The Applicant wishes to construct a single-family home with accessory structures on their property. LOCATION: 0214 West Sopris Creek Road; Tract 73 of the Nystrom Tracts. SITE DATA: The parcel is approximately 2 acres in size and is located in an existing rural residential area. The building envelope is located in the middle of the lot ahd will be accessed by a driveway off of West Sopris Creek Road. The building footprint indicated on the submitted site plan is approximately 900 square feet in size, not including a large deck attached to the proposed structure. 1041 Hazard Issues The subject parcel lies within mapped mule deer winter range and is adjacent to elk winter concentration areas. FINDINGS: The Division of Wildlife has reviewed. this application and has determined that the development represented in this application will not create additional impacts upon wildlife habitat. The DoW has indicated that the project site is, in effect, no longer within the mule deer winter range due to the existing residential development in the surrounding area. Randy Cote designated the irrigation ditch to the north of West Sopris Creek Road as the line which reflects the extent of mule deer winter range in this area. The Environmental Health Department has reviewed this application and will require. the Applicant to obtain a well permit prior to the issuance of a building permit. Lee Cassin has indicated that the septic system permit shows only two bedrooms and would like assurance that the. accessory building(s) do not contain water fixtures or bedrooms, as this would require enlargement of the septic system. The Environmental Health Department also has stipulated that woodstoves and fireplaces be allowed. only in the primary residential structure and are not to be allowed in any r, accessory structure(s). The 'Department has not received any information regarding special energy-conserving designs or construction methods, or other improvements to reduce air pollution from the proposed development and would request that the Applicant provide said information as a condition of approval.(memo attached for reference) The County Engineer has reviewed this application and has no concerns regarding this. application. The Zoning Office has reviewed this application and in discussions with Joanna Schaffner it was discovered that a building permit was not issued for the "existing .shed" and further research regarding the current use of said structure may be prudent. STAFF COMMENTS: The Applicant stated in their request that they intend to build a'sngle-family residence and accessory structures, while on the submitted site plan the only other structure is labeled "existing shed". The Applicant did not offer any information as to the use of the proposed accessory structures. The wood .deck connected to the structure labeled "shed" also .raised questions as to the current and future use of these outbuildings. Upon a site inspection it was discovered that the "existing shed" in question has been used for human occupancy in the recent past, albeit current habitation seemed unlikely due to the boarded-up nature of the structure and the growth of weeds through the deck. The above referenced building is a single-storied, wood-framed structure that is approximately 150 square feet in size. RECOMMENDATIONS: Section 5-400.5 (b) of the Land Use Code provides the authority for the Planning 'Director to approve a site plan and application for a Minor 1041 Hazard Review. Staff is recommending approval of the Feeney Minor 1041 Hazard Review subject to the conditions listed below. If you agree 'with the Staff's recommendation,. please sign this memo, which will serve as a reference document authorizing approval of said application. Planning Director's sign-off on a 1041 Review Site Plan is also necessary for completion of the administrative review process. The Site Plan shall be recorded in the Clerk and Recorder's office. A copy shall be placed in the file. Conditions of Approval: 1. The Applicant shall .submit a 24" X 36" Minor 1041 Hazard Review plat map for recordation. The Minor 1041 plat shall also include the following passage: WARNING and DISCLAIM~'R: " The provisions of these regulations do not in any way assure or imply that areas outside of designated hazard areas will be free of hazards, or that approved mitigation measures will guarantee the safety of any property" 2. Prior to recording, the Applicant shall amend the site plan to include the following: a) All conditions of approval as identified in this memo shall be added to the plat. b) The plat shall be modified to include a vicinity map indicating the parcel in relation to SH 82, the primary County Roads, West Sopris Creek and the irrigation ditch to the north. c) The plat shall depict the building envelope. d) The proposed access drive shall be included on the plat. 3. No development, except for access and extension of utilities shall occur outside of the building envelope. 4. All material representations made by the Applicant shall be adhered to. 5. The Applicant must ensure in writing to the Environmental Health Department and the Planning Office, that the existing accessory structure does not contain any water fixtures or bedrooms, prior to the issuance of a building permit. 6. Fireplaces and woodstoves are only permitted in the main residential structure. 7. Dogs shall be restrained by leash or a kenneling facility. The Applicant shall be required to construct a kennel if dogs are kept on the, property. 8. The Applicant shall provide documentation of a well permit to the Environmental Health Department prior to the issuance of a building permit. ATTACHMENTS: 1. SEWAGE TREATMENT AND COLLECTION: Sections 2-7 and 5-200: The owners have. applied for a septic system permit. However, their permit shows only two bedrooms. We would like to .ensure that none of the accessory buildings contain water fixtures or bedrooms. If at any time in the future, such buildings were remodeled to contain bedrooms or water fixtures, the septic .system world have to` be enlarged. AIR QUALITY: Sections_2-17 and 5-106: Only that development is permitted which will not contribute significantly to degradation of air quality in Pitkin County. This project is not expected to contribute significantly to air quality degradation. Fireplaces and woodstoves are not allowed in accessory structures, although they are allowed in the main residential structure. A report on air quality impact is required to address air quality characteristics of the site and the proposal. This includes addressing compatibility of the project with potential or existing alternatives to automobile traffic and• any 'special design or construction methods or improvements which would reduce the impacts of pollutants produced by the proposed development. This office has not received information about any special energy-conserving designs or construction methods, or other improvement to reduce pollution from the proposed development.
