All of which policies are further refined in Section 6.23.01 of the Code establishing the guidelines for administering applications for utility extensions, and WEU;REAS, the Board of County Commissioners has reviewed the recommendation of the Commission, and the evidence and testimony presented with respect to the application, and has found: 1. The Section 36 Subdivision is located at an approximately 9000 foot elevation andserviced by a single lane access roa% rising Snitiall;y (approximately) 6000 fee'., with a further 3000 foot change in elevation required to gain access to the subdivision. The road is a one lane road which (a} has steep grades, most in excess of 208, r.. has no shoulders, (c) traverses soils with weak bearing strength, (d) has no drain~ra (and ~` is very highly eroded) and (e) 1s, in many places, J when wet, impassable except by 6-wheel didve j vehicles. Section 36 is located in a remote part of the County served by inadequate roads and distant .from primary utility service areas, Hereby finds that the area is premature for development, unsuitable .based on 1041 considerations of the Land Use Code, and WHEREAS, the Commission further finds that. Section 36 contains numerous geologic hazards according to the CSU maps specifically: 1.) All of the property appears to be in excess of 30% slopes. 2.) Vast majority is construed non-occupancy land. 3.) The maps indicate there to be an elk migration route through the property. 4.) All of Section 36 is contained within a specified elk wintering range. 5.) Vast majority of the property lies in an area of high visual vulnerability. 6.) Several avalanche areas. 7.) Majority of Section 36 is_considered to be in a severe wildfire hazard area. From a wildfire hazard standpoint, the biggest 'hazard `in this"area is the fiigfily ' flammable fuel covering almost the entire area. Fuel breaks around homesites and all access roads will definitely be needed.. The access road into the site is very close to maximum grade, however, major work widening the road and another entrance-exit point should be located to allow for multiple ingress-egress to the area. in the event: of a major wildfire. The provision for separate,multiple ingress-egress is very `important in this area of such a high fuel hazard. ROLD Director RE: SECTION 36 SUBDIVISION-T8S, R87W It is unclear from your memorandum of May 15, 1978 whether we should be r~dewing the actual extension of the electrical service to this subdivision in question or the advisability of the subdivision itself. On the first matter, we have no doubt that a power line could be constructed within .the area given the geologic conditions. The second matter of whether or not this area is reasonable from a geologic point of view for a subdivision is more complex. Based on published mapping in the area, the western part of the section is composed of Mancos Shale bedrock and soils derived from that unit. The eastern part of the section is more complex and is separated from the west by a north to northwest trending fault. In that area bedrock units include the Dakota, Morrison, Entrada, Chinle, State Bridge, and Maroon Formations. Given the steep topography of much of the section there are some potentially severe geologic constraints associated with some of these formations. Major constraints located within this section would be 1) potentially or actively unstable slopes, 2) surface runoff including erosion and deposition, 3) poor conditions for standard individual sewage disposal systems, and 4) lack of groundwater resources. Judging by the subdivision layout which you sent, many sections of the proposed road will be traversing slopes in excess of 50% in potentially unstable areas. Since we have not actually been on the property nor has any other geotechnical professional that we know of, it is impossible to say how severe these above constraints might be. Certainly, the large lot size would provide a suitable site for construction of a dwelling on each lot. Access to that suitable site, however, may be difficult. It is our recommendation that prior to approval of this area for development that the developer provide the county with the appropriate geotechnical evaluation of the`road alignments, house sites and access, water supply, and waste disposal. This will benefit not only the county but the developer and future lot and homeowners. If we can be of further assistance, please contact our office. Sincerely, David C. KEY TO THE FUTURE _, MEMORANDUM DATE: May 16, 1978 TO: Richard Grice FROM: Jeff Davis RE: Grosjean Subdivision On Monday, May 15, a field inspection of the proposed subdivision was conducted. The site inspection was conducted to determine i£ adequate access, among other considerations, was safe and reasonable. Drainage, slope considerations and possible utility easements were also examined. The site is located in its entirety near the top of a large mountain with top elevations around 9000 feet. The initial access elevation is approximately 6000 feet. A 3000 foot change in elevation is then necessary to gain access to the subdivision. During inclement weather, this would not only be impossible but extremely dangerous as the roads are cut into hillsides whose slopes exceed 70g. If a vehicle were to slide off, i.n many cases, it would roll for several hundred feet before stopping. Soils in the area are composed mainly of clays which absorb water, making road surfaces extremely slippery. As was mentioned, access roads were cut into hillsides whose slopes exceeded 70~. The grade of the existing roads in many places exceed 23~ which is much too steep for subdivision roads. Additionally, all access roads that were examined were substandard in width, depth of base and drainage. The existing road conditions are recorded on film and in many cases, due to the lack of proper design, erosion i§ quite .evident; To construct these roads to safe standards would require consider- able widening which would result in several large. road cuts that could not be revegetated due to the existing slopes. Erosion;. could not be controlled on these road cuts. Drainage control will be very difficult due to the many steep road grades. Already, erosion has begun on the inside bank of the steep slopes. Many culverts with additional energy dissipators will be required just to keep the erosion to a minimum. The entire subdivision is located in an area of sage and oak brush. Even after the wet ,winter and spring fuel moisture is .. Memorandum May 16,,1978 Grosjean Subdivision Page Two becoming low indicating that the area is subject to wild fire hazard, Fuel breaks, in my opinion, due to grades and location will not alter the wild fire hazard significantly, The location is such that prevailing winds will push any fire up the hills! At this time I could find only one power line in the area. That being a short overhead spur to a newly built house, If the subdivision is to have power several miles of unsightly overhead lines with the accompanying vegetation swath will be required. Underground may be too costly and impossible due to existing grades, SUMMARY.' In summary, I find the proposed subdivision very inaccessible due to grades, soil conditions and drainage problems. The. increased development must utilize County road 5 for access which is already approaching design capacity. Utilities and water will also pose additional problems. In addition to the access and utility concerns the area is heavily used by wildlife as a winter range. Due to the above mentioned problems I find it difficult to believe that anyone would want to build a subdivision in this area. This application comes to us from Holy Cross Electric and is for a proposed line extension to the "Section 36" subdivision, located in Township 8 South, Range 87 West of the 6th P.M. The proposed power line is to be approximately 15,600 feet in length, and to serve 16 thirty-five to forty acre lots. According to the County Attorney's files, this subdivision was recorded in October of 1974 just prior to the amendment of the Land Use Code requiring the review of subdivisions of lots in excess of 35 acres by this commission. Therefore, there is some question as to the legality of the subdivision.. The Planning Office has briefly reviewed the application with the C.S.U. maps and has found the property to contain numerous hazards, specifically: 1. All of the property appears to be in excess of 30~ slopes. 2. Vast majority is construed non-occupancy land. 3. The maps indicate there to be an elk migration route through the property. 4. All of Section 36 is contained. within a specified elk wintering range. 5. Vast majority of the property lies in an area of high visual vulnerability. 5. Several avalanche areas. 6. The build-out rate of a total of 16 units on 640 acres would have to be examined with respect to the objectives of the Aspen/ Pitkin County Management Policy Plan.. Those objectives speak in part to a low rate of build-out in the rural .portions of the County due to the difficulty of serving these areas with usual public facilities, fire and police protection. The law under which this application is made specifically states: "The failure of the Commission to act within 30 days after the date of official submission to it shall be deemed approval, unless a longer period be grahted by the submitting board, body, or office."
