NOTICE OF PUBLIC HEARING
BEFORE THE PITKIN COUNTY BOARD OF ADJUSTMENT
TO ALL PROPERTY OWNERS AFFECTED' BY THE REQUESTED ZONING VARIANCE DESCRIBED BELOW:
Pursuant to Pitkin County Zoning Resolution, a Public Hearing will be held
in the County Commissioners Room Pitkin County Court House, Aspen, Colorado, (or at
such other place as the meeting may then be adjourned) to consider an application
filed with the said Board of Adjustment requesting authority for variance from the
provisions of the County Zoning Resolution.
All persons affected by the proposed variance are invited to appear and
state their views, protests or objections. If you cannot appear personally at such
meeting, then you are urged to state your views by letter, particular:y if you have
objection to such variance, as the Board of Adjustment will give serious consideration
to the opinions of surrounding property owners and others affected in deciding whether
to grant or deny the request for variance.

Dear Mr. Shuster:
I am writing to inform you that on December 7, 1976, at the Pitkin
County Board of Adju?tment meeting, your request for a variance was
granted.
Their decision was to allow you to transfer the 30+ acres to the
Monastery and to keep the remaining 5+ acres as a non-conforming
buil di ng site.
Your next procedure is to see Mr. Hal Clark at the City/County Land
Use Office. He will complete the process and get a subdivision
exemption for you.

Dear Sir:
I am sorry for the delay in getting back to you on this matter. I
have been on sick leave for several days.
We will be unable to process this division of land by a Board of
Adjustment appeal. You will need to go through a Subdivision
Exemption procedure which will require a hearing with the Planning
and Zoning Commission and the County Commissioners.
I am enclosing the section of the Land Use Code that covers these
requirements.

This letter is in respon&e to your letter of August 4, 1976, con-

cerning your request to ~l 30+ acres of your 3,)+ acre parcel to
"
St. Benedict's Honastery, an adjoining land m-mer, The property
is zoned RS-160, which requires a 160 acre minimlli~ lot size, The
division of a 35 acre parcel iuto a 30 acre and 5 acre parcel would be
a violation of county zoning regulations. Since the 30 acre parcel
would be couenanted to prevent development t liTe agree tha t there is
no negative development impact as a result of this transaetion. Vie
would suggest you appeal to the Pitkin County Board of Adjustment
for permission to create a non-'conforming lot.
