RECITALS
1. Pursuant to Subsection 4-30-50(i) of the Pitkin County Land Use Code, the Community
Development Director of Pitkin County, Colorado ("Director") may approve a Temporary
Commercial Use/Special Event Permit for commercial activities or special events.
2. The City of Aspen (hereafter, the "Applicant") has applied to the Director for approval of
a Temporary Commercial Use/Special Event Permit to conduct the Golden Leaf Half
Marathon on September 22, 2007. Participants will run from Snowmass Village to
Aspen along the Government Trail ending at Koch Park. The event will run from 8:30 to
12:30. Approximately 300 - 400 participants are expected.
3. The Pitkin County Sheriff's Office, the Aspen Fire Department, the Forest Service,
RFT A, and the Emergency Management Department have all approved this event.
Certificate of Insurance c'overing this event has been provided which names the County
as an Additional Insured.
4. The Sheriff's Office has stated that if a major search and rescue incident occurred during
the event, they would reclaim the necessary Mountain Rescue resources
5. RFTA has agreed to provide extra service to shuttle participants to Snowmass Village.
6. The Director finds that, to the extent applicable, the application complies with the
standards in Subsection 4-30-50(i) of the Land Use Code.
THE DIRECTOR HEREBY APPROVES the Temporary Commercial Use/Special Event
Permit for the Golden Leaf Half Marathon, subject to Applicant's compliance with each of the
following conditions:
1. Applicant shall adhere to all material representations made in, or in connection with,
the application.
2. All debris shall be cleaned up promptly after the event.
3. Failure to comply with the conditions of approval may result in revocation of this
permit.

REQUEST: The applicant is requesting approval of a Temporary Commercial Use/Special
Event Permit in order to conduct the annual Golden Leaf Half Marathon.
APPLICANT: City of Aspen (hereafter, "Applicant").
LOCATION: Trail run from Snowmass to Aspen on the Government Trail. Finish is at
Koch Lumber Park.
BACKGROUND: This event was most recently granted a permit by the County in 2006.
The event will be held September 22,2007 from 8:30 A.M. to 12:30 P.M. Approximately
300 - 400 people will participate.
REFERRAL COMMENTS: The application was referred to the USFS, Tom Grady, Ellen
Anderson, Ed Va nWa I raven , and RFTA.
Ellen Anderson signed off on the application for Emergency Management.
Ed VanWalraven approved the application for the Aspen Fire Department.
Tom Grady reviewed and signed off on the application for the Sheriff's Department.
However, if a major search and rescue incident occurred during the Golden Leaf, he would
reclaim the necessary Mountain Rescue resources.
The Forest Service has issued a permit.
RFT A has agreed to provide extra service .
STAFF COMMENTS:
Pursuant to Subsection 4-30-50(i) of the Land Use Code, Applicant must demonstrate that
adequate provisions have been made for all of the following:
1. Police supervision (if necessary);
2. Public parking;
3. Insurance;
4. Site set-up, maintenance and clean-up;
5. Emergency services; and
6. Safety of operations.
Additionally, temporary structures must conform to applicable building codes and other
County regulations. Each of these requirements is addressed, in turn, below.
Police SUDervision: No special provisions are deemed necessary. The Sheriff's
Office has signed-off on the application.
Public Parkina:, Applicant shall provide RFTA bus information to participants.
Insurance: It is acknowledged that the City of Aspen has adequate Liability Insurance.
Site Set-UD. Maintenance and Clean-UD: Outdoor set-up is minimal for this type of
event. The City of Aspen Parks Department is identified as the responsible party for any
clean up required.
Emeraencv Services: Applicant has provided a plan for dealing with emergencies during
the races. This includes aid stations along the route staffed by individuals that are in radio
and cell phone contact with each other as well as the race directors. Local emergency
personnel will be notified of the event.
Safety of ODerations: Race Directors will be located at the start and finish lines and will
be in radio and cell contact. Members of Mountain Rescue will sweep the course on a
mountain bike equipped with first aid, radio, and a cell phone. Dr. Niebur from Aspen
Medical Care will be the Chief Medical Officer, he will either be on the course or stationed
at the finish line.
Confonnance with Buildina Code: 10 X 10 pop up tents will be used at aid stations
along the route and Koch Park.
RECOMMENDATION: Staff recommends that the Director approve the Temporary
Commercial Use/Special Event Permit application subject to Applicant's compliance with
each of the conditions in the attached Administrative Determination.

INFORMATION ON THE PERMIT PROCESS AND APPLICATION

The temporary use and occupancy of public or private properties and/or roadways for
commercial activities or special events that are not otherwise permitted within a specific Zone
District may be permitted by the Community Development Director: The Community
Development Department coordinates the review of these activities/events by various referral
agencies in order to ensure that the activities/events are conducted in a safe manner, and that
any impacts on the community or on public resources are mitigated by the permittee. The
permittee is required by the Code to demonstrate that adequate provisions have been made for
police supervision, public parking, insurance, site set-up, maintenance and clean-up,
emergency services, and safety of operations. A permit will not be issued unless these
requirements are satisfied.
Special Events include, but are not limited to the following:
=:> Public events for amusement or entertainment, such as concerts or festivals;
=:> Fund-raising or non-commercial events to benefit nonprofit religious, educational, or
community service organizations; and
=:> Foot races and bike races.
Temporary Commercial Uses include, but are not limited to the following:
=:> Filming of movies, commercials, or promotional spots; and
=:> Trade shows.

If you answered YES to ALL of the questions above, then a permit from the Community
Development Department is NOT REQUIRED. However, you must still obtain any other
required permits or approvals, such as a special event liquor license, pyrotechnics permit, etc.
Contact Community Development at (970) 920-5526 for assistance in determining what other
permits may be required. In addition, you must notify the Sheriff and the County Engineer of the
time, place and estimated attendance for your event at least 72 hours prior to the event.

Community Development Department for review,
The Community Development Department will be the primary contact for the applicant during
the review process. Once the completed application and fee are submitted, Community
Development will distribute the application to the necessary referral agencies and, if necessary,

will schedule a date for the referral agencies to review the application with applicant and/or put
the referral agencies directly in touch with applicant.
Following review of the application, the Community Development Director will issue an
Administrative Determination granting or denying the permit.
Special event permit applications and temporary commercial use permit applications shall be
submitted to the Community Development Department not less than 60 days prior to the
event date, along with the following:
1, Fee for application: $1386 (Major Events), $463 (Minor Events); make check payable
to "Pitkin County Treasurer". Whether or not an event constitutes a "Major Event" or a
"Minor Event" will be determined by staff at the time of submittal. The fee is based on 2
hours of staff time, for Minor Events, and 6 hours of staff time, for Major Events; if staff
review time exceeds 2.4 hours for Minor Events, or 7.2 hours for Major Events, the
applicant will be charged for time in excess of 2/6 hours at a rate of $231 per hour.
2. Map (sketch or site plan) of event site, detailing any temporary or permanent structures,
street closures, all impacted properties (identifying owners), and parking.

The County may revoke a Temporary Commercial Use/Special Event Permit prior to or
during the event if the permittee violates any of the conditions of the permit.
The County may require the permittee to participate in a post-event debriefing with
referral agencies, affected citizens and other interested/involved parties to address
issues that arose during the event.
The County may require the permittee to post financial security to ensure compliance
with any of the conditions of the permit.
If a major incident or emergency occurs in the County during the event, the Sheriff
reserves the right to remove any and all emergency medical, fire and law resources from

because the emergency service infrastructure is funded by the Pitkin County taxpayers

SAFETY AND OPERATIONS PLAN REQUIREMENTS
The purpose of this part of your application process is to promote public safety in
the conduct of special events in Pitkin County. Please provide the following
information as it applies to your event. Note that some questions will not be
applicable, or appropriate, given the nature and/or scale of your event.
Contact the Public Safety Council for additional information or direction regarding these
requirements.

Golden Leaf Classic
1. Outline, in detail, all of the activities, risks, or other safety issues associated with
staging or participating in your event.
The golden leaf classic is a half marathon, trail run. It takes place on
the Government trail from Snowmass to Aspen. Some of the risks
involved are associated with the location of the trail, therefore we
request volunteers from Mountain Rescue to be a course sweep
behind the last racer, and various course Marshals stationed.
2, Outline, in detail, the safety measures you will have in place for the event:
A. Name the single point of contact public safety officials will be in
communication with at all times during the event. List all means of
communication and numbers/frequencies (e.g., cell phone, radio). Where
will this individual be located during the event?
Sandy Doebler, Nancy Lesley, Race Directors. Will be available in
radio contact as well as cell phones. Directors will be located at the
Start and Finish Lines. We request a member of Mountain Rescue to
sweep the course on a mountain bike, equipped with 1st aid, a radio
and a cell phone. Dr, Niebur from Aspen Medical Care will be our
Chief Medical Officer, either on the course or stationed at the Finish
Line. '
We will contact the hospital and Ambulance prior to event to inform
them of the event to ensure a quick response. We will be contacting
the Pitkin County Sheriff's Office to see jf Mountain Rescue will be
available to aid the event.

Please ensure that your map attached to the application clearly identifies emergency
facilities, emergency access routes and hazards.

mountain rescue. We are asking Mountain rescue to also be
on course, so they will be able to respond as soon as
possible.

We will request the presence of Mountain Rescue. From the
Pitkin County Sheriff's Office Dr. Niebur form Apsen Medical
Care will be our Chief Medical Officer.

prominently and clearly marked? If so, how?
Tables set up with water/1st aid, and will be pointed out to
participants before beginning of the race.
(The event may be required to supply its own Emergency Medical
Services (including ambulance service), depending on the scale and risk
assessment of the activities. You may contact local fire and ambulance
departments, or private providers for quotes and availability,)

In my experience, the Golden Leaf has been around many years and is always well run. Ifthis
application is the same as past ones, I give it thumbs up. I would also support multi-year with the

AUTHORITY:
Federal Lands Recreation Enhancement Act (FLREA), Title VIII, Division J, PL,lblic Law 108-447
City of Aspen Recreation Department... hereinafter called the Holder, is hereby authorized to use, subject to
the terms and conditions of this permit, National Forest System land identified within the unit area and
described as the Aspen Ranger District, White River National Forest, Pitkin County, Colorado. This
authorization covers approximately .1Q acres andlor 10 miles.
Portions of the Snowmass Ski Area and the Government Trail (FDT #1985) from the Snowmass Ski
Area Boundary east to the National Forest boundary within the Buttermilk Ski Area, as shown in the
permit file
The holder is authorized to conduct the following activities, and/or install the following temporary

Temporary aid/safety stations and race directional signing is approved as needed.
TERMS AND CONDITIONS
1. Us'e under this permit shall begin on 09/22/2007 and end on 09/23/2007. The permit shall not be
, extended.
2. The fee for this use is $350.00 (Three Hundred a'nd Fifty dollars) It shall be paid in advance and is not
refundable. .
3. The holder shall conduct the authorized activities according to the attached approved plans and
specifications: .
4. The holder shall not install any improvements not specifically identified and approved above.
5. No soil, trees, or other vegetation may be destroyed or removed from National Forest System lands
without specific prior written permission from the authorized officer.
6. The holder shall comply with all Federal, State, county, and municipal laws" ordinances, and regulations
which are applicable to the area or operations covered by this permit.
7. The holder shall maintain the improvements and premises to standards of repair, orderliness, neatness',
. sanitation, and safety acceptable to the authorized officer. The holder shall fully repair and bear the
expense for all damage, other than ordinary wear and tear, to National Forest System I~nds, roads and.
trails caused by the holder's activities. .
8. The holder has the responsibility of inspecting the use area and adjoining areas for dangerous trees,
hanging limbs, and other evidence of hazardous conditions which would pose a risk of injury to
individuals. After securing permission from the authorized officer, the holder shall remove such hazards.
9. The holder shall be liable for any damage suffered by the United States resulting from or related to use of
this permit, including damages to National Forest resources and costs of fire suppression.
10. The holder shall hold harmless the United States from any liability from damage to life or property arising
from the holder's occupancy or use of National Forest lands under this permit. ."
11, The holder agrees to permit the free and unrestricted access to and upon the premises at all times for all
lawful and proper purposes not inconsistent with the intent of the permit or with the reasonable exercise
and enjoyment by the holder of the privileges thereof.
12. This permit is subject to all valid existing rights and claims outstanding in third parties.
13. This permit may be revoked upon breach of any of the conditions herein or at the discretion of the
authorized officer. Upon expiration or revocation of this permit, the holder shall immediately remove all
improvements except those owned by the United States, and shall restore the site within 1 day(s), unless
otherwise agreed upon in writing. If the holder fails to remove the improvements, they shall become the

property of the United States, but that will not relieve the holder of liability for the cost of their removal and
restoration of the site.
14. This permit is a license for the use of federally 'owned land. It does not grant any interest in real property,
This permit is not transferable. The holder shall not enter into any agreements with third parties for
occupancy of the authorized premises and improvements.
15. Appeal of any provisions of this permit or any requirements thereof shall be subject to the appeal
regulations at 36 CFR, Subpart C, or revisions thereof.

17. The above clauses shall control if they conflict with additional clauses or provisions.
18. Public informational signage will be required to be posted at least one day prior to the event to inform the
general public of the potential encounters with bikers and runners. At a minimum, posting should occur at
the start of the Government Trail as it exists near the Elk Camp area of the Snowmass Ski Area, and at
the terminus of the trail as it intersects with the Tiehack Road.
19. Course marshalls with emergency radio contact capabilities will be required on the course throughout the
duration of each of the races.
20. Normal recreational use by the public will not be prohibited by any activity associated with this. permit.
21. Race sweeps will be conducted immediately following each days race event for safety, as well as trash
and race marker clean-up. '
