Jay Sandrich (hereafter referred to as "Applicant') has applied to the Community Development Director of Pitkin County ("Director") for Site Plan approval, a Minor Plat Amendment, and a Minor Amendment to a Development Permit for construction of photovoltaic tracking panels. 2. The Lot is located at 483 North Hayden Drive and is described as Lot 2 of the BOCC approved Castle Creek Valley Ranch Subdivision. The Lot is zoned AR-1Q approximately 13 acres, and is conforming in size PID#: 2735-231-02-002 The Castle Creek Valley Ranch Subdivision General Subdivision approval was granted pursuant to BOCC Resolution No. 90-75 which was later rescinded and reinstated with BOCC 90-124. Detailed Submission was approved pursuant to 92-174 (Rec. No. 346506) which established building envelopes on the Lots. Final Plat approval was granted pursuant to BOCC Resolution No. 92-57 (Rec. No. 35213). The Lot received approval for a CDU in 1993 however no Administrative Decision was recorded as the CDU is attached to the main residence on a lot that is conforming in size in the AR-10 zone district. 4. The affidavit of public notice was mailed on October 25s', 2007 to the adjacent property owners of the subject parcel. No comments were received within 30 days. Public notice was published in the paper on October 21 ", 2007. 5. The Director finds that the site proposed for development is exempt from Scenic Review pursuant to section 7-20-120(c)(4xa), contains no major drainages, and contains slopes > 30%. 6. The Director finds this request is consistent with the requirements of the Land Use Code. APPROVED by the Director, subject to the following conditions: 1. The Applicant shall adhere to all material representations made in the current or prior applications or in public meetings or hearings and shall consider those represenffitions to be conditions of approval, unless amended by other conditions. 2. No calculations for height, bulk, setback, size, floor area, or any other building and zoning requirements have been wnducted. These requirements will be considered at the time of building permit review. Structures represented in the application may not be permitted under building and zoning regulations. 3. Prior to submission of any future building permit applications, the Applicant shall be required to submit for approval by the County Attorney and Community Development a Plat in accordance with 2.1.13 of the Pitkin County Land Use Application Manual. No development, including grading,. excavation, fill placement, driveway, turnaround, berms, landscaping, vegetation removal or disturbance, entry or ranch gates shall occur outside of the approved activity envelope, with the exception of measures to comply with the wildfu•e mitigation required herein. 5. Prior to commencement of any earthmoving or other construction activity, the Applicant shall stake the corners of the activity envelope and install construction fencing around the construction site within the perimeter of the building envelope. The fencing shall remain in place until work is complete.. 6. All areas disturbed by construction shall be re-vegetated with native shrubs and grasses within one growing season of the project's completion. 7. Statutory vested rights for the approval contained herein are granted pursuant to the Pitkin County Land Use Code and Colorado Statutes, subject to the exceptions set forth in Pitkin County Land Use Code. 5-2-20-170 and C.R.S., § 24-68-105. STAFF COMMENTS: Subdivision Exemption for Minor Plat Amendments: Subsection 2-30-20(g)(5) of the Land Use Code authorizes a minor plat amendment to be approved if: D~~On~ ~ The proposed site gently slopes east and poses no geological issues. The site proposed for development and the proposed development is and will not be visible from Castle Creek Road as the view from this mapped scenic corridor is obstructed by topography and significant stands of trees. (5) (a) It is necessary to correct an inadvertent surveying error to a recorded plat that has been approved by Pitkin County, where the error was not intended to circumvent the provisions of this Land Use Code, the correction increases or does not substantially affect the degree of compliance with the standards of this Land Use Code; and the revised final plat will comply with the final plat standards of Pitkin County Land Use Application Manual; or Response: Though the request to amend a building envelope for construction of PV tracking panels is not an inadvertent surveying error, a Minor Plat Amendment process is being used as a vehicle to track this amendment to the Castle Creek Valley Ranch Subdivision. The proposed amendment will not substantially affect the degree of compliance with standards of the Land Use Code. The revised plat will be conditioned to be in compliance with the Land Use Application Manual. (b) The amendment increases or does not affect the degree of compliance with the standards of this Land Use Code; and the amendment is being made to a recorded plat that has been approved by Pitkin County; and the amendment is consistent with representations made during the conceptual and detailed subdivision reviews whichever is applicable. Response: The request to amend the approved building envelope for PV tracking panel construction will amend the recorded plat approved by Pitkin County and does not affect the degree of compliance with the standards of the Code and is consistent with the representations made during the conceptual and detailed subdivision reviews. Minor Amendment to a Develonment Permit. Pursuant to Section 2-20-150(b) of the July 6`s, 2006 Land Use Code, a minor amendment to any development application or permit is one that meets the following criteria, as determined by the Community Development Director: I. Is consistent with action(s) taken during previous development approvals for the property; and Response: The request to amend the previously approved envelope for construction of PV tracking panels is consistent with the original approvals. All previous approvals will be conditioned to be adhered to unless otherwise amended by this approval. 2. Does not change the use of the proposed development between residential, commercial, and tourist accommodation uses; and Response: The request does not change the use of the proposed development. 3. Does not change the basic character of the approved use of land on which the activity occurs, included basic visual appearance and method of operation, and Response: The request does not change the basic character of the approved use of land as approval of this amendment and site plan will result in production of green renewable energies accessory to a single family residence. 4. Does not constitute a new land development activity; and Response: The request does not constitute a new land development activity; only development accessory to the primary use. 5. Does not increase off-site impacts in the surrounding neighborhood; and ~~~Q~~ Response: The improvements proposed for this Lot will not create additional off site impact as the PV panels will not be visible from Castle Creek Road. 6. Does not endanger the public health, safety or welfare, and Response: The request does not endanger the public health, safety or welfare. 7. Does not violate any Land Use Code standard; and Response: The request will not violate any standard of the Land Use Code; 8. Does not substantially increase the need for on-site parking or utilities, or affect affordable housing generation; and Response: The request will not result in any impacts mentioned in No. 8. 9. Does not increase the, floor area of the use by more than five (5) percent or decrease the open space on the site by more the five (5) percent. Response: The request to amend the building envelope will not result in a violation of this standard. Water Courses and Drainage: Land Use Code Sec. 7-20-30 addresses water resource standards which are applicable to all development. Response: There are no significant drainages, gulches, or debris flow patterns at the site proposed for development. Steep and Potentially Unstable Slopes: Land Use Code Sec. 7-20-20 addresses standards for development on potentially unstable slopes; Response: The site proposed for development ofthe PV panels contains slopes less than 30%. SITE PLAN REVIEW The Applicant has requested site plan approval. This request requires a review of: (1) placement of development within an approved activity envelope; (2) development within a scenic view protection area pursuant to section 7-20- 120(d); (3) location of structures in accordance with rural character building guidelines pursuant to section 7-20- 120(e); and (4) landscaping and vegetation protection pursuant to section 7-20-130. Development within an Activity Envelope The Applicant has proposed an envelope that encompasses all development on the Lot. Scenic Review The Lot and the proposed PV panels are not visible from Castle Creek Road and can be exempted from Scenic Review pursuant to section 7-20-120(c)(4)(a). Rural Character Guidelines for Building Location The Lot does not contain any irrigated pastures or significant meadows. Landscaping and Vegetation Protection: V~UUQ~ Land Use Code Sec. 7-20-130 is intended to preserve existing vegetation on a development site to the maximum extent possible. Response: The area of the lot proposed for this development contains a variety of low growing grass and smaller diameter trees. It does not appear that any significant trees will be removed as part of this development. Nevertheless, Section 7-20-10(c) addresses tree removal mitigation and states that al] trees 6" diameter at breast height (d.b.h.) removed within an envelope shall be replaced with one or more trees with total d.b.h. at least equal to the caliper of the trees removed. The Applicant shall submit a landscape plan that identifies all trees proposed to be removed over 6" d.b.h. on the Lot and mitigate for their removal. RECOMMENDATION: Staff recommends that the Director approve the Sandrich Minor Amendment to a Development permit and Site Plan review for construction of two PV tracking structures subject to the conditions of the attached Administrative Decision. They still require enlargement of their existing Building Envelope but not to the initial extent. Please see the revised attached site plan, PV 2.0. They are forgoing future expansion of the system in this azea and will require space for only two (2) trackers. In addition, we have switched tracker manufacturers, from Lorentz to Wattsun, in an effort to reduce the overall height of the system. During winter months when the tracker is at its highest tilt angle, 55 degrees, the maximum height of the tracker will be 12' 9 1/8". See attached elevations, PV 1.0. Hayden Drive. The Sandrich's aze the "Applicant" in this land use application requesting a Minor Amendment to a Building Envelope and Site Plan Review. This summary letter explains the request, provides background information on any prior approvals and permits and addresses the code sections and criteria that aze listed in the Pre-Application Conference Summary. SUMMARY OF PROPOSAL The Sandrich's want to install a solar photovoltaic (PV) system to generate electricity for their home. The initial PV system will consist of two (2) pole-mounted tracking devices with a total capacity of 4.56 kilowatts. Based on the performance of the initial system, the Sandrich's may add an additional two (2) poles to double their capacity in the future. Given the proposed size of the system and the construction of their home a roof-mounted system is not a viable option. The next possible choice would be a ground-mounted system within the existing building envelope. Unfortunately, the best area suited for a PV system lies outside the existing building envelope. Consequently, the Sandrich's request an amendment to the existing building envelope for the sole use of the aforementioned PV system. Section 7-20-10: Site Preparation and Grading The installation of the pole mounted trackers will require trenching, excavation and back fill. See Attachment B for exact trench locations within the proposed Building Envelope. The installation will not require the removal of any trees. The impacted azeas will undergo revegetation as outlined in Section 7-20-10(d)1. Section 7-20-20: Slopes Topography is shown on the Site Plan (Attachment B) with slopes delineated. The proposed Building Envelope has been selected so that it is free of slopes greater than thirty percent. Otherwise, all slopes aze less than fifteen percent. Therefore, no steep and potentially unstable slopes as defined by the Land Use Code exist. Section 7-20-30: Water Courses and Drainage There aze no rivers, streams (including intermittent streams), ponds, wet meadows, or wetlands within the proposed Building Envelope. All standazds of Section 7-20-30 will be met. All standazds of Section 7-20-80 will be met. Section 7-20-120(d and e): Standards for Scenic View Protection Areas The property is located in a Scenic View Protection Area -the west side of Castle Creek Road. The proposed Building Envelope falls entirely within dense aspen stands which will obscure the visibility of the installation even during winter months. The maximum height of the photovoltaic modules on the tracking poles will be twenty-two feet when tilted to the full east or full west position. The tracking poles will not project above any ridgelines. Section 7-20-130: Landscaping and Vegetation Protection The natural vegetation within the Building Envelope consists primarily of field grasses. These will be impacted as described in Section 7-20-10 above. The natural vegetation will be preserved to the maximum extent practicable and revegeta6on will occur to return disturbed azeas to their natural state. No additional landscaping is proposed including no berms and/or no landscape enclosures. There is no required landscaping as outlined in Section 7-20-130(c) as no telecommunications equipmet will be installed in the proposed Building Envelope and the existing natural vegetation of dense aspen stands will screen the installation from any adjacent public roads.
