Jeff Hines and John Duncan (hereafter "Applicants) knave requested that the Planning and zoning Commission of Pitkin County (hereafter "Commission") grant approval fox an Insubstantial Change to the Final Plat of the Hines/Duncan 5o Percent Density Reduction Lot split subdivision pursuant to Section 4-2.1(b). The requested amendment allows the relocation of the access easement over the Hines property. The puxpose oP the proposed driveway relocation is to provide more useable front yard for the Hines property. 2. A public notice that applica- tions are being accepted shall be given no later than one month prior to the date of submission of applications. This shall be accomplished by placing at least one publication in a newspaper of general circulation in Pitkin County. Procedures for application, review and approval, disap- proval, or conditional approval of a subdivision are described in Article 6, CoIDmon. (8) PORPOSE The purpose of this regulation is to give ran:ners or large landowners the ability to subdivide tracts of land, which may not meet the minimum lot size requirements of the i underlying zone district, provided that the density of the total parcel complies writ the requirements of theunderiy- i ing zone district. Lots created pursuant to this section 1.'. , shall be consistent with the design guidelines outlined in Section 4-6.1(d). Examples. of the form that Low Impact Subdivision might take are as Pollows: (i) A clustered PtiD development whose lots are located outside of any' critical wildlife habitat, scenic foreground, irrigated meadowsv or land vsed for agricultural purposes and/or which maintains large, continuous areas in open space; er (ii) The creation of lots which meet or exceed the underly- ing zone district minimum Lot size yet restrict development within agrieultural~scenic and wildlife areas and which have cooperative working arrangements , i (or use other similar approaches) to maintain the integrity of the agricultural operation and/ox the ' wildlife habitat and/or the scenic or open space lands. (C) RE49IR8[ffiiT5 The following requirements shall apply to all applications for low impact subdivisions: (i) Low impact subdivision shall only be allowed on lands in the AP-1, RS-20 and RS-30 zone districts, and shall only bealiowed Por parcels bf lan3 which already contain one dwelling unit or which qualify For a growth management exemption for a dwelling unit pursuant to Section 5-510.2 (c). (iii) Applicants shall also be provided the option of developing one permanent moderate housing (PMH) lot within the subdivision, provfdedt2tat such lot shall meet price restrictions approved by the Aspen-Pitkin Housing Authority and occupancy gv idelines of the Aspen-Pitkin Housing Authority, for qualified low and moderateincome emFloyees. i Any lots created pursuant tc these provisions shall be exempt from any calculation of minimum lot area per dwelling unit for the entire parcel, and shall not ceunt as a unit of density. Lots created in this manner may be of a size equal to oY less than the minimum lot size of the underlying zone district. (iv} Subject to the limitations specified 'Herein, applicants who shall have oDtainhd the rigrt to subdivide through the full subdivision. process, Growth Management process or Grm:'th Management exception process as listed in Section 5- 510.2 (d), (d), (e), (g) and (i)'prior to August 25, 1937 shall be permitted to apply for additional development through these provisions on said lands. P.ny lots for which such rights have already been obtained on said lands must be deducted from the cumulative total number of lots which may be obtained on such lands by thelow impactsubdivision exemption. Existing units on the parcel which have not previously been subdivided from the parcel, except as provided for in Section (vii) below, shall not count against the cumulative total number of lots which may be approved unless the land on which they are located is subdivided as a separate lot. This subsection does not apply to any lands on which a restriction against further development has been placed, and such lands shall not be eligible for additional development pursuant to these regulations. (v) No illegal dwelling units shall exist on the property, i or illegal dwelling units shall ba legalized pursuant to t Section 3-8.13(d) of the Land Use Code or otherwise. Parcels created after such date shall not be eligible for low impact subdivision )' ~~- , provided that if the subdivision was Por fully developed land oP 35 aeres or greater, then the fathering parcel sha12 7 . remain eligible Por low impact subdivision. However, on - eligible lands lots ma tie creat d t , y e hrough the Low impact Subdivision Regulations over a series of years and need not be created all at one time. For parcels of land subdivided ' between January 1, 1987 and 6eptember 15, 1987 to be eligible for a low i t m-pac subdivision, the applicant shall be required to demonstrate to the sole satisfaction of the Hoard of County Commissioners tha± the subdivision did not create lots in addition to those to which the Pothering parcel is already entitled pursuant to this Section 4-6.1. (viii) All lots created through the Inw Impact Subdivision process shall be single Pamily lots, as defihed in subsec- tion 4-6.2 (e)(i) provided that if the lot does not meet the minimum lot area requirement of the underlying Zone district as ro id d i , p v e n subsection 4-6.1(C) (ii), it shall not be eligible to c t i on a r. an accessory dwelling unit. (D) Low Impact Subdivision Development Guidelines The following Guidelines are intended tobe followed by an applicant in order to develop a low impact subdivision which i s consistent with the intent of this regulation (see section 4-6.I (A). The priorities established by subsection (D)(iv)- (a) shall be followed to the extent feasible. (ii) Visual Site Planning Guidelines a. Development sites shall be planned to minimize visual i mpacts on scenic amenities as viewed froxi County or State roadways and to res p erve the rural character of the area. b. Land uses shall utilize existing topography such as ridges and hills to screen buildings and roadways. c. Land uses shall not rely upon large landforms and manmade visual barriers to justify building in i scen c areas, but manmade land£orms may be used on a limited basis to complement development. (iii) Guidelines to Minimize Interference wleh Agriculture and Wildlife a. Applicants shall adopt covenants which are intended t i i o m n mize interference with agriculture and i w ldlife, including, but not limited to provisions for adequate water rights, prohibition of dogs and i , ma ntenance of fencing between residential and agricult l ura uses. b. Where appropriate, developments shall utilize Planned Dnit Development (PUD) regulations to create lots which are smaller than the minimum lot si ze of the Land Dse Cadefor the underlying zone districts. c. Roads serving developments shall be constructed at a suYficient distance from property boundaries so that normal maintenance including snow removal does not damage agricultural fences. d. Developments shall make provisions to insure historic access to ditches, headgates, or roads used to maintain agricultural fences. Alternate access easements suitable £or these' purposes may be considered. (iv) Priority Preservaf ion Lands a. Zn determining which lands shall be restricted against development as provided in subsection (C)(ii), the priority shall be as follows: 1. preservaticn of wildlife lands 2. preservation of agricultural lands 3. preservation o£ visually sensitive lands 4. preservation of open space lands (E) SDBMISSION CONTENTS (i) a. Submit those documents raqui red by section 6-1 of this Code which are not otherwise addressed below. (ii) Provide a written description of: a. How the proposed development meets the require- meets of subsection (a) through (d) above. b. How the proposed development meets the applicable general policies and regulations of the Pitkin County Land Ose Cade. (iii) a. Prct'ide a map caregorizing the property as to those lands which are used for agricultural purposes, contain wildlife habitat, or have scenic or open space values. Hoth newly created parcels shall be restricted by covenant against further development and the subdivision must result in not more than fifty (50) percent of the density permitted under current underlying zoning. Applicants shall also be required to demonstrate that: (i) The proposed lots to be created shall meetthe follow- . ing definition of a single-family lot: A single-family lot is a lot which may contain no more than one principal dwelling unit. This lot may also contain an approved and legalized accessory dwelling unit which is deed-restricted with regard to occupancy by employees of the community as defined by the guidelines of the Aspen/Pitkin Housing Authority, and provided that said accessory unit shall not count as a unit of density for the purposes of the density calculation herein. Prior to issuance of a building permit, the applicant shall draft an agreement with the'County stipulating that, within thirty days of issuance of any Certificate of Occupancy (permanent or temporary). for the new residence, the existing residence on the site shall be demolished or removed from the property or converted to an accessory structure. 3. The applicant shall post financial security in a form acceptable to the County Attorney to guarentee the removal or conversion of the structure. The amount of the financeial security required shall be based on an estimate for demolition costs prepared by a bona fide demolition contrator. PURPOSE AVID SOOPE OF STUDY This. report presents the results of a subsoil study for the proposed D~uican residence to be located on Shady Tine, Aspen, Colorado. The project site is shown on Fig. 1. The puzpo~.,e of the study was to develop reconm~itions for the foundation design. The study was conducted in accordance with our. agreement for geotechnical engineering services to C. Welton Anderson & Associates, dated April 10, 1991. A field exploration program consisting of exploratory borings was conducted to obtain information on subsurface conditions. Samples obtained .. during the field exploration were tested in the laboratory to 7letermine engineering characteristics of the on-site soils. The results of the field. exploration and laboratory testing were analyzed to develop rendations for foundation types, depths and allowable pressures for. the proposed building foundation. The results of the field exploration and laboratory testing are ', presented in the report. This report has been prepared to summ~arize the d.-~ta obtained. during this study and to present our conclusions and recwmnendations based on the proposed construction and the subsoil conditions enxxxtntered. PNAPOSED O~'P!t[JC'PICaI The proper residence will be a two-story wood-frame structure with a garage area, located on the site as shown on Fig. 1. Ground floors will be a combination of structurally supported over crawl space in the residence and slab-on-cJrade in the garage. Grading for the construction is ass~m~ed to be relatively minor with cut depths between. abaft 2 to 5 feet. We assume relatively light foundation loadings, typical of the proposed type wnstruction. If building loadings, location or grading plans change significantly from those described above, we should be notified to .reevaluate the recamrr~dations contained in this report. SITE OOPIDITIONS The 2.03 acre parcel, which is located about l/2 mile west of the Mill Street Bridge on the north side of the Roaring Fork River, is the western portion of the Hines/DUrx,an lot split. 'Ihe site is occupied by an existi~ two- story wood frame house as shvwn_on Fig. 1. The grourxi surface is flat with a slight slope down to the southwest towards the_ROaring Fork River. Elevation difference across the proposed residence is about 3 feet arxi across the parcel is about 15 feet. The Roaring Fork River was generally at law level as spring runoff had not ', begun.. The extent of the floodplain was shown on the Hines/Duncan 1041 review m1p provided to us- FIEID EXI'IARATION The field exploration for the project was conducted on April 18, 1991. 7Wo exploratory borings were drilled at the locations shown on Fig. 1 to evaluate the subsurface. corditions. 'ihe borings were advanced with 4-inch. y.. diameter continuous flight auger powered by a truck-7munted CME-55 drill rig. The borings were logged by a representative of Chen-Northern, Inc. Samples of the subsoils were taken with a 1 3/8-inch LD. spoon sampler. The sampler was driven into the subsoils at various depths with blows frcen a i 140-pound hanmrer falling 30 inches. 'This test is similar to the standazd penetration test described by ASTM Method D-1586. The penetration resistance ', values are an indication of the relative density or consistency of the subsoils. Depths at which the samples were taken and the penetration resistance values are shown on the. Logs of EScploratory Borings, Fig. 2. The samples were returned to our laboratory for review by the project engineer and testing. Slotted PVC pipe was installed in boring 3 to a depth of 9 feet to allow monitoring of the grourr]water level. _ St)BSOIL UDPIDIR'ICtt~.4 The subsoil conditions encountered at the site are shown graphically on i Fig. 2. The subsoils consist of about 1/2 to 3 1/2 feet of man-placed fill and/or on7anic topsoil Overlying relatively dense, slightly silty sandy gravels ', containing cobbles and possible boulders. Drilling in the dense gravels with Chen~~Northern,lnc. ~ ~„~~,~~„~,~,t,,,,~„~:,;~,.:,~,~~:~~„~si> -4- auger equipment was difficult due to the cobbles. At depths of 5 1/2 feet to 7 1/2 feet in the borings, medium dense silty to clean sand was encountered to the maximwn depth drilled, 15 feet. Laboratory testing performed on samples obtained frwn the borings consisted. of gradation analyses. Results., of the gradation analyses performed on small diameter drive samples .(minus 1 1/2-inch fraction) of the natural subsoils are shown on Figs. A and 5. The laboratory testing is simmiarized in Table I. u Water was encountered in the borings at the time of drilling at depths of 2 1/2 to 3 1/2 feet below the growxl surface.. The subsoils were highly moist to wet with depth. Rise in the groundwater levels, Simi ar to that of the adjacent Roaring Fork River, should be expecEed. FbUHIaATION ~TION9 Considering the subsoil conditions encaantered in the exploratory borings and the nature of the proposed construction, we recomm?nd the building be founded with spread footings bearing on the natural granular .soils .below all fill and, topsoil. The design atxl constriction criteria presented belay should be observed for a spread footing foundation system. The construction criteria should be considered. when preparing Project docimrents. 1) Footings placed on the undisturbed natural granular soils should be designed for an allowable soil bearing pressure of'2500 psf. Exterior footings and footings beneath unheated areas should be provided with adequate soil cover above ,their. bearing elevatiott for frost protection. Placement of foundations at least 42 inches below exterior grade is typically used in this area. Continuous foundation walls should be reinforced top and bottcan to span local anomalies such as by ass~mung an unsupported lene~th of at least 10 feet. Fourxlation walls acting as retaining structures should also be designed to resist a lateral earth pressure corre<>potxiing to an equivalent fluid unit weight of 45 pcf. -All existing fill, topsoil and any loose or disturbed soils should be removed and the footing bearing level extended dawn to the relatively dense natural granular soils. If water seepage is encountered, the footing areas should be dewaterea before concrete .placement. The dewatering can probably be aa~q~lished by trenches leading to sumps where the water can be removed by pumping for shallow arawdam. The dewatering requirements can be limited by making the excavation. during the late simmer or fall when the river level is the lowest. A shallow depth of crushed roak can also be placed in the excavation bottom to allow the footings to be oonstsucted in the dry. The attached typical fascia and typical fascia with built-in gutter illustrate how we built the roof at this residence. See attached drawings dated July 17, 1992 and July 12, 1993. Due to the sealed air barrier and quality of construction and assemblage we do not anticipate air or water leakage within our soffit cavity. Additionally we have a 2 foot roof flashing at the entire roof perimeter. Our specifications included a continuous visqueen vapor barrier. beneath the interior gypsum board. I believe that some of the soffit damage problems that you have observed on other buildings may be due to inadequate roof flashing and fascia drip 1 details and to lesser. quality construction: I da not find that the the minimal surface area of our details would generate enough condensate to damage the fascia or soffits. In my experience this kind of damage has occured by moisture on the exterior surface or through penetrations of the roof and roof flashing more often than through accumulation of condensate within soffitt cavities. A continuous soffitt vent may actually encourage more condensate and associated problems by introducing more air movement and a method to renew and continually generate new condensate as fresh air moves aaoss the vapor barrier. We have used redwood and cedar as both our trim (.fascia, blocking, and wherever possible to further resist moisture problems. Additionally our owner will have annual maintenance of the gutters and we have included snowmelt at some valleys and problem areas to further dissipate ice and snowmelt accumulations.
