James Schine Crown Trust (hereafter referred to as "Applicant") has applied to the Community Development Director of Pitkin County, Colorado ("Director") for Activity Envelope and Site Plan for construction of stabilization devices to retain a failing, unstable slope above a residence. These devices include atwo-tiered retaining wall proposed on a hillside above a residence, a retaining wall that parallels West Tiehack Road, and improvements to a ditch. 2. The Applicant submitted an application after July 6, 2006, therefore, the application is being considered pursuant to the 2006 Land Use Code, as amended. 3. The Applicant did not request vesting with this application and therefore was not required to post public notice for this request. 4. The Lot is located at 340 West Tiehack Road and is legally described as Lot 1 of the Crown Subdivision PID#: 2735-101-02-001. The Lot is zoned SKI-REC and AR-2 and is approximately 8 acres. 5. The Lot received Conceptual Subdivision, GMQS Exemption, 1041 Hazard Review, EDU and CDU approval pursuant to BOCC Resolution No. 97-187. Detailed and Final Subdivision approval was granted pursuant to Resolution No. 164-2001. The Lot received approval to utilize a TDR as a development right on the newly created Lot pursuant to BOCC Resolution No. 004-2006. The parcel also rezoned from AF-SKI to AFR-2 pursuant to Ordinance No. 040-2001. 6. The Planning Engineer reviewed the proposal and offered recommendations that aze outlined as conditions below. 7. The Director finds that the residence is located below an unstable slope that has failed. The Director further finds that the mitigation devices proposed by the Applicant are necessary for the retention of the hillside and to prevent future, possible failures. APPROVED by the Director, subject to the following conditions: The Applicant shall adhere to all material representations made in the current or prior applications or in public meetings or hearings and shall consider those representations to be conditions of approval, unless amended by other conditions. 2. Prior to submission of any future building permit applications, the Applicant shall be required to submit for approval by the County Attorney and Community Development a Site Plan with an Activity Envelope in accordance with Land Use Code Section 2-30-20(g) and Application Manual Section 2.1.12. The above referenced approvals shall be a condition precedent to finalization and recordation. Tlie Site plan shall also incorporate the following change: a. Change the title to "James Crown Schine Activity Envelope and Site Plan". b. Show the length of the retaining wall on the site plan and draw an activity envelope azound this wall. The Applicant shall submit for review and approval, a construction management plan, drainage/erosion control plan, and revegetation plan acceptable to the Planning Engineer and Land Manager. The revegetation plan shall utilize vegetation consistent with vegetation in the surrounding area. 4. Building permits shall be obtained for all walls over 4' in height and shall be stamped by an engineer. 5. All work shall comply with CTL Thompson's report dated June 6, 2007. 6. Failure to comply with the conditions of this approval may result in revocation of this approval, or any subsequent permit(s) or approval(s) related to this property, or vested rights associated with this property. BAKER CONSTRUCT 1 O N October 1, 2007 Mr. Lance Clark Pitkin County Planning Director l30 South Galena Aspen, CO 80611 Dear Lance, This past spring during the run off from Buttermilk, a poorly maintained run off ditch that originates on Skico property and travels thru Lot 1 Crown Subdivision and into the Willow Ditch which travels under Panda Peak to the Airport. This poorly maintained ditch super saturates the slope below, which resulted in a mud slide on Lot 1. The Skico contacted CTL Thompson a Colorado Geo-technical Engineer to assess the slide area. CTL Thompson in a soils report that is attached recommended that the hill side be stabilized. After receiving CTL Thompson report and knowing our client I then proposed a plan with a series of landscape walls, boulder wall and re-vegetation. During this whole episode, we were granted a permit for the Guesthouse on the old Powder Panda site. This mud slide and soil saturation affected this site and CTL Thompson is recommending pernianent soiling nailing in one area of the excavation for the Guesthouse. Best regards, ;~:.~_ Bill Baker p~1~U04 Letter of Request for Activity Envelopes and Site Plan Reveiw Sec. 7-10-50 Activity Envelope. The Activity Envelope at the Guest House needs to be expanded on the west side of the existing building envelope so permanent soil nails can be installed. In this Activity envelope Landscape Re-vegetation would take place from what was damaged by the mud slide. The Activity Envelope at the Slide Area needs to be developed to stabilize the current slide area and widen the current driveway access to the Safir Residence on the adjacent lot. In this Activity Envelope we will be stabilizing the toe of slope, stabilizing the mid to upper slope, laying back the upper slope, landscaping and re- vegetation, and staging of materials. Sec. 7-20-20 Steep and Potentially Unstable Slopes This unstable slope failure was due to inadequately maintained runoff ditches from above the Panda Peak lift. The Aspen Ski Co. hired CTL Thompson a Colorado Geo-technical Engineer. Attached is their initial report dated June 6, 20(17. No retaining walls will be constructed over 7' in height. Sec. 7-20-10 Site Prep and Grading A. Since the existing slide area is so large, staging will occur at the base of the new wall replacing the failing tie wall and adjacent land next to the Skico land, but still on Lot 1 Crown Subdivision. B. Since the slide had to cleaned up ASAP, the debris was placed on Skico property and dispersed. This area will be re-vegetated at the completion of the tie replacement wall. C. We have removed or lost in the mud slide approximately ZO each ~6" Aspen trees. We plan to mitigate those trees in our re-vegetation plan. D. A re-vegetation plan is attached for your review and approval. E. Erosion, sedimentation and storm water management will occur oin site. Sec. 7-20-30 Water Courses and Drainage The run off ditch above the Slide Area will be repaired in accordance with the Geo-Tech report prepared by CTL Thompson dated June 6, 2007 attached. ooooo~ All runoff drainage will be maintained by Skico employee's on a yearly basis. Sec. 7-20-50 Landslide Area's We will ensure strict adherence to the recommended design, construction and maintenance procedures by CTL Thompson. See attached Geo-tech report. Sec. 7-20-130 Landscaping and Vegetation Protection Re-vegetation of all disturbed areas will conform to Pitkin County Standards. A re-vegetation plan will be submitted for approval. Sec. 7-20-120(d) Standards for Scenic View Protection Areas Current existing vegetation conceals the current slide area from Highway 82. Only the upper most part of the slide area is visible from Highway 82 and with the re- vegetation it will be repaired. Box 1248 Aspen, CO 61612 Attention: Mr. David Corbin Subject: Slope Failure Evaluation and Mitigation Recommendations Above the Crown Residence 0336 Tiehack Road Aspen, Colorado Project No. GS05005-145 A slope failure occurred during the firstweek of May, 2007 in the slopes below the Buttermilk Ski Area and above a private access drive above the Crown Residence at 0336 Tiehack Road in Aspen, Colorado. You requested that we visit the site to observe the failed slope, evaluate the most likely cause of the failure and provide recommendations to repair the ground surface in the area of the failure. This letter presents a summary of observations, our opinion of the likely cause ofthe failure and recommendations for remediation. Initial Conditions The slope failed below Buttermilk Ski Area propertyand above an access drive to a private residence. This drive is directly above the Crown Tiehack property. Plans are to construct a guest house on the Crown property below the drive.:>lope conditions prior to the failure were a result of past slope failures and small Dearth flows which have likely occurred during the last 100 to 200 years. Access drive construction likely steepened the slope atthe toe ofthe failed area. The ground prior to the slope failure generally faced east with ground surface slopes estimat~sd at between 45 and 100 percent. We believe ground cover prior to the most recent slope failure was medium dense stands of young aspen trees and various brush and grass ground cover. To the south of the failed area we observed areas of vertical depressions, tilted trees, hummocky ground and the presence of only young vegetation which are indicators of recent movement on the slopes to the south of the failed area. It is reasonable to assume similar conditions existed in the failed urea. Above the failed slope is a drainage ditch that carries water from snowmelt. Observations at the Failure We visited the site about 4 hours after the failure occurred. Selected photographs taken during our initial and subsequent site visits are presented in Appendix A. The type of failure that occurred is commonly referred to as an infinite 234 Center Drive I Glenwood Springs, Colorado 81601 Q ~ (~ O (]'~ Telephone: 970.945-2809 Fax: 970-945-7411 slope failure. An infinite slope failure is characterized by the depth of the slide mass being comparatively small compared to the lateral extent of the slide mass. Ttle area of the slide was between 3D and 60 feet across and extended up the slope+/- 60 to 70 feetfrom the uphill shoulder of the access drive (see Figure 1). The head scarp atthe top of the slide was near vertical and measured 6 to 10 feet high. The side flanks were near vertical and were generally 2 to 5 feet high. The southern flank terminated within an area remnant from a previous slope failure. A second feature of the failure was an eroded channel located within the north half of the overall slide masts. The eroded channel had side flanks of between 3 and 6 feet high. The slope failure occurred in soils deposited from previous slope failures and small earth flows. Soils observed in the head scarp, and flanks of the failed area and on the resulting ground surface were generally a poorly sorted gravel in a clay and silt matrix. Blocks of shale were observed in the bottom of the eroded channel. We measured the slope of the failed surface at between 45 and 120 percent. Cause of Failure When a slope fails it is not normally possible to isolate a single cause that resulted in instability. This failure above the Crown property occurred during a period of significantsnowmeltontheskislopesofButtermilkSkiArea. The ditch above the failed slope was conveying a large volume of water at a relatively high velocity. The combination of a large volume and high velocity of water in the ditch created a significant amount of energy. It appears this high energy resulted in a breactl in the ditch side or water overtopping the ditch bank. The ditch water then flowed over the top of the existing steep slope and began to erode a channel into the existing slope. Water from the channel then wet the adjacent soils resulting in an excess water pressure condition in the soils adjacent to the eroded channel. The failed slope progressed downhill from erosion as the soils above lost strength and gained weight due to saturation. We believe that the failure of the ditch was the event thattriilgered a series of events that resulted in the slope failure. We observed several areas; along the ditch that had been repaired to reduce ditch loses and fix past breaches in the ditch sides. Remediation We considered several alternatives for remediation of the failed slope. Our recommended mitigation is based on our opinion of the potential for another large failure in the area, potential affects of another large slope failure and constructability issues. The risk of another large slope failure at the same location ofthe failed) slope and involving a large mass of soil is judged to be low to moderate. Small slumps and surticial erosion will occur until the ground is protected or "armored". We recommend the failed slope be stabilized by a) piping or enlarging and lining the existing ditch above the failed slope, b) excavation of benches in the existing slope and placement of a boulder fill and c) installation of soil nails into the soils atthe head scarp at the top of slope failure. Letters1G5 0.5 0 0 6 165 L1.tloc recommended sequence are shown on Figures 2 and 3. A discussion of the recommendations is provided below. We recommend the existing ditch be cleared of debris. They ditch should be excavated as necessary to install a solid pipe to convey water and reduce the possibility of wetting slopes below the ditch. We believe that a corrugated metal pipe (CMP) may be appropriate. If it is desired to maintain the ditch as an open channel, the ditch should be enlarged and lined. 2. Benches with heights and widths of approximately 6 to 8 feetshauld be notched into the existing ground surface of the failed area. Boulders with a minimum dimension of 3 feet should be stacked on the benches. The boulders should be embedded at least t foot into the bottom ofthe bench. The boulders should be placed in a manner to maximize the contact area between individual boulders. A toe drain consisting of a 6- inch PVC pipe embedded in a well graded sand or concrete aggregate and wrapped in a geotextile fabric should be installed at the toe of the boulder fill. The initial boulder fill placement should extend up to within about 10 feet of the top of the failed slope. 3. From on top of the boulder fill, a drill rig should install soil nails to a depth of at least 15 feet into the existing head scarp material. Boulders can be placed in front of the soil nailed wall. Constructability tissues will need to be considered by the earthwork contractor and the shoring contractor. This conceptual repair plan is provided to the client to allow comment and discussion. We understand some modification to the plan will be required based on material availability and constructability issues. We appreciate the opportunity to work with you on this pro}ect. James Schine Crown Trust ("Applicant'), has applied [o the Board of County Commissioners of Pitkin County, ("BOCC"), for a GMQS Exemptiot and Special Review approval to Utilize a TDR for a Development Right for a second free-market unit. 2.
