Ms. Kerin Bean, hereinafter."Applicant", has applied to the Board of County Commissioners of Pitkin County, Colorado,. hereinafter "Board", for approval of 1041 Hazard and General Submission Review for the construction of a .single family residence, pursuant to Sections 5-400 and 6-3 of the Land Use Code. 2. The Applicant's lot is zoned RS-30 and is approximately 35 acres in size. 3. Said lot is described as Lot 27 of the Sopris Mountain Ranch, more specifically described in Exhibit A, attached. 4. The Planning and Zoninq Commission reviewed this application on October 18, 1994 and found that this proposal complies with the criteria. set forth in ,Land Use Code Sections 5-400 and 6-3. 5. The Board heard this application at a regularly scheduled meeting on January 10, 1995, at which time evidence and testimony was presented with. respect to this application. 6. .The Board determined that the. proposed development meets. the criteria established in Sections 5-400 ;and 6-3 of the Land Use Code. The Applicant shall adhere to all. material representations made in the application and in the public meetings. 2. Prior to building permit application, the Applicant shall record a 24 x 36 inch mylar 1041 Hazard Review Site Plan which meets the approval of the Planning Office and County Attorney. The site. plan shall include all the conditions of approval. a. The following 1041 Hazard Review Warning and Disclaimer shall be noted on the Plat: "The provisions of these regulations do not in any way assure or imply that areas outside of designated hazard areas will be free from hazards, or that approved mitigation measures will guarantee the safety of-any property." b. The building envelope shall be revised pursuant to Planning Office recommendations.. 3. The Applicant shall obtain an access permit from the County Engineer, prior to issuance of a building permit. 4. .Outside illumination shall comply with County lighting standards in effect at the time of building permit issuance. 5. The Applicant shall. comply with the recommendations of the DOW as follows: a. The building envelope shall be relocated to the north, so that it's southern boundary will be across from the switchback of the subdivision road. b. Dogs are prohibited c. Fencing shall be a maximum height of 42", 4 strands or less with a 12" kickspace between the top 2 strands. Any rail fencing shall be the round type, 48", 3-rail or less with at least 18" between 2 of the rails. d. All garbage shall be kept within bear-proof garbage containers. The DOW can supply specifications upon request. e. Horse grazing shall not occur on the subject property. All fencing shall be located within the approved building envelope. 6. Wildfire mitigation shall be as follows: a. A residential sprinkler system or foam retardant system. shall be installed which meets the standards of the Basalt Fire Protection District and the Uniform 'Building Code. b. The Applicant shall install an underground water storage tank to accommodate a minimum of ,1,000 gallons. Capacity and location shall be determined by the Basalt District ` Fire Marshall, Photo documentation of the underground tank shall be submitted to the Building Department, prior to the issuance of occupancy permits. c. The roof shall be kept clear of debris. d. The base of the building shall be kept cleared of weeds and debris. e. Firewood shall bestacked. on a contour away from the building. f. At least one ten pound approved ABC class fire extinguisher shall be placed in a visible and accessible location for each structure. g. Regarding vegetation: 1) All vegetation shall be removed within l0 feet of the structure. This area should be'maintained in the future as low ground cover. 2) Vegetation shall be thinned within a minimum of 45 feet around the structure, with a minimum of 20 feet crown separation between clumps of oak/serviceberry. Remaining clumps shall not. have an aggregate crown diameter in excess of 20 feet. Dead limbs and ladder fuels that could carry fire into the crowns of the brush shall be eliminated. Slash shall be properly disposed of by chipping, hauling away, or piling and burning during _a safe time period.: 3) Vegetation density in the oak brush shall be reduced by thinning out to a distance of at least l00 feet from the structure. 4) Maintenance. of .the "defensible .space" shall be required in order. to retain it's value as wildfire mitigation. Oak and serviceberry tend to sprout vigorously after cutting, so it will be necessary to trim back vegetation every year or two. h. Any additional proposed buildings within the .building envelope shall incorporate wildfire mitigation measures. i. Non-combustible roof material including tile, asphalt, metal or Class-A Certi-guard (registered brand name) Red Label shakes and shingles utilizing Class B construction. techniques (1/2" minimum solid sheathing) or better, shall be required for all structures of the subdivision.: j. Addresses shall be clearly marked and visible with minimum 2" letters. k. All power and telephone lines shall be buried within the driveway alignment. 7. Prior to issuance of a building permit, the Applicant shall provide documentation of an adequate domestic water supply. Quantity and quality of said supply shall meet the. approval of the Environmental Health Department. 8. The septic system designed for the site shall meet the approval of the Environmental Health Department. The Applicant _ shall obtain such approval prior. to the issuance of a building permit. 9. The Applicant shall obtain a fireplace/woodstove permit from Environmental Health Department, prior to the issuance of a building permit. 10. No development, including disturbance of vegetation and grading,. shall occur outside of the building envelope, other _ than that required for wildfire mitigation, construction of the access drive and necessary utility extensions.. 11. The building site shall be revegetated with natiye_grasses to limit water consumption and additional runoff,. immediately following project completion. 12. Wildlife - The DOW determined that this lot lies within elk and mule deer transitional range, and that it does receive some winter use in light snow years and early/late winter. Site drainage is limited to surface drainage and absorption. Scenic Quality - Due to the location of the building envelope relative to the existing topography and vegetation, the development will not be visible from the public right-of-way (W. Sopris Ck. Rd.). The development may be visible from the internal subdivision roads and adjacent parcels. The Applicant has represented that "the home will accentuate the use of natural materials and will blend very well with the setting". As-mentioned previously, there are currently no construction plans for .the residence. Water and Sewer - The Applicant is proposing to supply the development with domestic water by installing a well. State Statute provides for one exempt well right to serve one home and limited irrigation. The Applicant has represented that there are wells which have adequate yield and quality in the immediate area. The Environmental Health Department will require documentation of the 3 ,P .,. .. ~; adequate quality and quantity of the water supply.. The Applicant is proposing an Individual Sewage Disposal System for this project. The specifications of the Environmental Health Department must be followed for the .design of the ISDS. A Septic Permit will be required by the EHD, prior to the issuance of a building permit. Utility Extensions - All utility extensions shall occur in the access driveway. Electric and telephone service is available in the subdivision roads. RECOMMENDATION: Staff recommends that the Planning and Zoning Commission forward a recommendation to the Board of County Commissioners to approve the Bean Lot 27 General Submission and 1041 Hazard Review subject to the following conditions: 1. It does receive winter range use in light snow years and early/late winter. Elk calving generally lies further south. Black bear inhabit the area also. Wildlife impacts can be minimized by: 1. Moving building envelope `north where its southern boundary would be across from road switchback. TYere is a big oakbrush which is currently flagged in this vicinity and John Young said he had that point surveyed and marked. .This would probably be homesite location. fihs places the home close to the road and at the very north end of the aspen stand. 2. Ranch, prepared by John 8. ' Young Consultant Services, and visited the site oh July 27th, '. 1994. I have the following comments with regard to wildfire hazards on this property. Vegetation on the site consists of a mature aspen stand on the edge of a ~'"'~, patch of mature oakbrush and serviceberry. The brush is . tall (10=15 feet) and fairly continuous. The ground vegetation under the aspen timber on this lot is snowberry, servioeberry, and tall grass. Slope is about 15:K on this hillside 1bt: The lot contains both medium hazard fue is under the aspen', and high hazard fuels within the oakbrush. Vegetation and slope on portions of this lot pose a significant threat from wildfire; under certain burning conditions, a fire on this hillside would be quite intense and hard to control. The wildfire risk is mitigated somewhat by the moderate slope and ' the size of the lot. fn addition, the Homeowner's Association has jl - installed cisterns throughout this subdivision'specifcaTly for fire control, and the road system is adequate for emergency ~, response vehicles..-1n addition to these mitigation steps already taken, I recommend the following measures be incorporated into this site prior to development: -The proposed building should be placed in the aspen stand, and outside of the surround'i'ng oakbrush as much as possible. The oakbrush poses a higher wildfire hazard than the aspen. -Clearing of all vegetation within 70 feet of structures. This area should be maintained in low vegetation such as mowed grass. Vegetation thinning and landscaping to a minimum of 45 Peet around the structure with a minimum of 20 feet crown ... ~t ;. c, r-3 separation between clumps of oak/serviceberry. Remaining clumps should not have a crown diameter in excess of 20 feet. Dead limbs and ladder fuels that would carry fire into the crowns of brush should be'eliminated. S1asFi should be properly disposed of by chipping, hauling away, or piling and burning during a safe time. period. -Vegetation density in the`oakbrush should be reduced by thinning out to a distance of at least 100. .feet surrounding the structures.. -Maintenance of this "defensible space" as specified should be emphasized in order to retain its value as wildfir e hazard mitigation. Oak and serviceberry tend to sprout vigorously after cutting, so it will be necessary to trim back vegetation every year or two. -Roof coverings should be of non-combustible materials, Wood shingle roofs are a documented source of,_gnition in wildland fire situataions, and should be avoided. To receive a Septic Permit, the applicant will need to submit a Septic Permit Application and appropriate fee with a completed Soil Data Form including perc test results and profile hole information. Tt must be possible to design an adequate septic 'system before a building permit can be issued. It also must be determined_if a conventional system can be installed or if an engineered designed system is needed. An engineered system is required if any one of the following conditions occur: apercolation rate faster than 5 mpi or slower than 60 mpi; maximum seasonal level of-the groundwater table or bedrock exists less than four feet below the bottom of the proposed absorption system; or-a slope in excess of 30%: The applicant should be aware that percolation rates on neighboring lots have been greater than 200 mpi and it is likely that an engineered system will need to be designed. However, site- specfic soil data will have to be obtained. The applicant will need to adhere to minimum horizontal setback requirements for placement of septic system components which should be no problem on this large lot. The vegetation and slope on portions of the lot pose a significant threat from wildfire. The CSFS recommends that the building site be located in the aspen stand and outside the oakbrush as much as possible. Mr. Rogers recommended further mitigation measures for this development, which wi1S be included as conditions of approval. Although the Planning Office has not received written comments from the Basalt and Rural Fire Protection District on this application, Staff met with Steve Howard at the Sopris Mountain Ranch and discussed. general provisions for structure and wildfire mitigation for the development as a whole. Staff hopes to have written comments, specific to Lot 27, by the public meeting date. Steve Crockett indicated that the location of the structure(s) away ~" from the severe hazard,. .(oakbrush) and within the area of low wildfire hazard (aspen stand) would be the safest location from a wildfire perspective. Steve went on to say that this, coupled with the "Pitkin County Sheriff's Department Standard 1041 Wildfire Hazard Recommendations" adjusted for slope, should. adequately mitigate the wildfire hazard on the proposal. Previous approvals for the Sopris Mountain Ranch (Reso.#92-171) have required that the residences on the upper lots (17-22, 24 ahd 25) be limited with regards to the maximum allowable floor area. Based on the previous approvals and the findings of the Division of Wildlife with regards to wildlife impacts, Staff is recommending that the principal structure be limited to 10,000 square feet of floor area. The Planning Office will further recommend that all proposed outbuildings or accessory structures be reviewed and approved, prior to the issuance of a building permit, by the Division of Wildlife and the Colorado State Forest Service for sensitivity to 1041 hazard concerns. Geologic - The property contains slopes up to 30 percent. The areas of steep slopes are isolated to the extreme northwestern`portion of the parcel. The proposed building envelope contains slopes of approximately 6-12 percent and is located near the middle of the lot. The access driveway will not encroach on slopes in excess of 12 percent. 2 Wildlife - The DOW determined that this lot lies within elk and mule deer transitional range, and that it does receive some'winter use in light snow_ years 'and early/late winter. Elk calving generally lies further to the south of the property. Kevin Wright recommends that the building envelope be relocated to the north where it's southern :boundary would be across from the 'switchback of the subdivision road. The DOW also recommended that 'dogs be prohibited and that all .horse grazing be confined to .the lower common Ranch pastures. Staff feels that the building envelope must be revised in order to comply with the recommendations of the. referral agencies. Please see the attached site. plan with the proposed revisions to the building envelope GENERAL SQBMISSION Drainage and Erosion- There are no existing drainageways on the property. Site drainage is limited to surface.`drainage and absorption. The Applicant has stated that '"the home 'will be consistent in size with other homes"in the subdivision so the change in quantity of impervious surface will be minimal and the overall drainage impact will be similar". Development within the building envelope poses little potential for erosion provided that all areas'distnrbed by construction be revegetated within the first growing season following the completion of the development. The County Engineer will require that the 'proposed access driveway be designed to County standards. An access permit will"be required by the County Engineer, prior to the issuance of a building permit. Impacts to Roads - The County Engineer determined that this development will not cause significant additional impacts to the County roads. Scenic Quality - Due to the location of the building envelope relative to the existing topography and vegetation, the development will not be visible from the public right-of-way (W. Sopris Ck. Rd.). The development may be visible from the internal subdivision roads and adjacent parcels. The Applicant has represented that "the home will accentuate the use of natural materials and will blend very well with the setting". As mentioned previously, there are currently no construction plans for the residence. Water and Sewer - The Applicant is _ proposing to supply the development with domestic water by installing a well. State Statute provides for one exempt well right to serve one home and limited irrigation. The Applicant has represented that there are wells which have adequate yield and quality in the immediate area. The Environmental Health Department will require documentation of the adequate quality and quantity of the water supply. 3 c .. w The Applicant is proposing an Individual Sewage Disposal System for this project.""The specifications of the Environmental Health. Department must be followed for the design of the ISDS. A Septic Permit will be required by the EHD, prior` to the issuance of a building permit. Utility Extensions - All utility extensions shall occur in the access driveway. Electric and telephone service is available in the subdivision roads. RECOMMENDATION:. Staff recommends that the Planning and Zoning Commission forward a recommendation to the Board of County Commissioners to approve the Bean Lot 27 General Submission and 1041 Hazard Review subject to the following conditions.: 1. The Applicant shall adhere to all material. representations made in the application and in the public meetings. 2. Ranch Dear Ellen, I have reviewed the building application for the Kerin Bean residence (Lot 27) in Sopris Mtn. Ranch, prepared by John B. Young Consultant Services, and visited the site on July 27th, 1994. I have the following comments with regard to wildfire hazards on this property. Vegetation on the site consists of a mature aspen stand on the edge of a patch of mature oakbrush and serviceberry. The brush is tall (10-15 feet) and fairly continuous. The ground vegetation under- the aspen timber on this lot is snowberry, serviceberry, and tall grass. Slope is about 15%K on this hillside lot: The tot contains both medium hazard fuels under the aspen, and high hazard fuels within the oakbrush. Vegetation and slope on portions of this lot pose a significant threat from wildfire; under certain burning conditions, a fire on this hillside would be quite intense and hard to control. The wildfire risk is mitigated somewhat by the moderate slope and the size of the lot. fn addition, the Homeowner's Association has installed cisterns throughout this stabdivision specifically for fire control, and the road system is adequate for emergency response vehicles. in addition to these mitigation steps already taken, I recommend the following measures be ihcorporated into this site prior to developmehtc -The proposed building should be placed in the aspen stand, and outside of the surrounding oakbrush as much as possible. The oakbrush poses a higher wildfire hazard than the aspen. -Clearing of alt vegetation within 10 feet of structures. This area should be maintained in low vegetation such as mowed grass. -Vegetation thinning and landscaping to a minimum of 45 feet around the structure with a minimum of 20 feet crown separation between clumps of oak/serviceberry. Remaining clumps should not have 'a crown diameter i_n excess of 2Q _.. feet. All individual sewage disposal systems installed within Pitkin County require°septic permits and must oomply with the Pitkin County septic regulations. Septic permits are issued by the Aspen/Pitkin Environmental Health Department. To receive a Septic Permit, the applicant will need to submit a Septic Permit Application and appropriate fee with a completed Soil Data Form including pert test results and profile hole information. It must be possible to design an adequate septic system before a building permit can be issued. It also must be determined if a conventional system can be installed or if an engineered designed system'is needed. An engineered system is required if any"one of the following conditions occur: a percolation rate faster than 5 mpi or slower than 60 mpi; maximum seasonal level of the groundwater table or bedrock exists less than four feet below the Bottom of the proposed absorption system; or a slope in excess of 30%. The applicant should be aware that percolation rates on neighboring lots have been. greater than 200 mpi and it is likely that an engineered system will need to be designed. However; site- specific soil data will have to be obtained. The applicant will need. to adhere to minimum horizontal setback requirements for placement of septic system components which should be no problem on this large lot.
