APPLICANT'S REPRESENTATIVE: Marc Friedberg, Mason and Morse
LOCATION: A property know as Double S, north of the Rio Grande
railroad right-of-way, and west of Highway 82 at Wingo Junction,
Pitkin County. This is a pre-existing non-conforming parcel.
ZONING: The property is zoned AF-1 and contains. 'approximately 1
acre.
REQUEST:" Sandra Jo Nickel is requesting approval of a 1041
Environmental Hazard Review/Category 2 Exemption for construction
of a single family residence, pursuant to Sections 5-400 and 6-3
of the Land Use Code.
BACKGROUND: During the 1960's to the late 1970's the parcel was
used as a trailer park which contained between 16 and 20 camper
trailers. This use was abated by the County in 1978.
SITE DESCRIPTION: The site is divided into four benches. The
lowest bench is within the flood plain of the Roaring Fork River
and..-is separated from the building site by a 20 foot embankment.
Two of the upper benches are each approximately 30 feet wide and
are separated by an 8 foot step. The.. uppermost flat bench varies
in width around 100 feet. The building footprint is located on
the two middle benches which are flat except for the 8 foot step
between them. Existing vegetation is riparian on the steep
embankment down to the river. The remainder of the site is
primarily dryland grasses. On the northwest corner of the
property there_is a large pile of dried tree branches. Existing
utility service to the site includes water and electric.
REFERRAL COMMENTS:
1) LAND USE .ENGINEER: In his memo of February 2, 1990, Tom
Newland comments that:
a) The applicant must apply for and receive a State Highway
Access Permit, before any` work'on the new driveway can be
started.

b) It is recommended that the applicant reclaim and
revegetate the old, existing access along the railroad.
c) The new driveway must conform to County road standards.
d) The property is within the Basalt River Stabilization
Plan and the County is requesting an easement for flood
control purposes.
e) The proposed structure is located within the 200 foot
Highway 82 setback requirement. It is suggested that the
structure located. on the upper bench be limited to one-story
in height.
2) ENVIRONMENTAL HEALTH DEPARTMENT: In his memo`of February 5,
1990, Bob Nelson had the following comments:
Sewaae Treatment and Collection• The new residence will require
an on-site sewage disposal system. It is recommended that
effluent. be pumped up to the flat terrace above the river, rather
than attempting to fit an on-site sewage disposal system into the
building envelope area.
Adequate Provisions for Water Needs• There is an existing well
on-site which appears to be .adequate for the proposed residence.'
Air Oualitv• The proposed residence may have one fireplace and
one :other .certified wood burning device. All such devices must
be registered with the_Environmental Health Department.
Noise: Construction of the house shall be restricted to conform
to noise regulations stipulated by the Environmental Health
Department.
3) BASALT & RURAL FIRE PROTECTION DISTRICT: In his letter of
February 5, 1990, Ronald Thieving had the following comments:
The application for the proposed residence gives no
indication of problems dealing with the Fire Department..
Final building plans may indicate needs associated with fire
protection of the property and structure.
4) GEOLOGICAL REPORT: In his letter of December 3, 1989,'
consulting geologist Nicholas Lampiris, Ph.D had the following
comments:
1) The site is will above the 100 year flood boundary of
the Roaring Fork River and other drainages cannot affect the
envelope.
2) The steep bank down to the river should be avoided
.because it can be unstable when saturated as well as'
undercut by the river during high-flows. A minimum fifteen

foot setback from the edge of the bank is recommended.
3) A soils ..engineer should specifically address the issue
of positive drainage and foundation relationship to the
steep embankment.
4) The house should be designed so as to preclude the
accumulation of radon gas.
5) WILDLIFE: In a phone conversation with Randy Cote, of the
following homments;of Wildlife on February 7, 1990, he had the

the property, therefore no previsions need to be made to
mitigate impacts on wildlife.
2) It is recommended that no changes take place to the
riparian habitat along the steep slope and river.
FINDINGS...
1) The building envelope and driveway are located in an area
which no longer effect deer or elk habitat.
2) The building envelope and driveway should be located in an
areas which will not affect the steep slope and riparian
vegetation on the western portion of the parcel.
3) The County Attorney is satisfied that the property was
legally created and has not merged with any contiguous lots.
4) The applicant has addressed the category 2 exemption criteria
for land use.
RECOMMENDATIONd
Sections 5-400.3(b) and 5-400.5(b) of the Land Use Code provide
that the Planning Director is authorized to approve a site plan
and application for a Minor 1041 Hazard Review. Based on the
findings referenced .above, staff recommends approval of the
Nickel 1041 Minor Hazard Review and Category 2 Exemption. Said
approval is subject to the conditions listed below. If you agree'
with Staff's recommendation, please'sign this memo,"which will
serve as a 'reference document authorizing `approval of said'
application. Planning Director's sign-off on a 1041 Review Site'
Plan is also necessary for completion of the administrative'.
review process. The site plan with the conditions listed shall
be recorded in the Clerk & Recorder's office.
CONDITIONS OF APPROVAL.
1. Prior to the issuance of a Building Permit the applicant

must receive a State Highway Access Permit for construction
of the new access.
2. Prior to the issuance of a Building Permit a site specific
soils study shall be preformed by a qualified engineer to
insure proper foundation design.
3. The applicant shall remove all vegetation debris located on
the northwest corner of the lot.
4. No construction shall take place within 15 ,feet of the top
of the River bank.
5. Prior to issuance of a building permit, the applicant shall
receive required setback variances to accommodate siting of
the building envelope.
6. All fencing shall be 42" or less in height.
7. Leash or kennel all dogs.
8. Maintain all vegetation outside of building envelope.
9. The applicant must submit a revised plat for approval by the
Planning Director and recording in the Clerks & Recorder's
Office. The plat shall include conditions 1 though 8 as
notes.

Dear Marc;
This is to discuss with you my request for a 'River Bank
Stabilization Easement over a portion of the Nickel. property.
located immediately down stream from the Wingo Junction railroad
bridge in Pitkin County, Colorado.
The portion of the Roarinq Fork River between Wingo Junction and
the Basalt Sanitation Plant has experienced high water flooding
and bank erosion in the past, most recently in the spring of 1983
and 1984. Since that time, the local governments_(Pitkin County,
Eagle County and Basalt) have attempted to formulate a river
stabilization plan to cure this problem. After several years of
cooperative efforts, the local governments have developed what is'
known as the Roaring Fork River Stabilization Project. Attached'
as Exhibit A please find map locating the project's boundaries.
This plan will direct future flood control work in the area to
mitigate the impacts to property caused by flooding, and at the
same 'time assure that any work in the river will not adversely'
impact properties and buildings above and below stream:.
The easement is being requested to account for any potential
impacts that might occur to the property as a result of the
future placement of what is known as a "drop structure"
immediately above stream from the railroad bridge. Enclosed as'
Exhibit B please find a detailed map of this portion of the'
Roaring Fork River showing the proposed placement of the nearest.
drop structure. The drop structure is, in essence, a 'iV"-shaped
wall of large boulders across the course of the river. These
structures work by temporarily damming the flow of the river,
thereby slowing erosive currents on the banks above stream. The
current is then directed towards the center of the river and thee.

I have reviewed the information submitted and would like to
forward the following comments to you:
General: This property was used previously as a mobile home park
with trailers aligned on the level portions of 'the site. The
site steps down to the river in a series of benches. To the
north is an old excavation which has been poorly revegetated; to
the .south is .the Wingo railroad bridge and Aspen Earthmoving, a`
commercial, non-conforming use.
Impacts on Road System: I concur with the application's request
to replace the driveway with a new access to the north of the
site. The existing access parallels the railroad and approaches
the .highway at a location too close to the Aspen Earthmoving
access. The applicant must apply for and receive a State Highway
Access Permit. before any work on the new access can 'be started.
It is recommended that the applicant consider reclaiming and
vegetating the old, existing access along the railroad.
Internal Road Design: The proposed driveway shall be reviewed
for conformance with County standards through the State Access
permit. County standards require a driving surface of between 8''
and 16'; a grade of no more than 12%; the drive must approach the
highway in a perpendicular fashion for the first 20-feet; and any
roadside ditch must be culverted.
Floodplain: The property is within the reaches of the Basalt
River Stabilization Plan, a bank stabilization plan developed by
the local goverhments, (Pitkin County, Eagle County and Basalt) in
cooperation with affected landowners.. It is requested that the
applicant consider granting an easement for flood control
developmentoof tthis planty which would allow for the future

foot setback variance from. Highway 82. It is recommended any the
building envelope be re-designated to be completely excluded from
the setback area. It is further recommended that the portion of
the building .that is constructed on the upper bench within the
building envelope be limited to one-story in height.

Dear Ms. Houben:
Thank you for your letter dated December 19, 1989 regarding my 1041
Hazard Review and General Submission for. the Double S property.
As requested, I hereby submit the following information for your review
as per the Section 5 General Regulations.
The proposed log home on the subject property will be constructed in a
manner that will not adversely affect Pitkin County. There is already an
established road access to the site as well as necessary underground
utilities.
Nick Lampiris, the Geologist, has attested to the satisfactory soils on the
subject property. The building envelope will be on a flat site and situated
in accordance .with the geologist's recommendations.
The improvement will be constructed so as to reasonably preserve the
natural character of the area and all drainage from the proposed home will
be handled as per the recommendations of the geolog§t. The improvement
will not impede in any way the flow of natural water. courses.
I believe that the area covered by the improvement will not impact in any
'material manner the runoff on the property and will not require any special
measures outside of a good drainage plan to be designed by the landscape
architect. There aze no ditches on the property and the Roaring Fork
River is substantially below and away from the proposed building site.
The soil to be excavated on the site for the home will be utilized on the
property for berming adjacent to the improvements and there will be
minimal disturbance of the natural degetation and soil cover. The already
established building site will be expanded so as fo accommodate the
building with the result of minimal visual impact from Highway 82. The

natural vegetation on the slope adjacent to the Roaring Fork River will not
be disturbed.
There are no known archaeological sites, on or adjacent to the subject
Property.
The approximately 1 acre parcel is not currently used for agricultural
purposes and its use as a homesite will have no impact on food production.
Every effort will be made to reduce any visual impact from the proposed
home development. The siting of the structure and the berming will make
it invisible to Highway 82 and the landscape plan will insure an aesthetic
and natural environment.
I do not believe there will be any impact on air quality as a result of my
proposed house.
The subject property has an established well and I do not believe my use
of the well will have an adverse impact on the surrounding properties.
I trust that the pertinent questions in the general submission criteria have
been addressed in this letter and I hereby enclose 6 copies of the 1041
review map as well as the other documents requested.

hereby respectfully request approval of the 1041 Hazard Review and
General Submission of my proposed home on the property known as
Double S, Pitkin County.
'The building envelope for the home is not in the riparian area of the
Roaring Fork River and is 18 feet above the river on a flat portion of the
.approximately 1 acre parcel.
I have spoken to the Division of Wildlife who have indicated that they do
not have any problems with the siting of my home on this property.
Bob Nelson indicates that he is familiar with this land and feels a new

There is an existing well on the subject property and I have enclosed
pertinent information from Samuelson Pump Company dated June 1, 1988.

grade of the land adjacent to Highway 82 and planned berming of the
property, there will be no visual impact from the improvements to be
placed on this land to those traveling on Highway 82.

The Aspen/Pitkin Environmental Health Department has reviewed the
above-mentioned land use submittal under authority of the Pitkin
County Code, Title II, and has the following comments.
SEWAGE TREATMENT AND COLLECTION: Sections 2-7 and 5-200:
The new residence will require an on-site sewage disposal system.
The old sewage system for a mobile home park removed in the late
1970's consisted of a now abandoned aerated treatment plant, a
pumping chamber (wet well), and a seepage pit absorption system.
Most of this abandoned. equipment is no longer serviceable, but it
does indicate that the single-family residence could be served
with an on-site wastewater disposal system in compliance with the
Pitkin County regulations. We would recommend, as in the past
that effluent be pumped up to the flat terrace above the river,
rather than attempting to fit an on-site sewage disposal system
into the building envelope area.
There is a permit requirement for such systems prior to building,
and we .will reevaluate the specific situation and design
specification requirements prior to construction.
ADEQUATE PROVISIONS FOR WATER NEEDS• Sections 2 6 and 5 205:
The existing well appears to be adequate the proposed single-
family residence. The. applicant has submitted an evaluation of
the well which indicated that the existing water supply system
provides adequate capacity in excess of 15 gallons per minute and
meets minimum regulatory standards for drinking water quality.
The water supply was monitored for bacteriological quality for a
time when the mobile home park was there and consistently met

tion of the dwelling unit, should this proposal be approved. The
