RECITALS
1, Pursuant to Subsection 4-30-50(i) of the Pitkin County Land Use Code,
the Community Development Director of Pitkin County, Colorado
("Director") may approve a Temporary Commercial Use/Special Event
Permit for commercial activities or special events.
2. Bark Productions/Aspen Productions (hereafter, the "Applicant") has.
applied to the Director for approval of a Temporary Commercial
Use/Special Event Permit to film the Colorado Tourism Fall TV
Commercial on September 28th, with a weather day on 29th 2007. On
September 27th, 2007 a team of 5 will be scoutinl~ locations The
commercial will be filmed at The East and West Maroon Portals and the
Maroon Bells, The filming will consist of approximately 25-30 people,
Filming has been said to be of people taking in the views of the Bells and
people on horseback.
3 The Pitkin County Sheriff's Office and the Aspen Fire Department have
approved this event. The Emergency Manager has abstained from
commenting. A Certificate of Insurance covering this event and naming
the County as an Additional Insured has been received. RFTA and the
U ,S, Forest Service have approved thllS event with the conditions outlined
below.

5 The Director finds that, to the extent applicable, the application complies
with the standards in Subsection 4-30-50(i) of the Land Use Code,
THE DIRECTOR HEREBY APPROVES the Temporary Commercial
Use/Special Event Permit for the Colorado Tourism Fall TV CommerCial, subject
to Applicant's compliance with each of the following conditions:
1, Applicant shall adhere to all material representations made in or In
connection with, the application.
2, Applicant shall not block any emergency vehicle access at any of the
venues,
3. The U.S Forest Service has worked with the applicant regarding
parking and logistics. Parking is alllowed at the East and West Maoon
Portals. Parking at the Maroon Lake will be III the boneyard, RV, and
overnight parking area_
4. Applicant shall obtain a Forest Service Permit for the event
5 Applicant shall clean up all trash, debris, and horse manure associated
with the event.
6. At no time shall any roads be blocked or traffic flow, specifically RFTA
busses, be disrupted,
7, Failure to comply with the conditions of approval may result in
revocation of this permit

RECIT ALS
1. Pursuant to Subsection 4-30-50(i) of the Pitkin County Land Use Code,
the Community Development Director of Pitkin County, Colorado
("Director") may approve a Temporary Commercial Use/Special Event
Permit for commercial activities or special events.
2, Bark Productions/Aspen Productions (hereafter, the "Applicant") has

REQUEST: The Applicant is requesting approval of a Temporary Commercial Use/Special
Event Permit in order to film a TV commercial at the Maroon Bells Lake and the East and
West Maroon Portals for the Colorado Tourism Board
APPLICANT: Bark Productions/Aspen Productions (hereafter, Applicant").
LOCATION: Maroon Bells Lake and the East and West Maroon Portals
BACKGROUND: This is a TV commercial for the State of Colorado- Colorado Tourism
Fall Campaign. Bark/Aspen Productions plan to scout their locations with a team of 5 on
September 27th, film on September 28th, with a weather day on September 29th, 2007.
They plan to work from approx. 5 AM. to 7 P.M. 25 to 30 people will be involved. There
will be no road closures.
REFERRAL COMMENTS: The application was referred to the USFS, Tom C;rady, Ellen
Anderson, Ed Van Walraven, and RFTA.
Ellen Anderson was unavailable for comment.
Ed Van Walraven approved the application for the Aspen Fire Department but stated that
the filming crew must not block emergency vehicle access at any of the venues.
Martha Moran has approved the application for the U.S. Forest Service. Martha has worked
with the applicant to develop a parking and logistics plan,
The Certificate of Insurance has been provided by Applicant and approved.
Tom Grady reviewed and signed off on the application for the Sheriffs Department.
Kent Blackmer from RFT A expressed concerns regarding the 15 vehicles associated with
the film crew. It is RFT A's busiest time of the year up to the Maroon Bells. Kent stressed
that at no time must the film crew disrupt the traffic flow.
STAFF COMMENTS:
Pursuant to Subsection 4-30-50(i) of the Land Use Code, Applicant must demonstrate that
adequate provisions have been made for all of the following:
1. Police supervision (if necessary);
2. Public parking;
3. Insurance;
4. Site set-up, maintenance and clean-up;
5. Emergency services; and
6. Safety of operations.
Additionally, temporary structures must conform to applicable building codes and other
County regulations. Each of these requirements is addressed, in turn, below.
Police Suoervision: No special provisions are deemed necessary. The Sheriff's
Office has signed-off on the application,
Public Parkina: Parking for film crew will be at the East and West Maroon Portals and
parking for filming at the Maroon Bells will be in the parking lot near Maroon Lake in the
"boneyard" and overnight lot. Applicant's large motorhome and truck will be in the area
designated as RV Parking at the Bells. There will be no use of County parking lots for
filming or staging, There are approximately 15 crew vehicles. Vehicles will not disrupt traffic
flow.
Insuranee: Applicant has provided adequate proof of insurance.
Site Set-Uo. Maintenance and Clean-Uo: There will be one lighting and grip truck, one
camera cube, and one production cube. They will not be disturbing the ground. Film crew
will have two large containers for trash and will take it out with them
Emeraencv Services: Applicant will have a back country guide on sight as well as a
"wilderness first responder" They will have a first aid kit as well as oxygen tanks. They will
have a Suburban standing by if someone needs to go to the hospital. They will also have a
hard line to call 911.
Conformance with Sui/dina Code: Film crew will be using a generator. No structures
are proposed.
RECOMMENDATION: Staff recommends that the Director approve the Bark
Productions/Aspen Productions Temporary Commercial Use/Special Event Permit
application subject to Applicant's compliance with each of the conditions in the attached
Administrative Decision.

REQUEST: The Applicant is requesting approval of a Temporary Commercial Use/Special
Event Permit in order to film a TV commercial at the Maroon Bells Lake and the East and
West Maroon Portals for the Colorado Tourism Board.
APPLICANT: Bark Productions/Aspen Productions (hereafter, Applicant").
LOCATION: Maroon Bells Lake and the East and West Maroon Portals
BACKGROUND: This is a TV commercial for the State of Colorado- Colorado Tourism
Fall Campaign. Bark/Aspen Productions plan to scout their locations with a team of 5 on
September 27th, film on September 28th, with a weather day on September 29th, 2007.
They plan to work from approx. 5 AM, to 7 P.M. 2~; to 30 people will be involved. There
will be no road closures,
REFERRAL COMMENTS: The application was referred to the USFS, Tom Grady, Ellen
Anderson, Ed Van Walraven, and RFTA
Ellen Anderson was unavailable for comment.
Ed Van Walraven approved the application for the Aspen Fire Department but stated that
the filming crew must not block emergency vehicle access at any of the venues.
Martha Moran has approved the application for the U,S. Forest Service Martha has worked
with the applicant to develop a parking and logistics plan.
The Certificate of Insurance has been provided by Applicant and approved.
Tom Grady reviewed and signed off on the application for the Sheriff's Department.
Kent Blackmer from RFT A expressed concerns regarding the 15 vehicles associated with
the film crew. It is RFT A's busiest time of the year up to the Maroon Bells, Kent stressed
that at no time must the film crew disrupt the traffic flow.
STAFF COMMENTS:
Pursuant to Subsection 4-30-50(i) of the Land Use Code, Applicant must demonstrate that
adequate provisions have been made for all of the following:
1, Police supervision (if necessary);
2. Public parking;
3. Insurance;
4. Site set-up, maintenance and clean-up;
5. Emergency services; and
6. Safety of operations.
Additionally, temporary structures must conform to applicable building codes and other
County regulations. Each of these requirements is addressed, in turn, below.
Police Suoervision: No special provisions are deemed necessary. The Sheriff's
Office has signed-off on the application.
Public Parkina: Parking for film crew will be at the East and West Maroon Portals and
parking for filming at the Maroon Bells will be in the parking lot near Maroon Lake in the
"boneyard" and overnight lot. Applicant's large motorhome and truck will be in the area
designated as RV Parking at the Bells, There will be no use of County parking lots for
filming or staging. There are approximately 15 crew vehicles. Vehicles will not disrupt traffic
flow.
Insuranee: Applicant has provided adequate proof of insurance.
Site Set-Uo. Maintenanee and Clean-Uo: There will be one lighting and grip truck, one
camera cube, and one production cube. They will not be disturbing the ground, Film crew
will have two large containers for trash and will take it out with them
Emeraencv Serviees: Applicant will have a back country guide on sight as well as a
"wilderness first responder" They will have a first aid kit as well as oxygen tanks, They will
have a Suburban standing by if someone needs to ~~o to the hospital. They will also have a
hard line to call 911.
Conformance with Buildina Code: Film crew will be using a generator. No structures
are proposed.
RECOMMENDATION: Staff recommends that the Director approve the Bark
Productions/Aspen Productions Temporary Commercial Use/Special Event Permit
application subject to Applicant's compliance with each of the conditions in the attached
Administrative Decision.

2. Bark Productions/Aspen Productions (hereafter, the "Applicant") has
applied to the Director for approval of a Temporary Commercial
Use/Special Event Permit to film the Colorado Tourism Fall TV
Commercial on September 28th, with a weather day on 29th 2007. On
September 27th, 2007 a team of ~) will be scouting locations. The
commercial will be filmed at The East and West Maroon Portals and the
Maroon Bells. The filming will consist of approximately 25-30 people.
Filming has been said to be of people taking in the views of the Bells and
people on horseback.
3. The Pitkin County Sheriff's Office and the Aspen Fire Department have
approved this event. The Emergency Manager has abstained from
commenting. A Certificate of Insurance covering this event and naming
the County as an Additional Insured has been received. RFTA and the
U.S. Forest Service have approved this event with the conditions outlined
below.
4. The Director finds that, to the extent applicable, the application complies
with the standards in Subsection 4-30-50(i) of the Land Use Code.
THE DIRECTOR HEREBY APPROVES the Temporary Commercial
Use/Special Event Permit for the Colorado Tourism Fall TV Commercial, subject
to Applicant's compliance with each of the following conditions:
1. Applicant shall adhere to all material representations made 111, or In
connection with, the application.
2. Applicant shall not block any emer~lency vehicle access at any of the
venues.
3. The U.S. Forest Service has worked with the applicant re!;:]arding

TEMPORARY COMMERCIAL USE/SPECIAL EVENT PERMIT -
INFORMATION ON THE PERMIT PROCESS AND APPLICATION
The temporary use and occupancy of public or private properties and/or roadways for
commercial activities or special events that are not otherwise permitted within a specific Zone
District may be permitted by the Community Development Director. * The Community
Development Department coordinates the review of these activities/events by various referral
agencies in order to ensure that the activities/events are conducted in a safe manner, and that
any impacts on the community or on public resources are mitigated by the permittee. The
permittee is required by the Code to demonstrate that adequate provisions have been made for
police supervision, public parking, insurance, site set-up, maintenance and clean-up,
emergency services, and safety of operations. A permit will not be issued unless these
requirements are satisfied.
Special Events include, but are not limited to the following:
=> Public events for amusement or entertainment, such as concerts or festivals;
=> Fund-raising or non-commercial events to benefit nonprofit religious, educational, or
community service organizations; and
=> Foot races and bike races.
Temporary Commercial Uses include, but are not limited to the following:
=> Filming of movies, commercials, or promotional spots; and
=> Trade shows.

required permits or approvals, such as a special event liquor license, pyrotechnics permit, etc.
Contact Community Development at (970) 920-5526 for assistance in determining what other
permits may be required. In addition, you must notify the Sheriff and the County Engineer of the
time, place and estimated attendance for your event at least 72 hours prior to the event.
OTHER EVENTS AND USES:
If you answered NO to ANY or ALL of the questions above, you must complete the attached
application and submit the required fee and application (with all required attachments) to the
Community Development Department for review.
See Subsection 3-200-030 of the Pitkin County Land Use Code (the .Code-).

The Community Development Department will be the primary contact for the applicant during
the review process. Once the completed application and fee are submitted, Community
Development will distribute the application to the necessary referral agencies and, if necessary,
will schedule a date for the referral agencies to review the application with applicant and/or put
the referral agencies directly in touch with applicant.
Following review of the application, the Community Development Director will issue an
Administrative Determination granting or denying the permit. The Board of County
Commissioners reviews events of duration longer than 72 hours.
Special event permit applications and temporary commercial use permit applications shall be
submitted to the Community Development Deparbnent not less than 60 days prior to the
event date, along with the following: ...//

1. Fee for application: $1275 (Major Events~inor Events); make check payable
to "Pitkin County Treasurer". Whether or not an event constitutes a "Major Event" or a
"Minor Event'" will be determined by staff at the time of submittal. The fee is based on 2
hours of staff time, for Minor Events, and 6 hours of staff time, for Major Events; if staff
review time exceeds 2.4 hours for Minor Events, or 7.2 hours for Major Events, the
applicant will be charged for time in excess of 2/6 hours at a rate of $215 per hour.
2. Map (sketch or site plan) of event site, detailing any temporary or permanent structures,
street closures, all impacted properties (identifying owners), and parking.
3. Vicinity map.
4. Schedule of events/activities.
5. Detailed Safety and Operations Plan (see Attachment A).
6. Proof of General Liability insurancelindemnification (naming Pitkin County as an
"Additional Insured") and proof of Liquor Liability insurance (if applicable).
7. Letter of authorization/executed contract granting approval to use the specific site(s)
from public or private property owner(s).
8. Written approval of any applicable Caucus(es)/Homeowners' Association(s).
9. Copies of all other applicable permits. (Some helpful contacts and references are
included in Attachments Band C.) Other permits may be processed concurrently with
the application.

The purpose of this part of your application process is to promote public safety in the
conduct of special events in Pitkin County. Please provide the following infonnation as
it applies to your event. Note that some questions will not be applicable, or appropriate, given
the nature and/or scale of your event.
