REQUEST: The applicant is requesting approval to construct a caretaker dwelling unit within the lowest level of an existing residence in Holland Hills. The applicant is proposing a 700 square foot unit, pursuant to Section 3-8.13 (c) of the Land Use Code. SUMMARY: The Planning Office recommends that the applicant's request be denied, unless a water system evaluation can be prepared by a licenced professional engineer that proves there is adequate capacity in the water system to serve the approved undeveloped lots in addition to caretaker units within the subdivision. This recommendation is based upon the comments submitted by the Environmental Health Department (Attachment 1). Ordinance 91-11 permits the Board to approve Caretaker Dwelling Units if the unit does not exceed 700 square feet; the resulting density and FAR of the parcel does not exceed the FAR of the zone district; a deed restriction is filed which meets the requirements of Section 3-8.13(a) of the Code; the unit may be attached to the main residence on a non-conforming sized parcel; and, the proposal is not consistent with the special review criteria of the Code because adequate provision for water cannot be shown. The Environmental Health Department has submitted comments recommending that no additional units be constructed on the Holland Hills Water System until an additional evaluation to determine the adequacy of the water system to provide domestic water at satisfactory pressure to all residences has been prepared. SEWAGE TREATMENT AND COLLECTION: Sect_o_ns 2-7 and 5-2001 The property has an on-site sewage disposal system constructed in 1991 and meeting the Pitkin County Regulations on Individual Sewage Disposal Systems. The application and permit on file with this office', for the individual sewage disposal system indicate that the system was sized for' a four-bedroom house. The septic tank installed in the system should have sufficient volume to accommodate an extra one bedroom caretaker unit. The absorption field is also adequate in size. We would, in any case, discourage the use of a garbage disposal or washing machine in the caretaker unit in'order to minimize the chance of premature absorption area failure. ADEQUATE PROVISIONS"FOR WATER NEEDS• Sections 2-6 and 5205• The applicant's property is currehtly served with potable water from the Holland Hills subdivisioh community water system. This system consists of four wells producing a total of 38 gallons per minute to the storage tanks in this system. The evaluation of the well water yields was done ten years ago, and before two additional water storage tanks were constructed to supplement peak demand. The engineering study then indicated that the system was marginally acceptable as a domestic water system, but, once build-out occurred, the water supply and distribution system could not consistently meet Summer irrigation demands. When the fairly low production yield is taken in consideration with the small diameter PVC water distribution lines sizes, the additional demands from several caretaker units could mean that the domestic water system demand may not consistehtly be met. Several independent engineering studies done in .the last 15 years have consistently demonstrated that the system should provide adequate quantity of `domestic water which-meets the minimum Pitkin County Code standards found in section 5-.205. The wells and water rights are still owned, by virtue of a Special Warranty Deed, by Landmark Universal. This company has no other interest in the subdivision. .They are charging, but not receiving tap fees and service .charges for the system. It has been expressed that the company would like to figure a way to deed the water supply system to the Holland Hills homeowners. This system consists of five wells, four serving the subdivision and one for the. townhouse lot. The four subdivision wells were tested and analyzed in 1979 as producing a total of 38 gallons per minute when in full production. Currently, however, one well is not producing and another may be limited because of the low water shut-off of the pump. These wells are reported to recharge with the runoff and irrigation seasons, but at this point the actual production may only be 25 gallons per minute. That production will provide the domestic demand for the existing development. In fact, since the irrigation water was controlled, the homeowners report no shortage or pressure problems with the system. However the pumps are running 24 hours per day and the maintenance records show that the replacement is occurring at a two to three year cycle on these pumps due to wear and tear. The owner of the system is proposing to drill another well to substitute for the non-producing well. That may improve the system. However, the evaluation of the well water yields that was done ten years ago, and before two additional water storage tanks were constructed to supplement peak demand still shows that the system will never meet Pitkn County Land Use Code requirements of three times average day demand, even without caretaker units. The two engineering studies then indicated that the system was marginally acceptable as a domestic water system, but, once build- out occurred, the water supply and distribution system could not meet irrigation demands. The application does not contain. enough information pertaining to the employee dwelling unit. The Housing Office requests a floor plan designed to scale of said unit and also the calculations. of the net liveable square footaye of the unit before an approval can be made. Dnce the plans are received and reviewed, and the conditions listed below .met, this will satisfy the Housing Office and approve the unit at that time. The conditions are as follows: 1. The caretaker unit cannot be larger than 700 square feet, and this dwelling unit shall be included in the calculation of the floor area for the property on which it is located, and applicable FAR"requirements must be met.. 2. The applicant shall by deed restriction or other permanent condition running with the land, guarantee that 'the caretaker unit shall not be required to be rented; not be condominiumized or sold; not be occupied by ''the owner or spouse; be limited to occupancy by not more than two (2) adults, and related children, who qualify as (and have been found by the Housing Office to be) employees of the community under such guidelines as may be from time`to time established by said Authority; be rented for terms not less than six (6) months if rented. The caretaker dwelling may be occupied by members of the immediate family even though they may not qualify as employees of "the community. "Immediate Family" shall mean a person related by blood or marriage who is a first cousin (or closer relative) and his or her children. 3. A deed restriction must be recorded by the applicant pursuant to building permit approval.
