The Pitkin County Open Space and Trails Board, on behalf of the Meyer Family Partnership (hereinafter "Applicants"), request a Subdivision Exemption to create a parcel to facilitate the maintenance of the existing trail and to provide for further improvements to the public access and facilities. 2. The parcel is zoned AF-1 and contains 5.846 acres. 3. The property is located approximately 1/2 mile south of the Basalt city limits adjacent to SH 82 and the SH 82 Basalt Bypass. 4. On August 24, 1993 the Pitkin County Planning and Zoning .Commission (hereinafter "Commission") reviewed the Meyer Subdivision Exemption for the Creation of a Community Facility and the Rezoning from AF-1 to Public. The Commission recommended the approval of both requests. 5. The Applicants received approval from the Pitkin County Board of County Commissioners`(hereinafter referred to as the "Board") for the rezoning of the parcel from AF-1 to Public pursuant to Ordinance No. 93-,~. 6. The Pitkin County Open Space and Trails Board, on behalf of the Meyer Family Partnership (hereinafter "Applicants") have applied to Pitkin County to request the rezoning of a 5.846 acre parcel from AF-1 to Public. 2. The Applicants received approval from the Board of County Commissioners. .(hereinafter "Board") fora subdivision exemption for the creation. of a community facility pursuant to Resolution No. 93- t 3. RE: Meyer/Pitkin County Subdivision Exemption and 2nd Reading & Public Hearing - Rezoning for a Community Facility SUMMARY: On September 14, 1993 the BOCC approved first reading of a rezoning of a portion of the Meyer parcel to Public.. The purchase and subdivision of the Meyer property will be for the purpose of converting the subdivided property into .open space and trails facilities and to insure public access to the trail segment which already exists on the property. The property consists of two parcels separated by old Highway 82 (refer to the attached site map). One parcel is located on the north side of the Highway and is 2.739 acres. in size, while the other is located to the south between the Roaring Fork River and the Highway. The latter parcel consists of 3.107 acres. The Open Space and Trails Board has determined that the property meets the Land and Trails Acquisition Criteria required to purchase land for public use. The property also complies with the land use criteria for a public zone district, therefore, rezoning is recommended by the Planning and Zoning Commission and the Planning Office at this time. REQUEST: On behalf of the Meyer Family Partnership, the Pitkin County Open Space and Trails Board is requesting the following approvals: 1. Subdivision Exemption for the Creation. of a Community Facility, pursuant to Section 4-2.2(a)(4) of the Land Use Code. :' 2. Rezoning of the parcel from AF-l to Public, pursuant to Sections 1-2.2, 1-2.3, and 17-2.3 of the Land Use Code. DESCRIPTION bF THE PROPOSAL: The` Open Space and Trails Program proposes to purchase the parcel to facilitate the maintenance of the existing trail and to provide for further improvements to public access and facilities. The details of management and use of the property will be included in a Management Plan to be developed by the Open Space and Trails Board upon acquisition of the property. However, the following parameters have been established: - It will be available to the general public,. although access and use will be restricted by the Management Plan. f - The trail segment will be limited to non-motorized traffic. - The balance of the property will be available for passive uses, including picnicking, fishing and boating access to the Roaring Fork River. STAFF CONMENTSE Pursuaht to Section 4-2.2(a)(4) of the Land Use Code, the Board of County Commissioners may exempt from the definition of subdivision and subdivided land, any division which creates parcels for community facilities' provided. that the exemption conforms with the policies and regulations of the Code. The proposed 5.846 acre parcel does not conform to the area and bulk requirements for the. AF-1 zone district, therefore, rezoning of the property to Public is necessary to facilitate the creation of a conforming lot. REZONING:. Pursuant to Sections 1.12 and 17=2. 3 of 'the Land Use Code, rezoning approval is subject to compliance with. General Submission criteria and compliance with the intent of the requested zone district. Intent Section 3-1.10 of the Land Use Code stipulates that the intent of the PUB, Public Zone District "..is to provide for the development of public uses, facilities and services for governmental, civic, educational, humanitarian, health care and other public purposes which are consistent with the land use plans and related uses which are customarily incidental or accessory to public uses, facilities and services." Use of this parcel for the provision of public access to public land and facilities clearly complies with the intent of the district. Area and bulk requirements for the public district as they relate to the specific site design will be considered during Special Review, as will a management plan, conceptual site plan, a landscape and revegetation plan and a drainage and erosion control plan. Compliance with Policies and Regulations - 1041. Hazards - Floodplain - Portions of the property, specifically that area between old Highway 82 and the Roaring Fork River, are within the 100 year floodplain. The Applicant has indicated that no structures or earthwork will take place in these areas that would change the existing streamflow or flood patterns. Any and all development in these areas will be reviewed by the appropriate referral agencies and mitigation of potential impacts will be required as necessary. Geologic - Parking area and trail construction could create minor and temporary instability. The mitigation of these potential hazards. will be required as necessary. Wildlife - Any and all development in the floodplain may result in impacts to the riparian wildlife habitat. The proposal will be referred to the DOW and mitigation of potential impacts will be required as necessary. The site contains no other mapped 1041 hazards. - Visual Quality - The site is within the viewplane of the SH 82 Basalt Bypass and the old Highway 82 access to Basalt, but is not within the mapped Scenic Overlay Zone. The acquisition of the property will preserve the visual quality of this area by precluding future development. Controlling use through the development of well-marked, maintained and. patrolled facilities should help to preserve the long-term visual quality of the area. The Applicant has committed to mitigate any degradation, due to trail and parking facility development, by revegetation and landscaping. However, as part of Special Review, the Applicant will be required to submit a plan for revegetation and landscaping which will be evaluated by the Planning Office, the County Engineer and the Public Resource Department. SUMMARY: The Planning Commission and Staff find that the proposed land use complies with the intent of the public zone district, and generally complies with the policies and regulations of the Land Use Code. However, during Special Review, more information must be submitted by the Applicant to fully evaluate the details of site design, management, drainage and erosion control, water quality and landscaping. The Board approved: the 1st Reading at the September 14, 1993 regular meeting. As the subdivision exemption is dependent upon ~-, n~ the approval of rezoning, the Board should approve both requests at this meeting. RECOMMENDATION: The Planning Commission and Staff recommend that the Board of County Commissioners approve the second reading of the rezoning of a 5.846 acre portion of the Meyer property from AF-1 to Public and approve the subdivision exemption for the Creation of a Community Facility, pursuant to the following conditions: 1.
