The Kirshon Family Limited Partnership ("Applicant") has applied to the Community Development Director of Pitkin County ("Director") to obtain Site Plan Review approval to replace the single family residence. 2. The lot is located at 0294 Draw Drive, and is described as Lot 30, Ridge of Red Mountain. 3. The lot contains 34,194 square feet and is within the R-30 zone district. 4. The existing residence was legally constructed with a valid building permit and a Certificate of Occupancy was issued in 1979; therefore, the residence is eligible to be replaced exempt from growth management The residence was remodeled several times in subsequent years. 5. The Director finds that the proposed Site Plan is consistent with the applicable requirements of the Code, as follows: A. The activity envelope is primarily comprised of slopes of less than 30%. The areas of slopes in excess of 30% and less than 45% are man-made and qualify as minor slope anomalies pursuant to Sec. 7-20-20(c)(3) of the Code. B. The wildfire hazard is mapped as severe, and can be mitigated pursuant to the provisions of Sec. 7- 20-60.c of the Code. C. The replacement residence is exempt from the Scenic View Protection standards as it is not visible from Highway 82, due to an intervening ridge. APPROVED by the Director, subject to the following conditions, which shall run with the land and be binding on all successors in interest: I . The Applicants shall adhere to all material representations made during the application process. 2. Prior to submission of any future building permit applications, the Applicant shall be required to submit for approval by the County Attorney and Community Development a Site Plan with an Activity Envelope in accordance with Land Use Code Section 2-30-20(g) and Application Manual Section 2.1.12. The above referenced approvals shall be a condition precedent to finalization and recordation of them. 3. Prior to issuance of a building permit for the residence, the Applicant shall: A. Obtain an access/driveway permit from the Planning Engineer to relocate the driveway. B. Obtain a fireplace/woodstove permit from the Community Development Department, if necessary. C. Submit a site specific drainage and erosion control plan prepared by a qualified engineer or geologist for review and approval by the Planning Engineer. D. Submit a detailed revegetation plan for disturbed areas with appropriate seed mixes. G. Provide a report from a qualified engineer or geologist demonstrating that the areas of slopes in excess of 301/o are not prone to instability or failure and that the proposed development will not cause greater instability or increase the potential for slope failure. 4. 5,750 square feet of gross floor area is exempt from growth management without the use of TDRs or growth management allotments for additional floor area. 5. The Applicant shall comply with the following standards for Development in a Severe Wildfire Hazard Area: A. Defensible Space: The area around all buildings/structures, limited by property boundaries that may limit a property owner's ability to comply with this section, shall incorporate landscaping with wildfire defensible space considerations as follows (note: actual vegetation manipulation to meet these conditions may not be necessary where the natural vegetation patterns have already fulfilled these conditions): 1) The area within 15' of the structure and the furthermost projection of combustible construction shall be of primarily noncombustible hardscape surfaces, low growing perennials, flowerbeds, cut grass and deciduous, well -trimmed and irrigated plants. Woody vegetation should not be planted within this area. 2) Beyond 15' and up to 65' of the structure and the furthermost projection of combustible construction or to the property line, maintain natural and/or irrigated grass at less than 6" and thin existing trees, sagebrush, and brush into individuals or clusters. Oak and serviceberry should be thinned and clustered. Limbs of trees shall be pruned to Y2 the height of the tree or 10' whichever is less. No brush or shrubs which when mature shall be tall enough to act as ladder fuels shall be installed or marinated around the trees. Clusters of bushes or shrubs should be separated from each other and from those beyond the 65' area by a distance of 2 Y2 times the height of the mature vegetation. The diameter of a cluster shall be limited to 2Y2 times the height of the mature vegetation. Thin and remove lower branches of brush or shrubs within clusters or individual plants to eliminate ladder fuel. Treat cut ends with an herbicide to prevent resprouting. 3) All branches that extend over the roof eaves shall be trimmed and all branches within fifteen (15) feet of chimneys shall be removed. 4) The density of fuels up to a one hundred (100) foot perimeter of the structures shall be reduced where natural reduction has not already occurred. 5) All deadfall up to a one hundred (100) foot perimeter shall be removed. 6) The property owner shall be responsible for the continued maintenance of the defensible space vegetation requirements. B. Roofing Materials: Class A covering or Class A assembly as defined by the currently adopted Building Code. No wood shakes or shingles. All other adopted Building Code compliant methods and materials permitted. Roofs with less than a 3:12 pitch are not permitted unless they comply with the following: Administrative Decision No. JE -2007 Page 3 1) All roof coverings shall be constructed of non-combustible materials and installed on a Class .A roof assembly. 2) All roof coverings shall have a surface that shall facilitate the natural process of clearing roof debris. 3) Protrusions above the roofline, such as parapets, shall be prohibited, unless constructed as for a one-hour fire resistive assembly, as recommended by Art Hougland, Wildfire Expert (letter attached as Exhibit C). 4) Roofs shall be installed as required by the adopted Building Code and shall have a minimum pitch of 1:48. 5) All roof designs, coverings, or equivalent assemblies shall be specifically approved by the Fire Marshal prior to submittal of a building permit application. C. Roof Venting: 1) Soffit venting shall be located in the outer 1/3rd portion of the overhang. 2) Attic, soffit and other roof venting shall be of non -corrosive metal mesh with maximum '/4" openings. D. Projections at the Roofline, including Soffits, Rafters, Porch or Deck Roofs, Fascias, or Other: One hour rated material or any material underlain by 5/8" Type X gypboard or equal, or "Type IV" Heavy Timber materials, per the currently adopted building code. E. Decks, Decking, Cantilevered Floors, or Other Projections Below the Roofline: 1) Construction with noncombustible or one (1) hour rated material, or material with flame spread <25 (tested to ASTM E84 and listed for exterior use), or 2) Conventionally framed deck with waterproof surface and underside protected with 5/8" Type X gypboard or equal (decking as "a" above), or 3) "Type IV" Heavy Timber materials: joist and beams minimum 6"x10", columns minimum 8"x8", decking minimum 4" in depth, or decking as "a" above; or equivalent log construction, or 4) Enclose projection vertically to ground with one hour fire resistive materials. Decking as "a" above. F. Railings: Railings must be constructed of noncombustible or "Type IV" Heavy Timber materials. G. Exterior of the Structure, Including All Walls: 1) One (1) hour fire resistive rated materials, or 2) 5/8" gypboard underlying combustible materials, or 3) Cement stucco, minimum'/4" thickness. 4) All glazing to be tempered glazing; and 5) Doors to be metal or wood I %" thick minimum. H. Foundations: Foundations, skirting, and crawl space openings shall be fully enclosed and constructed with materials approved for one (1) hour fire -resistive construction on the exterior side of the walls and shall extend from the top of grade to the underside of the floor decking or walls. Maintenance and Miscellaneous Requirements 1) Roofs and gutters shall be kept clear of debris. 2) Roof vents shall be screened with corrosive resistant wire mesh, with mesh one-fourth (Y.) inch maximum. 3) Any outbuilding shall adhere to the same wildfire requirements. 4) Yards shall be kept clear of all litter, slash and flammable debris. 5) All flammable materials shall be stored on a parallel contour a minimum of fifteen (15) feet away from any structure. 6) Weeds and grasses within the ten (10) foot perimeter shall be maintained to a height not more than six (6) inches. 7) Firewood/wood piles shall be stacked on a parallel contour a minimum of fifteen (15) feet away from the structure. 8) Swimming pools and ponds shall be accessible by the local fire district. 9) Fences shall be kept clear of brush and debris. 10) Wood fences shall not connect to other structures. 11) Fuel tanks shall be installed underground with an approved container. 12) Propane tanks shall be buried, if possible, or installed according to NFPA 58 standards and on a contour away from the structure with standard defensible space vegetation mitigation around any aboveground tank. Any wood enclosure around the tank shall be constructed with materials approved for two (2) hour fire -resistive construction on the exterior side of the walls. 13) Each structure shall have a minimum of one ten (10) pound ABC fire extinguisher. 14) Addresses shall be clearly marked with two (2) inch non-combustible letters and shall be visible at the primary point of access from the public or common access road and installed on a non-combustible post. 15) Utilities shall be extended underground. 7. The Applicant shall comply with the applicable codes and requirements of the Aspen Fire protection District, including but not limited to access, turning around of fire apparatus, installation of an approved fire sprinkler system and an on-site water supply for fire fighting (20,000 gallons on-site or confnn Proximity to a fire hydrant to the satisfaction of the Fire Marshal). 8. Native vegetation shall be maintained outside of the Activity Envelope, except to comply with the wildfire mitigation measures described above. 9. Trash/garbage shall be kept in an approved bear resistant container or enclosure, pursuant to the County's Wildlife Protection Ordinance. Verification of compliance shall be provided prior to issuance of a certificate of occupancy. 10. Prior to commencement of any earthmoving or other construction activity, the Applicant shall stake the comers of the activity envelope and install construction fencing around the construction site within the perimeter of the activity envelope. The fencing shall remain in place until issuance of a Certificate of Occupancy. 11. No structural development in excess of 30", with the exception of fencing, shall occur within the setbacks of the parcel. Landscaping in the form of berms shall not exceed four feet from the most restrictive grade. Any structural development located within setbacks mandated by County zoning Administrative Decision No. LL_�-2007 Page 5 regulations shall require a variance from the Board of Adjustment. Approval of an activity envelope within such setbacks does not assure approval of a variance. 12. No calculations for height, bulk, setback, size, floor area, or any other building and zoning requirements have been conducted. These requirements will be considered at the time of building permit. Any structures represented in the application may not be permitted under building and zoning regulations. 13. Statutory vested rights for the approval contained herein are granted pursuant to the Pitkin County Land Use Code and Colorado Statutes, subject to the exceptions set forth in Pitkin County Land Use (;o4e § 2-20-170 and C.R.S. § 24-68-105. The statutory vested rights granted herein shall expire on 2010. 14. Failure to comply with the conditions of this approval may result in revocation of this approval, or any subsequent permit(s) or approval(s) related to this property, or vested rights associated with this property. RESPONSE: This is an existing lot which meets the zone district's dimensional requirements. (b) New lots must have frontage on Redstone Boulevard. RESPONSE: This is an existing lot. Equestrian, pedestrian, vehicular or other trails may also be reserved by the Board of County Commissioners. (c) Any written instrument of vacation or a resubdivision plat approved by the Board of County Commissioners purporting to vacate or relocate roadways or portions of roadways that is of record in the counties where the roadways affected are situated for a period of seven (7) years shall be prima facie evidence of an effective vacation of such former roadways. (8) APPROVAL OFAN ACTIVITY ENVELOPE OR SITE PLANS BY HEARING OFFICER When an application for approval of an Activity Envelope or Site Plan is heard by the Hearing Officer, either because the Community Development Director has referred the application pursuant to Sec. 2-30-20(i), or because the application is intended to result in a vested property right pursuant to Sec. 2-20-170, the Hearing Officer shall apply the same approval criteria that Community Development Department staff would have applied to an administrative approval of the application under Sec. 2-30-20(g). (9) DESIGNATION TO OR REMOVAL FROM HISTORIC REGISTER (a) Designation of properties to the Pitkin County Historic Register, or the removal of properties from the Historic Register, are both accomplished through a resolution approved by the Board of County Commissioners. An application for designation may be filed by the property owner, the Community Development Director, the Planning and Zoning Commission, or the Board of County Commissioners. (b) The criteria for designation of properties to the Historic Register are in compliance with those standards and criteria set forth in the Pitkin County Historic Register. (c) The Justification for delisting includes, but is not limited to: (i) the loss of significance due to loss of or damage to the associative qualities or physical characteristics that make the property or district historic or architecturally important, or (ii) contradictory information to the analysis and/or findings of the original designation report. Sec. 2-40-20 ( f) 119 Conditions on Revocation In the event that a permit is revoked the Board may specify that neither the permittee nor a successor for the same site may re -apply to the Board for a mineral exploration and mining permit for up to one (1) year after the date of revocation or the date all permit improvements and inventory were actually removed and all operations actually ceased, whichever date occurs last. If the Board suspends or revokes a permit of an operator, the operator may continue previously permitted operations only for the purpose of bringing the previously permitted operation into satisfactory compliance with the provisions of the operator's County permit, or to carry out reclamation requirements of the State of Colorado. Sec. 4-30-50 (e)(1)(2) (e) Caretaker Dwelling Unit These standards are for the purposes of providing a voluntary caretaker dwelling unit on a legally created lot or parcel in the County. Caretaker dwelling units created pursuant to these provisions, shall not be used for mitigation of employee housing requirements as established elsewhere in this Land Use Code. (1) CDUAS PERMITTED ACCESSORY USE In the RS -160, RS -35, RS -30, RS -20, AR -10, AR -2, R-30, R-15, R-1 5A, and R-6 zone districts, one (1) caretaker dwelling unit shall be a permitted accessory use provided that: (a) It is attached to a single family home ("principal dwelling"); RESPONSE: It is within the principal dwelling. (b) The lot or parcel on which it is located conforms to the minimum lot are requirements for each dwelling in the zone district in which the caretaker dwelling unit is located, as shown in Table 5-1; RESPONSE: The lot does conform to the requirements. (c) The caretaker dwelling unit shall not exceed one thousand (1,000) net livable square feet on lots or parcels that are thirty thousand (30,000) square feet or greater in lot area, and seven hundred (700) net livable square feet on lots or parcels that are less than thirty thousand (30,000) square feet in lot area; RESPONSE: The caretaker unit meets the square footage requirements. (d) The floor area of the caretaker unit shall be included in the total allowed floor area for the lot or parcel of land (e.g., if the CDU is seven hundred (700) square feet, the maximum total area of the primary residence and other included accessory structures shall be seven hundred (700) square feet less than what would apply without the CDU); RESPONSE: The floor area is included in the total allowed floor area for current construction. (e) Two (2) off-street parking spaces shall be provided for each caretaker dwelling unit. Shall not be required to be rented; RESPONSE: This unit is not required to be rented. 2. Shall be limited to occupancy by (i) not more than two (2) adults, and related children, who qualify as (and have been found by the Housing Office to be) employees of the community under such guidelines as may from time to time be established, or (ii) members of the owner's immediate family, even though they may not qualify as employees of the community. (g) The Caretaker Dwelling Unit restriction may be removed by the property owner upon approval of the Community Development Director, subject to the requirement that the dwelling is removed or modified. If modified, the remaining improvements must no longer be capable of occupancy as a dwelling unit and must meet otherwise applicable requirements of this Land Use Code. RESPONSE: This is understood. (h) The provisions of this regulation are for the purpose of providing a voluntary Caretaker Dwelling Unit on a legally created lot or parcel in the County. Sec. 6-30-40 (c) (e) Caretaker Dwelling Units ("CDUs") One (1) Caretaker Dwelling Unit ("CDU") may be exempted from Growth Management on any lot or parcel located in a zone district in which a CDU is an allowed use, a use allowed by special review, or a use allowed as part of a master plan, as shown in Table 4- 1. The CDU may be allowed even if the lot or parcel is substandard in size and the resulting development on the lot or parcel would not conform to the underlying zone district's minimum parcel size for each dwelling unit, subject to the standards in Sec. 4- 30-50(e). The CDU may be either attached to a singlefamily dwelling unit ("principal .qui -11 dwelling") or other use or may be detached from the principal dwelling or other allowed use if it complies with the standards in Sec. 4-30-50(e).
