On November 27, 1985, the Planning Commission heard and recommended. ', approval of the Nystrom 1.041 Hazard Review and Lot Separation subject to the following conditions: 1. A parking area should be shown on the site plan and should be _ designed to keep the roadway open for adjacent uses. A parking, area needs to be located ,by the applicant on the site plan and should be designed to .keep the roadway access open to traffic from adjacent users." 3. .Department of 8nvironmental Health In g_memo., dated, November 18, 1985, Bob Nelson made the followin iecommen' a- tions "l. wells whPChphasWalready beenepermitted__byothe Division of Water Reso,urce_s. ,..,Well water supplies', in this area are ..usually marginal' in quantity and, chemcalq utility, but with proper planning and', engineering a source should be available. in they _, alluvial material near West Soprs Creek. We anticipate `that the domestic~'water_w system will' require storage of 1000 gallons, and treatment for removal of hardness, and_,iron. .The previous owners', have. apparently gone to the trouble of obtaining the necessary easements to allow development of, the water supply near the creek on another parcel of land, which is probably "the .only means qf, supplying an acceptable source of water. 2. Sewage Disposal - There _appears to be suitable',.... soils in the region of the building site, and development of a conven£ional septic system should be allowed under the County regulations. The geology report, soils maps`and percola£ion and profile tests on adjacent properties all seem to indicate a cobbly, loam' soil with, moderately rapid permeability and a very low chance of shrinking or swelling when wet. This should be satisfactory forthe installation of _a septic tank-seepage bed. B. Staff Comments: The. Land Use Code, Section 7-2.4 requires that. exceptions be reviewed with consideration given to the following'.. factors... 1. The number of substandard lots developed in the area and the effect of separate development on the character"of the neighborhood and purposes of the zone category; 2. The extent to which the lot_ s ,comply with existing subdiv-' sion regulations; 3. The effect of separate development on available utilities, roads and other public services; 4. Any physical limitations of the lots; 5. The configuration 'of the lots as it affects their suit.-, 2 ,i ability for separate development; 6. The degree of economic loss to the owner if separate'.. development permission is not granted (including a consider-' atvis their v lue eif used in~ conjunotonawth eachlopeeL~is-', 7. The history of acquisition (including a consideration of the' purposes of the purcfiase and whether or not the lots were involuntarily. acquired); and 8. The historical use of the lots. William Gates has submitted a letter in, response to the above points (attached) . The staff Peels that this application does comply with the intent' of the, above review factors for the following reasons: 1. The existing neighborhood is characterized by single-family'. residences' on small one to five acre lots. The_ proposed' residence will not alter this character. 2. Lot 11 is non-conforming with respect to the lot size which.', is 489 acres where the zoning is RS=30 PUn.. The lot_is' large enough that setbacks may be complied with, however,' the building envelope as proposed may' encroach on thg, required sideyard setback. A revised site plan should be submitted that shows the building envelope outside of the, required setbacks. 3. Lot 11 currently has existing utilities including a well' permit, a suitable septic tank site, electric and telephone lines and is adjacent to the County Road. 4. There are no physical limitations which woul,d_ preclude the'. separate developnent of this lot.. 5. The configuration of Lot. 11 does not. affect its suitability' for development. 6. The lot is currently owned. by Colorado National Bank and, Alpine Bank. There is a single-family residence on Lot IO which is now owned separately by °another individual, therefore, if this exception is not approved, the Bank, in' effect, owns a worthless piece of pr"aperty"aue to Lot lI', being considered as combined with Lot 10. An economic loss'. would accrpe to the banks which hold a lot that cannot be' built on. 7. Lot 11 and portions. of it have changed ownership approxi-' mately 11 times since March of 1973. Lot ll was originally' sold as separate metes and bounds parcel and a part of the Nystrom'Tracts. The lots in the Nystrom Subdivision have historically been used' for single-family `residences. '' Based on the above factors, the Planning Office feels that this' lot separation in appropriate. A Special Review is also required' for this property .because of the presence of 1Od1 Aazards,' specifically Wildlife and Geology. According to Randy Cote of the Division of Wildlife, this proposal presents no hazagds to wildlife if the building .envelope st"ays below the irri ation ditch which traverses the__upper portion of the lot. We offer the following review comments for your consideration: 1. WATER.SUPPLY Water is to be supplied from a well, which has already been permitted by the division of water resource's: ~~Well`water supplies in this area are usually .marginal in quantity and chemical quality, but with proper planning and engineering a source should be available in the alluvial material near West Sopris Creek. We anticipate that the domestic water system will require storage of 1000 gallons, and treatment for removal of harness and iron. The previous owners have .apparently gone to the trouble of obtaining the necessary easements' to allow development of the water supply near the creek on another parcel of land, which is probably the only means of supplying an acceptable source`of water. 2. SEWAGE DISPOSAL There appears to be suitable soils in the region of the building site, and development. of a conventional septic system should be allowed under the county regulations. The geology report, soils maps, and percolation and profile tests on adjacent properties all seem to indicate a cobbly, loam soil with moderately rapid permeability and _a very low chance of shrinking 'or swelling when wet.
