The topography of the site consists of a, gently south sloping open meadow with scrub oak: and native grasses. The homesite rests on the west bank: of Sopris Creek, a year round stl^eam. There are irrigation ditches near the envelope. The geology of the site consists of Cretaceous. age Mancos ShalE dipping gently to the east ih this area. Ellen Sassano explained that most of the impact is "fill". The road is_going down a hillside., and will need fill, but is not visible from a County road. Jody Edwards was here in .place of Joe Krabacher, the representative for.the applicant. Jody clarified on some mapping that no visibility will occur from the, County road... Bill Ayres noted the importance of enforcing Condition No. 6.c. Kate McBride questioned Condition No. 6.b. Ellen Sassano suggested that, taking into consideration the steepness of the driveway and access road, and distance from the,fire station, a sprinklering system be required as recommendedQin Condition No. 6.c. Bill Ayres questioned requiring something that the experts did not .:,require. It was explained that the experts do not yet have the right to require and therefore can only "strongly recommend".sprinklering. Jack Kaufman felt that since this would be a downhill „~u ,~ ~;....., battle, possibly no sprinklering sYiould`kie required, but explained he .could go` either way.'" Discussion ensued. Jody Edwards .suggested that... sprinklering systems are generally incorporated for the purpose of an interior fire. It was pointed out that the house fire could ._. potentially start the wildfire. Ms,. McCurry explained that they prefer not to have the additional financial burden of a required sprinklering system, Bill Ball noted that there are 'public policy concerns which, need to be considered. Kate McBride .believes that since it was strongly recommended, she believes it should" be a requirement which would tend to protect the applicant and the public. Ms. McCurry represented that she would be using non-combustible materials for„the structure. Bill Ayres moved to recommend .approval to the BOCC subject to the conditions recommended„by staff. Bill Ball urged the Commission. to follow the.. recommendations of the referral comments and noted the importance of""the Commission to act as the enforcing body. Mr. Glisman requested and was, granted approval for a one-step review before. the Planning Commission for both General. Submission and 1041 Hazard Review. Staff. and Bud,Eylar recommend that the building envelope exclude the creek. The applicant agreed to move the building envelope back 20 feet from the creek .and to_allow the DOW, to identify critical and riparian habitat. The .,.applicant would be allowed to build only on the west side of the creek... Ellen Sassano explained that the .applicant will be required to get approval from the Board of Adjustment for the south end of the building envelope. In the event that approval is not granted, the building envelope will be adjusted to comply with the required setbacks. Mr. talisman explained that overflow from the river would... be expected to qo to the east side of the creek. He noted that he intends. to fence out livestock along the creek which will help improve the riparian area. The. applicant represented that he will not build in the boggy, riparian area of the site. The applicant spoke about the location of adjacent homes in the area.' The Commission and staff discussed the 00 year floodplain and Bud Eylar assured"the Commission that the 20 foot. setback will satisfy any concerns. Ellen. Sassano spoke about fire .safety and visual concerns. Discussion ensued regarding the kenneling requirements. The applicant is concerned about fire safety and has agreed to sprinklering the structures, and Mr. talisman also noted. that he has always been very concerned about dogs running at large and is in agreement with kenneling requirements. Jack Kaufman moved to approve the request subjecf to the recommended conditions, with the following changes: adjusting the building envelope to be restricted to the west side of the creek, and to comply within the required setbacks unless approval is granted for a variance from the south property line, Condition No. 8 will be adjusted to include the same condition regarding dogs as that which was required in the master plan approval for the entire Sopris Creek Ranch, and editing Condition No. 8.a. to indicate that the building envelope shall be removed from the riparian area and be set back at least 20 feet from the Creek. The Environmental Health Department anticipates a water well yield of sufficient quality and quantity. At building permit. application review, the Environmental. Health Department will review well and septic system design and location. Air quality impacts associated with development will be negligible. 2) COUNTY ENGINEER,:.. Bud_Eylar notes that the driveway to the =building envelope must comply with County driveway standards. He recommends that the,Sopris Creek drainage be removed from the envelope, and that a sediment/erosion control plan be submitted by the applicant to mitigate potential water quality impacts to Sopris Creek. This, plan should be submitted to the County Engineer prior to building permit application for review and. approval. 3) COUNTY ATTORNEY: The Assistant County Attorney indicates that .:. , ..~<.u~, there are no merger or legal access issues associated with the application. 4) BASALT AND RURAL FIRE DISTRICT: In his review of the proposed development, Ronald Thieving made the following recommendations for fire mitigation: a. The placement of_a water storage tank of not less than 2,000 gallons with a Fire: Department connection accessible by roadway and near the ..structure. to be occupied; b. Although not required, it is strongly recommended that.. a residential automatic,_sprinkler system be installed in all residences and when practical, other buildings on the same property. c. Roof materials of any structures shall be of_a non- combustible material approved by Underwriters Laboratory. d. Road grades shall not exceed 12%. e. .Curve radius shall be no less than 18 feet. 5) COLORADO STATE FOREST SERVICE: John Grieve has reviewed the development request and makes several recommendations regarding wildfire mitigation which have been incorporated into the recommended conditions of .,,approval. Mr. Grieve notes ~. w,,, that there is minimal wildfire danger associated with the. building site.. 2 €' 6) ZONING side,,, yard__setbacks. the recommends that. the envelope be~ _,., m we., ..... reduced to"accommodate setbacks, or that tie applicant apply for a Board of AdTustment variance to allow encroachment into _ the setback areas. Ms. Schaffner also notes that, if development is proposed for an area where the grade has been altered, a certified topographic survey (two foot intervals) of the site prior to regrading and no more han one, year old, will be required at the time of building permit application. The survey will facilitate building height measurement.... 7. Mr. Wright notes that. placement of the homesite on the eastern edge of the property will "follow the concept of impact areas developed for the Joint Ventures application." He recommends the following measures as a means of minimizing impacts to wildlife• a. The riparian area shall be preserved with no construction past or into the aspen/willow type along the Creek; b. Home placement shall be _ on the west, side of the designated envelope; c. All dogs shall be kenneled. d. All fencing shall be 42', 4 strand or less with a 12" kick space between top two wires; (Rail fencing shall be 48",~ 3 rail or less). e. All horse grazing shall be located in the lower pastures of the ranch already designated for grazing. If grazing is allowed to occur on this parcel, no grazing shall be ~~,n , . ~'°"` allowed within the riparian area. PLANNING STAFF COMMENTS 1041 REVIEW,. The site is encumbered _by floodplain, low wildfire hazard and slopes exceeding 15% in grade. Wildlife habitat is not mapped on- site, but is discussed in context of the overall wildlife management plan which has been established for the subdivision. The' building site lies on the west bank of Sopris Creek. 3 Hazards are reviewed in the .following section: Floodolain The 100 year floodplain elevation associated with Sopris Creek has not been identified on the site plan. It is recommended that the plan be revised to delineate`a 20 foot setback from the Creek, and that- the building site be located outside of ',the setback area _. Consulting geologist, Nick Lampiris, recommends that a levee of boulders, which has formed on the west., bank of the Creek, be fortified in two low areas, with excavated material from the site, to prevent very high flows from approaching the building site. He also recommends that landscaping be used to elevate the homesite. He recommends subsurface drainage around the base of the foundation,. and a site specific soils study to insure proper foundation design. GeolocL The majority of the site, including the building envelope, contains slopes of less than 15$ in grade. The driveway to the .building envelope crosses an adjacent parcel to the south. There are no slopes exceeding 15$ within the driveway alignment. No mitigation of slopes is required.. Wildfire The site is mapped as a "low wildfire hazard area" _on CSU 1041_, maps. John Grieve, Assistant District Forester for the State Forest Service, indicates that the applicant's parcel is located.' in an area with minimal wildfire danger:' Minimal vegetative manipulation is recommended by Mr. Grieve for wildfire mitigation. Recommended mitigation is as follows: a. A 10 foot perimeter around all. structures„ shall ,be clear of tall. grass and brush. The grass in this perimeter shall be kept mowed and only small plants or shrubs shall_be used for landscaping. b. Beyond the 10 foot perimeter a defendable space should be established within 30 feet of structures. Within the 30 foot perimeter, clumps of brush should be'thinned and/or~pruned to break up ,.the continuity of the vegetation. thinning should result in ten feet of space between the live crowns of brush patches. Patches of brush. shall be kept small; 'measuring 15 feet across the live crown. In addition, the. Fire Chief recommends.. the. following fire mitigation measures: a. GENERAh SIIBMISSION Drainage and Erosion - The County Engineer has requested that a drainage and erosion control plan be submitted for his review and approval prior to building permit application. The plan is to assure that water quality of the Creek is not impacted by development. It is recommended that the site drainage and building foundation be designed and certified by a Colorado registered Professional Engineer. Impacts to Roads - Development of this, parcel will have negligible impacts on West Sopris Creek Road. Cumulative impacts of development of the subdivision .were considered in review of the: Joint Venture application. •$cenic Ouality - Staff has recommended modifications to the. 'Cuilding envelope to accommodate_floodplain, riparian areas and 5 *~ ~;_ setback requirements. Prior to the meeting, Staff will review. the modified envelope on-site to determine whether visual impacts relative to the_County Roadwill be an issue. Recommendations for limiting visual"impact will. be discussed at the meeting. Utilities - Utilities on the ranch are underground. Phone and. electricity have been brought up to the parcel boundary. All extensions will be underground. RECOMMENDATION• Staff recommends that, the Planning Commission approve the talisman _., General Submission and 1041 Hatiard Review subject to modification of the building envelope and subject to the following conditions: 1. Prior to building permit .application, the applicant shall record a 24 x 36 inchmylar 1041 Review site plan which meets the approval of the Planning Office and County Attorney. 2. Plans for drainage and building foundation shall be designed and certified by a Colorado registered Professional Engineer. Said plans shall be submitted. at building permit application. 3. Drainage and erosion control plans shall be approved by the County Engineer prior to building permit application. 4. An access permit shall be obtained_.by the applicant prior to commencement of improvements to driveway. 5. Utilities shall be extended underground. 6. The applicant shall comply with County air quality and lighting standards in effect,at_the time of building. permit issuance. 7. At building permit application the .applicant shall show compliance with_the following wildfire mitigation measuresc a. The applicant shall comply with. Colorado... A portion of the lot and the building envelope is situated near a drainage vegetated with tall grasses, brush and aspen trees. The actual footprints of the proposed structures have not been specifically defined, however; Mr. Glisman was able to show me generally where the structures will_ be located. it is possible to locate the structures where minimal vegetative manipulation for wildfire safety will be necessary. I recommended to Mr. Glisman that he maintain a 10 foot perimeter around all structures that is clear of tall grass and brush. The grass in this perimeter should be kept mowed and ohly small plants or shrubs should be used for landscaping. Beyond the 10 foot perimeter a defendable space should be_established and maintained within 30 feet of structures. Within the 30 foot perimeter, clumps of brush should be thinned and/or pruned to break up the horizontal and vertical dontinuity of the vegetation. Thinking should result in 10 feet of space between the live crowns. of brush patches. The patches of brush should be kept small; measuring 15 feet across the live crown. Most of the oak brush I saw did not have limbs on the lower 3-4 feet of the trunk. Some oak patches may need to be pruned to"create this effect and break up the vertical continuity of potential fuels. Mr. Glisman mentioned that he was planning to install a cistern to store water for domestic use. l suggested that .this water be made available to firefighters by way of a dry hydrant or some other opening where water can be pumped out of the cistern to fight fire. The application states. that this system will comply with the Pitkin County Regulations on Individual Sewage Disposal Systems. our preliminary evaluation of this site. is based, on some, of our previous experience in Sopris Mountain Ranch. _The soi: s in Sopris Mountain Ranch contain a significant amount ofclay.` Most of the parcels that have been developed thus far have required an engineer designed system because of slow. percolation. rates. Measured., percolation rates in the area have ranged from 60 minutes per inch to over 24.0 minutes per inch. This slow _rate precludes the installation of a standard,,system. However, a system designed to mitigate specific site conditions ,by a registered professional engineer meets _the .County regulations and can .most likely be constructed. The consulting geologist, Nick Lampiris, in his letter of November 5, 1991 indicates that "...waste disposal should be available through the use of a septic system with accompanying leach field in these soils." Lampiris further indicated that the.:,percolation rates are expected to be'slow. He highlighted a site that he considers suitable, located to the north of the homesite which_ would provide a sufficient distance to the stream on the property. We would recommend that the applicant explore this and several, other areas within the building envelope to determine all of the , locations which may be most suitable far the sewage disposal system. Soil percolation tests should be done in any of these areas that are less than 20% slopes, because the soil of the area is variable and the soil types can change, sometimes in a few feet. In looking at the size of the parcel, and the experiences of neighboring property owners in developing wells, we do not anticipate that the applicant will have a problem in obtaining a permit for drilling anew well, and that this. well will produce a sufficient quantity.. Glismann, requests general submission approval and 1041 hazard review for the construction of a single "family residence on 35.07 acres of land located in unincorporated Pitkin County, on `West Sopris Creek Road in the Sopris"Mountain Ranch area. The application is divided into four parts; the project site, the proposed development, item by item review supporting compliance with. the requirements of the Land Use Code and all `pertinent supporting documents. II. PROJECT SITE The project site consists of a 35.07 acre. Colorado State Metes and Bounds. parcel of land squired by applicant in October of 1988. The property is not part of a Pitkin County approved subdivision and pursuant to the interpretation oP the Pitkin ~,,, _ County Planning and Zoning Department, subject to the requirements of section 18-2.2 (Adc)i£ional Biiildng Permit Application Requirements) and 5-1-400 (General Regulations) Hof the_Pitkin County'Land Use Code. As shown on the accompanying map, access is provided by West Sopris Creek Road to the north of"..the parcel and then via the Sopris Mountain Ranch Road which passes to the west and south of the parcel. Access to the parcel from the ranch road is a driveway, approximately 100 yards in length, running south to north, `traverses an approved easement through Lot 30, to the parcel's edge of the 2.5 acre `building envelope'. Topography is flat with a gentle south to north down "sloping. The primary drainage oP Sopris Creek runs throught the eastern border of the property and an irrigation ditch runs through the western edge of the property. A geologic statement regarding floodplain potential and stability is included'~iri ~theappendx. Negation consists'of gra'ss`,°'alfaTfa,`scrubga'k;sage~ brush, with scattered aspens on the eastern most 'edge of the lot. Current improvements include electricity and telephone service to the southern edge of the envelope." III. PROPOSED DEVELOPMENT /""'~ The proposed development consists of a single family dwelling, horse barn and agricultural stgrage facility within the 2.5-acre building 'envelope. The f1ooT area of the residence will be allowable .square footage limits on a parcel of this size. The utilities will be extended to serve the new structure. All utilities will be underground and conform to _utility company requirements. As the building envelope is flat, there will be no need for grading, retaining walls, erosion control etc. Any an"d all areas disturbed by the temporary process of construction will be restored to original level. IV. REVIEW REQUIREMENTS The proposed development is exempt Prom the County's growth management regulations pursuant to 'the provisions of Section 5- 510.2(b) of the Land Use Code: The new residence, however, per the opinion of the Planning Office, is subject`to both general submission and Minor 1041 Hazard Review. A. GENERAL SUBMISSION Pursuant to interpretation by the Planning Office of Section 18,.2..2 of the Code, general submission 'review is required to develop a parcel of, land which is not a platted lot located within an approved subdivision. While 'the construction of a single family residence may be exempted from this requirement, an exemption cannot be .approved if the parcel in question lies within an area of 1041 concern. Water supply will be from an underground well, which will hot impact groundwater resources. Sopris Creek flow will not be effected and all stream setback. guidelines will be followed. 2.
