The two,pre-existing lots merged in 1977. APPLICANT: David Frank Bishop and Dianna Gail Bishop. APPLICANT'S REPRESENTATIVE: Robert Francis, Attorney. at Law. DESCRIPTION OF THE PROPOSAL: The 1 52 acre parcel consists of a ~_ ~..,.,~...v~.. F single family residence which is approximately 1,250 square feet in size which was constructed in 1967. The 0.62 acre .parcel consists of a single family residence which is approximately 1,900' square feet and was constructed in 1969. LOCATION: The parcel is located adjacent to the Holland Hills...... Subdivision. Holland. Hills consists of 55 .parcels ranging from 0.3 acres to 2.8 acres. ZONING: The 2.14 acre parcel is zoned AF-1. SEWER: The existing homes are serviced by on-site septic tank absorption systems. WATER: There is one well shared by both residences for water.; needs.. ACCESS: The. parcel is accessed via the Holland Hills: Subdivision road. system to Adams Way. REFERRAL AGENCY COMMENTS: 1. Environmental Health Department- In a memo dated December 31, 1991 the Environmental Health Department submitted the .following summarized comments: Sewaae Treatment and Collection- It is our conclusion that the soil on this site should°be suitable for the operation or replacement construction of individual sewage disposal systems which will comply with the Pitkin County Reaulations on Individual Sewage Disposal Svstems. The applicant is aware and should .document on the recorded plat the septic system n ~ location for the split level house... As drawn, the proposed lot line bearing west is very close to and parallels the_ septic tank-absorption field_ ystem location. To meet the regulations this system should be located at least ten (l0') from the property line. Control. of irrigation water and drainage courses on the lots may prove important to sewage disposal system operation, and should be addressed as an overall part of the site drainage plan. Water Needs- We recommend. that the water be tested to , determine if all significant water quality parameters meet the requirements of the Colorado Department of Health. The general aquifer. yields wells .producing less than (10) gallons per minute. Without adequate storage of 500 gallons or more, this is an insufficient, quality for two houses during peak usage. We recommend that the well be pump tested, and if the yield is less than 15 gallons per minute, adequate storage be provided. The documentation and easements for the shared well, as recorded in the deeds, are 'vague, unspecific, and rely on outdated costs for the operations and maintenance of a water supply system. Anew, updated, shared well agreement should be recorded which spells out easements and ,provides for maintenance. This should be reviewed by the County Attorney. 2. County Zoning- In a memo dated" December 16, 1991 Joanna Schaffner raised the following issues: Zoning- This parcel is just over two acres in the AF-1,(10 acre) zone district. It is' non-conforming in size, hence, subdividing., this parcel will. result in greater non- conformities. Setbacks- The required setbacks for. the AF-1 zone district are 100" Poot front yard, 30 feet side and rear yards. Portions of both residences are located within the required setback areas. Any future development in these areas will require Board of .Adjustment variances.. Other-- The two lots do not appear to close. Ownership of the two slivers of land should be resolved. 3. County Attorney- In a message dated January 17, 1992, Assistant County Attorney John Ely submitted the following comments: Due to extended and existing uses of the property and the fact the parcel has been occupied by two households and the fact 2 that the merger occurred in 1977, I don't see any reason not to let this go through with the restriction (if one is even needed) that there be"no further development on the property. 4. Holland Hills Homeowners Association- In a letter dated December 5, 1991 Monroe Summers 'commented that the homaowner's association has no objection to the applicant's request. 5. Basalt Fire Protection District- In a phone conversation on January 21, 1992 with. Chief Thiering, he indicated that there are no issues associated with this application.. 3TAFF COMMENTS. The residences depicted on the plat were held in separate ownership until 1977. The Bishops acquired the residences at separate times, the 1.52 acre parcel from Valdez in 1970 and the 0.62 acre parcel from Hoaglund in 1977. At the time the Bishops acquired the Hoaglund parcel, cumulation or merger occurred between these two. parcels. Section 7-2.3 Cumulation of the Land Use Code describes' this action. Since 1977, -the Bishops have owned. both residences. They have lived in one, and rented the other. The Bishops how wish to sell each residence separately, but the current land use regulations of the County prohibit such a separation without Board of County Commissioners approval. The Holland Hills lots adjacent to the Bishop parcel are .32 to .41 acres in size, and approximately 77' x 220' by dimensions. The separation would .create a 1.52 acre triangular shaped parcel and a .62 acre parcel which is approximately 80' x 260'. The separation would not create any parcels which are substantially different in size or dimensions than the adjacent Holland Hills Subdivision. However, the newly created parcals are substantially smaller in size and dimensions than .the adjacent ranch"to the north. Subdivision Regulation Section 4-2.2(a)(6) Other Exemptions (6) is for the purpose of subdividing fully developed lands under existin zonin or zoni occurred g g 4 ng in effect when the development ..(even thou h resulting lots and uses be nonconforming) if the development was done in conformance with the law at the time and not done .(without subdivision approval) to avoid subdivision (or othef land use) regulations. For the purposes of this subsection "fully developed" includes a requirement that there shall be no. restoration, reconstruction or replacement of any legally established structure. that results in any change in use, addition of dwelling units, or expansion of .floor area. This limitation does not preclude Ehe remodeling of an existing 3 i residential dwelling unit that may result in an expansion of floor area. (Amended by Resolution 89-61, June 1989) Response: The existing residences on the parcel were developed in 1967 and 1969. County zoning did not extend to this area until 1973, therefore, the development of the two residences in the late 1960's was done in conformance with the law at the time. Should the applicant's request be approved, the properties shall be restricted against restoration, reconstruction or replacement of the structure but ,does not preclude the remodeling of the unit which may result in an expansion of floor area. For informational purposes, the applicants should understand that in the revised land.... use code under consideration, Yemodeling as related to fully developed lands subdivision is limited to "within the existing footprint". Second story additions may be permitted. SIIMMARY: The applicant's. proposal to separate a nonconforming parcel with two legally established residences will be consistent with the criteria of the Land Use 'Code 'if the issues raised by the referral agencies are adhered to by the applicant. If this request is approved, the applicant will need to revise the draft plat to be consistent with Appendix A of the Land Use Code. RECOMMENDATION: The Planning Office recommends. approval of the applicant's .request subject to the following conditions: 1. The subdivision shall be comprised of two lots. 2. Proof of ownership: Attached are deeds to the Bishops from the Hoaglunds and Valdezs. 2. Chain of title: I have attached the. chain of title documents for the big parcel out of which both ubject parcels were derived. 3. Proof of/date of legal creation: In this regard, I have enclosed copies of the records from the assessor's office establishing the respective dates. of the creation of both residences. 4. I have enclosed herewith a copy of a recent survey showing existing lot lines, proposed lot ,line, improvements, and access. 5. I am also enclosing a copy of the Holland Hills plat for a vicinity map. The subject property is indicated thereon. 6. I would like this letter to serve as the "summary letter1t which the planning department has requested in the application. The request is that the Bishops be permitted to sell the two existing residences .separately. At all times, the Bishops have considered the two residences as separate residences, while living in one and renting the other. In fact, they acquired the residences at separate times (one in 1970 from Hoaglund, and the other in 1977 from Valdez), and were genuinely surprised to learn that the properties may have merged. We view the application as an unremarkable "lot split" (with attendant lot line adjustment). You request that we address specifically the code sections listed. It strikes me that sections 4-2.2(a)(6) and 4-2.2(a)(2) both expressly n :_ permit the request. As indicated above, the two lots have been developed for 23 and 24 years respectively, thereby predating the concept of merger. Both houses were built at separate times, and both have been separately assessed since their construction. With reference to the. Article 2 "Policies" portion of the land use code, I can see no impacts whatsoever on road system, sewage treatment, water needs, drainage, extension of utilities, etc. for the reason, obviously, that these. structures have been existing for a substantial period of time, and essentially have predated the Holland Hills subdivision. Likewise, I can see no reason that the Article 5 concerns also need to be specifically addressed. 7. I am forwarding herewith the requested deposit. 8. I am enclosing also herewith, a letter from the owner authorizing my representation.. I believe the foregoing address all of the items which were listed on the application.. The parties, their heirs, personal. representatives, successors and assigns shall equally divide the expenses of operating, maintaining, repairing, replacing and insuring of said well. The cost of installing, repair and/or replacement of a delivery pipeline shall be borne„by the owner(s) of the residence for whose" benefit the delivery pipeline exists. Further, each residence shall be entitled to only one 3/4 'inch delivery pipe from the said well. 4: Easement/right of way. In order to effectuate this Agreement, the parties hereto grant an easement, and right of way from the location of the said well, as presently in place, to the boundary line of ..Parcel 1 for the purpose of permitting the delivery pipeline serving the residence upon Parcel 1_to pass from the well to said residence. Said easement shall consist of a tubular shape with a radius of 1 foot measured from the center of ~~ rr. the said pipe as presently in place. ~ Said'~easeinent shall also include the right of the owners of Parcel 1, their heirs, devisees, personal .representatives, and assigns, and/or their representatives, to enter upon Parcel 2 as shall be reasonably necessary to allow maintenance, repair, and replacement of said pipeline from time to time. 5. SEWAGE TREATMENT AND COLLECTION: Sections 2-7 and 5-200: The application indicates that wastewater from the single family residences is disposed of by means of an on-site septic system- absorption fields. The two existing houses involved in this lot split are currently served with on-site septic tank-absorption systems, and conditions were found acceptable when these systems were originally installed. Our evaluation of.. he sites, using information from permit records on one of these parcels and on several of the adjacent parcels indicates that sewage systems should function properly. However, if it becomes necessary"to replace them, this department believes that there are alternate, acceptable areas` available on each property, as the boundary is depicted. The general conditions reported on the Soil Conservation Service maps are also suitable. The Soil Conservation Service soil type on this parcel is 32C. This soil type is characterized as a sandy loam with 0 to 15% coarse fragments, deep depth to bedrock, and a low'shrink=swell' potential. The permeability of this soil type is described as moderately rapid. The systems can, therefore be relatively small and take up less than 750 square feet of surface area. It is our conclusion that the soil on this site should be suitable for the operation or replacement construction of individual sewage disposal systems which will comply with the Pitkin County Reaulations on Individual Sewaae Disposal Systems.. The applicant is aware and should document on the recorded plat, the septic system location for the split level house. As drawn, the proposed lot line bearing west is very close to and parallels the septic tank-absorption field system location. To meet the regulations: this system should be located at least ten (10'') from the property line.
