected, altered,
placed upon or permitted to remain thereon other than
one detached single-family dwelling and appropriate

Re: Metcalf exemption
Dear Herb:
Please don't consider me a meddlesome practitioner,
but since the new law and the exemption provisions are
both still in the trial and error stages, I felt it in
order to make the following suggestion concerning the
captioned exemption, voted to be recommended to the
Commissioners at the July 19 meeting at the County Planning
& Zoning Commission. It would also apply, of course, to
any similar future exemptions.
As you know, we are actually operating under two laws,
the state statute (S.B. 35) and the Pitkin County Subdivision
Regulations, which contain different definition language,
etc. However, each authorizes the Commissioners to exempt
certain divisions of land from its specific definition of
subdivision. See C.R.S. 106-2-33(3)(d) and Pitkin County
Subdivision Regulations §1.4 B. Accordingly, should not the
Resolution in such cases state that the Commissioners are
exempting the division of land in question "from the definition
of the terms 'subdivision` and'subdivided land' as such defin-
ition appears in Colorado Revised Statutes Sec. 106-2-33, as
amended, and as such definition appears in Sec. 1.4 of the
Pitkin Cody Subdivision Regulations" or words to this effect?

Otherwise, title companies and others may raise the question
whether obtaining an exemption under one law still leaves
the division in question subject to the other,

f review the language of the Commissioner's Resolution, once
passed, before it goes of record with the survey plat showing
the 8 acre tract being exempted. I am thinking, of course,
of title questions such as the above which might be raised.

Gentlemen:
As you know, Section 1.4 B of the new Pitkin County Subdiv-
ision Regulations, in accordance with the new Colorado Subdivision '
law, authorizes the Board of County Commissioners to exempt from
these Regulations any division of land. not within the purposes of
Article I:
"The Board of County Commissioners may, pursuant
to rules and regulations or resolution, exempt
from this definition of the terms "subdivision"
and "subdivided land," as defined in this Subsection
A., any division of land if the Board of County
Commissioners determines that such division is not
within the purposes of this Article. The Board of
County Commissioners shall submit to the Colorado
Land Use Commission a monthly report of each
exemption granted pursuant to this Subsection B."

On behalf of our client, Mrs. David R. Metcalf, the
former Sheila Horan, we wish to request a Resolution under
this Section exempting from the definition of "subdivision",
and from these Regulations, the following described proposed
transfer of land:
Sheila Horan Metcalf is the owner of the 41.697 acres,
more or less, of land in Pitkin County, Colorado, depicted
on the Trico Management, Inc. survey plat attached hereto as
Exhibit "A".
Mrs, Metcalf wishes to sell the approximately 8 acres
shown on this survey plat as "Area of Proposed Sale", and
retain the balance of said 41.697 acres without further division.
All existing improvements on this tract are on the approximately
8 acres to be sold, and the Metcalfs plan to build a new home on
the balance of the 41.697 acres which they will retain. .25 c.f.s.
of Mrs. Metcalfs .45 c.f.s, water right in the Manning Ditch will
accompany the conveyance of this 8 acres, a1d there is also a
registered domestic well on this tract.
At the time of the only previous sale of acreage by Mrs.
Metcalf (5.010 acres conveyed to Abol Bakhtiar et al by Warranty
Deed dated October 15, 1971, and recorded Novem~er~0, 1971, in
Book 259 at page 696, copy attached hereto as Exhibit "B^),
Restrictive Covenants were imposed on 31.392 acres of this land,
including the 5.010 acre parcel sold and the 8 acre parcel which
Mrs. Metcalf now wishes to sell. See the document recorded in
Book 258 at page 629, copy attached as Exhibit "C". This means
that the two parcels being sold off (5.010 acres sold to Bakhtiar,
and the 8 acre parcel which Mrs. Metcalf now wishes to sell)
cannot be resubdivided under Restrictive Covenant No. 1 of these
ovenants which reads as. follows:
"1. That no tract shall be re-subdivided into, nor
shall any dwelling be erected or placed on an area
of less than five acres and no tract shall be re-
subdivided unless each of the subdivided tracts shall
contain at least five acres."
As indicated above, the Metcalfs intend to keep the
balance of the 41,697 acre tract as one tract for the foreseeable

future and would, of course, be subject to (a) the requirements
of the Pitkin County Subdivision Regulations should they ever
change their minds about this, as well as (b) the requirements
of the Restrictive Covenants mentioned.
We believe that this request for exempting this 8 acre
transfer from the requirements of the Pitkin County Subdivision
Regulations is in order, and that the requested division "is
not within the purposes of this Article", to quote the above-
mentioned §1.4 B.
If any additional information is needed concerning this
request, please contact the undersigned. As Dr. and Mrs. Metcalf
are anxious to proceed with the sale of the 8-acre tract mentioned,
your early consideration of this request would be appreciated.
