NOW THEREFORE BE IT RESOLVED by the Board of County Commissioners that special review ..approval be and hereby is granted for the expansion of the Carter duplex. November 22, 1977 This application requests permission through the special review process to expand an existing duplex in the Wngo Junction area. The matter requires special review because a duplex is a special review matter in the AF-2 district; any expansion of the use also requires soeciaT reivew. The public hearing was scheduled for November 23th. The duplex now consists of a small one (1) bedroom rental unit and a 2 bedroom unit owned'.. and lived in by the Dick Carter family. A couple of years ago, Carter converted part of his unit to a studio where he does his art work. In doing so, he projected the building out to the front approximately 8 feet requiring a variance because the setback in Af-2 is 75 feet. The house did not meet the setback anyway as the lots were platted prior to the AF-2 zoning. The lot is sub-standard at one-half acre. The creation of the studio left the unit with two small bedrooms and minimal living space. As the Carter family has expanded to two ghildren, the needs for space are similarly greater. The Carter's have searched for other housing to no avail. The existing two bedrooms would be converted to a dining and study area. The application states that existing floor area is 1344 square feet; the addition will add 672 square feet fora total of 2015 square feet. We find that the use of the studio complies with the newly adopted home occupation definition. We do not find the 201.8 square feet unreasonable in light of the legitimate use'of the stuiio and the family's needs. It is also true that houses can expahd'in the subdivision without any review whatsoever. The two units of the Carter duplex represent reasonable housing for locals, affording the owner in addition some much needed studio space. No land use impact is incurred. ', At their October 19th meeting, the Planning and Zoning commission recommended. approval, noting that the request did not constitute any change of use of the existing duplex. Kane said t}te developers need to know whether the application for Lone Pine will be consi.ilered before any specifics are addressed. The issue was not resolved. .Carter Duplex. Special Review AnPlicat-ion Karen Smith presented a special review appli.cati.on for. an addition to the Carter duplex,. This involves expansion of an existing duplex in Wi.ngo Junc- tion which eras built i;i 1970. The present duplex is divided into a one- bedroom unit and a two-bedroom unit. The Carters would like to add three bedrooms onto the two-bedroom unit and convert the two existing bedrooms to a living room and a dining room. 1'he Planning Office r.ecpmniends approval, not- ing that the single-family residences in the area don't have to ohtai.n a special review permit in order to expand. Gassman moved to recommend approval of the special. review application, noting that if-does not constitute a change of use for the existing duplex. Lane seconded the motion and it passed unanimously. LDS Church [dater Line Extension _ ~ 'I The Commission considered a request fora city water line extension to the Latter Day'Saints Church. Ted Mularz, representing the Church, noted that 'they initially thought they could get water from the Highlands [Water and Sanitation District, but have discovered that they can't; a city extension ~ will be necessary. Tile line caould be 230' long and 1'2" in diameter with a 1" tap. T•he line could not suitably serve anyone beyond the. Church. Guy asked why they could not obtain water from Highlands. Dfularz replied that the Highlands idater and Sanitation'Di.strict does. not laant to take on any additional taps because they are having internal trouble with their system. .
