MATTAWAY MINOR AMENDMENT TO DEVELOPMENT PERMIT AND SCENIC VIEW PROTECTION REVIEW Administrative Decision No. ~-2007 RECITALS 1. Pursuant to Section 2-20-150.6 of the Land Use Code, Richard and Lisa Mattaway ("Applicant") have applied to the Community Development Uirector of Pitkin County, Colorado ("Director") to amend the previously recorded 1041 hazard review site plan to establish an "access, landscape and utility envelope" and a "landscape envelopes" In addition, the Applicant is requesting Scenic View Protection review approval for a single fhmily residence. 2. The property is located east of Aspen, and is more specifically described in Exhibit A. 3. The property contains approximately 3.3 acres and is anon-conforming size parcel in the AR-10 zone district. 4. The Hearing Officer granted 1041 hazard review and conceptual submission approval, pursuant to Determination No. 30-2004. "I'he vested rights for the approval expire 11/16/2007. The Community Development Director approved a minor amer~lment to allow dogs and permit wildlit~friendly fencing outside of the building envelope, pursuant [o Administrative Decision No. 103-2006. 5. The Director finds that the proposed envelope amendments comply with the applicable provisions of the land use code. 6. The Director further finds that the proposed residence complies with the provisions of Sec. 7-20- 120(d) of the Code, as it is nut located on the most visible portion of the site as seen from Highway 82, is sited as far as practical from the highway, and does not project above a ridgeline; the bulk and mass of the residence has been broken up into a series of smaller forms and rooflines are staggered; and the residence will be screened with existing and additional trees and vegetation. THE DIRECTOR DOES IIEREBY APPROVF, the Mattaway Minor Amendment to a Development Permit and Scenic View Protection Review, subject to the following conditions, which shall run with the land and be binding on all successors in interest: 1. All conditions of Hearing Officer Determination No. 30 2004 and Administrative Decision No. ]03- 2006 shall remain in full force and effect, except as amended herein. 2. Prior to submission of a building permit application, the Applicant shall be required to submit for approval by the County Attorney and Community Development Department an amended Site Plan. The above referenced approvals shall be a condition precedent to f finalization and recordation. The mylar copy of the site plan must be signed by the owner prior to submittal for recording. Galena Street Aspen, CO. 81611 RE: Minor Amendment to a Development Permit and Scenic View Protection Review for the Mattaway Property (PID# 2737-201-00-005) Dear Mike: Davis Horn Incorporated represents Rick Mattaway, the owner of a 3.3 acre property one mile east of Aspen on Highway 82, Independence Pass. Mattaway is the "Applicant" in this land use application requesting a Minor Amendment to a Development Permit and approval for a Scenic View Protection Review. The property's location is shown on a map in Attachment 1 and the legal description is found in Attachment 2. The original approval for this property was pursuant to the old Pitkin County Land Use Code so an Activity Envelope was not established. The approved Site Plan designated a building envelope for the proposed home and a gravel access driveway. The Applicant is requesting the minor amendment to the existing approval to expand the approved access driveway to include small areas for utilities, landscaping and an enhanced access to the on-site water source and an improved fire protection turn around. This land use application is addressed under the following headings: Background, Proposal, Land Use Requests and Summary. BACKGROUND/ PREVIOUS APPROVALS The subject property is located up Independence Pass one mile from Aspen in the AR-10 zone district. The previous owner, Juliet Shield Taylor, received 1041 Hazard Review and Conceptual Submission approval pursuant to Hearing Officer Determination No. 30-2004 on November 16, 2004. An administrative approval was granted on October 31, 2006 for a minor amendment to the development permit pursuant to Administrative Decision No. 103 of 2006. This minor amendment did not amend the building envelope or access driveway, but amended conditions regarding fencing and dogs. These two approval documents are found in Attachments 3 and 4 and the approved Shield 1041 Hazard Review Site Plan is found in Attachment 5. This Shield Site Plan repealed and replaced a previously approved Site Plan for the Hansons, the owners prior to Shield. The proposed Mattaway 1041 Hazard Review Site Plan is in Attachment 6. This will include land area for a line to the existing well, a line to the existing pond which will be used as a water source for fire protection and an larger driveway area to allow a turn around for improved fire protection access. The Applicant is also seeking Scenic View Protection approval. The building envelope and the proposed Access, Landscaping and Utility Envelope are away from the highway on the heavily treed site and is barely visible from the road. The dense site coverage with trees, brush and other vegetation will make the improvements invisible from the Highway 82 corridor in the summer and barely visible in the winter months. LAND USE REQUESTS A pre-application conference summary is found in Attachment 7. As required in the summary, the following sections of the Pitkin County Land Use Code will be addressed: Section 2-120-150 Minor Amendments to a Development Permit; Section 7-20-120(d) Standards for Scenic View Protection Areas; The Land Use Code language is given in bold, and the Applicant's response follows. SECTION 2-20-150.b Minor Amendment to a Development Permit A minor amendment to a development application or permit must meet the following criteria as determined by the Community Development Director: 1) Consistent with actions taken during previous development approvals for the property; and 2) ~ Does not change the use of the proposed development between residential, commercial and tourist accommodations uses; and 3) Does not change the basic character of the approved use of land on which the activity occurs, including basic visual appearance and method of operation; and 4) Does not constitute a new land development activity; and 5) Does not increase off-site impacts in the surrounding neighborhood; and 6) Does not endanger the public health, safety or welfare; and 7) Does not violate any Land Use Code standards; and 8) Does not substantially increase the need for on-site parking or utilities, or affect affordable housing generation; and -2- OdflU 9) Does not increase the floor area of the use by more than five percent or decrease the open space on the site by more than five percent. The proposal to expand the access driveway previously approved to include a utility line to the existing well, a line from the existing pond for a water source for fire protection and to include a larger driveway area for a turn around for fire protection meets these criteria for a Minor Amendment to a Development Permit. The use is consistent with the original approvals, the residential use is not changed, the basic character is the same, there is no new development activity, it does not endanger the public in any way, nor does it violate the any Land Use Code Standards, increase parking, utility or affordable housing impacts, increase floor area or decrease open space. The improved fire protection increases public safety. The request meets this section of the Land Use Code. SECTION 7-20-120(d) STANDARDS FOR SCENIC VIEW PROTECTION AREAS The applicant will comply with the following review standards designed to protect the viewplane from the Highway 82 corridor, the scenic corridor on which the property is located. Due to the heavy vegetation on the site and the distance of the development from the highway, minimal visual impacts will be generated. There may slightly more visual impacts in the winter than in the summer as there is less vegetation. The location away from the highway in combination with the year round vegetation should substantially screen the improvements even in the winter months. The proposed landscape plan is in Attachment 8. A natural landscape plan utilizing the native and existing vegetation is proposed. There are several large ponderosa pines on site which will provide year round buffering of visual impacts. The utility line extensions and larger driveway for fire protection access which are proposed as part of the minor amendment to a development permit will not create negative impacts to the view corridor after completion. Please refer to Attachment 9, elevations of the proposed home and Attachment 10, photo simulations of the view toward the proposed improvements from Highway 82, first heading east and second heading west. These photographs have a shaded area where the improvements will be, though they are not expected to be visible. The shading it to indicate where they may be partially visible in the winter months. The adjacent property has been developed at a similar distance from Highway 82 with a 15,000 square foot house and the home is barely visible, and is most often not visible at all. This is a good indication that the proposed development's visual impacts will be minimal, similar to this property adjacent to the west, the Potamkin residence. -3- ~~~Q~~ The Code's Scenic View Protection standards are addressed in the following discussion. The standard is given in bold and the applicant's response follows. Please refer to the elevations and the photographs in Attachments 9 and 10. 1. The proposed development shall utilize existing topography and natural vegetation, such as ridges, hills, and existing trees, to screen buildings to the maximum extent practicable when viewed from those right-of--way listed in subsection(b) above. The proposed improvements will utilize the natural vegetation and existing trees to the maximum extend practicable and this should substantially reduce the visual impacts which will be minimal anyway due to the location away from Highway 82. 2. The proposed development shall avoid the location of structures within the Scenic View Protection Areas, and shall avoid the location of structures within any Viewplane identified in the State Highway 82 Corridor Master Plan and Down Valley Comprehensive Plan, if possible. If location outside the Scenic View Protection Area and defined Viewplanes is not practicable, then the proposed development shall not be located on the highest ground or most visible portion of any site as viewed from those corridors listed in subsection (b) above. The proposed improvements are as far away from the protected view corridor as practical given the location at the base of a steep slope to the north and the Highway to the south. The improvements will not be on the highest ground and will be in the least visible portion of the property. The site is not within any mapped viewplanes. 3. The proposed development's height and bulk shall be designed to avoid, to the maximum extend practicable, the visibility of buildings from those corridors listed in subsection (b) above. This may include, but shall not be limited to, breaking the mass of the building down into a series of smaller forms, articulation of the building facades to avoid a wall or row effect, and staggering rooflines to avoid a long unbroken plane. As seen in the picture of the model of the proposed residence in Attachment 11, the bulk and mass of the home has been broken into a series of smaller forms, there is no wall or row effect with the design and the rooflines are broken and are not one continuous plane. The visibility of the home through the vegetation from Highway is limited and these design features will further minimize the visual impacts. The home will be a collection of individually articulated pieces. These pieces correspond to the various program elements of the home and lock the mass of the home into the landscape. Each piece is carefully sculpted and rotated to align with desired views and to mimic the angles of the surrounding mountains. -4- OQO~ 4. Proposed structure shall be placed so it does not project above a ridgeline such that a structure silhouettes against the sky when viewed from those corridors listed in subsection (b), unless there are no alternate building sites on the lot or parcel. There proposed residence does not project above a ridgeline, so this standards is not applicable. 5. The proposed development shall be designed to complement the natural topography of the land through the use of techniques such as earth-sheltered design, the use of natural materials and coloring, the use of low-reflectance materials, or clustering of structures on the least visible portions of the site. When a building is proposed near a ridgeline, then its form (particularly its roof form) shall replicate, parallel, or complement the natural form of the ridgeline so that it appears to be an element of the natural ridgeline. The proposed design complements the natural topography. The property is at the base of Smuggler Mountain and is predominantly flat, but rises gently up to the base of the steeper slopes which rise to the Mountain. Though the structure will be barely visible, natural materials and coloring and low-reflective materials will be used. A wide range of natural materials is proposed for the home including, but not limited to reclaimed wood board, shiplap wood siding, dry stacked stone, earth colored concrete and other similar natural appearing materials. Connecting elements such as bridges, stairs and study area will be weathered lead coated copper or something similar. 6. The proposed development shall preserve natural vegetation and avoid development within irrigated meadows, to the maximum, extent practicable. The site is heavily vegetated with dense brush, trees and ground cover which will be preserved as much as practicable. There are no irrigated meadows on the property. 7. The proposed development shall install utilities in locations and through procedures that minimize visual impacts to the maximum extent practicable. The water lines being added as part of the proposed utility line extensions will be underground and will be re-vegetated within one season after completion. The line to the well and from the pond will not result in visual impacts after completion of construction and revegetation. The addition to the driveway proposed for fire protection purposes is at the end where a turn around will be added. This is located away from the Highway and will have negligible visual impacts as it cannot be seen from the Highway. 8. All satellite dishes in the proposed development shall be located to minimize visibility from those right-of--way listed in subsection (b), and shall use earth tone colors and/or screening to minimize their visual impact. -5- • ooou~~ Any satellite dishes will be located to minimize visibility from the Highway. If visible, any dish will be screened with vegetation and will use earth tone colors as necessary. 9. The proposed development shall not use earth moving and berms as the primary means of compliance with these regulations, but earth moving may be utilized in conjunction with other techniques to comply with standards in this section. Where earth moving techniques are necessary, man-made forms should be undulating and natural in appearance. No berms are proposed nor necessary for screening. 10. In the Rural Areas only, development shall be located so that activities and development occur in at least one of the locations specified in subsection (f) as they may apply to the particular property. This property is not in the Rural Area. 11. EARTH TONE MATERIALS The exterior of all development, except development located and designed in the form of a ranch compound, shall be built or painted with indigenous earth tone materials or colors. The exterior or a ranch compound should be built or painted with indigenous earth tone materials, or shall be painted or stained using local, traditional ranch colors, which shall include shades of red, brown, or white. Paints or stains that simulate weathered barn wood also shall be permitted. Earth tone materials and colors are proposed for the development and the home will comply with this standard. 12. ROOFS All roofs shall have anon-reflective color or composition. Reflective roof materials shall not be used unless the materials are treated prior to installation to eliminate reflection, with the exception of materials associated with solar or photovoltaic equipment. The roofs will meet the color and composition requirements of this standard. 13. REVEGETATION OF DISTURBED AREAS Lands disturbed by earth moving or berms should be revegetated using native species that are already growing on or near the site. Topsoil shall be stockpiled and placed on disturbed areas. Irrigation shall be provided to the revegetated areas if it is necessary to ensure survival of planted native species. Lands disturbed by earth moving will be revegetated as necessary with native species already growing on site. Topsoil will be stockpiled and placed on disturbed areas. -6- ®ODO~u The on-site pond will provide for any irrigation necessary to ensure the survival of the revegetation and plant materials. 14. DRIVEWAYS AVOID DIVIDING MEADOWS AND PASTURES To the maximum extent practicable, roads and driveways shall be located to skirt the edge of and avoid dividing meadows and pastures and to avoid major road cuts. Roads and driveways should take advantage of the screening potential of natural topography and existing vegetation. Existing roads and driveways shall be used where practical. To enhance screening, a row of trees may be planted along the roads or driveways. To the maximum extent practicable, roads and driveways located around the edge of or in meadows shall be laid out with soft, curving edges and shall avoid straight line corridors that are incongruous with the natural setting. A large part of the proposed driveway is existing. As it is located in heavy vegetation, visibility from the Highway is minimal. The natural, existing trees and vegetation will screen the driveway. There is no meadow on the property so the driveway will not split or divide a meadow. The driveway is soft with curving edges and fits in with the natural setting. Each of these standards to minimize visibility from the Highway 82 Scenic corridor will be met. SUMMARY The Applicant owns a vacant property on Independence Pass, one mile east of downtown Aspen and is requesting approval of a Minor Amendment to a Development Permit and Scenic View Protection review for his property A 1041 Site Plan was approved for the property, along with a minor amendment regarding fencing and dogs, in 2004 and 2006 respectively. The current owners are now seeking approval to a minor amendment to the approvals which would allow two short underground pipes to be installed, one to the existing well and one from the pond to be used for fire protection purposes. The approved driveway is also proposed to be expanded for improved fire access by providing an appropriate turn around for fire vehicles. The owner is also seeking approval for a Scenic View Protection Review as the property is adjacent to the Highway 82 Scenic Corridor. The site is heavily wooded with trees and other vegetation and visual impacts from the scenic corridor are minimal. The design and materials proposed for the home are such that the residence will blend with the topography and the surroundings. Juliet Shield ("Applicant") has applied to the Pitkin County Hearing Officer ("Hearing Officer") for approval ofa building envelope. 2. The parcel is located on State Highway 82, approximately I.5 miles east of Aspen, and is more specifically described in Exhibit A. The parcel contains 3.3 acres and is anon-conforming sized parcel in the AFR-10 zone district. 4. The parcel was created prior to June 12, 1978, and has not merged with any adjacent parcels, and, therefore, is exempt from growth management up to 5,750 square feet of floor area. 5. The original 1 acre parcel was increased to 3.3 acres through a lot line adjustment in 1981 -the plat was recorded in Piat Book 16 at Page 81. The Planning Commission granted 1041 hazard review and scenic overlay approval pursuant to Resolution No. PZ-91-17. The BOCC granted general submission approval pursuant to Resolution No. 91-34. The 1041 site plan was recorded in Plat Book 29 at Page 12. The BOCC granted an extension of vested rights pursuant to Resolution No. 96-27b; the vested rights expired in 1999. 6. The Hearing Officer considered this application at a duly noticed public hearing on November 1 b, 2004, at which time evidence and testimony were presented with respect to this application. 7. The Hearing Officer finds that while the proposed building envelope is adjacent to elk winter range/critical habitat and an elk migration corridor, the impacts of the development can be mitigated. 8. The Hearing Officer further finds that the building envelope avoids wetland or riparian areas adjacent to the ponds, is located on slopes of less than 30%, and the wildfire hazard is rated as low and can be mitigated. NOW THEREFORE BE IT RESOLVED by the Pitkin County Community Development Hearing Officer that he does hereby approve the Shield 1041 Hazard Review and Conceptual Submission, subject to the following conditions, which shall run with the land and be binding on all successors in interest. I . This approval and the conditions herein shall repeal and replace Planning Commission Resolution No. PZ-91-17, and BOCC Resolution Nos. 91-34 and 96-276, and their conditions of approval. 2. Prior to submission of any earthmoving, access, or building permit applications, the Applicant shall submit a 1041 Hazard Review Site Plan to the Community Development Department for approval and recording. The mylar copy of the site plan must be signed by the owners prior to submittal for recording. 3. The Community Development Department steal[ review and approve the mitigation plan prior to issuance of any building permits, and the Applicant shall comply with any specific mitigation measures recommended by this analysis. 4. A structural engineer shall design the foundation walls and footings to resist lateral forces and to insure proper foundation design for soils, which are likely to be hydrocompactive. 5. Prior to submission of a septic permit for the new residence, the Applicant shall provide documentation of an adequate domestic water supply on the property. Quantity and quality of said supply shat I meet the approval of the Environmental Health Department. 6. Prior to issuance of any building permits for the new residence, the Applicant shall: A. Submit an application for Scenic Overlay_.R~wfew, once building plans are prepared. B, Complete a fireplace/woodsfdve'registration form with the Community Development Department, if necessary. C. Obtain a County access/driveway permit to improve the driveway. D. Obtain a CDOT access permit. E. Submit a mitigation report from an engineer or geologist licensed in the State of Colorado. The report shall demonstrate that the site can be engineered in such a way that there is no hazard posed, and shall show the area of disturbed slopes, any re-grading required and the size and location of all mitigation devices. Any new development shall be conditioned upon compliance with the report. F. Submit a drainage and erosion control plan for review and approval by the County Engineer. G. Submit a construction management plan for review and approval by the County Engineer showing the locations of staging, material storage and employee and construction traffic parking. No parking or other construction related activity may occur within the highway right-of--way. H. Pay the applicable road impact fee. I. Obtain approval of a septic permit from the Environmental Health Department. The septic system shall be located within the approved building envelope, and must comply with the setback requirements from surface and groundwater sources. A qualified professional engineer must design the system. 7. Prior to commencement of any earthmoving or construction activity, the Applicant shall stake the corners of the building envelope and install construction fencing around the perimeter of the building envelope. The fencing shall remain in place until a Certificate of Occupancy is issued for the residence. 8. The Applicant shall comply with the following landscaping and wildfire defensible space mitigation standards: A. Within 30' of all structures, all upland brush species (oak, serviceberry, chokecherry, sagebrush, etc.) shat) be removed and remaining stumps shall be painted with Garcon herbicide to prevent resprouting. Wetland species (willow, birch, alder) may remain, unless within 15' ofa window. B. All other vegetation shall be kept to less than 1' in height within 30' of all structures. D. All branches from trees and brush within 30' of all structures shall be pruned to a height of 10' above the ground with removal of ladder fuels from around trees and brush. E. AI! deadfall within 50 feet of all structures shall be removed. F. Installed or native landscaping within 20' of the residence shall not contain any brushy or coniferous species. Aspen trees may be planted, but not within 10' of the residence and shall be kept limbed to 10'. G. The Applicant shall be responsible for the continued maintenance of the defensible space vegetation requirements. 9. The Applicant shall comply with the following additional wildfire mitigation standards: A. Roofs shall be constructed with a Class A roof covering or a Class A assembly as defined in the UBC 1997 Section ] 504. Wood shake/shingle roof coverings are prohibited. Roofs with less than a 3:12 pitch are not permitted unless they comply with the following: 1) All roof coverings shall be constructed of non-combustible materials and installed on a Class A roof assembly. 2) All roof coverings shall have a surface that shall facilitate the natural process of clearing the roof. 3) All roof designs shall facilitate the natural process of clearing roof debris. Protrusions above the roofline, such as parapets, shall be prohibited. 4) Roofs shall be installed as required by the adopted building code and shall have a minimum slope of 1:48. S) Alt roof designs, coverings, or equivalent assemblies shall be specifically approved by the Fire Marshal prior to submittal of a building permit application. B. Vents shall be screened with corrosive resistant wire mesh with mesh %< inch maximum. C. Roofs and gutters shall be kept clear of debris. D. Yards shall be kept clear of all litter, slash, and flammable debris. E. All flammable materials and firewood/wood piles shall be stored on a parallel contour a minimum of 1 S feet away from any structure. F. Weeds and grasses within a l 0 foot perimeter of all structures shall be maintained to a height of not more than 6 inches. G. Swimming pools or ponds shall be accessible to Fire Department vehicles. Propane tanks shall be installed according to NFP A 48 standards and on a contour away from the structure with standard defensible space vegetation mitigation around any above-ground tank.
