COLORADO, GRANTING EXTENSION OF VESTED REAL PROPERTY RIGHTS FOR
RICHARD FILIPPINI FOR LOT 1 SOPRIS MOUNTAIN RANCH
Resolution No. 98-5$
1. Richard Filippini, hereafter "Applicant", has applied to the Pitkin County Board of County
Commissioners, hereafter "Board", to consider an extension of vested real property rights for Lot 1
of the Sopris Mountain Ranch, pursuant to Section 4-140.30 of the Land Use Code.
2. The property received a Major 1041 Hazard Review approval in 1995 and was recorded in Book 36,
Page 47 (Bean 1041).
3. The property is legally known as Lot I, Sopris Mountain Ranch and more specifically described in
Exhibit A.
4. The Board heard this application at its regularly scheduled meeting on March 25, 1998, at which time
evidence and testimony were presented with respect to the application.
5. The Board determined that the proposed development meets the criteria established in Section 4-14030
of the Land Use Code, and therefore found the extension to be appropriate:
NOW, THEREFORE BE IT RESOLVED by the Pitkin County Board of County Commissioners
that it does hereby grant an extension to the vested property rights until March 25, 2001, for Lot 1 of the
Sopris Mountain Ranch subject tothe following conditions:
The c: editions of this resolution replace all conditions of approval est dished in BOCC
Resolution 95-7 (Bean 1041).
2. The Applicant shall implement the following measures to mitigate impacts to wildlife:
A. There shall be a one dog limit with a kemtel restriction. The kennel shall be constructed
before a certificate of occupancy is issued. Any dog owned by construction workers or
materials delivery personnel shall be restrained on-site. 'k
B. Wire fencing shall employ a three strand barbed or smooth wire fence with a 42 inch
maximum height above groundlevel and at least 12 inches between the top two strands.
Wood rail fencing shall employ three rails or less, be the round or split rail type, shall not '`
exceed 48 inches in height above ground level and 12 inches in widfh (top'view), arid shall t~
have at least 18 inches between 2 of the rails.
C. All garbage shall be kept within bear-proof garbage containers. The DOW can supply ;;
specifications upon request.
D. Native vegetation outside the building envelope shall be maintained to the extent possible ~`
given wildfire mitigation requirements.

3. The Applicant shall comply with the following landscaping and wildfire defensible space
mitigation standards:
A. Brush, debris, and non-ornamental vegetation shall be removed within a minimum 10 foot
perimeter around the structure.
B. Vegetation shall be reduced to break up the vertical and horizontal continuity of the fuels a
minimum of a 30 foot perimeter aoound a structure built on flat ground.
C. Spacing between clumps of brush and vegetation within the 30 foot perimeters shall be a
minimum of two times the height of the fuel. Maximum diameter of the clumps shall be two
times the height of the fuel. All measurements shall be from the edges of the crowns of the
fuel
D. All branches from trees and brush within the 30 foot perimeter shall be pruned to a height of
10 feet above the ground and removal of ladder fuels from around trees and brush.
E. Tree crown separation within the 30 foot perimeter shall have a minimum of 10 feet between
the edges of the crowns. This does not apply to mature stands of Aspen trees where the
,above recommendation for removal of ladder fuels have been compiled with. In areas of
aspen regeneration, the spacing guidelines shall be followed.
F. All branches which extend over the roof eaves shall be trimmed and all branches within I S
feet of the chimneys shall be removed.
G. The density of fuel within a 100 foot perimeter of the structures shall be reduced where
natural reduction has not already occurred.
H. All deadfall within the 100 foot perimeter shall be removed.
I. The Applicant shall be responsible for the continued maintenance of the defensible space
vegetation requirements.
4. The Applicant shall comply with the following additional wildfire mitigation standards:
A. Roof construction shall be Class A, non-combustible material with no flat roofs.
B. Vents shall be screened with corrosive resistant wire mesh with mesh 1/4 inch maximum.
C. Roofs and gutters shall be kept cleaz of debris.
D. Yazds shall be kept clear of all litter, slash, a~ d flammable debris.
E. All flammable materials shall be stored on a parallel contour a minimum of 15 feet away
from any structure.
F. Weeds and grasses within the 10 foot perimeter shall be maintained to a heighfnot more than
6 inches.
G. Firewood/wood piles shall be stacked on a parallel contour a minimum of 15 feet away from
the structure.
H. Swimming pools shall be accessible to Fire Department vehicles.
I. Fences shall be kept clear of brush and debris.
J. Wood fences shall not connect to the structure.
K. Any outbuildings or additional structures shall adhere to the same standards as structures.
L. Fuel tanks shall be installed underground with an approved container.
M. Propane tanks shall be installed according to NFPA 48 standazds and on a contour away
from the structure with defensible space vegetation mitigation around any above-ground
tank. Any wood enclosure aoound the tank shall be constructed with materials approved for
2 hour fire-resistive construction on the exterior side of the wails.
N. Each structure shall have a minimum of one 10 pound ABC fire extinguisher.

O. Addresses shall be clearly marked with 2 inch non-combustible letters and shall be visible
and installed on anon-combustible post.
P. The driveway shall be designed to comply with county standards.
Q. All utility extension shall be buried within the driveway alignment.
R. Prior to the issuance of the Certificate of Occupancy, the Applicant shall install an
underground water storage tank to accommodate a minimum of 1,000 gallons. Capacity and
location shall be determined and approved by the Basalt District Fire Marshall
S. Any additional proposed buildings within the building envelopes shalCincorporate wildfire
mitigation measures.
5. The Applicant shall apply for and receive an access permit from the County Engineer prior to the
issuance of any building permits.
6. No development, including grading, well, landscaping (including berming), vegetation removal
or disturbance and sewage disposal system shall occur outside of the designated building
envelope, except for utility and driveway extension and maintenance, and as may be necessary to
implement the wildfire mitigation measures required elsewhere in this document.
7. The building site shall be revegetated with native grasses to limit water consumption and
additional runoff, immediately following project completion.
8. Prior to the submittal of a building permit application, the Applicant shall obtain a septic permit
from the Environmental Health Department. All sewage disposal systems must be designed by a
registered professional engineer. The engineered design system shall be submitted with the septic
permit application, appropriate Yee, and a completed Soil Data Form including percolation test
results and profile hole information,. building floor plans, and proof of adequate water quantity and
quality. The site plan and sewage disposal system shall comply with the requirements addressed in
the Environmental Health Department letter's dated January 8, 1998.
9. Prior to the issuance of a building permit, the Applicant shall provide documentation of an
adequate domestic water supply. Quantity and quality of said supply shall meet the approval of
the Environmental Health Departme~ t.
10. The Applicant shall obtain afireplace/woodstove permit from the Environmental Health
Department, prior to the issuance of a building permit.
11. Outside illumination shall comply with County lighting standards.
12. The principal structure shall be limited to 10,000 square feet of floor area.
13. The applicant shall adhere to all material representations made in the application and public
meetings.
14. For any free market residential structure of 5,000 gross square feet or greater, the applicant is
required to provide the following traffic studies:
A. Prior to application for building permit the applicant shall provide for review and approval of
the County Engineer a construction trip generation study.

SUMMARY OF REQLIF'ST: Pursuant to Section 4-140.30 of the Land Use Code, the. applicant is
requesting an Extension of Vested Rights fora 1041 Hazard Review and Genera_1 Submission approved
on November 23, 1995 (Resolution` 95-7) to construct a single family 'residence.
PROCEDURF/PRO E C• An Extension of Vested Rights is a one-step review before the Board of
County Commissioners.
BACKGRO 11VD/FXiCTTNC f~ntynrmrnxrc pursuant to Resolution 95-7, the Board of County
Commissioners granted a 1041 Hazard Review and General Submission for Lot 1 (Bean 1041). The
1041 Hazard Review Plat was recorded in Book 36, Page 47.
The property contains azeas mapped for wildfire (low to high), geologic (slopes of 5 to 15 percent) and
wildlife hazazds (elk and mule deer winter range and riparian habitat). The property is primazily
composed of moderate north facing slopes with a prominent "knob" located neaz the center of the paccel.
The approved building envelope is approximately 2.75 acres in size and the approved accessory building
envelope, immediately to the south of the building envelope, is approximately 2.25 acres. The building
envelope will be accessed by a 700 foot driveway through the pasture from an existing subdivision road
above the parcel. West Sopris Creek runs from west to east at the northern portion of the property. The
County right-of--way of West Sopris'Creek Road is located immediately to the northwest of the property.

The Environmental Health Department has reviewed this application and has noted that the same
comments that were written in June of 1994 apply today, with the exception that all sewage disposal
systems must be designed by a registered professional engineer. ` In addition, the well and sewage
disposal system must be located within the building envelope and may not be located in the easements.
Joanna Schnaffer, Zoning OfSeer, has reviewed this application and has suggested modifications to the
approved conditions in Resolution 95-7. These suggestions have been incorporated within the conditions
of the attached resolution.
The Division of Wildlife has reviewed the application and has noted that the conditions of the original
approval are adequate to mitigate impacts on wildlife.
The Colorado State Forest Service has reviewed the application and has also indicated that the
conditions of the original approval are adequate to mitigate impacts on wildfire.

Staff Comments: There were no conditions which required performance prior to the date of application
for extension of vested rights.
2. The progress made in pursuing the project to date, including the effort to obtain any other
permits, such as building permits,. and the expenditures made by the applicant in pursuing the
project.
Staff Comments: There have been no efforts made to obtain building permits
3. The nature and extent of any benefits already received by the County as a result of project
approval, such as impact fees or land dedications.
Staff Comments: There-have been no benefits received. by the County such as impact fees or land
dedications. There are were no land dedications required.

4. The needs of the County and the applicant that would be served by approval of the extension or
reinstatement request.
Staff Comments: The applicant's needs would be serviced as he would be allowed an extended time
frame for development.
5. An extension or reinstatement maybe in the form of a development agreement duly authorized
and executed by the applicant and the County. Reasonable conditions may be imposed by the
Board when grantir:g any such extension or reinstatement.
Staff Comments: An extension will allow for needed. updated conditions regarding wildfire and wildlife
mitigation measures.

The Aspen/Pitkin Environmental Health Department has reviewed the details of the application under the
authority of the Pitkin Cduntv Land Use Code and has the' following comments:
The same comments apply today that were written in Environmental Health's comments (dated June 22, 1994)
for the previous approval, with the exception that all sewage disposal systems must be designed by a
Registered Professional Engineer as of January 1st, 1998. The engineered design must be submitted along
with the septic permit application and appropriate fee with'a completed Soil Data'Form mcludin ~ #'
g percolation
test results and profile hole information, building floor plans, as well as proof of adequate water quantity and
quality. It must be possible to design an adequate septic system before a building permit oan be issued.
The site map must include showing locations of all existing and proposed wells within setback distances
(including on surrounding properties), contour intervals, all proposed and existing buildings, property lines,
easements, ditches, slopes of greater than 15%, water lines, springs, suction lines, drinking water cisterns,
drain tiles, irrigation ditches, lakes, water courses; streams, creek, rivers, floodplains, floodways, dry gulches,
or existing septic systems. If these features are not shown on the map because they do not exist, it must be
noted as such.
The following are some itemsthat needed further clarification:
The well must be located with in the building envelope.
Sewage disposal systems must be located within the building envelope; they may not be located in
easements. In accordance with the Pitkin County Land Use Code, no soil absorption system shall be
permitted in areas where the ground slope is in excessbf thirty percent (30%). The applicant will need to
adhere to minimum horizontal setback requirements for placement of sewage disposal system components
and systems must be installed in accordance with the sewage disposal system regulation. The leach field will
need to be located a minimum of 100 feet from the applicant's well and from any neighboring wells, however,
this distance may be greater depending on the size of the home and the number'of rooms that must be
considered in sizing the system. For example, a home between 2,000-6,000 sq. ft. wifh four rooms that rrrust
be cohsidered in sizing, will have to be at least 132. ft. from anywells.
If the well permit states that the septic system must be of the non-evaporative type where the water is returned
to the same stream system in which the well is located. Ttis means that a completely lined field, such as an
evapo-transpiration bed, is not allowed unless the applicant contacts the Coloradd Division of Water
Resources and a new well permit is in place or a plan of augmentation is created.

I read through the application ahd looked through my Sopris Mountairi Ranch file
to see if Lot 1 was originally given 1041 wildfire approval as some lots. I could
find no record of Lot 1 getting such approval. Billy Long the owner's
representative vvas able to locate and send me copies. of comments by Steve
Crockett and Kelly Rogers for Lot 1. I enclosed copies of both for your
information.
After reading through their comments and recommendations Icould see no
changes that I would make to their recommendations. Therefore I stand by what
they recommended to mitigate the existing wildfire hazard,
