Subdivision Exemption and Barta Ranch Subdivision Dear Mr. Barta: i I am writing this letter in order to explain to you what additional infor= mation you need to supply us in order to complete the two applications which ', you recently filed with the Aspeh/Pitkin Couhty Plahhing'Office. 1. The mapping should reflect the entire ownership. At the tine you and I I visited in my office, you indicated that the entire ranch consisted of approximately 90 acres. The mapping identified only 66+ acres.. 2. The written description of your proposal states that it is a subdivision of approximately 9~ acres and yet the mapping indicates that it isga subdivision of onl 66+'acres.' Also, the subdivision exemption re uest is for a 10 acre parcel and yet the mapping shows that you are trying t~to create a 3 acre parcel. Please correct the written descriptions. 3. The only way that you can create a parcel. smal7.er than the 10 acre minimum lot size for the Af-1 zone is through PUD procedures. PUD means Planned Unit Development. It allows for a variance .from the minimum lot size of 10 acres provided that the overall density is not exceeded. The code specifically requires that applications for Planned Unit Development include the following: "Description of how the PUD takes advantage of or preserves or enhances the site by use of unique natural features, topography, vegetation, water courses, etc., or other such factors which justify a variance of the PUD for normal zone district require- ments of this code." Since the minimum lot area for the zone is l0 acres, you must at a minimum identify 7 additional. acres which 'will be permanently steri]ized for development purposes in order to accarmcdate the 3 acre. parcel being created. _ ,: _~ P1r. You need to demonstrate,that is the burden is on you to prove, that your property is currently operated as a"bonafide"ongoing agricultural .operation. Such demonstration would include a description of the agricultural andJor animal husbandry operations which currently exist on the property. 5. The board of County Commissioners has amended their submission fee I schedule since you and I first talked. The fees were adjusted drastically upward in order that all of the costs of processing such applications would be covered. The Board feels strongly that the costs associated with processing land use applications should be borne, by those persons who directly benefia rather than by the community at large. The report addresses the groundwater supply concern of Pitkin County as outlined in Section 5.25.024 of the Pitkin County Land Use Code. This section of the code is applicable for subdivisions that will be served by community,or individual, wells. The Barta property is located on the northeast side of the Roaring Fork River, about 2 miles upstream of the confluence with the Fryingpan River, and in Sections 20, 21, Township 8 South, Range 86 !+lest; of the 6th P.M. in Pitkin County. It is our understanding that one single family residence and the St. Vincent's Catholic Church will be located on the property. This report contains an evaluation of the surficial geology and groundwater availability appurtenant to the proposed building site. The evaluation was restricted to an office study utilizing the following resources: (1) U. S. Geological Survey Geologic Flapping of the 4Joody Creek and Basalt Quadrangle, (2) Pitkin County Groundwater Geology maps, prepared by !fright 4later Engineers in 1977, (3) Environmental and Engineering Geology Clapping ', of the Roaring Fork and Crystal Valleys, prepared by the Colorado Geologicap Survey in 1974, and (4) the State Engineer's Office list of registered wells dated 1-17-77. . ..•, Mr. Dandin Barta November 9, 1981 -2- A review of th.e State Enoineer's Office tabulation of registered wells indicate the existence of 19 wells within a one mile radius of the oroperty. This glacial deposition probably overlays the State Bridge Formation and the Maroon Formation. The State Bridge Formation is reddish brown and, in places, is mottled gray or purple. The Maroon Formation consists of reddish, arkosic sandstone ~~ith nterbeds of silts tone, claystone, and some con- glomerate and limestone. The Maroon Formation can yield water at rates of 5 to 20 gallons per minute (apm). The glacial fill material is very poorly sorted debris with large boulders' in a matrix of sand and clay. Generally, the greater the clay content in the glacial material, the lower the permeability. The best potential source for domestic water wells is contained in the unconsolidated alluvial deposits found in the valley bottom along the Roaring Fork River. The alluvial deposits are characterized by poorly sorted gravel, sand, and silt deposits, ranging in size from boulders to clay particles overlying the bedrock. Jhile a well penetrating several feet of saturated sand and gravel material generally will yield low to moderate supplies of groundwater, the variation in permeability and saturated thickness of unconsolidated material, recharge properties, pattern of use and seasonal precipitation fluctuations, may result in a wide range of well yields in a given area. A study of the Pitkin County Groundwater Geology maps shows the property is located in a major recharge area, which is associated with the glacial alluvial deposition of the Roaring Fork River channel. Therefore, on the basis of our interpretation of the material, and the experience of our office related to groundwater availability in the Roaring Fork basin, we feel that the well sites located on the Barta property shoul~ld be acceptable for low to moderate yielding wells. The principal aquifer underlying the property, the unconsolidated alluvial and glacial material, can exhibit permeability and recharge properties that are capable of sustaih- ino viable long term supplies of acceptable quality groundwater. It should'. be recognized that the wells must penetrate the local water table and several feet of saturated material. The following comments address the eroundwater supply concerns of Pitkin County as outlined in Section 5.25.02d of the Land Use Code. 1. Based upon our evaluation and general knowledge of the area, we anticipate that wells of proper location and construction 'can be drilled on the property and would be reasonably capable of low to moderate withdrawals on a long term basis. We anticipate the depth of the wells to be on the order of less than 100 feet. 6rouidNater withdrawn from the wells is tributary to the Roaring Fork River and should be of satisfactory chemical quality. Recharge for the alluvial aquifer comes from the extensive glacial and alluvial deposits associated with the river channel. 2. ;do problems are anticipated with reoard to leng term supply, pollution, or long term maintenance. 3. A well yield of 5 to 10 gpm is generally sufficient to serve 1 single family residence with limited irrigation. 4. Pollutant sources can be disregarded because there are no major waste discharge sites in the immediate area. Determination of ' any local contamination due to leach fields would require a review of soils test data. 5. As previously stated, the two proposed wells are expected to be capable of serving the single family residence and the Catholic Church. The pressure associated with the distribution system is dependent upon the engineering design of the system. i - r i -, i Mr. Darwin 8arta 5- November 9, 1981 6. lJe recommend that you apply for well permits for the proposed wells with the Division of Nater Resources, State Engineer's Office. Drilling can be initially accomplished under a test hole permit approved by the State Engineer's Office. A final permit will have to be issued prior to putting the water to beneficial use. Also we recommend that you consult the State Engineer, and possibly a water attorney, regarding the necessity' of a water supply plan, or a decreed plan for augmentation, for the two proposed wells. Recent demands for water in the Roaring' Fork/Colorado River drainage have caused a change in policy re- garding the issuance of well permits in the Colorado River basin: lde feel these comments are comprehensive in addressing the County's water supply requirements for the proposed building site.
