The Applicant shall record a employee dwelling unit deed restriction with the Housing Office, pursuant to Section 3- 1510, prior to the issuance of a building permit. 2. The employee dwelling unit shall be limited to 1500 square feet of livable area. 3. The Applicant shall submit foundation plans with the building permit submittal, prepared by a qualified geotechnical engineer, prior to the issuance of a building permit. 4. The Applicant shall obtain a Septic Permit from the Environmental Health .Department, prior to the issuance of a building permit. 5. The Applicant shall provide documentation of an adequate water supply (quantity and quality) for this development to the Environmental Health Department, prior to the issuance. of a building permit. 6. RECOMMENDATION: As loxig as the employee dwelling unit follows the, guidelines listed below, the Housing Office would recommend. approval. Pursuant to Section 3-8. i3 of the Pitkin County Land Use' Code and Board of County Commissioner Ordinance 91-11 with. regards to the following: Section 3-8.13(b)(1) states: Detached or attached,employee dwellings shall not exceed one thousand five hundred (1500) square feet of floor area. As stated in the application, the employee dwelling unit is proposed to be_1,200 square feet and will be detached from the primary residence, on the northwest side of the lot,. The applicant. must also. .comply with Section 3-8.13(b)(4)(A), (B) and (C), added per a Code... amendment enacted with Ordinance 91-11, which states: (A) Shall be required to be rented and be rented for,peridds of no less than 6 months. Upon vacancy of the unit, a landlord is granted 90 days in which to locate a qualified tenant. If no tenant is.placed by the landlord, the Hdusing Authdrity may rent the unit to a qualified tenant. (B) Shall not be occupied by the owner or memberspf the immediate family nor shall it be used as a guest house or guest facilities. (C) Maximum rental rates shall not exceed the Housing Authority Category 3 level or equivalent. Employees shall be qualified by APCHA as td employment only, and not maximum income qr asset limitation. Prior to building permit approval, a-signed and recorded Deed Restriction must be completed and on file with the Housing Office. A copy of the required Deed Restriction can be obtained from the Housing Office. This process could take from three to four days. Lots in the Holland Hills area are served by individual septic systems.. Al1_ndividual sewage disposal systems installed within Pitkin County require septic permits and must comply with the Pitkin County septic regulations. Septic permits are issued by the Aspen/Pitkin Environmental Health Department. To receive a Applicationlandtappropriatetfeell need £o submit a Septic Permit. Because of the close. proximity to the main house's septic system, soil data from that system can be used to design the new system. It should be possible to use a conventional system. The Bowdens will need to adhere to minimum horizontal setback requirements . ..~ro for placement of septic system components which should not_be difficult on this large, gentle sloping lot. The location of the well is a minimum of 100 feet from the proposed septic site. The area for the leach field should be located in an ;area of no traffic, planted with dry land grass,'and should not be watered. The proposed septic site is below the,house,so that .the system . m,_ . _ k~., ......, can operate by gravity. Please refer to the Pitkin County Sewage Regulations for .detailed information. Any on-site ditches might pose problems. Water drainage from a ditch could. impair the functioning of`the septic system by overloading and. saturating the. soils.
