COLORADO, GRANTING APPROVAL OF THE WILLIAMS EXTENSION OF VESTED REAL
PROPERTY RIGHTS

RECITALS
1. J. Winston Williams, (hereafter "Applicant") has applied to the Pitkin County Board of County
Commissioners (hereafter "Board") to consider an extension of vested real property rights pursuant to
Section 4-140-30.
2. 1041 Hazard Review and General Submission approval to construct a single family residence
was granted by the Board pursuant to Resolution No. 94-195.
3. The property is located approximately 2.2 miles from East Sopris Creek Road up Section 36
Road, and is more specifically described in Exhibit A.
4. The parcel is zoned RS-30 and contains approximately 35.3 acres.
5. The Board reviewed the request at its regularly scheduled meeting of March 25, 1998, at which
time evidence and testimony was presented with respect to this application.
6. The Board determined that the proposed development meets the criteria establi;,ned in Section 4-
140.30 of the Land Use Code, and, therefore, found the extension to be appropriate.
NOW, THEREFORE, BE IT RESOLVED by the Pitkin County Board of County
Commissioners that it does hereby grant approval of the Williams Extension of VestedRights, subJ ect
to the following conditions and all conditions of Resolution No. 94-195, except as amended below.
1. The applicant shall comply with the following landscaping and wildfire defensible space mitigation
standazds:
A. Brusli, debris, and non-ornamental vegetation shall be removed within a minimum 10 foot
perimeter azound the structure.

B. Vegetation shall be reduced to break up the vertical and horizontal continuity of the fuels a
minimum of 40 feet uphill and to the sides and 47 feet downhill of all structures, hereafter
the "perimeter".
C. Spacing between clumps of brush and vegetation within the perimeter shall be a minimum
of two times the height of the fuel. Maximum diameter of the clumps shall not exceed 10
feet. All measurements. shall be from the edges of the crowns of the fuel.
D. All branches from trees and brush within the perimeter shall be pruned to a height of 10
feet above the ground and ladder fuels from around trees and brush shall be removed.
E. Tree crown separation within the perimeter shall have a minimum of 10 feet between the
edges of the crowns.
F. All branches which extend over the roof eaves shall be trimmed and all branches within I S
feet of the chimneys shall be removed.
G. The density of fuels within a 100 foot perimeter of all structures shall be reduced.
H. All deadfall within the 100 foot perimeter shall be removed,
I. Low vegetation shall be maintained within a 10 foot perimeter around all structures.
J. The applicant shall be responsible for the continued maintenance of the defensible space
vegetation requirements.
2. The applicant shall comply with the following additional wildfire mitigation standards:
A. Roof construction shall be Class A, non-combustible material with no flat roofs.
B. Vents shall be screened with corrosive resistant wire mesh witkmesh'/o inch maximum.
C. Roofs and gutters shall be kept clear of debris.
D. Yards shall be kept clear of all litter, slash, and flammable debris.
E. All flammable materials shall be stored on a parallel conbur a minimum of 15 feet away
from any structure.
F. Weeds and grasses within the 10 foot perimeter shall be maintained to a height not more
than 6 inches.
G. Firewood/wood piles shall be stacked on a parallel contour a minimum of 15 Feet away
from the structure.
H. Swimming pools shall be accessible to Fire Department vehicles.
I. Fences shall be kept clear of brush and debris.
J. Wood fences shall not connect to the structure.
K. Any outbuildings or additional structures shall adhere to the. same standards as structures.
L. Fuel tanks shall be installed underground with an approved container.
M. Propane tanks shall be installed according to NFPA 48 standards and on a contour away
.from the structure with standard defensible space vegetation mitigation around any above-
ground tank. Any wood enclosure around the tank shall be constructed with materials
approved for 2 hour fire-resistive construction on the. exterior side of the walls.
N. Each structure shall have a minimum of one 10 pound approved ABC fire extinguisher
placed in a visible and accessible location.
O. Addresses shall be clearly marked with 2 inch non-combustible letters and shall be visible
and installed on anon-combustible post.
P. Utility tines shall be buried within the driveway alignment.
Q. Pullouts shall be located at a minimum of 750 foot intervals along Section 36 Road to
accommodate two-way traffic. Some flexibility in the location of the pullouts will be
allowed to promote their assimilation with the existing topography and vegetation.
R. The applicant shall consult the Basalt Fire Protection District on the design and
construction of aturn-around area on Section 36 Road for emergency vehicles.

S. The applicant shall install a sprinkler system or foam fire retardant system in the residence.
The system shall meet the requirements of the Basalt Fire Protection District and the
Uniform Building Code.
T. The applicant shall install an underground water storage tank to accommodate a minimum
of 1,000 gallons. Capacity and location shall be determined by the Basalt District Fire
Mazshal.. Photo documentation of the underground tank shall be submitted to the Building
Division, prior to issuance of a Certificate of Occupancy.
U. The structure shall be designed and located in such away that no decks or any part of the
structure will protrude over, abut or be within 35 feet of the steep oak-covered slopes to the
east, west or south of the building envelope.
3. No development, including grading, landscaping, vegetation removal'ot disturbance, well and
septic system, shall occur outside of the approved building envelope, except for utility and
driveway extension and maintenance, and as may be necessary to implement the wildfire mitigation
measures required elsewhere in this document.
4. The applicant shall adhere to all material representations made in public heazings and in the
application.
5. This extension shall expire three years from the date of this approval on March 25, 2001.

4. The Planning and zoning Commission reviewed this
application on August 2, 1999 and found that• this proposal
complies with.the criteria set forth in Land Use Code Sections
5-400.and 6-3.

Colorado reg3 tered professional engineer. Foundation plans
.,shall be submitted at the time of building permit application.
The Applicant shall obtain an access permit from the County
Engineer, prior. to issuance of a, building permit,. '
.The Applicant shall submit a drainage and erosion control plane
-which meets the approval, of the County Engineer, prior to the
issuance of a building permit, The plan shall nolude, bnt is
not limited to, the insta.llatiop of temporary sedimentation
ponds, hay bale dikes, and diversion swales for temporary
.erosion cont~:al measures during construction to prevent soil
and sediment from impacting East Sopx-is Creek. In addition,
the plan shall address drainage and erosion contz-ol measures
for the access driveway.
6. The building site shad be revegetated with native grasses to

and paved areas shall be detained on-site through the use of
dry wells.

7. The .proposed access drive shall be improved to meet County
standards,` as specified by the County Engineer,'prior to the

REQUEST: Pursuant to Section 4-140.30, the applicants are tequesting a three year extension of the
vested properly rights for the 1041 Hazard Review and General Submission approval granted pursuant to
Resolution No. 94-195.
APPLICANT: J. Winston Williams
REPRESENTATIVE: Kent Schuler
LOCATION: Metes and bounds parcel located approximately 2.2 miles up Section 36 Road from East
Sopris Creek Road.
ZONING/LOT SIZE: The lot is zoned RS-30 and contains;approximately 35.3 acres.
REFERRAL COMMENTS: Comments from Environmental Health are attached for reference. The
application was also referred to the CO State Forest Service, Basalt Fire and the Wildlife Officer, but no
comments were received. The comments from 1994 from the State Foresf Service are included with the
application. The previous recommendations from Basalt Fire are incorporated in the conditions of
approval.
STAFF COMMENTS: There are no proposed changes to the Site Specific Development Plan. The
approval was granted under the provisions of the "old" Land Use Code. Staff has reviewed the previous
approval for conformance with current County policies andregulations.
1041 HAZARD REVIEW: Hazards on the parcel include severe wildfire hazard areas, slopes in excess of
30%, and the parcel is located within elk-and mule deer winter range.
Geologic: The slopes within the building envelope range from 10-25%. The driveway designated on the
site plan crosses small areas of lopes in excess of 30%
Wildfire: The wildfire hazard on the site was rated as severe by Kelly Rogers of the Colorado State
Forest Service during the review in 1994.' Mitigation tequired inResolution No. 94-195 included
defensible space thinning, use ofnon-combustible roof materials, creation of pullouts and a turnaround
for emergency vehicles on the access road, installation of a sprinkler system and an undergound water
storage tank, and prohibition of construction over or near the steep oak covered slopes to the east, west or
south of the building envelope. These mitigation measures are consistent with the provisions of the
"new" Code; staff has included the previous requirements in the conditions of approval of this extension.
Development within a severe wildfire hazard area. is prohibited under the current Code, unless there is no
area on the property free of severe wildfire hazard. 'The entire property is considered severe, and Mr.
Rogers considered the building envelope to be in the best location, given the fact that other portions of
the lot contain more dense and higher brush.
Wildlife: Resolution No. 94-195 recommended kennelling of dogs and wildlife compatible fencing to
mitigate the impact of construction of the residence within elk. and mule deer winter. range. These
standards aze consistent with the "new" Code.
VESTED xiGxTS ExTENSioN: The Boazd shall consider, but not be limited to, the following criteria in
reviewing a request for an extension of vested property rights:
1. Compliance with conditions of approval: The. site plan was recorded in Plat Book 35 at Page 98,
and was amended as required by Resolution No. 94-195 to reduce the building envelope. The other
conditions of Resolution No. 94-195 are not applicable until buildingpermit submittal or issuance.
2. Progress in pursuing the project: The applicant recently purchased the property, and has not had
time to develop.
3. Nature and extent of benefis received by the County: No benefits were required to be granted to
the County as a result of the previous approval.
4. Needs of the County and the applicant that would be served by approval of the request: The
extension allows the County to update the approval to be consistent with the current standards of the
Code and allows the applicant additional time before proceeding with development of the property.
RECOMMENDATION: Pursuant to Section 4-140.30, staff recommends that the Board approve the
Williams Extension of Vested Rights, subject to the attached Resolution.

The Aspen/Pitkin Envirommental Health Department has reviewed the details of the Williams
application under the authority of the Pitkin County Land Use Code. The conditions that this
Department required in the 1994 approval remain the same. Clarification of regulation changes are
discussed below.
ADEQUATE PROVISIONS FOR WATER NEEDS: Sections 2-17 and 3-1104:
'7t is the policry ofthe County to insure the avaita6ility of awafer supply of adequffie quality, quantity, pressure and dependability for fire protection
and support of aproposed land use prior to approval of the use.'lhe Comely shalt require land uses to hookup to exisdag public systems if service
is available."
This Department needs adequate information on the quantity and the quality of water available.
The quantity can be determined from a pumping test of the well on-site by a water engineer's or
well driller's report. The applicant must ensure that the water quality is acceptable by having it
tested by a lab such as the Snowmass Water and Sanitation District or Aspen Consolidated
Sanitation District. Before a septic permit can be issued, the well must be drilled to assure that
setback requirements from the well to the septic system can be maintained. Pitkin County Land
Use Code requires that the well site be within the building envelope.
A condition of approval for this application is the receipt of information documenting
that the location of the well meet setback requirements and can be placed within the
building envelope and that quantitylquality of the welt water is adequate. Without
meeting these requirements a septic permit and building permit cannot be issued.
SEWAGE TREATMENT .AND COLLECTION: Sections 2-18 and 3-1105:

Lots in the Sopris Creek area are served by individual septic systems. All such systems installed
within Pitkin County require septic permits issued by the Environmental Health Department; and
must comply with the County's septic regulations. To receive a septic permit, the applicant will
need to submit a septic permit application through a Registered Professional Engineer who will
design the domestic wastewater system. Included in the packet must be percolafion test results and
profile hole information, site plan with pertinent physical features, floor plan for the dwelling, and
a copy of the County's approval for the extension of vested rights. Once the completed application
is received, the Department will analyze and review the proposed septic design. Before a building
permit can be approved, a septic permit must be issued.
The applicant should be aware that horizontal setback distances between components of a sewage
disposal system and pertinent physical features will increase when the calculated sewage flows for
a dwelling are in excess of 1,000 gallons/day. This flow is determined by the square footage of the
home and the number of bedrooms or rooms that maybe used as bedrooms in the future. As the
size of a home increases, it is likely that the required setbacks will also increase. The ,~,;n;r„um
setback from the property's leach field to the well or arty neighboring wells is 160 feet.
A condition of approval for this application is the receipt and approval of the septic
permit by the Environmental Health Department before a bnilding permit can be
issued.
WATER QUALITY IMPACTS: Sections 2-14 and 3-705 and 3-710•

flows, further deslruMion of wildlife habitat, m major exprndinses to reacquire or redistribute major water resources. It is also the policy of the
County to maimain anamral vegetative bufferalong its surface waters such that the surface and groundwaters afthe area are not encroached upon by
land uses or other hmnan activities which could cause deterioration of water quality or impair the natural treatment processes provided by meadows
and wetlands."
The Environmental Health Department will be addressing water quality impacts on down stream
water quality. This application is not expected to impact down stream water quality if the minimum
horizontal distances between components of the system and physical features are in accordance
with the }?itkin County Sewage Regulafions.
The Environmental Health Department is charged with preserving and protecting the quality of
Pitkin County's water resources. Since a large percentage of the population is dependent upon
water from wells, elimination of groundwater pollution, and protection of aquifers and their
drainage areas are of utmost importance. Roofs and asphalt areas can be nonpoint sources of water
discharge which can contaminate water supplies. This Department recommends that nonpoint
sources of discharge be retained on the property of origin which can be accomplished through
landscaping, drainage patterns, detention ponds, and dry wells for water runoff from buildings.
The County Engineer should review all pacing and drainage plans.
There is no condition of approval.
AIl2 OUALTTY: Sections 2-13 and 3-602:
"Only thffi development is permitted which will not contribute significantly to degradation of air quality in PitkinCouiuy. Developments may not
constitute an indirect or direct air pollution souree under Federal, State or County regulations."
FIREPLACE
The applicant must file a fireplacelwoodstavepermit with the Environmental Health Department
before the building permit will be issued if such devices are to be used.. The less densely populated
parts of the 1'itkin County like this site may have two devices per building: a maximum of one
wood burning fireplace and a second device which can be either a gas log fireplace or a certified
woodstove. In addition, unlimited numbers of decorative gas appliances are allowed. Coal may not
be burned in any device. No wood burning device maybe installed in barns or agricultural
buildings.
A condition of approval for this applicatf®n is the receipt and approval of the
fireplace/woodstove permit by the Environmental Health Department before the
building permit can be issued'.

submitted by Davis Horn, Inc., and visited the site on May 24th,
1994. i have the following comments with regard to w ildfire
hazards...
vegetation on .the Joy lot consists of _,patchy oak and serviceberry
brush approximately 2 to 8 feet in height, interspersed with
sagebrush and grass. Slone is about 15~ on this suite. The,
building envelope as identified on the site plan contains fairly
low brush interspersed with bare; rocky owtcrops: Other portions
of the lot have more_„dense, higher brush, with scattered junipers
and some aspen timber. The site has been„mapped as severe
wildfire hazard; the vegetation and slope on much of this and the
adjoining lots pose a significant threat from wildfire. Under,
favorable burning conditions, a fire originating below this site
would probably'be quite intense and difficult„to, control. This
~., .. ~.,. _ .u..,u. risk should be'mitgated substantially by impfiementing the
measures specified under the Wildfi,re,sectioh_n, they application,
in particular the standard o,n n,on-combustible roofing materials.
Additional mitigation measures on this site should include:
-Removal of all vegetation within 10 feet of structures.
This area should be, maintained as low ground cover such as
mowed grass.
-Vegetation thinning and landscaping to a minimum of „45 feet
around the structure,with,a minimum of 10 feet crown
separation between clumps of oak%serviceberry. Remaining
clumps should not have.a crown, diameter in excess of ib

downhill side of the structure if the actual footprint. is on
the steeper ground of this parcel.

The current access road does not meet:C~~~ standards for grade
and width, and does not provide `for dual ingress%egress to'the
area. In the event of a large wildfire in this area,'the high
hazard fuels along much of this road combined with the relative
remoteness of the site might limit access for emergency vehioles
into this and adjacent parcels. For these reasons, 'it is even
more important that the applicant`understand`the potentiaT`risk
from wildfire, and that appropriate mitigation measures as
outlined in this letter and'the` Tand use application are taken.

Pitkin County, Pursuant to Board of County Commissioners Resolution No. 96-
52, has established a fee: structure, for the processing of land. use applications.: A ,
flat fee or deposit is collected for eland use .applications based. on the type. of
application. submitted.. Referral. fees far other. County departments reviewing. the
application will also be collected when.. necessary. One check including .the
deposit for Planning and referral agency fees must be submitted. with each land use
application, made payable to the Aspen/Pitkin Community Development
Department. Applications will not be accepted for processing without the required
application fee..
A flat fee is collected by Planning for Staff Approval which normally take a
minimal .and predictable amount of staff.. time to process. The fee is not
refundable..
A deposit is collected by Planning when more. extensivestaff review. is. required;
as hours are likely to vary substantially from one application to another. Actual
staff time spent will be charged against the .deposit. After the deposit has'"been
expended, the applicant. will be billed monthly based on actual staff hours.
Cur; ent billings must be paid. within 30 days or processing of the application will
be suspended.. If an ;applicant has previously failed to pay application fees as
required, no new or additional applications will. be accepted. for processing until
the outstanding fees are paid.. Outstanding balances must be paid before a Land
Use Takings Determination is heard before the Board of County` Commissioners.
In no case will Building Permits be issued until all .costs associated with case
processing have been. paid. After the final action on the project, any remaining
balance from the deposit will be refunded to the applicant.
Applications which require a deposit must include an Agreement for Pa~nent of
Development Application Fees. The Agreement establishes the applicant as being
responsible for payment of all costs associated with processing the application.
The Agreement must be signed by the party. responsible -for payment and
submitted with the application in order for it to be accepted.
